San José, a las nueve horas con treinta\nminutos del diecinueve de diciembre de dos mil diecisiete. Se establece al\nFondo Nacional de Financiamiento Forestal la cantidad de hectáreas a financiar\npor actividad en el Programa de Pago por Servicios Ambientales y el monto a\npagar con base en los recursos asignados en el Presupuesto Nacional y aprobados\npor la Contraloría General de la República al citado Fondo, las Políticas\nNacionales de Conservación y los criterios de priorización definidos por el\nSistema Nacional de Áreas de Conservación y oficializados por el Poder\nEjecutivo.\n\nRESULTANDO\n\nÚNICO: Que el presupuesto asignado para la formalización de nuevos contratos en\nel Programa de Pago por Servicios Ambientales para el año 2018, es por la suma\nde ¢4.118.187.284, lo cual está incluido en el Plan-Presupuesto 2018 aprobado\npor la Contraloría General de la República, mediante el oficio DFOE-AE-0446 del\n11 de diciembre 2017.\n\nCONSIDERANDO\n\nPRIMERO: Que el artículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto\nEjecutivo N° 25721-MINAE, del 17 de octubre de 1996 y sus reformas, dispone que\nel Ministro de Ambiente y Energía como Jerarca del Ministerio de Ambiente y\nEnergía, en funciones de la Administración Forestal del Estado, emitirá\nanualmente mediante Resolución Ministerial, las actividades a financiar en el\nPrograma de Pago por Servicios Ambientales y los montos a pagar con base en los\nrecursos asignados en el Presupuesto Nacional para el ejercicio del año fiscal\n2018.\n\nSEGUNDO: Que la Administración Solís Rivera a través del Plan Nacional de\nDesarrollo Alberto Cañas Escalante 2014-2018, establece la economía social\nsolidaria, como una forma de lograr la reducción de la pobreza. Bajo este\nprincipio, los instrumentos financieros deben orientarse a apoyar los pilares\ndel Plan Nacional de Desarrollo; no estableciendo discriminación, sino la\norientación prioritaria a las organizaciones de productores que apoyan los\npequeños y medianos productores forestales; y quienes se ubican en los cantones\nde mayor rezago social, considerando los objetivos de la creación del Fondo\nNacional de Financiamiento Forestal según la citada Ley Forestal, sin dejar de\nlado los criterios de orden técnico establecidos.\n\nTERCERO: Que el Plan Nacional de Desarrollo citado, considera como una de las\nmetas nacionales el mantener bajo el Programa de Pago por Servicios\nAmbientales, al menos trescientas mil hectáreas, en sus diferentes actividades.\nAdemás, dispone como uno de sus desafíos: desarrollar instrumentos financieros\nnovedosos y fortalecer los existentes, orientados al manejo forestal\nsostenible, incluyendo la Protección, Regeneración y el establecimiento de Sistemas\nAgroforestales y Plantaciones Forestales; así como, la industrialización y\ncomercialización de los bienes y servicios generados por los ecosistemas\nforestales.\n\nCUARTO: Que ante la necesidad de aumentar proyectos de pago por servicios\nambientales en la actividad de Reforestación, la Oficina Nacional Forestal\npropuso una nueva sub actividad, que ofrezca condiciones más ventajosas y\natractivas, para utilizar esquemas científicos y tecnológicos, para lograr\nreducir los turnos de corta de algunas especies de rápido crecimiento, las\ncuales serán dedicadas a la producción de embalajes y proyectos dendro- energéticos.\n\nQUINTO: Que debido al esquema y requisitos establecidos para la ejecución del\nPrograma de Pago por Servicios Ambientales, los proyectos de las actividades de\nProtección de Bosques, Reforestación, Regeneración y Sistemas Agroforestales de\nproductores, cuyas fincas tienen áreas menores a 10 hectáreas, se hacen poco\nrentables, desmotivando a todos los actores propietarios, ingenieros forestales\ny organizaciones de productores. Por otra parte, dada la tenencia de la tierra\nen el país, que principalmente está compuesta por pequeños propietarios, es\nnecesario innovar mecanismos de fomento, a fin de que estos tengan acceso al\nprograma.\n\nSEXTO: Que la Oficina Nacional Forestal preocupada por la pérdida de interés de\nlos productores, en establecer plantaciones forestales, propone al Ministerio\nde Ambiente y Energía, la creación de un nuevo modelo o esquema de plantación\nforestal, que permite ser más atractiva a los productores, pues pueden cosechar\nen un plazo menor, ello en virtud de la utilización de técnicas de mejoramiento\ngenético más eficientes y un paquete tecnológico preparado con ayuda de los\ningenieros forestales regentes de los proyectos.\n\nSÉTIMO: Que en virtud de lo anterior, esta Resolución establece una propuesta de\nun nuevo mecanismo para incentivar que el programa de pago por servicios\nambientales integre a los pequeños productores en áreas menores a 10 hectáreas.\n\nPOR TANTO:\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nRESUELVE\n\nArtículo 1°. Establecer el límite de gasto al Fondo Nacional de\nFinanciamiento Forestal, para proyectos nuevos a financiar por actividades y\ndeterminar los montos de pago por actividad.\n\n1. Actividades a financiar: Para el año 2018, se considerarán dos\nmodalidades a financiar; a- Recuperación de la Cobertura Forestal, que\nincluye las actividades de Reforestación, Regeneración y Sistemas\nAgroforestales y b-Mantenimiento de la Cobertura Forestal, que incluye\nProtección y Protección Post Cosecha. Para tal fin, se establece la siguiente\ndistribución:\n\n| Modalidades de PSA | Actividad | Cantidad | | --- | --- | --- | | Recuperación de la Cobertura\nForestal* | Reforestación con especies de rápido crecimiento | 875 hectáreas | | | Reforestación\ncon especies de mediano crecimiento | 2.735 hectáreas | | | Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR) | 2.000 hectáreas | | | Regeneración Natural | 3.000 hectáreas | | |\nEstablecimiento de árboles en Sistemas Agroforestales | 500.400 árboles | | | Sistemas\nAgroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF) | 50.000 árboles | |\nMantenimiento de la Cobertura Forestal | Protección de Bosque | 35.352 hectáreas | | | Protección\nde Bosque para el resguardo del Recurso Hídrico | 5.000 hectáreas | | | Protección post cosecha** |\n200 hectáreas |\n\n*: El Fonafifo dará trámite a todas las solicitudes de ingreso\nque se presenten en las sub actividades de Reforestación por 600 hectáreas y\nSistemas Agroforestales, con especies contenidas en los decretos ejecutivos de\nveda y especies amenazadas o en peligro de extinción (Decreto N° 25663-MINAE y\nDecreto N° 25700-MINAE y sus reformas).