Y\n\nConsiderando:\n\nI─ Que es función\nesencial del Estado velar por la seguridad y la información del consumidor.\n\nII─ Que el proceso de\napertura comercial que experimenta el país tiende a lograr una mayor\ncompetencia entre los productos que se ofrecen en el mercado, tanto de fabricación\nnacional como importado.\n\nIII─ Que dentro del\ncontexto\nde esta apertura es necesario proteger al consumidor contra las prácticas que\npuedan inducirlo a error o engaño.\n\nIV─ Que el Estado debe\ntomar las medidas tendientes a garantizarle a la población el acceso a productos\nindustriales, que cumplan con las características técnicas reconocidas\ninternacionalmente, máxime en aquellos casos, en donde los productos no cuentan\ncon los parámetros de la calidad y seguridad requeridos, y que podrían poner en\nriesgo la vida de las personas, los animales y los materiales.\n\nV-Que existe la necesidad de controlar algunas mercancías por medio de\ndeclaraciones de conformidad, a fin de garantizar a la población que los\nproductos que se comercialicen en el mercado cumplen con los requisitos\ndefinidos en los reglamentos técnicos.\n\nVI- Que el presente Decreto Ejecutivo, cumple con los principios de\nmejora regulatoria de acuerdo al Informe Nº DMR-DAR-INF-004-16, emitido por el\nDepartamento de Análisis Regulatorio de la Dirección de Mejora Regulatoria.\n\nPor tanto,\n\nDECRETAN:\n\nArtículo 1º.- Aprobar el siguiente Reglamento Técnico:\n\nRTCR 486: 2016 Reglamento Técnico para Llantas Neumáticas.\n\n1. OBJETIVO\n\nEstablecer los requisitos técnicos y de marcado que deben cumplir las\nllantas neumáticas que se comercializan en el territorio nacional.\n\n(*)2. ÁMBITO DE\nAPLICACIÓN. Aplica a las llantas neumáticas nuevas de\nreemplazo incluidas en las fracciones arancelarias indicadas en la Tabla Nº 1,\nya sea que se fabriquen en el país, se importen de manera definitiva o se\ncomercialicen dentro del territorio nacional.\n\nTabla\nNº 1\n\nClasificación de\nllantas según tipo y fracción arancelaria\n\n \n\n| Partida | Texto de la subpartida | Producto | | --- | --- | --- | | 4011.10.00.00.00 | Incluidos\nlos del tipo familiar (\"break\" o \"station wagon\") y los de carreras). | Llantas neumáticas para\nvehículos de pasajeros incluidos los camperos (llantas tipo II y tipo III) | | 4011.20.10.00.00 |\nRadiales | Llantas neumáticas para autobuses o camiones (llantas tipo IV). | | 4011.20.90.00.00 |\nOtros |  |\n\n \n\nNota: las partidas arancelarias podrán ser modificadas por la Autoridad\nAduanera Nacional, para lo cual publicará la respectiva resolución\nadministrativa.\n\nSe excluyen de la aplicación de este reglamento técnico las llantas que\ningresen instaladas en vehículos nuevos o usados y su respectiva llanta de\nrepuesto.\n\nSe excluyen también las llantas especialmente diseñadas para los\nvehículos mencionados en el párrafo quinto del artículo 24 de La Ley N° 9078\ndel 04 de octubre del 2012, Ley de Transito por Vías Públicas Terrestres y\nSeguridad Vial; publicada en el Alcance Nº 165 de La Gaceta Nº 207 del 26 de\noctubre del 2012, en cuyo caso se deberá tramitar el proceso de dispensa\nincluido en el Decreto Ejecutivo Nº 41422-MEIC del 16 de octubre del 2018,\ndenominado: \"Procedimiento para dispensar del cumplimiento de la nota técnica a\nproductos del sector no alimentario que se encuentran fuera del ámbito de\naplicación de un reglamento técnico competencia del MEIC\", publicado en el\nDiario Oficial La Gaceta N° 237 del 20 de diciembre del 2018.\n\n(*) (Así reformado\nel apartado 2) anterior por el artículo 3° del decreto ejecutivo N°42507 del 29\nde julio del 2020)\n\n3. DEFINICIONES\n\n3. 1 ancho de sección de la llanta: Ancho del neumático, montado en aro de\nmedición, inflado a la presión de medición, sin carga. No incluye barras,\nribetes ni adornos que sobresalgan del perfil normal del costado.