Como tal, la EARTH está\n\n\n\n\n\nhabilitada para ofrecer grados académicos y títulos profesionales, los\n\n\n\n\n\ncuales facultarán para el ejercicio de la profesión respectiva.\n\n\n\n\n\n(Así reformado por el artículo 1º de la ley No. 7357 de 7 de\n\n\n\n\n\nsetiembre de 1993)\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 2º.- La Escuela de Agricultura de la Región Tropical Húmeda\n\n\n\n\n\ntendrá personalidad jurídica propia y capacidad para adquirir derechos,\n\n\n\n\n\ncontraer obligaciones y entablar procedimientos judiciales y\n\n\n\n\n\nadministrativos.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 3º.- Esta institución se regirá por los principios y\n\n\n\n\n\ndisposiciones del Derecho privado.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 4º.- La Escuela de Agricultura de la Región Tropical Húmeda\n\n\n\n\n\ntendrá su domicilio en la ciudad de San José, pero podrá establecer\n\n\n\n\n\nagencias, oficinas, centros o dependencias en cualquier lugar del país o\n\n\n\n\n\nfuera de él.\n\n\n\n\nFicha articulo\n\n\n\n\n\nOBJETIVOS\n\n\n\n\n\nARTICULO 5º.- La institución tendrá los siguientes objetivos:\n\n\n\n\n\na) Establecer centros para la enseñanza,la investigación y la\n\n\n\n\n\ndifusión de conocimientos sobre la agricultura y la conservación\n\n\n\n\n\ndel trópico húmedo.\n\n\n\n\n\nb) Propiciar el desarrollo socioeconómico de Costa Rica y de otros\n\n\n\n\n\npaíses del área, mediante el desarrollo de tecnologías adecuadas\n\n\n\n\n\npara el cultivo, cosecha y procesamiento de productos agrícolas\n\n\n\n\n\nen la zona tropical húmeda.\n\n\n\n\n\nc) Llevar a cabo investigación, experimentación y difusión\n\n\n\n\n\ncientífica relacionadas con el trópico húmedo y su defensa\n\n\n\n\n\necológica.\n\n\n\n\n\nch) Instruir y capacitar personal técnico en el campo de la\n\n\n\n\n\nagroindustria del trópico húmedo.\n\n\n\n\n\nd) Llevar a cabo programas de extensión cultural.\n\n\n\n\n\ne) Emprender otras actividades afines con su especialidad.\n\n\n\n\n\n(Así reformado por el artículo 2º de la ley No.7357 de 7 de\n\n\n\n\n\nsetiembre de 1993, la cual derogó su inciso d) y corrió la numeración de\n\n\n\n\n\nlos incisos e) y f), que pasaron a ser los actuales d) y e),\n\n\n\n\n\nrespectivamente).\n\n\n\n\nFicha articulo\n\n\n\n\n\nPATRIMONIO\n\n\n\n\n\nARTICULO 6º.- Para la realización de sus objetivos, la institución\n\n\n\n\n\ncontará con las rentas que perciba de una dotación inicial. De\n\n\n\n\n\nconformidad con los convenios para la estabilización y recuperación\n\n\n\n\n\neconómica de Costa Rica firmados con el Gobierno de los Estados Unidos de\n\n\n\n\n\nAmérica, los fondos de esta dotación serán asignados a un fideicomiso que\n\n\n\n\n\nse creará, preferentemente dentro del país, para invertirlos y\n\n\n\n\n\nadministrarlos. La \"W.K. Kellogg Foundation,\" de Battle Creek,Michigan,\n\n\n\n\n\nEstados Unidos de América, donará fondos destinados a la asistencia\n\n\n\n\n\ntécnica necesaria para estructurar y organizar la Escuela. Además,\n\n\n\n\n\nconstituirán su patrimonio todas las donaciones, aportes económicos y\n\n\n\n\n\nbienes de cualquier clase que la institución acepte, excepto rentas del\n\n\n\n\n\nfondo para el financiamiento de la educación superior estatal.\n\n\n\n\nFicha articulo\n\n\n\n\n\nCAPACIDAD JURIDICA\n\n\n\n\n\nARTICULO 7º.- Para el logro de sus fines, la institución podrá\n\n\n\n\n\nrealizar otras actividades que requiera o que se deriven de su\n\n\n\n\n\nnaturaleza, inclusive operaciones comerciales. Los ingresos y ganancias\n\n\n\n\n\nque obtenga los destinará exclusivamente a la realización de sus fines\n\n\n\n\n\neducativos.\n\n\n\n\nFicha articulo\n\n\n\n\n\nGOBIERNO Y ADMINISTRACION\n\n\n\n\n\nARTICULO 8º.- La institución funcionará bajo la dirección de un\n\n\n\n\n\nConsejo Directivo. Habrá un director para la ejecución de las\n\n\n\n\n\nresoluciones del Consejo Directivo y la representación de la institución.\n\n\n\n\n\nEl director y el Consejo tendrán funciones propias, el primero\n\n\n\n\n\nsubordinado al segundo.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 9º.- Habrá además una Junta de Fiduciarios que será creada\n\n\n\n\n\npor las instituciones donantes iniciales, la cual tendrá las siguientes\n\n\n\n\n\nfunciones:\n\n\n\n\n\na) Administrar e invertir, en fideicomiso, la dotación.