Que de conformidad con el artículo 22 de la Ley de Biodiversidad\nNº7788, se crea el Sistema Nacional de Áreas de Conservación (en adelante\nSINAC), con personería jurídica propia, como un sistema de gestión y\ncoordinación institucional, desconcentrado y participativo, que integra las\ncompetencias en materia forestal, vida silvestre y áreas protegidas, con el fin\nde dictar políticas, planificar y ejecutar procesos dirigidos a lograr la\nsostenibilidad en el manejo de los recursos naturales de Costa Rica.\n\n2. Que es política prioritaria del SINAC facilitar y promover acciones\nque conlleven a la protección, conservación y manejo sostenible de los recursos\nnaturales y la biodiversidad presentes en las Áreas Silvestres Protegidas ( en\nadelante ASP) de las Áreas de Conservación.\n\n3. Que mediante Decreto Ejecutivo Nº 32611-MINAE del 28 de Junio del\n2005, se declaró el Refugio Nacional de Vida Silvestre Ara Macao, con categoría\nmixta.\n\n4. Que el Refugio Nacional de Vida Silvestre \"Ara Macao\" de\nPropiedad Mixta, se ubica en un terreno que comprende el área ubicada en los\ndistritos de Jacó y Tárcoles, cantón de Garabito, provincia de Puntarenas con\nbase en la Hoja Cartográfica Tárcoles, 3245II del mapa básico de Costa Rica\nescala 1 :50.000, edición 2 del Instituto Geográfico Nacional; que posee el\nFolio Real Nº 6020175-000, con una medida de 3 8 hectáreas con 8965 metros\ncuadrados de acuerdo al plano de catastro N º P-1888493-2016, y cuyos linderos\nse describen en el derrotero de dicho plano. Que adyacente a la finca Nº\n6020175-000, sometida al régimen de Refugio Mixto, se encuentra la franja de la\nZona Marítimo Terrestre, que comprende la' zona pública y la zona restringida\nde conformidad· con lo que delimitan los mojones del Instituto Geográfico\nNacional comprendidos entre el Nº 452 y el Nº 499.\n\n5. Que dicha área está compuesta de bosque primario y secundario\navanzando.\n\n6. Que la administración de la vida silvestre y la recomendación de\nmedidas que aseguren la perpetuidad de las especies es función del Sistema\nNacional de Áreas de Conservación del Ministerio del Ambiente y Energía.\n\n7. Que el 29 de Junio de 2015 se cumplió el periodo de diez años,\nestablecido por el Decreto Ejecutivo Nº 32611- MTNAE, dando por concluido el\nperíodo de vigencia de la declaratoria de Refugio Nacional de Vida Silvestre\nAra Macao.\n\n8. Que el Plan de Manejo para el Refugio Nacional de Vida Silvestre\n\"Ara Macao\" aprobado en fecha del 26 de Setiembre de 2005, cumplió\ncon su vigencia en el año 2015, evidenciadose que a este es necesario\nincorporársele algunos aspectos establecidos en la Guía de diseño y formulación\ndel Plan General de Manejo de las Áreas Silvestres Protegidas actualizada en el\n2014, y en apego a la política vigente para las Áreas Silvestres Protegidas del\nSTNAC, en la cual obliga a la Administración a desarrollar herramientas y\nmetodologías que promuevan un manejo adaptativo de la biodiversidad. Por lo que\ndebe elaborarse un nuevo plan de manejo, el cual acate los procedimientos de\nelaboración de Planes de Manejo dentro de Áreas Silvestres Protegidas\noficializados por el STNAC y denominados \"Procedimiento para la\nElaboración, Actualización y Oficialización del Plan General de Manejo de las\nÁreas Silvestres Protegidas\" según oficio STNAC-DE418- 2016 del 17 de\nmarzo del 2016 y la \"Guía para el diseño y formulación del Plan General de\nManejo de las Áreas Silvestres Protegidas de Costa Rica\".\n\n9. Que El Paseo de Lindara Sociedad Anónima,\ncédula jurídica Nº 3-101-284270, inscrita en el Registro Público, Registro\nMercantil, es dueña de la finca que corresponde al plano catastrado Nº\nP-1888493-2016 y que tiene una _extensión según plano de 38 hectáreas con 8965\nmetros cuadrados, inscrita al Folio Real Nº 6020175-000, situado en los\ndistritos uno Jacó y dos Tárcoles, cantón Garabito, provincia de Puntarenas, la\ncual solicita en tiempo y forma ante la Administración su anuencia a seguir\nsometiendo su terreno al Régimen de Refugio Mixto de Vida Silvestre.\n\n10. Que el propietario del terreno privado\naccedió voluntariamente a incorporarse a este régimen de protección de la flora\ny la fauna silvestre por un período de diez años prorrogables.\n\n11. Que el manejo del Refugio, deberá apegarse a\nlo establecido por el Plan de Manejo debidamente aprobado.