Esta\nContraloría General advierte a la ARESEP, la obligación de que, previo a\nrealizar el cobro, éste se encuentre incorporado efectivamente en la tarifa que\ncobran las empresas que brindan el servicio regulado a sus usuarios finales,\nconsiderando que esas entidades autorizadas para prestar el servicio no son más\nque recaudadores del canon, por lo que este debe ser neutro respecto de su\nsituación financiera (.)\".\n\nII- Mediante el oficio OF-0666-IA-2018 del 25 de septiembre del 2018, la\nIntendencia de Agua recomendó la apertura de un expediente administrativo para\nla aplicar de oficio, un ajuste en el monto de los cánones de regulación para\nel año 2018, a la Empresa de Servicios Públicos de Heredia, S.A. (ESPH,S.A) y\nal Instituto Costarricense de Acueducto y Alcantarillado (AyA) y\ncorrespondiente a los servicios de acueductos, alcantarillados e hidrantes.\n(Folio 01).\n\nIII- Mediante el oficio OF-0667-IA-2018 del 25 de septiembre del 2018,\nla Intendencia de Agua solicitó a la Dirección General de Atención al Usuario\n(DGAU), la convocatoria a audiencia pública para exponer el estudio tarifario\nde oficio de referencia. (Folio 03).\n\nIV- La Autoridad Reguladora publicó la convocatoria a audiencia pública\nen los siguientes periódicos: La Extra y La Teja del 11 de octubre del 2018\n(folio 21) y el Diario Oficial La Gaceta Nº188 del 11 de octubre del 2018.\n(Folio 21).\n\nV- La audiencia pública se realizó el día 13 de noviembre del 2018 a las\n17:30 horas, en el Auditorio de la Autoridad Reguladora de los Servicios\nPúblicos, ubicado en Guachipelín de Escazú, Oficentro Multipark, edificio\nTurrubares; por medio del sistema de videoconferencia interconectado con los\nTribunales de Justicia ubicados en los centros de Limón, Heredia, Alajuela,\nLiberia, Puntarenas, Pérez Zeledón y Cartago, y también en forma presencial en\nel Salón de la Cruz Roja de San Ignacio de Acosta, ubicado 25 metros al sur del\ncostado oeste del parque Monseñor Sanabria, San Ignacio, Acosta, San José. para\nconocer la propuesta de \"Estudio tarifario de oficio para aplicar ajuste de\ncánones para el periodo 2018 en los servicios de acueducto, alcantarillado e\nhidrantes del Instituto Costarricense de Acueductos y Alcantarillados (AyA) y\nde los servicios de acueducto y alcantarillado de la Empresa de Servicios\nPúblicos de Heredia S.A. (ESPH S.A.)\", tramitada en el expediente ET-051- 2018.\nSegún el informe N° IN-0072-DGAU-2018 no se recibieron oposiciones ni\ncoadyuvancias.\n\nVI- Mediante el oficio OF-0861-IA-2018 del 04 de diciembre de 2018, la\nIntendencia de Agua emitió el informe denominado \"Ajuste por rebaja en los\ncánones para el año 2018 para los servicios de acueducto, alcantarillado,\nhidrantes y riego. Expediente ET-051-2018\". (Mismo que corre agregado a los\nautos).\n\nVII- En los plazos y procedimientos se han cumplido las prescripciones\nde Ley.\n\nCONSIDERANDO\n\nI- Del oficio OF-0861-IA-2018 del 04 de diciembre de 2018, que sirve de\nbase a esta resolución, conviene extraer lo siguiente:\n\n\"(.)\n\nI. Servicios de Acueductos, Alcantarillado Sanitario, Hidrantes\n\na) Introducción\n\nEl presente estudio surge ante la necesidad de efectuar ajustes en las\ntarifas al actualizarse el monto del canon de regulación aprobado por la\nContraloría General de la República para el año 2018, con el fin de cumplir con\nla recomendación de esa entidad en el sentido de que el canon \"debe ser neutro\na su situación financiera\"; la cual debe ser acatada por la Autoridad\nReguladora.\n\nPara cumplir con la directriz anteriormente mencionada y en vista de que\nel canon de regulación es parte de la tarifa del servicio que pagan los\nabonados, la Autoridad Reguladora debe ajustar este cargo en la proporción que\ncorresponda.\n\nEl mecanismo con el cual la Autoridad Reguladora puede lograr que el\najuste del canon llegue a los abonados, es mediante la modificación de las\ntarifas y por la vía\n\nordinaria; excepto\nen las tarifas de riego y avenamiento ya que el modelo tarifario establecido\nmediante resolución RIA-009-2015 del 08 de septiembre del 2015 indica que se\ndebe realizar el ajuste por la vía extraordinaria (.).