que cobre el Ministerio de Ambiente y Energía (Minae) a los\nusuarios por concepto de uso y aprovechamiento de agua, se destinará un\ncincuenta por ciento (50%) al Sistema Nacional de Áreas de Conservación (Sinac)\npara la implementación del Plan General de Manejo de Uso Sostenible y Racional.\n\n Ficha articulo\n\nARTÍCULO 6- Finalizadas las obras de construcción y puesto en operación\nel Embalse Río Piedras por parte del Servicio Nacional de Aguas Subterráneas,\nRiego y Avenamiento (Senara), el área de embalse, que incluye el anillo de\nprotección, se constituirá en un ecosistema de humedal administrado por el\nSistema Nacional de Áreas de Conservación (Sinac) y conforme a lo establecido\nen el artículo 33 de la Ley N.° 7575, Ley Forestal, de 13 de febrero de 1996.\nDeberá existir estricta coordinación con Senara para la utilización del agua\nconforme a diversos usos requeridos. file\n\nARTICLE 3- The National System of Conservation Areas (Sinac) is authorized to use, for its own purposes, the harvestable timber extracted from the storage reservoir area of the Río Piedras of the Water Supply Project for the Middle Basin of the Tempisque River and Coastal Communities (Paacume). Likewise, it may authorize donations to ministries, their deconcentrated bodies, autonomous and semi-autonomous institutions, local governments, or comprehensive development associations, upon prior written request to the Arenal Tempisque Conservation Area.\n\nArticle file\n\nARTICLE 4- The National Groundwater, Irrigation, and Drainage Service (Senara) shall be the entity responsible for carrying out the environmental study of the Water Supply Project for the Middle Basin of the Tempisque River and Coastal Communities (Paacume), which must include prevention, mitigation, and compensation measures for the affected area addressed in Article 2 of this law, which must be implemented by the developer.\n\nThe environmental impact assessment (estudio de impacto ambiental) must consider the baseline approved by the entities and endorsed by the Regional Council of Conservation Areas of the National System of Conservation Areas (Sinac), without prejudice to the terms of reference issued by the National Environmental Technical Secretariat (Setena), in accordance with the corresponding legal framework.\n\nArticle file\n\nARTICLE 5- The Embalse Río Piedras area, which includes the protection ring, forms an integral part of the Water Supply Project for the Middle Basin of the Tempisque River and Coastal Communities (Paacume) to be developed by the National Groundwater, Irrigation, and Drainage Service (Senara), which will allow the storage and regulation of water from the Arenal Dengo Sandillal Hydroelectric Complex (Ardesa) with subsequent conveyance and equitable distribution to supply the needs of agricultural productive consumption, hydroelectric generation, tourism promotion, and population supply, the latter through the Costa Rican Institute of Aqueducts and Sewers (AyA), in addition to those other activities that are necessary for the fulfillment of the objectives proposed by Paacume.\n\nOf the fee collected by the Ministry of Environment and Energy (Minae) from users for the use and exploitation of water, fifty percent (50%) shall be allocated to the National System of Conservation Areas (Sinac) for the implementation of the General Plan for Sustainable and Rational Use Management.\n\nArticle file\n\nARTICLE 6- Once the construction works are completed and the Embalse Río Piedras is put into operation by the National Groundwater, Irrigation, and Drainage Service (Senara), the reservoir area, which includes the protection ring, shall constitute a wetland ecosystem administered by the National System of Conservation Areas (Sinac) and in accordance with the provisions of Article 33 of Law No. 7575, Forestry Law (Ley Forestal), of February 13, 1996. There must be strict coordination with Senara for the use of water according to the various required uses. The Executive Branch, through Sinac, shall carry out the necessary studies to grant said space a management category, which must not conflict with the use given to the water resulting from the Water Supply Project for the Middle Basin of the Tempisque River and Coastal Communities (Paacume).\n\nFor the preparation of the General Plan for Sustainable and Rational Use Management, a commission shall be formed with representation from Sinac, Senara, and the Municipality of Bagaces.\n\nArticle file\n\nSINGLE TRANSITORY PROVISION- The Executive Branch shall make the modifications to the General Management Plan of the Lomas Barbudal Biological Reserve, and shall issue the necessary regulations for the authorization of ecosystem rehabilitation and adaptive management actions in the compensation areas that require actions of this nature, within a period of one year from the registration in the name of the Ministry of Environment and Energy (Minae).\n\nThis law shall be effective upon its publication.\n\nGiven at the Presidency of the Republic, San José, on the seventeenth day of the month of October of the year two thousand eighteen.\n\nArticle file\n\nGeneration date: 5/5/2026 05:43:02\n\nGo to the beginning of the document"
