101 del 27 de mayo\nde 1998 y sus reformas, se crea el Sistema Nacional de Áreas de Conservación\n(SINAC) como un sistema de gestión y coordinación institucional, desconcentrado\ny participativo, que integrará las competencias en materia forestal, vida\nsilvestre, áreas protegidas y el Ministerio de Ambiente y Energía, con el fin\nde dictar políticas, planificar y ejecutar procesos dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica, de manera\nque la Dirección General de Vida Silvestre, la Administración Forestal del\nEstado y el Servicio de Parques Nacionales ejercerán sus funciones y\ncompetencias como una sola instancia, mediante la estructura administrativa del\nSistema, sin perjuicio de los objetivos para los que fueron establecidos.\n\nII.-Que mediante el oficio\nidentificado como DM-890-2017 del 19 de setiembre de 2017, el Ministerio de\nAmbiente y Energía, solicitó la ampliación del gasto presupuestario máximo del\nSINAC para el año 2017, en un monto de ¢1.202.864.448,00 (un mil doscientos dos\nmillones ochocientos sesenta y cuatro mil cuatrocientos cuarenta y ocho colones\nexactos), con el fin de incorporar recursos para atender objetivos y\nobligaciones institucionales. Dicha solicitud fue autorizada por el Consejo\nNacional de Áreas de Conservación (CONAC) en el acuerdo N° 4 tomado en la\nsesión N° 09-2017 del 25 de setiembre del año 2017, y además ratificada por el\nDirector Ejecutivo del SINAC por medio del oficio SINAC-DE-1680-2017 del 10 de\noctubre de 2017. Asimismo, fue avalada por el Ministro a. í. de Ambiente y\nEnergía, en su carácter de Ministro Rector a. í., por medio del oficio DM-890-2017\nya mencionado.\n\nIII.-Que de dicho monto,\ncorresponde ser ampliado por la vía del Decreto Ejecutivo, la suma de\n¢490.555.456,00 (cuatrocientos noventa millones quinientos cincuenta y cinco\nmil cuatrocientos cincuenta y seis colones exactos), misma que será financiada\nen su totalidad con recursos provenientes de superávit específico, según el\nsiguiente desglose: superávit específico del Fondo SINAC por un monto de\n¢364.065.456,00 (trescientos sesenta y cuatro millones sesenta cinco mil\ncuatrocientos cincuenta y seis colones exactos) que servirá para el pago de\nterrenos en calidad de humedal ubicados en Caño Blanco, Guatuso del Área de\nConservación Huetar Norte y que se anexarán al Refugio de Vida Silvestre de\nCaño Negro; superávit específico del Fondo de Vida Silvestre de recursos que\ncorresponden al veinticinco por ciento de los ingresos a este Fondo en\ncumplimiento del artículo 11 de la Ley N° 7317, Ley de Conservación de la Vida\nSilvestre publicada en La Gaceta N° 235 del 7 de diciembre de 1992 y sus\nreformas, y superávit específico del Fondo de Parques Nacionales que provienen\nde la recaudación del timbre para los Parques Nacionales según el artículo 43\nde la Ley N° 7788, Ley de Biodiversidad publicada en La Gaceta N° 101 de\n27 de mayo de 1998 y sus reformas, por un monto total de ¢10.990.000,00 (diez\nmillones novecientos noventa mil colones exactos) para realizar transferencias\na la Comisión Nacional de Gestión de la Biodiversidad (CONAGEBIO) y superávit\nespecífico del Fondo de Parques Nacionales por un monto de ¢115.500.000,00\n(ciento quince millones quinientos mil colones exactos) proveniente del\ncincuenta por ciento de los ingresos al Parque Nacional Manuel Antonio para\ntransferir al Fideicomiso existente entre el Ministerio de Ambiente y Energía y\nel Banco Nacional de Costa Rica para el pago de terrenos.\n\nIV.