\n\nc) Cálculo del Impacto del Canon en los ingresos estimados\n\nSe calculó el impacto sobre los ingresos de la diferencia entre el canon\nincorporado por la Autoridad Reguladora en los estudios tarifarios elaborados\npara los servicios de acueducto, alcantarillado e hidrantes para el Instituto\nCostarricense de Acueductos y Alcantarillados (AyA); servicio de acueducto,\nalcantarillado e hidrantes de la Empresa de Servicios Públicos de Heredia\n(ESPH, S.A.) y en el servicio de riego para el Servicio Nacional de Aguas\nSubterráneas, Riego y Avenamiento (Senara) para el año 2018, con respecto al\ncanon aprobado por la Contraloría General de la República para cada servicio.\nProducto de la Evaluación realizada se determinó lo siguiente:\n\nPara el servicio de hidrantes de la ESPH, S.A. y Riego y Piscicultura de\nSENARA los montos a ajustar resultaron insignificantes en las tarifas fijadas,\npor lo que no se consideran en el cambio tarifario (.).\n\nSe determinó que para el AyA se debe hacer el ajuste del año 2018; por\nlo que procede hacer una disminución en el costo, el cual se relaciona con los\ningresos estimados, determinándose los porcentajes de rebaja que se aplicarían\na los servicios de acueducto, alcantarillado e hidrantes, lo cual se detalla en\nel cuadro 2 y con respecto a ESPH, S.A, se determinó que se requiere de una\ndisminución en los ingresos para los servicios de acueducto y alcantarillado\npara el año 2018 como se muestra en el cuadro 2.\n\n \n\n \n\nComo se observa, los ajustes que deben realizarse en los ingresos del\naño 2018 para el AyA corresponden a una disminución para acueducto de 0,48%,\npara alcantarillado de 0,90%; en ESPH también resulta una disminución de 0,35%\npara acueducto y 0,35% para alcantarillado.\n\nII. Impacto Tarifario\n\na) Ajustes en las tarifas vigentes: Con el fin de considerar las rebajas\nen el canon de regulación en AyA, se recomienda disminuir las tarifas de\nacueducto y alcantarillado en un periodo de dos meses. Dadas las razones que\nllevan a la rebaja, esta se aplicará sólo a aquellos bloques y categorías\ntarifarias que no se encuentran subsidiadas. Las tarifas que se ajustarán son\nlas que corresponden a las categorías empresarial, gubernamental y domiciliaria\na partir de los bloques de consumo de 61 m3. Para la categoría preferencial y\nlos bloques menores de 60 m3 de la categoría domiciliar, no se estimó\ndisminución dado que estos ya cuentan con un subsidio por razones de tipo\nsocial. En ESPH se recomienda disminuir la tarifa de acueducto y alcantarillado\npor un periodo de dos meses en las mismas categorías.\n\nEn cuanto a los costos y al mercado, se mantienen los datos constantes\nsegún lo estimado en el último estudio tarifario para cada servicio. De manera\nque se toman como válidas las proyecciones de mercado y de ingresos, y\nsolamente se mide cuánto representa el ajuste de los nuevos cánones sobre los\ningresos que necesita la Institución para sufragar los costos que ya fueron\nestimados en estudios tarifarios en que se determinaron las tarifas que aplican\nactualmente para AyA como ESPH, en los servicios de acueducto y alcantarillado.\n\nSegún lo anterior, para AyA aplica una rebaja de 6,36% en las tarifas de\nacueducto y de un 7,96% en las de alcantarillado, mientras en ESPH aplica una\ndisminución de 4,60% en el servicio de acueducto y de un 3,45% en el servicio\nde alcantarillado.\n\nb) Hidrantes: Es necesario indicar que el monto a devolver en la tarifa\nde hidrantes para AyA solicitado es de 20.017.477 colones, los cuales se van a\nrebajar en el mes de enero, para todos los servicios y categorías. Las tarifas\nde hidrantes para el servicio medido pasan de 24 a 22 colones por metro cúbico\ny en servicio fijo de 510 a 478 (.).\n\nIV. Conclusiones\n\n(.)