\n\nPOR TANTO,\n\nDECRETAN:\n\n\"Renovación de Declaratoria del Refugio Nacional de Vida Silvestre\n\"Ara Macao\" de\n\nPropiedad Mixta\"\n\nArtículo 1 °- Renovar por un periodo de diez años la Declaratoria\ndel Refugio Nacional de Vida Silvestre \"Ara Macao\" de Propiedad\nMixta, el cual se encuentra en un terreno ubicado en los distritos de Jacó y\nTárcoles, cantón de Garabito, provincia de Puntarenas con base en la Hoja\nCartográfica Tárcoles, 3245II del mapa básico de Costa Rica escala 1 :50.000,\nedición 2 del Instituto Geográfico Nacional; que posee el Folio Real Nº\n6020175-000, con una medida de 38 hectáreas con 8965 metros cuadrados de\nacuerdo al plano de catastro N º P-1888493-2016, y cuyos linderos se describen\nen el derrotero de dicho plano. La ejecución del\nPlan de Manejo será supervisada por la Comisión, quien podrá señalar\ndisposiciones técnicas y científicas futuras que deberán ser atendidas por los\npropietarios, siempre en el marco del plan de manejo.\n\nArtículo 3 °- La propietaria del inmueble Folio Real Nº\n6020175-000 se compromete a no apartarse de lo establecido en el Plan de\nManejo, y realizar actividades que permitan la existencia de la flora y fauna,\nasí como a brindar la colaboración necesaria a investigadores, y funcionarios\ndel MINAE que visiten dicha área en funciones oficiales.\n\nArtículo 4°- Se deja sin efecto el plan de manejo oficializado en el año 2005 para el\nRefugio Nacional de Vida Silvestre Ara Macao. Deberá procederse a la\nelaboración del Plan de Manejo para el Refugio Nacional de Vida Silvestre Ara\nMacao de conformidad con la Guía de diseño y formulación del Plan General de\nManejo de las Áreas Silvestres Protegidas actualizada en el 2014, y en apego a\nla política vigente para las Áreas Silvestres Protegidas del SINAC,\ncontemplando las herramientas y metodologías que promuevan un manejo adaptativo\nde la biodiversidad.\n\nArtículo 5°- Dicho terreno estará sometido a la categoría de Refugio Nacional de Vida\nSilvestre de categoría mixta durante un período, de diez años prorrogables por\nperíodos iguales, para lo cual la propietaria privada deberá solicitar la\napertura del proceso de renovación con un mes de antelación a la finalización\nde dicho período ante el Área de Conservación Pacifico Central del Sistema\nNacional de Áreas de Conservación (SINAC).\n\nArtículo 6°- El manejo y uso de los recursos naturales, estarán sujetos a lo\nestablecido en el Plan de Manejo aprobado por el Sistema Nacional de Áreas de\nConservación, quien supervisará su ejecución y podrá emitir disposiciones\ntécnicas y científicas que deberán seguir los propietarios.\n\nArtículo 7°- Los propietarios de\ndicho inmueble se comprometen a no desarrollar ninguna actividad que ponga en\npeligro la existencia de la flora y fauna y darán toda la colaboración necesaria\na investigadores, guardaparques y técnicos del SINAC, que visiten dicha área en\nlabores oficiales a su cargo.\n\nArtículo 8°- La vigilancia de este Refugio y el cumplimiento de las disposiciones\ntécnicas que al efecto emita el SINAC serán responsabilidad del propietario del\ninmueble, lo anterior sin perjuicio de las potestades de tutela demanial en la\nprotección del Patrimonio Natural del Estado y sus recursos que posee el\nSistema Nacional de Áreas de Conservación en cuanto a la supervisión del\ncorrecto uso de los recursos ambientales.\n\nTransitorio l. That in accordance with article 22 of the Biodiversity Law Nº 7788, the National System of Conservation Areas (hereinafter SINAC) is created, with its own legal personality, as a decentralized and participatory management and institutional coordination system, which integrates competencies in forestry, wildlife, and protected areas matters, with the purpose of issuing policies, planning, and executing processes aimed at achieving sustainability in the management of Costa Rica's natural resources.\n\n2. That it is a priority policy of SINAC to facilitate and promote actions that lead to the protection, conservation, and sustainable management of the natural resources and biodiversity present in the Protected Wild Areas (hereinafter ASP) of the Conservation Areas.\n\n3. That by means of Executive Decree Nº 32611-MINAE of June 28, 2005, the Ara Macao National Wildlife Refuge was declared, with a mixed category.\n\n4. That the \"Ara Macao\" National Wildlife Refuge of Mixed Ownership is located on a property comprising the area located in the districts of Jacó and Tárcoles, canton of Garabito, province of Puntarenas based on the Tárcoles Cartographic Sheet, 3245II of the basic map of Costa Rica scale 1:50,000, edition 2 of the National Geographic Institute; which holds Real Folio Nº 6020175-000, with a measurement of 38 hectares and 8965 square meters according to cadastral plan Nº P-1888493-2016, and whose boundaries are described in the boundary description of said plan. That the administration of wildlife and the recommendation of measures to ensure the perpetuity of species is a function of the National System of Conservation Areas of the Ministry of Environment and Energy.