\n\n**: Se refieren a\ntodas las solicitudes de ingreso con fincas en las cuales se ha finalizado el\nplan de manejo forestal.\n\nEl Fondo Nacional de Financiamiento Forestal, podrá variar la\ndistribución establecida en el cuadro anterior, de acuerdo con la oferta, según\nlas solicitudes recibidas por cada una de las actividades; siempre y cuando, no\nsobrepasen el presupuesto aprobado para el Programa de Pago por Servicios\nAmbientales.\n\nDe disponer de una mayor asignación de recursos, según el artículo 5 de la Ley de Simplificación y\nEficiencia Tributarias N° 8114 publicada en La Gaceta N° 131, del día 9 de julio de 2001 y otros\nrecursos financieros que capte el Fonafifo para el Pago por Servicios Ambientales, se distribuirán\nsegún el criterio de los financiadores y del Fonafifo. En todo caso, los recursos utilizados para\nestos fines, deberán ser incorporados en el presupuesto institucional y ser aprobados por la\nContraloría General de la República.\n\n2. De los montos de pago por actividad y otras condiciones:\n\n2.1. Actividad de Reforestación: Las condiciones que regirán para el trámite\nde solicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Reforestación, son las siguientes:\n\na) El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis y Vochysia hondurensis, será de seiscientos cuarenta y nueve mil\nquinientos treinta y ocho colones con 00/100 (¢649.538) por hectárea, desembolsados durante un\nperíodo de cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el\nsegundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto año.\n\nb) El monto a pagar para las especies de mediano crecimiento referidas\na: Tectona grandis,\nPinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será de\nsetecientos sesenta y cinco mil doscientos diez colones con 00/100 (¢765.210)\npor hectárea, desembolsados durante un período de cinco años. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15%\nel tercer año, 10% el cuarto año y 5% el quinto año.\n\nc) El monto a pagar para especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, será de un millón ciento cuarenta y siete mil ochocientos\ndieciséis colones (¢1.147.816) por hectárea, desembolsados durante un período\nde cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el\nprimer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el\nquinto año.\n\nd) El monto a pagar para las Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR), será de trecientos sesenta y cinco mil ciento\ncuarenta y seis colones 00/100 (365.146 colones con 00/100) por hectárea. Los\npagos serán distribuidos de la siguiente forma: 50% el primer año, 25% el\nsegundo año y 25% el cuarto año.\n\ne) Subactividad denominada\nPlantaciones Forestales establecidas con recursos propios para pago por\nresultados. Las condiciones para esta modalidad son: El monto a pagar para\nlas especies de mediano crecimiento referidas a las incluidas en el inciso b\nanterior es de setecientos sesenta y cinco mil doscientos diez colones con 00/\n100 ( 765.210) por hectárea, Los montos serán distribuidos de la siguiente\nforma un 50 por ciento 12 meses después de la firma del contrato, 20% a los\nveinticuatro meses de la firma del contrato, 15% a los treinta y seis meses de\nla firma del contrato, 10 por ciento a los cuarenta y ocho meses de la firma\ndel contrato y cinco por ciento a los sesenta meses posteriores a la firma del\ncontrato. El plazo del contrato será de dieciséis años, contados a partir de la\nfecha promedio de plantación. Los resultados del incremento anual volumétrico\ndeberán ser los establecidos en el cuadro dos de esta resolución.\n\n(Así adicionado el inciso anterior mediante\nresolución R-132-2018-MINAE del 23 de abril del 2018)\n\nf) Se instruye al Fondo Nacional de Financiamiento Forestal para que\nincorpore en los contratos de Pago por Servicios Ambientales en la actividad de\nReforestación y Sistemas Agroforestales en bloque, los valores mínimos\naceptables para realizar los pagos.\n\n(Corrida la numeración del inciso anterior mediante\nresolución R-132-2018-MINAE del 23 de abril del 2018, que lo traspasó del\nantiguo inciso e) al f))\n\nEl Fondo Nacional de Financiamiento Forestal utilizará los siguientes\nvalores de referencia para tramitar los pagos correspondientes a cada año:\n\nCuadro 1. Dichos\npagos corresponden al total de años del plazo convenido; no obstante, a fin de\npermitir el establecimiento de la plantación y su mantenimiento, se adelantará\ndurante los primeros cinco años.\n\nh) El Fonafifo podrá modificar cuando así se\nsolicite, aquellos contratos suscritos antes del año 2006, que demuestren haber\nalcanzado una producción mínima de 13 metros cúbicos de incremento medio anual\npor hectárea. Para tales efectos, el Fonafifo podrá\nsolicitar la información que considere pertinente.\n\n2.2. Actividad de Regeneración Natural: Las condiciones que regirán para el\ntrámite de solicitudes, para el reconocimiento de los servicios ambientales en\nla actividad de Regeneración Natural, se detallan a continuación.\n\na) El monto a pagar en Regeneración Natural, será de ciento diez mil\nciento noventa y siete colones con 00/100 (¢110.197) por hectárea,\ndesembolsados en cinco pagos anuales de 20% durante un período de cinco años.\n\n2.3. Actividad de Sistemas Agroforestales: Las condiciones\nque regirán para el trámite de solicitudes, para el reconocimiento de los\nservicios ambientales en la actividad de Sistemas Agroforestales, se detallan a\ncontinuación.\n\na) El monto a pagar será de novecientos cuarenta colones con 00/100\n(¢940) por árbol, integrados a Sistemas Agroforestales y desembolsados durante\nun período de cinco años. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 25% el tercero año y 25% el año quinto.\n\nb) El monto a pagar será de mil trescientos noventa y tres colones con\n00/100 (¢1.393) por árbol, integrados a Sistemas Agroforestales, estrictamente\ncon especies nativas contenidas en los Decretos Ejecutivos N° 25663-MINAE del 8\nde octubre de 1996 y N° 25700-MINAE del 15 de noviembre de 1996, desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 25% el tercero año y 25% el año quinto.\n\nc) El monto a pagar será de mil trescientos noventa y tres colones con\n00/100 (¢1.393) por árbol bajo la actividad de Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF), financiados\nmediante el crédito forestal. Los pagos serán distribuidos de la siguiente\nforma: 80% a la firma del contrato, una vez que los árboles hayan alcanzado los\n36 meses de edad y 20% restante en el año quinto del proyecto cuando los\nárboles hayan alcanzado los 60 meses de edad.\n\nd-) Sub actividad\ndenominada Sistemas Mixtos en agroforestería para\nmicro productores. Las condiciones para esta modalidad son: Cuando realicen\nactividades de protección de bosque, un pago de treinta y cuatro mil\ncuatrocientos tres colones (¢34.403,00) por hectárea por año durante un periodo\nde cinco años, (aquí de ser necesario se calcularán las fracciones de hectáreas\nexistentes, hasta el primer decimal. Cuando se realicen actividades de\nregeneración de áreas denudadas un pago de veintidós mil treinta y nueve\ncolones con cuarenta céntimos (¢22.039,40) por año durante un periodo de cinco\naños. Cuando realice actividades de reforestación de especies maderables o de\nuso múltiple fuera del área boscosa un pago de cincuenta y cinco mil\nsetecientos veinte colones (¢55.720,00) por año, por cada doscientos árboles\nplantados o identificados hasta un máximo\nde mil seiscientos árboles. En esta sub-actividad podrá realizarse un solo\ncontrato que comprenda las diferentes actividades y el plazo será de cinco años\ncontados a partir de la firma del contrato.\n\n(Así\nadicionado el inciso anterior mediante resolución R-132-2018-MINAE del 23 de\nabril del 2018)\n\n(Así\nreformado el inciso anterior mediante resolución N° R-227-2018-MINAE del 30 de\njulio del 2018)\n\ne-) Sub Actividad de Sistemas Agroforestales, con plantaciones ya establecidas, para esta modalidad\nsolamente podrán ingresar las personas y empresas comprendidas en el área de venta de reducción de\nemisiones con el Fondo de Carbono denominado \"Coopeagri RL.\", estas plantaciones SAF tendrán los\nmismos requerimientos y condiciones que los Sistemas Agroforestales generales, el monto a pagar por\nárbol será de mil novecientos cincuenta colones (¢1950), que se distribuirá en dos tractos de 80% el\nprimero con la firma del contrato y el 20% restante doce meses después, la vigencia del contrato\nserá de siete años contados a partir del año 2012.\n\n(Así adicionado el inciso anterior mediante\nresolución R-132-2018-MINAE del 23 de abril del 2018)\n\n2.4. Actividad de Protección de Bosque: Las condiciones\nque regirán para el trámite de solicitudes, para el reconocimiento de los\nservicios ambientales en la actividad de Protección de Bosque, se detallan a\ncontinuación:\n\na) El monto a pagar será de ciento setenta y dos mil quince colones con\n00/100 (¢172.015) desembolsados en cinco pagos anuales de 20% durante un\nperíodo de cinco años. Cuando se trate de solicitudes que se ubiquen dentro de\nlas zonas de importancia hídrica, identificadas por el Instituto Costarricense\nde Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo,\nse reconocerá un monto adicional de siendo el monto total a pagar de 43.005\ncolones por hectárea, desembolsados en cinco pagos anuales de 20% durante un\nperíodo de cinco años.\n\nEste monto adicional se aplicará hasta agotar el presupuesto asignado en\nesta actividad.\n\nb) El monto a pagar en proyectos de Protección Post Cosecha será de\nciento treinta y cuatro mil trescientos ochenta y ocho colones con 00/100\n(¢134.388) por hectárea, desembolsados en cinco pagos anuales de 20% durante un\nperíodo de cinco años.\n\n3. Actualización de los montos a pagar. Los montos establecidos por actividad\ndentro del Programa de Pago por Servicios Ambientales, se actualizarán\nanualmente con el Índice de Precios al Consumidor (IPC), calculado por el\nInstituto Nacional de Estadística y Censo (INEC), al cierre del período del año\nanterior.\n\nArtículo 2°. Se instruye al Fondo Nacional de Financiamiento Forestal para que\nincorpore en los contratos de Pago por Servicios Ambientales las siguientes\ncondiciones:\n\n1. De los plazos de vigencia de los contratos: Los plazos de vigencia\nde los contratos de Pago por Servicios Ambientales, generados por las sub\nactividades que corresponden a las modalidades de recuperación y/o\nmantenimiento de cobertura forestal serán los siguientes:\n\na) Los contratos correspondientes a la actividad de Reforestación\nmediante el establecimiento de las especies de rápido crecimiento, tendrán una\nvigencia de diez años a partir de su firma.\n\nb) Los contratos correspondientes a la actividad de Reforestación que\nincorporen especies de mediano crecimiento y las especies nativas contenidas en\nlos\n\nDecretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15\nde noviembre de 1996, su vigencia será de dieciséis años, a partir de su firma.\n\nc) Los contratos correspondientes a la sub actividad de Plantaciones\nForestales con Turnos de Rotación Reducidos (PFTRR), tendrán una vigencia de\nseis años.\n\nd) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales con especies de rápido, mediano y con las\nespecies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700-MINAE del 15 de noviembre de 1996, tendrán una vigencia de\ncinco años a partir de su firma.\n\ne) Los contratos correspondientes a la sub actividad de Sistemas\nAgroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF)\ntendrán la misma vigencia; sin embargo, dado que ya están plantados se les\nreconocerán retroactivamente tres años por su establecimiento previo.