\n\n2- Al revisar el monto autorizado por la Contraloría General de la\nRepública en las estimaciones del canon por regulación para el año 2018, se\ndeterminó que los ingresos del AyA requerirían una disminución para el servicio\nde acueducto de un 0,48% y para el servicio de alcantarillado un 0,90%; con\nrespecto a ESPH las necesidades de ingresos disminuirían en un 0,35% para el\nservicio de acueducto y un 0.35% para el servicio de alcantarillado.\n\n3- Ante la rebaja en la necesidad del ingreso, es necesario aplicar una\ndisminución en las tarifas de los servicios de acueducto y alcantarillado del\nAyA y de la ESPH, es conveniente que dichas variaciones rijan durante 2meses,\nque corresponden de enero y febrero de 2019.\n\n4- Para el servicio de Hidrantes del AyA se debe rebajar en el mes de\nenero 2019. La tarifa de hidrantes para el servicio medido pasa de 24 a 22\ncolones por metro cúbico y en servicio fijo de 510 a 478.\n\n5- Para el servicio de Hidrantes de la ESPH no se recomienda hacer\nningún ajuste por poca cuantía.\n\n6- Para el servicio de Riego y Avenamiento no se recomienda hacer ningún\najuste por resultar de poca cuantía (.)\".\n\nII- De conformidad con los resultandos y considerandos que preceden y de\nacuerdo con el mérito de los autos, lo procedente es:\n\n1. Rebajar un 6,36% en la tarifa vigente del servicio de acueducto y un\n7,96% en la tarifa vigente del servicio de alcantarillado para las categorías\nempresarial, de gobierno y para los bloques a partir de 61 m3 de la categoría\ndomiciliar del AyA.\n\nPara el servicio de acueducto, las tarifas rigen a partir del 01 de\nenero de 2019 al 28 de febrero 2019. A partir del 1º de marzo 2019, aplicarán\nlas tarifas fijadas según resolución RIA-008-2017 del 14 de septiembre del\n2017, publicada en la Gaceta N°179 del 21 de septiembre de 2017 para AyA.\n\nPara el servicio de alcantarillado, las tarifas rigen a partir del 01 de\nenero de 2019, hasta el 28 de febrero de 2019. A partir del 1º de marzo 2019,\naplicarán las tarifas fijadas según resolución RIA-009-2017 del 14 de\nseptiembre del2017, publicada en la Gaceta N°179 del 21 de septiembre del 2017\npara AyA.\n\n2. Rebajar un 4,60% en la tarifa vigente del servicio de acueducto y un\n3,35% en la tarifa vigente del servicio de alcantarillado para las categorías\nempresarial, de gobierno y para los bloques a partir de 61 m3 de la categoría\ndomiciliar de la ESPH.\n\nPara el servicio de acueducto, las tarifas rigen a partir del 01 de\nenero hasta el 28 de febrero del 2019; a partir del al 01 de marzo de 2019 se\naplicarán a las tarifas fijadas, según la resolución RIA-006-2015 del 09 de\njulio del 2015,publicada en La Gaceta Nº135, del 14 de julio del 2015 para\nESPH.\n\nPara el servicio de alcantarillado, las tarifas rigen a partir del 01 de\nenero hasta el 28 de febrero del 2019; a partir del 01 de marzo de 2019 se\naplicarán a las tarifas fijadas, según la y la resolución RIA-003-2015 del 19\nde marzo del 2015,publicada en La Gaceta Nº 61, del 27 de marzo del 2015 para\nESPH.\n\n3. Para el servicio de Hidrantes que suministra el AyA, la tarifa del servicio\nmedido pasa de 24 a 22 colones por metro cúbico y del servicio fijo de 510 a\n478,rebajas aplicables para el mes de enero 2019. Al 01 de febrero de 2019 se\naplicarán a las tarifas fijadas, según la resolución RIA-002-2016 del 03 de\nfebrero del 2016, publicada en la Gaceta N°28 del 10 de febrero del 2016.\n\n4. Para los servicios de Hidrantes en ESPH, Riego y Piscicultura de\nSENARA no se recomienda hacer ningún ajuste por resultar las diferencias\ntarifarias de poca cuantía.