\n\n\n\n\n\nb) Proveer fondos para la realización de objetivos como los\n\n\n\n\n\ncontemplados en el artículo quinto.\n\n\n\n\n\nc) Aprobar los presupuestos de la Escuela, en el nivel de Programas\n\n\n\n\n\ny vigilar su ejecución.\n\n\n\n\n\nch) Fiscalizar la utilización de los fondos.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 10.- El Consejo Directivo estará integrado por doce\n\n\n\n\n\nmiembros entre los cuales habrá dos de la Junta de Fiduciarios y cuatro\n\n\n\n\n\nmiembros costarricenses en representación, uno de las universidades\n\n\n\n\n\nestatales, uno del Gobierno y dos de los productores agrícolas. Todos los\n\n\n\n\n\nmiembros deberán ser personas de reconocida capacidad y experiencia en\n\n\n\n\n\nla especialidad de la Escuela, que reúnan los requisitos que se exijan en\n\n\n\n\n\nlos estatutos. Cada miembro del Consejo Directivo tendrá derecho a un\n\n\n\n\n\nvoto.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 11.- Los primeros miembros del Consejo Directivo, en\n\n\n\n\n\ncantidad no menor de seis, serán elegidos por la Junta de Fiduciarios; un\n\n\n\n\n\ntercio de ellos por dos años, otro tercio por cuatro años, y el tercio\n\n\n\n\n\nrestante por seis años. Los nombramientos posteriores se harán en la\n\n\n\n\n\nforma y por el plazo que se estipule en los estatutos.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 12.- Las funciones y atribuciones del Consejo Directivo\n\n\n\n\n\nserán:\n\n\n\n\n\na) Dictar la acción y la política educacional y administrativa de la\n\n\n\n\n\nEscuela, teniendo en cuenta el carácter internacional que debe\n\n\n\n\n\nproyectar la institución así como su apego a los principios\n\n\n\n\n\ndemocráticos.\n\n\n\n\n\nb) Elaborar los estatutos de la Escuela y, con la aprobación de la\n\n\n\n\n\nJunta de Fiduciarios, promulgarlos y reformarlos.\n\n\n\n\n\nc) Consultar a la Junta de Fiduciarios cualquier proposición de\n\n\n\n\n\nreforma a esta ley.\n\n\n\n\n\nch) Aprobar, reformar e interpretar los planes de estudio, programas\n\n\n\n\n\ny reglamentos.\n\n\n\n\n\nd) Concertar convenios con instituciones públicas o privadas, tanto\n\n\n\n\n\nnacionales como extrajeras, para la realización de sus fines.\n\n\n\n\n\ne) Nombrar o destituir al director de la Escuela, con observancia de\n\n\n\n\n\nlos requisitos que se señalen en los estatutos para el ejercicio\n\n\n\n\n\ndel cargo.\n\n\n\n\n\nf) Nombrar o remover al auditor externo y al abogado de la\n\n\n\n\n\ninstitución.\n\n\n\n\n\ng) Conferir y revocar toda clase de poderes.\n\n\n\n\n\nh) Proponer a la Junta de Fiduciarios el presupuesto anual de\n\n\n\n\n\noperaciones y de inversión, para la aprobación definitiva de los\n\n\n\n\n\ningresos y gastos en el nivel de programas.\n\n\n\n\n\ni) Establecer los requisitos del ingreso de los alumnos a la\n\n\n\n\n\nEscuela.\n\n\n\n\n\nj) Asignar responsabilidades o prioridades de estudio o de trabajo.\n\n\n\n\n\nk) Establecer organismos subsidiarios o comisiones para facilitar\n\n\n\n\n\nsus labores.\n\n\n\n\n\nl) Informar a la Junta de Fiduciarios sobre las actividades de la\n\n\n\n\n\nEscuela, a solicitud de aquélla.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 13.- El Consejo Directivo nombrará de su seno un\n\n\n\n\n\npresidente, un vicepresidente y un secretario. En los estatutos de la\n\n\n\n\n\ninstitución se determinarán el período de esos nombramientos y las\n\n\n\n\n\nfunciones de los directivos, así como las cuestiones de procedimientos y\n\n\n\n\n\nfuncionamiento del Consejo Directivo, de los órganos y del personal de la\n\n\n\n\n\ninstitución. El Consejo Directivo podrá celebrar reuniones en cualquier\n\n\n\n\n\nlugar fuera de la sede de la institución.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 14.- El director será el funcionario administrativo de\n\n\n\n\n\nmayor rango de la Escuela y ostentará la representación judicial y\n\n\n\n\n\nextrajudicial de la institución, con las atribuciones de un apoderado\n\n\n\n\n\ngeneralísimo sin límite de suma, según el artículo 1253 del Código Civil.\n\n\n\n\n\nSu nombramiento se inscribirá en la Sección de Personas del Registro\n\n\n\n\n\nPúblico.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 15.- Las funciones y atribuciones del director serán:\n\n\n\n\n\na) Representar judicial y extrajudicialmente a la institución.\n\n\n\n\n\nb) Asistir a la reuniones del Consejo Directivo, con voz pero sin\n\n\n\n\n\nvoto.\n\n\n\n\n\nc) Ejecutar la política de la institución.