\n\n3. 2 ancho total (W): Ancho de la sección transversal de la llanta\nneumática que incluye barras ribetes o los adornos más sobresalientes en la superficie\nexterna de los costados.\n\n3. 3 autobús: Vehículo rígido concebido y construido para el\ntransporte de personas con capacidad superior a 44 plazas, incluido el\nconductor.\n\n3. 4 automóvil: Vehículo concebido y construido para el\ntransporte de personas y con capacidad hasta 9 plazas, incluido el conductor.\n\n3. 5 banda de rodamiento: Conocida también como piso o rodado, es la\nparte de una llanta neumática que entra en contacto con el suelo, protege la\nestructura de la llanta de daños mecánicos.\n\n3. 6 camión de carga pesada: Vehículo concebido y construido para el\ntransporte de carga cuyo peso bruto sea al menos de 8000 kilogramos.\n\n3. 7 camión Ligero/Pick Up: Vehículo concebido para el transporte de\ncarga liviana sea menor de 8000 kilogramos.\n\n3. 8 capacidad de carga (LR: load range, en\ninglés): Término expresado con una letra del alfabeto incluida en la descripción\ndel neumático, se usa para relacionar un neumático con su presión y rango de\ncarga.\n\n3. 9 capacidad de lonas (PR: ply rating, en\ninglés): Número que representa la resistencia de la carcasa. Bajo su máxima carga\nrecomendada, en un tipo específico de servicio. No representa el número real de\ncapas del neumático.\n\n3. 10 capas: Capa de cuerdas paralelas cubiertos de caucho.\n\n3. 11 carcasa: Estructura de la llanta sin la banda de rodamiento\nni el caucho del lateral, que cuando es inflada, soporta la carga.\n\n3. 12 caucho del lateral: Capa de caucho en el lateral de la llanta\nneumática y sobre la carcasa, que puede incluir ribetes ornamentales o\nprotectores y líneas afines.\n\n3. 13 ceja (o pestaña): Parte de la llanta constituidas de alambres de\nacero, en forma de anillos, recubiertos de pliegos y elastómeros especiales,\nque le proporcionan la forma apropiada para el correcto asentamiento de la llanta\nen el aro.\n\n3. 14 certificado de conformidad: atestación de tercera parte que atestigüe el\ncumplimiento de los reglamentos técnicos.\n\n3. 15 certificación de producto: es un procedimiento mediante el cual un\ntercero otorga una garantía escrita de que un producto cumple con\nespecificaciones técnicas.\n\n3. 16 código de construcción: indica la construcción interna de la llanta. En las llantas de\nconstrucción radial las cuerdas de las capas que forman el casco o armazón interior de la llanta\nestán dispuestas en forma de \"radios\" de un lado a otro de la llanta. Otras letras usadas como\nindicadores son D, para construcción diagonal y B, para construcción con cinturón.\n\n3. 17 cinturón (Overlay): Capa de\nmaterial debajo de la banda de rodamiento, colocada substancialmente en la\ndirección de la línea de centro de la banda de rodamiento que restringe\ncircunferencialmente a la carcasa, presente en algunas llantas.\n\n3. 18 cuerda: Trenza textil o no-textil (hilos) utilizados en\nvarios componentes de la carcasa de la llanta neumática, capas, cinturones,\nrefuerzos.\n\n3. 19 desmontaje de la ceja: Desacomodo de la llanta neumática de la\npestaña del aro como producto de una carga lateral, teniendo como resultado la\npérdida del aire.\n\n3. 20 documento normativo: Las normas internacionales, regionales y\nnacionales aprobadas por organismos de normalización que han adoptado el Código\nde Buena Conducta para la elaboración, adopción y aplicación de normas del\nAcuerdo de Obstáculos Técnicos al Comercio o los reglamentos técnicos de otros\npaíses o regiones y sus partes.\n\n3. 21 ente oficial competente: Autoridad o cualquier organismo designado\ncomo tal en el Estado, según el ordenamiento jurídico del país de fabricación\ndel producto.\n\n3. 