\n\nPOR TANTO\n\nCon fundamento en las facultades conferidas en la Ley N° 7593 y sus\nreformas, en la Ley General de la Administración Pública N° 6227, en el Decreto\nEjecutivo 29732- MP, que es el Reglamento a la Ley N° 7593, y en el Reglamento\nInterno de Organización y Funciones de la Autoridad Reguladora de los Servicios\nPúblicos y sus Órganos Desconcentrados,\n\nEl INTENDENTE DE AGUA\n\nRESUELVE\n\nI. Fijar para los servicios de acueducto y de alcantarillado que brinda\nel Instituto Costarricense de Acueductos y Alcantarillados (AyA), las\nsiguientes tarifas:\n\nServicio Acueducto AyA\n\nEnero-Febrero 2019\n\nen colones\n\n \n\n \n\nEstas tarifas rigen a partir del 01 de enero de 2019, hasta el 28 de\nfebrero de 2019. A partir del 01 de marzo 2019, aplicarán las tarifas fijadas\nsegún resolución RIA-008-2017 y RIA-009-2017 del 14 de septiembre del 2017,\npublicada en la Gaceta N°179 del 21 de septiembre del 2017 para AyA.\n\nII. Fijar para los servicios de acueducto y de alcantarillado que brinda\nla Empresa de Servicios Públicos de Heredia, S.A., las siguientes tarifas:\n\n \n\n \n\n \n\n \n\nEstas tarifas rigen a partir del 01 de enero de 2019, hasta el 28 de\nfebrero de 2019. This\nContraloría General warns ARESEP of the obligation that, prior to\ncharging it, it must be effectively incorporated into the tariff that\nthe companies providing the regulated service charge their end users,\nconsidering that these entities authorized to provide the service are merely\ncollectors of the regulatory fee (canon), and therefore it must be neutral with respect to\ntheir financial situation (.)\".\n\nII- By official communication OF-0666-IA-2018 of September 25, 2018, the\nWater Superintendency (Intendencia de Agua) recommended the opening of an administrative file for\nthe ex officio application of an adjustment to the amount of the regulatory fees (cánones de regulación) for\nthe year 2018, to the Empresa de Servicios Públicos de Heredia, S.A. (ESPH, S.A.) and\nthe Instituto Costarricense de Acueductos y Alcantarillados (AyA) and\ncorresponding to the aqueduct, sewerage, and hydrant services.\n(Page 01).\n\nIII- By official communication OF-0667-IA-2018 of September 25, 2018,\nthe Water Superintendency (Intendencia de Agua) requested the Dirección General de Atención al Usuario\n(DGAU) to convene a public hearing to present the referenced ex officio tariff study.\n(Page 03).\n\nIV- The Regulatory Authority published the notice of public hearing\nin the following newspapers: La Extra and La Teja of October 11, 2018\n(page 21) and the Diario Oficial La Gaceta No. 188 of October 11, 2018.\n(Page 21).\n\nV- The public hearing was held on November 13, 2018, at\n17:30 hours, in the Auditorium of the Autoridad Reguladora de los Servicios\nPúblicos, located in Guachipelín de Escazú, Oficentro Multipark, Turrubares\nbuilding; by means of a videoconference system interconnected with the\nCourts of Justice located in the centers of Limón, Heredia, Alajuela,\nLiberia, Puntarenas, Pérez Zeledón, and Cartago, and also in person in\nthe Salón de la Cruz Roja of San Ignacio de Acosta, located 25 meters south of the\nwest side of Monseñor Sanabria Park, San Ignacio, Acosta, San José, to\nhear the proposal for an \"Ex officio tariff study to apply adjustment of\nregulatory fees (cánones) for the 2018 period in the aqueduct, sewerage, and hydrant\nservices of the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and\nof the aqueduct and sewerage services of the Empresa de Servicios\nPúblicos de Heredia S.A. (ESPH S.A.)\", processed in file ET-051-2018.\nAccording to report No. IN-0072-DGAU-2018, no oppositions or\njoinders were received.\n\nVI- By official communication OF-0861-IA-2018 of December 4, 2018, the\nWater Superintendency (Intendencia de Agua) issued the report entitled \"Adjustment by reduction in the\nregulatory fees (cánones) for the year 2018 for the aqueduct, sewerage,\nhydrant, and irrigation services. File ET-051-2018\". (Which is attached to the\nproceedings).\n\nVII- The prescriptions of the Law have been complied with regarding the\ndeadlines and procedures.\n\nCONSIDERING\n\nI- From official communication OF-0861-IA-2018 of December 4, 2018, which serves as\nthe basis for this resolution, it is appropriate to extract the following:\n\n\"(.)