\n\n\n\n\n\nch) Formular los planes de trabajo, que incluirán un presupuesto\n\n\n\n\n\nanual de operación y otro de inversiones.\n\n\n\n\n\nd) Nombrar y remover al cuerpo docente y demás personal de la\n\n\n\n\n\ninstitución, de acuerdo con los estatutos.\n\n\n\n\n\ne) Desempeñar las demás funciones que le encomiende el Consejo\n\n\n\n\n\nDirectivo.\n\n\n\n\nFicha articulo\n\n\n\n\n\nPRERROGATIVAS\n\n\n\n\n\nARTICULO 16.- La Escuela de Agricultura de la Región Tropical Húmeda\n\n\n\n\n\ntendrá exención tributaria, arancelaria y de sobretasas para la\n\n\n\n\n\nimportación y exportación de todos aquellos artículos que requiera para\n\n\n\n\n\nsus programas de docencia e investigación.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 17.- Las inversiones que haga la institución y las rentas\n\n\n\n\n\nque obtenga en Costa Rica estarán libres de todo impuesto y gravamen. Las\n\n\n\n\n\nrentas que genere el fideicomiso solamente podrán usarse para los\n\n\n\n\n\npropósitos académicos de la Escuela.\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 18.- La institución podrá tener fondos en divisas\n\n\n\n\n\ncorrientes de cualquier clase y llevar sus cuentas en cualquiera de\n\n\n\n\n\nellas. Podrá celebrar toda clase de actos y controles exigibles, podrá\n\n\n\n\n\ntransferir sus fondos en divisa corriente de un país a otro y\n\n\n\n\n\nconvertirlos a otras divisas.\n\n\n\n\nFicha articulo\n\n\n\n\n\nArtículo 19.—El rector, los directores y el personal docente de la Institución, no costarricenses o\nresidentes en Costa Rica, estarán exentos del pago de impuestos, tasas y contribuciones sobre la\nimportación de equipaje, menaje de casa, vehículos y demás artículos de uso personal y doméstico,\nasí como de todos los impuestos de carácter nacional.\n\n\n\n\n\nEn el caso de los vehículos, la exoneración se aplicará en intervalos de cuatro años, a partir de la\nfecha en que sea otorgada por primera vez. La disposición y venta de los vehículos en Costa Rica, se\nautorizará pasados cuatro años desde la fecha de inscripción.\n\n\n\n\n\nLos funcionarios que por algún motivo terminen su relación laboral con la Institución y cuyo\nvehículo no haya cumplido los cuatro años de haber sido inscrito, deberán proceder a liquidar los\nimpuestos de importación correspondientes, de acuerdo con el tiempo transcurrido, según la\nlegislación vigente.\n\n\n\n\n\n(Así reformado por el artículo único de la Ley N° 8120 de 3 de agosto del 2001)\n\n\n\n\n\nFicha articulo\n\n\n\n\n\nARTICULO 20.- Los nombres de las personas con derecho a los\n\n\n\n\n\nprivilegios concedidos en esta ley se consignarán en una nómina oficial\n\n\n\n\n\nque llevará el Ministerio de Relaciones Exteriores y Culto.   "body_en_text": "Creation of EARTH (Escuela Agricultura Región Tropical Húmeda)\n\nLAW FOR THE CREATION OF THE SCHOOL OF AGRICULTURE\n\nOF THE TROPICAL HUMID REGION\n\nARTICLE 1.- A private university-level higher education institution is created, for purposes of public utility, called the School of Agriculture of the Tropical Humid Region (EARTH), specializing in the teaching, research, and dissemination of knowledge about the agriculture and conservation of the humid tropics. As such, EARTH is authorized to offer academic degrees and professional titles, which will qualify the holder to practice the respective profession.\n\n(As amended by Article 1 of Law No. 7357 of September 7, 1993)\n\nARTICLE 2.- The School of Agriculture of the Tropical Humid Region shall have its own legal personality and the capacity to acquire rights, incur obligations, and initiate judicial and administrative proceedings.\n\nARTICLE 3.- This institution shall be governed by the principles and provisions of private law.\n\nARTICLE 4.- The School of Agriculture of the Tropical Humid Region shall have its domicile in the city of San José, but may establish agencies, offices, centers, or dependencies in any place within the country or abroad.\n\nOBJECTIVES\n\nARTICLE 5.- The institution shall have the following objectives:\n\na) Establish centers for the teaching, research, and dissemination of knowledge about the agriculture and conservation of the humid tropics.\n\nb) Promote the socioeconomic development of Costa Rica and other countries in the area, through the development of appropriate technologies for the cultivation, harvesting, and processing of agricultural products in the tropical humid zone.