\n\nf) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales relacionados a convenios u otros donantes o\nsocios tendrán una vigencia de cinco años a partir de su firma.\n\ng) Los contratos correspondientes a la actividad de Regeneración Natural\ntendrán una vigencia de cinco años a partir de su firma.\n\nh) Los contratos correspondientes a la actividad de Protección post\nCosecha, tendrán una vigencia de cinco años a partir de su firma. De previo a\nla firma del contrato, deberá constar en el expediente la certificación de que\nfue aprobado el plan de manejo, según los Estándares de Sostenibilidad para\nManejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de\nPrácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE\npublicado el 2 de noviembre de 1998, y el Decreto Ejecutivo N° 34559-MINAE\npublicado en La Gaceta N° 115, del día 16 de junio de 2008.\n\ni) Los contratos correspondientes a la actividad de Protección de Bosque\ny Recurso Hídrico tendrán una vigencia de cinco años a partir de su firma.\n\n2. Consideraciones Especiales. Condiciones establecidas para los montos\ny actividades de las solicitudes PSA:\n\n2.1.Se faculta al Fondo Nacional de Financiamiento Forestal a establecer\nactividades y montos diferenciados a los señalados en esta resolución, de\nconformidad con acuerdos, convenios o contratos o proyectos específicos con\nentidades, que aporten recursos financieros al Programa de Pago por Servicios\nAmbientales, que reconozcan montos y condiciones diferentes a los establecidos\npara los diferentes servicios ambientales; para estos proyectos no aplicarán\nlos criterios de priorización que se detallaron anteriormente, sino los\npactados en cada convenio. Los pagos se realizarán siempre y cuando se tenga\ndisponibilidad presupuestaria para cubrir los compromisos adquiridos mediante\nel Programa de Pago por Servicios Ambientales.\n\n2.2.Los montos pendientes por pagar para los contratos de años\nanteriores, se regirán según lo establecido en los Decretos Ejecutivos y\nResoluciones Administrativas correspondientes para cada año.\n\n2.3.Para cubrir el costo de inscripción del contrato ante el Registro\nPúblico, el Fondo Nacional de Financiamiento Forestal retendrá en el primer\ndesembolso del monto total del contrato un 0,6%.\n\n2.4.Los recursos recuperados en virtud de los incumplimientos de\ncontratos de pago por servicios ambientales o las devoluciones o finiquitos,\nserán transferidos al Fideicomiso 544 FONAFIFO/BNCR y serán presupuestados para\nla ejecución de nuevas actividades de fomento de pequeños y medianos productores.\n\n2.5.El beneficiario del proyecto deberá contar durante todo el plazo del\ncontrato, con un regente forestal debidamente inscrito en el Colegio de\nIngenieros Agrónomos. Salvo en aquellos casos que se haya determinado que el\nproyecto será supervisado directamente por el Fondo Nacional de Financiamiento\nForestal. Sin perjuicio de otras disposiciones, el o los beneficiarios deberán\naportar una certificación anual o informe de regencia anual emitido por un\nregente forestal para el trámite de pago.\n\nAdicionalmente, para los contratos de Reforestación de rápido\ncrecimiento, deberá presentar adicionalmente los informes de visita, donde\ncertifique el estado de los proyectos en los años 8 y 10 a partir de su fecha\nde plantación; para los proyectos de mediano crecimiento y otras especies\ndeberán presentar dichos informes al año 8, 12 y 16, a partir de su fecha de\nplantación.\n\n2.6. Sin perjuicio de otras acciones que representen incumplimiento a\nlas obligaciones del contrato, para los contratos de Reforestación de rápido crecimiento\no bloques a partir de los 12 meses y para las plantaciones de mediano\ncrecimiento o bloques a partir de los 24 meses de establecida la plantación, se\nconsidera incumplido el contrato si la plantación no presenta el crecimiento\nmínimo establecido en el inciso e del punto 2.1 de esta resolución, o el\nindicado de previo en el estudio técnico respectivo para otras especies. Como\nconsecuencia de este incumplimiento, el productor no recibirá el pago\ncorrespondiente a este año, siendo que el Fondo Nacional de Financiamiento\nForestal debe suspender los pagos respectivos y dar por terminado el contrato\ncon responsabilidad para el beneficiario previo cumplimiento del debido\nproceso.\n\n2.7. Como principio general, serán motivo de eximente de responsabilidad\npor incumplimiento del contrato, el caso fortuito, la fuerza mayor, el hecho de\nun tercero como eximentes generales debidamente comprobadas y valoradas a\njuicio del Fonafifo. De igual forma, se procederá cuando el propietario de la\nplantación demuestre que una plaga o enfermedad afectó la plantación y que las\nacciones oportunamente realizadas no lograron erradicarla. Se procederá de\nigual manera cuando el daño sea producto de un incendio que no pudo ser\ncontrolado a pesar de las medidas preventivas reportadas.\n\n2.8. No podrán ejecutarse proyectos en fincas que hayan sido objetos de\nplagas, enfermedades, o incendios; en tal supuesto la finca no podrá ser sujeto\nde contratos en Reforestación y/o Sistemas Agroforestales, en un plazo de 3\naños, a partir del último contrato finalizado por esta causa.\n\n2.9.En relación a las plagas y enfermedades que afecten las plantaciones\nforestales, la Junta Directiva de Fonafifo, determinará lineamientos para\nabordar y resolver estos supuestos.\n\n2.10. El Fonafifo, será el responsable de monitorear las plantaciones\nforestales que ingresen al Programa, debiendo no solo hacer un seguimiento a\nnivel regional, sino un protocolo de control, mediante un mecanismo aleatorio\nde visitas según su capacidad técnica y administrativa. De igual forma, deberá\ncustodiar la información de las parcelas permanentes de mediciones de las\nplantaciones, a fin de sustentar los pagos y respaldar las fijaciones de\ncarbono y otros gases de efecto invernadero.