\n\nI. Aqueduct, Sanitary Sewerage, and Hydrant Services\n\na) Introduction\n\nThis study arises from the need to make adjustments to the\ntariffs upon updating the amount of the regulatory fee (canon de regulación) approved by the\nContraloría General de la República for the year 2018, in order to comply with\nthat entity's recommendation that the regulatory fee (canon) \"must be neutral\nto their financial situation\"; which must be followed by the Regulatory Authority.\n\nTo comply with the aforementioned directive and considering that\nthe regulatory fee (canon de regulación) is part of the service tariff paid by\nsubscribers, the Regulatory Authority must adjust this charge in the proportion\nthat corresponds.\n\nThe mechanism by which the Regulatory Authority can ensure the\nadjustment of the regulatory fee (canon) reaches the subscribers is by modifying the\ntariffs and through the ordinary\nprocedure; except\nin irrigation and drainage (riego y avenamiento) tariffs, since the tariff model established\nby resolution RIA-009-2015 of September 8, 2015, indicates that\nthe adjustment must be made through the extraordinary procedure (.).\n\nc) Calculation of the Impact of the Regulatory Fee (Canon) on Estimated Revenues\n\nThe impact on revenues of the difference between the regulatory fee (canon)\nincorporated by the Regulatory Authority in the tariff studies prepared\nfor the aqueduct, sewerage, and hydrant services for the Instituto\nCostarricense de Acueductos y Alcantarillados (AyA); the aqueduct,\nsewerage, and hydrant service of the Empresa de Servicios Públicos de Heredia\n(ESPH, S.A.); and the irrigation service for the Servicio Nacional de Aguas\nSubterráneas, Riego y Avenamiento (Senara) for the year 2018, with respect to\nthe regulatory fee (canon) approved by the Contraloría General de la República for each service,\nwas calculated. As a result of the Evaluation conducted, the following was determined:\n\nFor the hydrant service of ESPH, S.A. and the Irrigation and Fish Farming (Riego y Piscicultura) service of\nSENARA, the amounts to adjust proved insignificant in the fixed tariffs,\nand are therefore not considered in the tariff change (.).\n\nIt was determined that for AyA, the adjustment for the year 2018 must be made;\ntherefore, a decrease in cost is appropriate, which is related to the\nestimated revenues, determining the reduction percentages to be applied\nto the aqueduct, sewerage, and hydrant services, which is detailed in\nTable 2, and regarding ESPH, S.A., it was determined that a\ndecrease in revenues is required for the aqueduct and sewerage services\nfor the year 2018 as shown in Table 2.\n\n \n\n \n\nAs observed, the adjustments that must be made to the revenues for the\nyear 2018 for AyA correspond to a decrease for aqueduct of 0.48%,\nfor sewerage of 0.90%; for ESPH, a decrease of 0.35%\nfor aqueduct and 0.35% for sewerage also results.\n\nII. Tariff Impact\n\na) Adjustments to Current Tariffs: In order to consider the reductions\nin the regulatory fee (canon de regulación) for AyA, it is recommended to decrease the\naqueduct and sewerage tariffs over a two-month period. Given the reasons\nfor the reduction, it will be applied only to those tariff blocks and categories\nthat are not subsidized. The tariffs to be adjusted are\nthose corresponding to the business, government, and residential categories\nstarting from the consumption blocks of 61 m³. For the preferential category and\nthe blocks under 60 m³ of the residential category, no\ndecrease was estimated given that these already have a subsidy for social\nreasons. For ESPH, it is recommended to decrease the aqueduct and sewerage tariff\nover a two-month period in the same categories.\n\nRegarding costs and the market, the data remains constant\nas estimated in the last tariff study for each service. Thus,\nthe market and revenue projections are taken as valid,\nand only the amount representing the adjustment of the new regulatory fees (cánones) over the\nrevenues needed by the Institution to cover the costs already\nestimated in tariff studies in which the currently applicable tariffs were determined\nfor AyA as well as ESPH, in the aqueduct and sewerage services,\nis measured.