22 estrías de la banda de rodamiento: Espacio entre las\ncostillas adyacentes o bloques en el diseño de la banda de rodamiento.\n\n3. 23 estructura o construcción diagonal (\"O\" o \"-\"): Es la llanta neumática cuya carcasa está\nconstituida por pliegos cuyas cuerdas se extienden de pestaña a pestaña formando ángulos alternos\nmenores a 90 grados con respecto a la línea central de la banda de rodamiento. Ejemplos: LTS (Light\nTruck Bias) y TBS (Truck & Bus Bias).\n\n3. 24 estructura o Construcción\ndiagonal con cinturón (bias belted)\n(D, B o \"-\"): Llanta neumática de\nconstrucción diagonal, en el cual la carcasa está circundada por un cinturón\n(refuerzo o breaker) constituido por una o más capas\nde cuerdas debajo de la banda de rodamiento. Ejemplos: LTS (LightTruck\nBias) y TBS (Truck &\nBus Bias).\n\n3. 25 estructura o construcción radial (R: radial): Llanta neumática\ncuya carcasa está constituida por una o más capas de telas cuyos hilos\ndispuestos de pestaña a pestaña, están colocados fundamentalmente a 90°, en\nrelación a la línea del centro de la banda de rodamiento, estando esta carcasa\nestabilizada por cinturón circunferencial constituido por dos o más capas\nbásicamente inextensibles.\n\n3. 26 evaluación de la conformidad (conformidad): demostración de que\nse cumplen los requisitosrelativos a un producto,\nproceso, sistema, persona u organismo.\n\n3. 27 hombro: Parte externa de la banda de rodamiento en las\nintersecciones con los costados.\n\n3. 28 ILAC: Cooperación Internacional de Acreditación de Laboratorios (en inglés \"International\nLaboratory Accreditation Cooperation\".\n\n3. 29 IND (industrial): letra (opcional) colocada inmediatamente delante\nde ancho de sección para identificar una llanta industrial.\n\n3. 30 indicadores de desgaste (TWI: tread wear indicator, en inglés): Partes salientes,\ndispuestas dentro de las estrías de la banda de rodamiento, que permite\nmediante una inspección visual evaluar si el neumático ha alcanzado el límite\nde desgaste previsto.\n\n3. 31 índice de carga (LI): Es un código numérico asociado a la carga\nmáxima que una llanta neumática puede soportar a una velocidad determinada por\nsu símbolo de velocidad.\n\n3. 32 índice o símbolo de velocidad: Es un símbolo que indica la categoría de\nvelocidad (de acuerdo a los libros técnicos TRA, JATMA) a la cual una llanta\npuede ser llevada a un correspondiente índice de carga bajo condiciones\nespecíficas de servicio.\n\n3. 33 investidura oficial: Delegación de una función que le corresponde\na la autoridad competente, para actuar en nombre de esta y con el fin de\ncumplir los objetivos estatales, bajo propia decisión y en ejercicio del poder.\n\n3. 34 lateral: Parte de la llanta comprendida entre los límites de\nla banda de rodamiento y la pestaña, visible cuando la misma, ajustada a un\naro, se ve de lado.\n\n3. 35 llanta de banda de rodamiento especial (ET): Llanta cuyo diseño\nde la banda de rodamiento es primordialmente para suministrar un desempeño\nsatisfactorio bajo condiciones de servicio especial (ejemplo uso mixto, dentro\ny fuera de carretera, autobús urbano).\n\n3. 36 llanta de repuesto para uso temporal tipo T: Llanta de repuesto\npara uso temporal diseñada para utilizarse a una presión de inflado más alta\nque la establecida para llantas normales y reforzadas.\n\n 3. 37 llanta de repuesto para\nuso temporal: Llanta diferente a una que sea destinada a ajustarse a un\nvehículo en condiciones normales de manejo, y solo es destinada para uso\ntemporal bajo condiciones restringidas de manejo.\n\n3. 38 llanta neumática: Componente flexible del conjunto de la rueda, hecho\nde hule y  materiales de refuerzo, que\ninflada con gas a presión, permite a la rueda como parte del conjunto del eje\ncargar y trasmitir las fuerzas longitudinales y transversales. En condición sin\ncarga la llanta es esencialmente un toroide.