\n\n2.11. Para uniformizar la información requerida de las parcelas\npermanentes de plantaciones y bloques, el Fonafifo emitirá el formato del\ncontenido de la base de datos en Excel, que se remitirá anualmente con los\ndatos individuales.\n\n2.12. En caso de que en las solicitudes presentadas se determinara la\nexistencia de traslapes o desplazamiento entre ellas y/o con otras fincas, el\nFonafifo valorará de acuerdo a criterios técnicos y legales la aprobación o no\nde las solicitudes de ingreso.\n\n2.13. En el caso de las solicitudes de ingreso en la actividad de\nProtección que son valoradas según la Matriz de Valoración y que presenten\nvarias fincas; la calificación dependerá de la finca de mayor tamaño que se\nincluya en la solicitud.\n\n2.14. En el caso de las solicitudes de ingreso de Reforestación y\nSistemas Agroforestales que involucren mezclas de especies de rápido, mediano\ny/o en vías de extinción, se deberá generar contratos separados, en virtud de\nlas diferencias de crecimiento que se presentan entre estos grupos de especies.\nAdemás, los proyectos que estén conformados por especies nativas contenidas en\nlos Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, deberá contener el 100% de los árboles de las especies\ncontenidas en los mencionados decretos; de lo contrario tendrá un valor en\nfunción del monto menor establecido para Reforestación.\n\n2.15. San José, at nine thirty in the morning on the nineteenth of December of two thousand seventeen. The following is established for the National Forest Financing Fund: the number of hectares to be financed per activity within the Program for Payment of Environmental Services and the amount to be paid, based on the resources allocated in the National Budget and approved by the Comptroller General of the Republic to said Fund, the National Conservation Policies, and the prioritization criteria defined by the National System of Conservation Areas and made official by the Executive Branch.\n\nWHEREAS\n\nSOLE: That the budget allocated for the formalization of new contracts in the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA) for the year 2018 is the sum of four billion one hundred eighteen million one hundred eighty-seven thousand two hundred eighty-four colones (¢4,118,187,284), which is included in the 2018 Budget Plan approved by the Comptroller General of the Republic, through official communication DFOE-AE-0446 of December 11, 2017.\n\nCONSIDERING\n\nFIRST: That Article 38 of the Regulation to the Forestry Law No. 7575, Executive Decree No. 25721-MINAE, of October 17, 1996, and its amendments, stipulates that the Minister of Environment and Energy, as the head of the Ministry of Environment and Energy, functioning as the State Forestry Administration, will annually issue, by Ministerial Resolution, the activities to be financed within the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA) and the amounts to be paid based on the resources allocated in the National Budget for the 2018 fiscal year.\n\nSECOND: That the Solís Rivera Administration, through the Alberto Cañas Escalante National Development Plan 2014-2018, establishes a social solidarity economy as a means to achieve poverty reduction. Under this principle, financial instruments must be oriented to support the pillars of the National Development Plan, not by establishing discrimination, but by providing priority orientation to producer organizations that support small and medium forestry producers, and those located in cantons with the greatest social lag, considering the objectives for the creation of the National Forest Financing Fund according to the cited Forestry Law, without neglecting established technical criteria.\n\nTHIRD: That the cited National Development Plan considers as one of its national goals the maintenance of at least three hundred thousand hectares under the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA), across its different activities. Furthermore, it stipulates as one of its challenges: the development of novel financial instruments and the strengthening of existing ones, oriented towards sustainable forest management, including Protection, Regeneration, and the establishment of Agroforestry Systems and Forestry Plantations, as well as the industrialization and commercialization of the goods and services generated by forest ecosystems.\n\nFOURTH: That given the need to increase payment for environmental services projects in the Reforestation activity, the National Forestry Office proposed a new sub-activity that offers more advantageous and attractive conditions, utilizing scientific and technological schemes to achieve reduced harvest rotations for certain fast-growing species, which will be dedicated to the production of packaging and dendro-energy projects.\n\nFIFTH: That due to the scheme and requirements established for the execution of the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA), projects in the activities of Forest Protection, Reforestation, Regeneration, and Agroforestry Systems for producers whose farms have areas smaller than 10 hectares become unprofitable, discouraging all owner stakeholders, forestry engineers, and producer organizations. On the other hand, given the land tenure in the country, which is mainly composed of small landowners, it is necessary to innovate promotional mechanisms so that they can access the program.\n\nSIXTH: That the National Forestry Office, concerned about the loss of producer interest in establishing forestry plantations, proposes to the Ministry of Environment and Energy the creation of a new forestry plantation model or scheme that is more attractive to producers because they can harvest in a shorter timeframe, owing to the use of more efficient genetic improvement techniques and a technological package prepared with the help of the forestry engineers managing the projects.\n\nSEVENTH: That by virtue of the foregoing, this Resolution establishes a proposal for a new mechanism to incentivize the payment for environmental services program to integrate small producers in areas smaller than 10 hectares.