\n\nAccording to the above, for AyA, a reduction of 6.36% applies to the\naqueduct tariffs and 7.96% to the sewerage tariffs; for ESPH, a\ndecrease of 4.60% applies to the aqueduct service and 3.45% to the\nsewerage service.\n\nb) Hydrants: It is necessary to indicate that the amount to be refunded in the\nhydrant tariff for AyA requested is 20,017,477 colones, which will be\nreduced in the month of January for all services and categories. The\nhydrant tariffs for metered service go from 24 to 22 colones per cubic meter\nand for fixed service from 510 to 478 (.).\n\nIV. Conclusions\n\n(.)\n\n2- Upon reviewing the amount authorized by the Contraloría General de la\nRepública in the estimates of the regulatory fee (canon) for regulation for the year 2018, it was\ndetermined that AyA's revenues would require a decrease for the aqueduct\nservice of 0.48% and for the sewerage service of 0.90%; with\nrespect to ESPH, the revenue requirements would decrease by 0.35% for the\naqueduct service and 0.35% for the sewerage service.\n\n3- Given the reduction in the revenue requirement, it is necessary to apply a\ndecrease in the tariffs for the aqueduct and sewerage services of\nAyA and ESPH; it is convenient that said variations be in effect for 2 months,\ncorresponding to January and February 2019.\n\n4- For the Hydrant service of AyA, a reduction must be made in the month of\nJanuary 2019. The hydrant tariff for metered service goes from 24 to 22\ncolones per cubic meter and for fixed service from 510 to 478.\n\n5- For the Hydrant service of ESPH, no adjustment is recommended\ndue to the small amount.\n\n6- For the Irrigation and Drainage (Riego y Avenamiento) service, no adjustment is recommended\ndue to the resulting small amount (.)\".\n\nII- In accordance with the preceding Whereas clauses and Considerations, and\nin accordance with the merits of the proceedings, it is appropriate to:\n\n1. Reduce by 6.36% the current tariff of the aqueduct service and by\n7.96% the current tariff of the sewerage service for the business\nand government categories and for the blocks starting from 61 m³ of the\nresidential category of AyA.\n\nFor the aqueduct service, the tariffs are in effect from January 1,\n2019, to February 28, 2019. As of March 1, 2019,\nthe tariffs set according to resolution RIA-008-2017 of September 14,\n2017, published in La Gaceta No. 179 of September 21, 2017, for AyA shall apply.\n\nFor the sewerage service, the tariffs are in effect from January 1,\n2019, until February 28, 2019. As of March 1, 2019,\nthe tariffs set according to resolution RIA-009-2017 of September\n14, 2017, published in La Gaceta No. 179 of September 21, 2017,\nfor AyA shall apply.\n\n2. Reduce by 4.60% the current tariff of the aqueduct service and by\n3.35% the current tariff of the sewerage service for the business\nand government categories and for the blocks starting from 61 m³ of the\nresidential category of ESPH.\n\nFor the aqueduct service, the tariffs are in effect from January 1\nto February 28, 2019; as of March 1, 2019,\nthe tariffs set according to resolution RIA-006-2015 of July\n9, 2015, published in La Gaceta No. 135, of July 14, 2015, for\nESPH shall apply.\n\nFor the sewerage service, the tariffs are in effect from January 1\nto February 28, 2019; as of March 1, 2019,\nthe tariffs set according to resolution RIA-003-2015 of March\n19, 2015, published in La Gaceta No. 61, of March 27, 2015, for\nESPH shall apply.\n\n3. For the Hydrant service provided by AyA, the tariff for the metered\nservice goes from 24 to 22 colones per cubic meter and for the fixed service from 510 to\n478, reductions applicable for the month of January 2019. As of February 1, 2019,\nthe tariffs set according to resolution RIA-002-2016 of February\n3, 2016, published in La Gaceta No. 28 of February 10, 2016, shall apply.\n\n4.