\n\n3. 39 llanta reforzada, carga extra (XL): Llanta de automóvil\nde pasajeros diseñadas para cargas y a una presión de inflado más alta que la\nversión normal.\n\n3. 40 llanta tipo II: Llantas para automóviles de pasajeros.\n\n3. 41 llanta tipo III: Llantas para camionetas, camperos y otros\nvehículos comerciales tales como camiones ligeros (menores a 5 toneladas de\npeso bruto vehicular).\n\n3. 42 llanta tipo IV: Llantas para camiones, autobuses, trailers, tractomulas y otros\nvehículos de servicio múltiple en carretera.\n\n3. 43 MRA: Acuerdo de reconocimiento\nmutuo (en inglés \"Mutual Recognition Agreement\").\n\n3. 44 Organismo de certificación de producto (organismo de\ncertificación): organismo que tiene competencia técnica para realizar la certificación\nde producto. Dichos organismos pueden ser de naturaleza pública o privada,\nnacionales o extranjeros.\n\n3. 45 P: Letra (opcional) colocada inmediatamente adelante del ancho de sección\npara identificar una llanta para automóvil de pasajero.\n\n3. 46 prueba de fuerza: Determinación de la energía de rotura de la llanta\nneumática a una fuerza de penetración aplicada en la banda de rodamiento\nmediante un cilindro macizo con extremo hemisférico de diámetro determinado.\n\n3. 47 requisito dimensional: Cada una de las magnitudes de un conjunto\nque sirven para definir la llanta, incluye el ancho de sección, perfil,\ndiámetro del aro.\n\n3. 48 resistencia a la alta velocidad: capacidad de soportar los límites máximos\nde velocidad para la cual fue diseñada la llanta neumática.\n\n3. 49 resistencia o aguante de la llanta neumática: Rodamiento de la llanta\nneumática en contacto con una rueda de acero a velocidad constante sometido a\ncargas variables durante periodos de tiempo determinados.\n\n3. 50 T: Letra colocada inmediatamente adelante del ancho de sección para\nidentificar una llanta de repuesto para su uso temporal.\n\n(*)4. Las posiciones de los indicadores de desgaste de la banda de rodamiento deben ser identificados,\nsegún las prácticas de manufacturas reconocidas internacionalmente, por ejemplo, por medio de las\nsiglas TWI (Tread Wear Indicador), por medio de un triángulo (▲) u otro símbolo que especifique este\nindicador. Esta indicación debe estar grabada en el hombro del neumático en posición adyacente al\nindicador ubicado dentro de estrías de la banda de rodamiento. La cantidad de indicadores de\ndesgaste no deben ser menores de 3 de cada lado.\n\n2. Los dos primeros dígitos son para indicar la semana y los otros dos para\nel año. Ej.: «1911», corresponde a una llanta fabricada en la 19ª semana del\n2011.\n\n3. El tipo de vehículo para el cual fue diseñada la rotación preferida, banda de rodamiento\nespecial, se utilizan las palabras \"TUBELESS\", \"REINFORCED\" o \"EXTRA LOAD\", \"BIAS BELTED\", RADIAL,\nP, IN, según sea el caso.\n\n5.2. El lugar de marcado de la carga, las características de velocidad, el\ntamaño y la construcción deben estar en al menos un costado de la llanta. No\nobstante, lo anterior, la información podrá ser agregada, previo a su\ncolocación en el mercado, mediante una etiqueta complementaria cuando la misma\nno esté en idioma español.\n\n(Así reformado el inciso\nanterior por el artículo 3° del decreto ejecutivo N°42507 del 29 de julio del\n2020)\n\n6. EQUIVALENCIA CON OTROS DOCUMENTOS NORMATIVOS\n\n(Así modificada la\nnumeración del apartado anterior por el artículo 1° del decreto ejecutivo N°\n42507 del 29 de julio del 2020, que lo traspaso del antiguo apartado 5) al 6)\n\nSerán equivalentes con este reglamento técnico, aquellos documentos\nnormativos que hayan sido declarados como tales, de conformidad con el Decreto\nEjecutivo Nº 38849-MEIC del 06 de enero de 2015, Procedimiento para demostrar\nequivalencia con un reglamento técnico de Costa Rica (RTCR).