\n\n7. That on June 29, 2015, the period of ten years established by Executive Decree Nº 32611-MINAE expired, thereby concluding the effective period of the declaration of the Ara Macao National Wildlife Refuge.\n\n8. That the Management Plan for the \"Ara Macao\" National Wildlife Refuge approved on September 26, 2005, reached the end of its validity in 2015, evidencing that it is necessary to incorporate into it certain aspects established in the Guide for the design and formulation of the General Management Plan for Protected Wild Areas updated in 2014, and in adherence to the current policy for the Protected Wild Areas of SINAC, which obligates the Administration to develop tools and methodologies that promote adaptive management of biodiversity. Therefore, a new management plan must be developed, which must comply with the procedures for the development of Management Plans within Protected Wild Areas made official by SINAC and named \"Procedure for the Development, Updating and Officialization of the General Management Plan for Protected Wild Areas\" according to official note SINAC-DE418-2016 of March 17, 2016 and the \"Guide for the design and formulation of the General Management Plan for the Protected Wild Areas of Costa Rica.\"\n\n9. That El Paseo de Lindara Sociedad Anónima, legal identification number Nº 3-101-284270, registered in the Public Registry, Mercantile Registry, is the owner of the property corresponding to the cadastral plan Nº P-1888493-2016 and which has an extension according to the plan of 38 hectares and 8965 square meters, registered under Real Folio Nº 6020175-000, located in districts one Jacó and two Tárcoles, canton Garabito, province of Puntarenas, which timely and in due form requests the Administration's consent to continue subjecting its land to the Mixed Wildlife Refuge Regime.\n\n10. That the owner of the private land voluntarily agreed to enter into this flora and wild fauna protection regime for a renewable period of ten years.\n\n11. The development of the Management Plan for the Ara Macao National Wildlife Refuge must proceed in accordance with the Guide for the design and formulation of the General Management Plan for Protected Wild Areas updated in 2014, and in adherence to the current policy for the Protected Wild Areas of SINAC, contemplating the tools and methodologies that promote adaptive management of biodiversity.\n\nArticle 5- Said property shall be subject to the category of National Wildlife Refuge of mixed category for a period of ten years, renewable for equal periods, for which the private owner must request the opening of the renewal process one month prior to the end of said period before the Central Pacific Conservation Area of the National System of Conservation Areas (SINAC).\n\nArticle 6- The management and use of natural resources shall be subject to the provisions of the Management Plan approved by the National System of Conservation Areas, which shall supervise its execution and may issue technical and scientific provisions that the owners must follow.\n\nArticle 7- The owners of said property commit to not developing any activity that endangers the existence of flora and fauna and shall provide all necessary collaboration to researchers, park rangers, and technicians of SINAC who visit said area in official duties under their charge.\n\nArticle 8- The surveillance of this Refuge and compliance with the technical provisions issued for this purpose by SINAC shall be the responsibility of the property owner, without prejudice to the powers of public domain tutelage in the protection of the Natural Patrimony of the State and its resources held by the National System of Conservation Areas regarding the supervision of the correct use of environmental resources.\n\nTransitory I. Once this Executive Decree is published in the Official Gazette, within a period of three months, the procedures for the development of the management plan indicated in article 4 must be initiated, which shall comply with the procedures for the development of Management Plans within Protected Wild Areas made official by SINAC named \"Procedure for the Development, Updating and Officialization of the General Management Plan for Protected Wild Areas,\" officialization via official note SINAC-DE-418-2016 of March 17, 2016, and the \"Guide for the design and formulation of the General Management Plan for the Protected Wild Areas of Costa Rica.\"\n\nArticle 9- Shall be effective upon its publication in the official newspaper La Gaceta.\n\nDone at the Presidency of the Republic.