\n\nc) Carry out scientific research, experimentation, and dissemination related to the humid tropics and its ecological defense.\n\nch) Instruct and train technical personnel in the field of agroindustry of the humid tropics.\n\nd) Carry out cultural extension programs.\n\ne) Undertake other activities related to its specialty.\n\n(As amended by Article 2 of Law No. 7357 of September 7, 1993, which repealed subsection d) and renumbered subsections e) and f), which became the current d) and e), respectively.)\n\nPATRIMONY\n\nARTICLE 6.- To achieve its objectives, the institution shall have the income it receives from an initial endowment. In accordance with the agreements for the stabilization and economic recovery of Costa Rica signed with the Government of the United States of America, the funds of this endowment shall be assigned to a trust that shall be created, preferably within the country, to invest and administer them. The \"W.K. Kellogg Foundation,\" of Battle Creek, Michigan, United States of America, shall donate funds destined for the technical assistance necessary to structure and organize the School. Furthermore, its patrimony shall consist of all donations, economic contributions, and assets of any kind that the institution accepts, except income from the fund for financing state higher education.\n\nLEGAL CAPACITY\n\nARTICLE 7.- To achieve its purposes, the institution may carry out other activities that it requires or that derive from its nature, including commercial operations. The income and profits it obtains shall be used exclusively for the fulfillment of its educational purposes.\n\nGOVERNMENT AND ADMINISTRATION\n\nARTICLE 8.- The institution shall function under the direction of a Board of Directors. There shall be a director for the execution of the resolutions of the Board of Directors and the representation of the institution. The director and the Board shall have their own functions, the former subordinate to the latter.\n\nARTICLE 9.- There shall also be a Board of Trustees that shall be created by the initial donor institutions, which shall have the following functions:\n\na) Administer and invest, in trust, the endowment.\n\nb) Provide funds for the achievement of objectives such as those contemplated in Article Five.\n\nc) Approve the School's budgets, at the program level, and monitor their execution.\n\nch) Supervise the use of the funds.\n\nARTICLE 10.- The Board of Directors shall be composed of twelve members, among which there shall be two from the Board of Trustees and four Costa Rican members representing, one from the state universities, one from the Government, and two from agricultural producers. All members must be persons of recognized capacity and experience in the School's specialty, who meet the requirements established in the bylaws (estatutos). Each member of the Board of Directors shall have the right to one vote.\n\nARTICLE 11.- The first members of the Board of Directors, in a number no fewer than six, shall be elected by the Board of Trustees; one-third of them for two years, another third for four years, and the remaining third for six years. Subsequent appointments shall be made in the manner and for the term stipulated in the bylaws.\n\nARTICLE 12.- The functions and powers of the Board of Directors shall be:\n\na) Establish the educational and administrative action and policy of the School, taking into account the international character that the institution must project as well as its adherence to democratic principles.\n\nb) Draft the School's bylaws and, with the approval of the Board of Trustees, enact and reform them.\n\nc) Consult the Board of Trustees on any proposal to reform this law.\n\nch) Approve, reform, and interpret the study plans, programs, and regulations.\n\nd) Conclude agreements with public or private institutions, both national and foreign, for the fulfillment of its purposes.\n\ne) Appoint or dismiss the director of the School, observing the requirements established in the bylaws for holding the position.\n\nf) Appoint or remove the external auditor and the institution's attorney.\n\ng) Grant and revoke all types of powers of attorney.\n\nh) Propose the annual operating and investment budget to the Board of Trustees, for the final approval of income and expenses at the program level.