-Que mediante el Decreto\nEjecutivo N° 39613-H, publicado en el Alcance N° 46 a La Gaceta N° 61 de\n30 de marzo de 2016 y sus reformas, en el que se emitieron las Directrices\nGenerales de Política Presupuestaria, Salarial, Empleo, Inversión y\nEndeudamiento para entidades públicas, ministerios y órganos desconcentrados,\nsegún corresponda, cubiertos por el ámbito de la Autoridad Presupuestaria, para\nel ario 2017, se estableció en el artículo 12, que para las entidades públicas\ny órganos desconcentrados, el gasto presupuestario máximo del año 2017, se\nestablecerá con base en la proyección de ingresos totales (corrientes, capital\ny financiamiento) 2017, definida por las entidades públicas y órganos desconcentrados\nen coordinación con la Secretaría Técnica de la Autoridad Presupuestaria (en\nadelante STAP). Para tal efecto, la STAP utilizará como insumo la serie\nhistórica de ingresos del periodo 2013-2015, así como la estimación de ingresos\npara los arios 2016 y 2017 que suministren las entidades y órganos\ndesconcentrados a más tardar el último día del mes de marzo del año 2016.\n\nV.-Que en correspondencia\ncon dicha disposición, el monto de gasto presupuestario máximo para el ario\n2017 resultante para el SINAC, fue establecido en la suma de ¢31.431.040.983,00\n(treinta y un mil cuatrocientos treinta y un millones cuarenta mil novecientos\nochenta y tres colones exactos), comunicado en oficio STAP- 0616-2016 del 27 de\nabril del dos mil dieciséis. Este monto fue posteriormente modificado mediante\noficio STAP-2555-2016 de 16 de diciembre de dos mil dieciséis, fijándose en\n¢37.306.605.940,21 (treinta y siete mil trescientos seis millones seiscientos\ncinco mil novecientos cuarenta colones con veintiún céntimos). Finalmente el\nmonto antes mencionado fue modificado y comunicado con oficio STAP-0246-2017 de\ntres de marzo del dos mil diecisiete fijándose en ¢38.376.897.028,21 (treinta y\nocho mil trescientos setenta y seis millones ochocientos noventa y siete mil\nveintiocho colones con veintiún céntimos); cifra que no contempla el gasto\nindicado previamente en este decreto.\n\nVI.-Que mediante el Decreto\nEjecutivo N° 32452-H, publicado en La Gaceta N° 130 de 6 de julio de\n2005 y sus reformas, se emite el \"Lineamiento para la aplicación del artículo\n6° de la Ley N° 8131 de la Administración Financiera de la República y\nPresupuestos Públicos y la regulación de la clase de ingresos del Sector\nPúblico denominada Financiamiento\".\n\nVII.-Que en relación con el\nsuperávit específico, el numeral 9° del referido Decreto Ejecutivo N° 3245241,\nposibilita la utilización de éste, para el pago de gastos definidos en los\nfines establecidos en las disposiciones especiales o legales aplicables a tales\nrecursos.\n\nVIII.-Que por lo anterior,\nresulta necesario ampliar el gasto presupuestario máximo fijado al Sistema\nNacional de Áreas de Conservación para el año 2017, incrementándolo en la suma\nde ¢490.555.456,00 (cuatrocientos noventa millones quinientos cincuenta y cinco\nmil cuatrocientos cincuenta y seis colones exactos). Said request was authorized by the National Council of Conservation Areas (Consejo Nacional de Áreas de Conservación, CONAC) in agreement N° 4 taken at session N° 09-2017 of September 25, 2017, and also ratified by the Executive Director of SINAC through official communication SINAC-DE-1680-2017 of October 10, 2017. Likewise, it was endorsed by the Acting Minister of Environment and Energy, in his capacity as Acting Rector Minister, through the aforementioned official communication DM-890-2017.\n\nIII.—That of that amount, the sum of ₡490,555,456.00 (four hundred ninety million five hundred fifty-five thousand four hundred fifty-six colones exactly) is to be expanded via Executive Decree, which will be financed entirely with resources from specific surplus (superávit específico), according to the following breakdown: specific surplus (superávit específico) from the SINAC Fund in an amount of ₡364,065,456.00 (three hundred sixty-four million sixty-five thousand four hundred fifty-six colones exactly) that will serve for the payment of lands designated as wetlands located in Caño Blanco, Guatuso of the Huetar Norte Conservation Area and that will be annexed to the Caño Negro Wildlife Refuge; specific surplus (superávit específico) from the Wildlife Fund from resources corresponding to twenty-five percent of the income to this Fund in compliance with article 11 of Law N° 7317, Wildlife Conservation