\n\nTHEREFORE:\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nHEREBY RESOLVES\n\nArticle 1. To establish the spending limit for the National Forest Financing Fund for new projects to be financed by activity and determine the payment amounts per activity.\n\n1. Activities to be financed: For the year 2018, two funding modalities will be considered: a- Recovery of Forest Cover (Recuperación de la Cobertura Forestal), which includes the activities of Reforestation, Regeneration, and Agroforestry Systems and b- Maintenance of Forest Cover, which includes Protection and Post-Harvest Protection. Payments shall be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nb) The amount to be paid for medium-growing species referred to as: Tectona grandis, Pinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, shall be seven hundred sixty-five thousand two hundred ten colones with 00/100 (¢765,210) per hectare, disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nc) The amount to be paid for native species listed in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, shall be one million one hundred forty-seven thousand eight hundred sixteen colones (¢1,147,816) per hectare, disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth year.\n\nd) The amount to be paid for Forestry Plantations with Reduced Rotation Periods (Plantaciones Forestales con Turnos de Rotación Reducidos, PFTRR) shall be three hundred sixty-five thousand one hundred forty-six colones with 00/100 (365,146 colones with 00/100) per hectare. Payments shall be distributed as follows: 50% the first year, 25% the second year, and 25% the fourth year.\n\ne) Sub-activity called Forestry Plantations established with own resources for payment by results. The conditions for this modality are: The amount to be paid for medium-growing species referred to in subsection b above is seven hundred sixty-five thousand two hundred ten colones with 00/100 (765,210 colones with 00/100) per hectare. The amounts shall be distributed as follows: fifty percent 12 months after the signing of the contract, 20% at twenty-four months from the signing of the contract, 15% at thirty-six months from the signing of the contract, 10 percent at forty-eight months from the signing of the contract, and five percent at sixty months following the signing of the contract. The term of the contract shall be sixteen years, counted from the average planting date. The results of the annual volumetric increment must meet those established in table two of this resolution.\n\n(Thus added the preceding subsection by resolution R-132-2018-MINAE of April 23, 2018)\n\nf) The National Forest Financing Fund is instructed to incorporate, in the Payment for Environmental Services (Pago por Servicios Ambientales, PSA) contracts for the Reforestation and Agroforestry Systems en bloc activity, the minimum acceptable values for making payments.\n\n(The numbering of the preceding subsection was adjusted by resolution R-132-2018-MINAE of April 23, 2018, which transferred it from the former subsection e) to f))\n\nThe National Forest Financing Fund will use the following reference values to process the payments corresponding to each year:\n\nTable 1. Said payments correspond to the total years of the agreed term; however, in order to allow the establishment of the plantation and its maintenance, they will be advanced during the first five years.\n\nh) Fonafifo may modify, when so requested, those contracts signed before the year 2006 that demonstrate having reached a minimum production of 13 cubic meters of mean annual increment per hectare. For such purposes, Fonafifo may request any information it deems pertinent.\n\n2.2. Natural Regeneration Activity: The conditions that will govern the processing of applications for the recognition of environmental services (servicios ambientales) in the Natural Regeneration activity are detailed below.\n\na) The amount to be paid for Natural Regeneration shall be one hundred ten thousand one hundred ninety-seven colones with 00/100 (¢110,197) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\n2.3. Agroforestry Systems Activity: The conditions that will govern the processing of applications for the recognition of environmental services (servicios ambientales) in the Agroforestry Systems activity are detailed below.\n\na) The amount to be paid shall be nine hundred forty colones with 00/100 (¢940) per tree, integrated into Agroforestry Systems and disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nb) The amount to be paid shall be one thousand three hundred ninety-three colones with 00/100 (¢1,393) per tree, integrated into Agroforestry Systems, strictly with native species listed in Executive Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, disbursed over a period of five years. Payments shall be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nc) The amount to be paid shall be one thousand three hundred ninety-three colones with 00/100 (¢1,393) per tree under the activity of Agroforestry Systems established in Forest Harvesting Plantations (Plantaciones de Aprovechamiento Forestal, PPAF), financed through forestry credit. Payments shall be distributed as follows: 80% upon the signing of the contract, once the trees have reached 36 months of age, and the remaining 20% in the fifth year of the project when the trees have reached 60 months of age.\n\nd-) Sub-activity called Mixed Agroforestry Systems for micro-producers. The conditions for this modality are: When they carry out forest protection activities, a payment of thirty-four thousand four hundred three colones (¢34,403.00) per hectare per year for a period of five years (here, if necessary, existing hectares fractions will be calculated, up to the first decimal). When they carry out regeneration activities on denuded areas, a payment of twenty-two thousand thirty-nine colones with forty cents (¢22,039.40) per year for a period of five years. When they carry out reforestation activities of timber or multi-use species outside the forested area, a payment of fifty-five thousand seven hundred twenty colones (¢55,720.00) per year, for every two hundred trees planted or identified up to a maximum of one thousand six hundred trees. In this sub-activity, a single contract may be executed covering the different activities, and the term shall be five years counted from the signing of the contract.