\n\ni) Establish the requirements for student admission to the School.\n\nj) Assign responsibilities or priorities of study or work.\n\nk) Establish subsidiary bodies or commissions to facilitate its work.\n\nl) Report to the Board of Trustees on the activities of the School, at the request of the Board.\n\nARTICLE 13.- The Board of Directors shall appoint from its members a president, a vice president, and a secretary. The institution's bylaws shall determine the term of these appointments and the functions of the officers, as well as matters of procedure and operation of the Board of Directors, the bodies, and the staff of the institution. The Board of Directors may hold meetings in any place outside the institution's headquarters.\n\nARTICLE 14.- The director shall be the highest-ranking administrative official of the School and shall hold the judicial and extrajudicial representation of the institution, with the powers of a generalisimo attorney-in-fact without limit of sum, according to Article 1253 of the Civil Code. His appointment shall be registered in the Persons Section of the Public Registry.\n\nARTICLE 15.- The functions and powers of the director shall be:\n\na) Represent the institution judicially and extrajudicially.\n\nb) Attend the meetings of the Board of Directors, with voice but without vote.\n\nc) Execute the institution's policy.\n\nch) Formulate work plans, which shall include an annual operating budget and an investment budget.\n\nd) Appoint and remove the faculty and other personnel of the institution, in accordance with the bylaws.\n\ne) Perform the other functions entrusted to him by the Board of Directors.\n\nPREROGATIVES\n\nARTICLE 16.- The School of Agriculture of the Tropical Humid Region shall have tax, tariff, and surcharge exemption for the import and export of all those articles it requires for its teaching and research programs.\n\nARTICLE 17.- The investments made by the institution and the income it obtains in Costa Rica shall be free of all taxes and levies. The income generated by the trust may only be used for the academic purposes of the School.\n\nARTICLE 18.- The institution may have funds in current currencies of any kind and keep its accounts in any of them. It may enter into all types of acts and enforceable contracts, may transfer its current currency funds from one country to another, and convert them to other currencies.\n\nArticle 19.—The rector (rector), the directors, and the teaching staff of the Institution, who are not Costa Rican or residents in Costa Rica, shall be exempt from the payment of taxes, fees, and contributions on the import of luggage, household goods, vehicles, and other articles of personal and domestic use, as well as from all national-level taxes.\n\nIn the case of vehicles, the exemption shall apply at intervals of four years, from the date it is first granted. The disposal and sale of the vehicles in Costa Rica shall be authorized after four years from the registration date.\n\nOfficials whose employment relationship with the Institution terminates for any reason and whose vehicle has not completed four years since being registered must proceed to pay the corresponding import taxes, in accordance with the time elapsed, according to the legislation in force.\n\n(As amended by the sole article of Law No. 8120 of August 3, 2001)\n\nARTICLE 20.- The names of the persons entitled to the privileges granted in this law shall be recorded on an official list kept by the Ministry of Foreign Affairs and Worship. The institution shall timely inform the Ministry of the names of persons who must be included on the list or excluded from it.\n\nARTICLE 21.- The State and its institutions shall facilitate the work of the institution and its officials.\n\nDISSOLUTION\n\nARTICLE 22.- If the institution is dissolved or liquidated for any cause, the assets held by the School at the time of its dissolution, which entered its patrimony by virtue of direct donations from the Agency for International Development, shall become the property of the Government of Costa Rica, which may transfer them to other educational institutions. The other goods and assets of the institution shall be liquidated and distributed among non-profit educational organizations, by a liquidator appointed and instructed by the Board of Trustees.\n\nARTICLE 23.- It shall take effect as of its publication."