Law published in La Gaceta N° 235 of December 7, 1992 and its amendments, and specific surplus (superávit específico) from the National Parks Fund originating from the collection of the stamp for National Parks according to article 43 of Law N° 7788, Biodiversity Law published in La Gaceta N° 101 of May 27, 1998 and its amendments, for a total amount of ₡10,990,000.00 (ten million nine hundred ninety thousand colones exactly) to make transfers to the National Commission for Biodiversity Management (Comisión Nacional de Gestión de la Biodiversidad, CONAGEBIO) and specific surplus (superávit específico) from the National Parks Fund in an amount of ₡115,500,000.00 (one hundred fifteen million five hundred thousand colones exactly) originating from fifty percent of the income to Manuel Antonio National Park to transfer to the existing trust (Fideicomiso) between the Ministry of Environment and Energy and the National Bank of Costa Rica for the payment of lands.\n\nIV.—That through Executive Decree N° 39613-H, published in Supplement N° 46 to La Gaceta N° 61 of March 30, 2016 and its amendments, which issued the General Guidelines on Budgetary, Salary, Employment, Investment, and Indebtedness Policy for public entities, ministries, and deconcentrated bodies, as applicable, covered by the scope of the Budgetary Authority, for the year 2017, it was established in article 12 that, for public entities and deconcentrated bodies, the maximum budgetary expenditure for the year 2017 would be established based on the projection of total revenues (current, capital, and financing) 2017, defined by the public entities and deconcentrated bodies in coordination with the Technical Secretariat of the Budgetary Authority (Secretaría Técnica de la Autoridad Presupuestaria, STAP). For this purpose, STAP will use as input the historical revenue series for the period 2013-2015, as well as the revenue estimate for the years 2016 and 2017 provided by the entities and deconcentrated bodies no later than the last day of March 2016.\n\nV.—That in correspondence with said provision, the resulting maximum budgetary expenditure amount for the year 2017 for SINAC was established at the sum of ₡31,431,040,983.00 (thirty-one billion four hundred thirty-one million forty thousand nine hundred eighty-three colones exactly), communicated in official communication STAP-0616-2016 of April 27, two thousand sixteen. This amount was subsequently modified through official communication STAP-2555-2016 of December 16, two thousand sixteen, set at ₡37,306,605,940.21 (thirty-seven billion three hundred six million six hundred five thousand nine hundred forty colones with twenty-one céntimos). Finally, the aforementioned amount was modified and communicated with official communication STAP-0246-2017 of March three, two thousand seventeen, set at ₡38,376,897,028.21 (thirty-eight billion three hundred seventy-six million eight hundred ninety-seven thousand twenty-eight colones with twenty-one céntimos); a figure that does not contemplate the expenditure previously indicated in this decree.\n\nVI.—That through Executive Decree N° 32452-H, published in La Gaceta N° 130 of July 6, 2005 and its amendments, the \"Guideline for the application of article 6 of Law N° 8131 of the Financial Administration of the Republic and Public Budgets and the regulation of the class of Public Sector revenues called Financing\" is issued.\n\nVII.—That in relation to the specific surplus (superávit específico), numeral 9 of the referred Executive Decree N° 32452-H makes possible its use for the payment of expenses defined in the purposes established in the special or legal provisions applicable to such resources.\n\nVIII.—That for the foregoing, it is necessary to expand the maximum budgetary expenditure set for the National System of Conservation Areas for the year 2017, increasing it by the sum of ₡490,555,456.00 (four hundred ninety million five hundred fifty-five thousand four hundred fifty-six colones exactly).