\n\n(Thus added the preceding subsection by resolution R-132-2018-MINAE of April 23, 2018)\n\n(Thus amended the preceding subsection by resolution No. R-227-2018-MINAE of July 30, 2018)\n\ne-) Sub-Activity of Agroforestry Systems with already established plantations. For this modality, only individuals and companies included in the area of sale of emission reductions with the Carbon Fund called \"Coopeagri RL.\" may enter. These SAF plantations will have the same requirements and conditions as the general Agroforestry Systems. The amount to be paid per tree shall be one thousand nine hundred fifty colones (¢1950), which shall be distributed in two installments: 80% upon the signing of the contract and the remaining 20% twelve months later. The term of the contract shall be seven years counted from the year 2012.\n\n(Thus added the preceding subsection by resolution R-132-2018-MINAE of April 23, 2018)\n\n2.4. Forest Protection Activity: The conditions that will govern the processing of applications for the recognition of environmental services (servicios ambientales) in the Forest Protection activity are detailed below:\n\na) The amount to be paid shall be one hundred seventy-two thousand fifteen colones with 00/100 (¢172,015) disbursed in five annual payments of 20% over a period of five years. For applications located within zones of hydrological importance, identified by the Costa Rican Institute of Aqueducts and Sewers, the Water Directorate, and Fonafifo, an additional amount shall be recognized, making the total amount payable forty-three thousand five colones per hectare, disbursed in five annual payments of 20% over a period of five years.\n\nThis additional amount will be applied until the budget assigned to this activity is exhausted.\n\nb) The amount to be paid for Post-Harvest Protection projects shall be one hundred thirty-four thousand three hundred eighty-eight colones with 00/100 (¢134,388) per hectare, disbursed in five annual payments of 20% over a period of five years.\n\n3. Updating of payment amounts. The amounts established per activity within the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA) shall be updated annually using the Consumer Price Index (Índice de Precios al Consumidor, IPC), calculated by the National Institute of Statistics and Censuses (INEC), at the close of the prior year's period.\n\nArticle 2. The National Forest Financing Fund is instructed to incorporate the following conditions into the Payment for Environmental Services (Pago por Servicios Ambientales, PSA) contracts:\n\n1. Regarding the terms of contract validity: The terms of validity for Payment for Environmental Services (Pago por Servicios Ambientales, PSA) contracts, generated by the sub-activities corresponding to the modalities of recovery and/or maintenance of forest cover, shall be as follows:\n\na) Contracts corresponding to the Reforestation activity through the establishment of fast-growing species shall have a validity of ten years from their signing.\n\nb) Contracts corresponding to the Reforestation activity that incorporate medium-growing species and native species listed in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, shall have a validity of sixteen years from their signing.\n\nc) Contracts corresponding to the sub-activity of Forestry Plantations with Reduced Rotation Periods (Plantaciones Forestales con Turnos de Rotación Reducidos, PFTRR) shall have a validity of six years.\n\nd) Contracts corresponding to the activity of establishing trees in Agroforestry Systems with fast-growing, medium-growing species, and with native species listed in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, shall have a validity of five years from their signing.\n\ne) Contracts corresponding to the sub-activity of Agroforestry Systems established in Forest Harvesting Plantations (Plantaciones de Aprovechamiento Forestal, PPAF) shall have the same validity; however, given that they are already planted, three years will be retroactively recognized for their prior establishment.\n\nf) Contracts corresponding to the activity of establishing trees in Agroforestry Systems related to agreements or other donors or partners shall have a validity of five years from their signing.\n\ng) Contracts corresponding to the activity of Natural Regeneration shall have a validity of five years from their signing.\n\nh) Contracts corresponding to the activity of Post-Harvest Protection shall have a validity of five years from their signing. Prior to the signing of the contract, the record must contain the certification that the management plan was approved, according to the Sustainability Standards for Natural Forest Management: Principles, Criteria and Indicators, Code of Practices and Procedures Manual, Executive Decree No. 27388-MINAE published on November 2, 1998, and Executive Decree No. 34559-MINAE published in La Gaceta No. 115, of June 16, 2008.\n\ni) Contracts corresponding to the activity of Forest and Water Resource Protection shall have a validity of five years from their signing.\n\n2. Special Considerations. Conditions established for the amounts and activities of PSA applications:\n\n2.1. The National Forest Financing Fund is authorized to establish activities and differentiated amounts from those indicated in this resolution, in accordance with agreements, covenants, contracts, or specific projects with entities that contribute financial resources to the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA), which recognize amounts and conditions different from those established for the various environmental services (servicios ambientales). For these projects, the prioritization criteria detailed previously shall not apply, but rather those agreed upon in each covenant. Payments will be made provided budget availability exists to cover the commitments acquired through the Program for Payment of Environmental Services (Pago por Servicios Ambientales, PSA).\n\n2.2. The outstanding amounts payable for contracts from previous years shall be governed by the provisions established in the Executive Decrees and Administrative Resolutions corresponding to each year.\n\n2.3. To cover the cost of registering the contract with the Public Registry, the National Forest Financing Fund will withhold 0.6% from the first disbursement of the total contract amount.\n\n2.4. Resources recovered by virtue of breaches of payment for environmental services (pago por servicios ambientales) contracts, or refunds or settlements, shall be transferred to Trust 544 FONAFIFO/BNCR and shall be budgeted for the execution of new promotional activities for small and medium producers.\n\n2.5. The project beneficiary must retain, for the entire duration of the contract, a forest manager (regente forestal) duly registered with the College of Agronomist Engineers. Except in those cases where it has been determined that the project will be supervised directly by the National Forest Financing Fund. Without prejudice to other provisions, the beneficiary or beneficiaries must provide an annual certification or annual management report (informe de regencia anual) issued by a forest manager (regente forestal) for the payment process.\n\nAdditionally, for fast-growing Reforestation contracts, they must additionally submit visit reports certifying the status of the projects at years 8 and 10 from their planting date; for medium-growing and other species projects, they must submit said reports at years 8, 12, and 16 from their planting date.\n\n2.6. Without prejudice to other actions that represent a breach of the contract obligations, for fast-growing Reforestation contracts or blocks, from 12 months onward, and for medium-growing plantations or blocks, from 24 months after the plantation is established, the contract is considered breached if the plantation does not show the minimum growth established in subsection e of point 2.1 of this resolution, or that previously indicated in the respective technical study for other species. As a consequence of this breach, the producer shall not receive the payment corresponding to that year, and the National Forest Financing Fund must suspend the respective payments and terminate the contract with liability for the beneficiary, following the due process.\n\n2.7. As a general principle, the following shall be grounds for exemption from liability for breach of contract: fortuitous event, force majeure, and the act of a third party, as general exonerations, duly verified and assessed at the discretion of Fonafifo. The same procedure will apply when the plantation owner demonstrates that a pest or disease affected the plantation and that actions taken in a timely manner failed to eradicate it. The same procedure will also apply when the damage is the result of a fire that could not be controlled despite the reported preventive measures.\n\n2.8. Projects may not be executed on farms that have been subject to pests, diseases, or fires; in such an event, the farm may not be the subject of contracts for Reforestation and/or Agroforestry Systems for a period of 3 years, starting from the last contract terminated for this cause.\n\n2.9. Regarding pests and diseases affecting forestry plantations, the Board of Directors of Fonafifo will determine guidelines to address and resolve these situations.\n\n2.10. Fonafifo will be responsible for monitoring forestry plantations that enter the Program, and must not only conduct follow-up at the regional level but also implement a control protocol through a random mechanism of visits according to its technical and administrative capacity. Likewise, it must safeguard the information from permanent measurement plots of the plantations, in order to support the payments and back the carbon and other greenhouse gas sequestration claims.\n\n2.11. To standardize the information required from the permanent plots of plantations and blocks, Fonafifo will issue the content format for the Excel database, which will be submitted annually with individual data.\n\n2.12. In the event that submitted applications are determined to have overlaps or displacement between them and/or with other properties, Fonafifo will assess the approval or rejection of the entry applications according to technical and legal criteria.\n\n2.13. In the case of entry applications for the Protection activity that are assessed according to the Assessment Matrix and that involve multiple properties, the qualification will depend on the largest property included in the application.\n\n2.14. In the case of entry applications for Reforestation and Agroforestry Systems that involve mixtures of fast-growing, medium-growing, and/or endangered species, separate contracts must be generated, by virtue of the differences in growth that occur between these groups of species. Furthermore, projects composed of native species listed in Decrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15, 1996, must contain 100% of the trees of the species listed in said decrees; otherwise, their value will be based on the lower amount established for Reforestation.\n\n2.15. Projects financed with resources from agreements or other donors or partners shall have management services (servicios de regencia) financed with resources from this agreement, or those established with other donors or partners.\n\nArticle 3. The Board of Directors of the National Forest Financing Fund is instructed to establish, in the year 2018, a promotional and/or financing mechanism that allows owners of farms with areas smaller than 10 hectares to participate in the Environmental Services Program (Programa de Servicios Ambientales) in its different modalities.\n\nArticle 4. This resolution shall take effect upon its publication." }