\n\n7. DEMOSTRACION DE LA CONFORMIDAD\n\n(Así modificada la\nnumeración del apartado anterior por el artículo 1° del decreto ejecutivo N°\n42507 del 29 de julio del 2020, que lo traspaso del antiguo apartado 6) al 7)\n\n7.1 Para los efectos de este reglamento se utilizará el Modelo 5, consignado\nen el Cuadro Nº 1 del Apartado 4, Modelos de Evaluación de Conformidad para Demostrar\nel Cumplimiento con los Reglamentos Técnicos, del Decreto Ejecutivo N°\n37662-MEIC-H-MICIT del 12 de diciembre del 2012, Procedimiento para la\nDemostración de la Evaluación de la Conformidad de los Reglamentos Técnicos.\n\nEste modelo está basado en ensayos, evaluación y vigilancia de sistemas\nde calidad, además de la vigilancia continua de los productos provenientes de\nla fabricación, del mercado o ambos de acuerdo con los requisitos especificados\nen este reglamento técnico y que son evaluados para determinar su conformidad.\n\nEste modelo de certificación incluye la implementación de las siguientes\netapas:\n\na) El organismo de certificación solicita muestras de producto.\n\nb) Determinación de las características relevantes del producto mediante\nensayos (ISO/IEC 17025, versión vigente) o evaluación.\n\nc) Auditoria inicial del proceso de producción y el sistema de calidad.\n\nd) Revisión del informe de ensayos o evaluación.\n\ne) Atestación de la conformidad.\n\nf) Emisión de una licencia para utilizar los certificados o las marcas en\nlos productos.\n\ng) Vigilancia del proceso de producción o del sistema de calidad o ambos.\n\nh) Vigilancia mediante el ensayo o inspección de muestras de la fábrica,\ndel mercado abierto, o ambos.\n\n7.1.1 Para el punto anterior, los Certificados de Conformidad deben ser\nemitidos por un Organismo de Certificación de producto de tercera parte\nacreditado bajo la norma internacional ISO 17065: vigente o su norma homóloga\nvigente en el país de origen, por el Ente Costarricense de Acreditación (ECA) o\npor una entidad acreditadora reconocida por el ECA, mediante un acuerdo de\nreconocimiento multilateral (MLA por sus siglas en inglés) ante el Foro\nInternacional de Acreditación (IAF por sus siglas en inglés), para los alcances\nrequeridos en este Reglamento o que alternativamente estén acreditados en los\nalcances generales para la fabricación de productos de caucho, de acuerdo con\nla Nomenclatura estadística de actividades económicas de la Comunidad Europea\n(NACE, alcance 22.1).\n\n(Así reformado el inciso\nanterior por el artículo 3° del decreto ejecutivo N°42507 del 29 de julio del\n2020)\n\n7.1.2 Los Organismos de Certificación deberán cumplir con los Criterios para\nla utilización de laboratorios por los organismos de certificación de producto,\nestablecidos por el Ente Costarricense de Acreditación (Código ECA-MC-C01 en su\nversión vigente en su página web)\n\n(Así reformado el inciso\nanterior por el artículo 3° del decreto ejecutivo N°42507 del 29 de julio del\n2020)\n\n7.1.3 No obstante lo indicado en los numerales 7.1.1 y 7.1.2, a solicitud de\nun país, la Autoridad Nacional Competente, podrá entablar negociaciones\nencaminadas: a la conclusión de acuerdos mutuos de reconocimiento de los\nresultados de sus respectivos procedimientos de evaluación de la conformidad; o\nrealizar acuerdos reconocimientos de los procedimientos de evaluación de la\nconformidad, aun cuando estos difieran, siempre que se tenga el convencimiento\nde que, se trata de procedimientos que ofrecen un grado de conformidad con el\nreglamento técnico.\n\nPara lo anterior, es posible que se requiera previamente a realizar\nconsultas para llegar a un entendimiento mutuamente satisfactorio.\n\n7.1.4. No obstante lo indicado en 7.1.1), cuando en\nel país de fabricación de las llantas no se utilicen esquemas de evaluación de\nconformidad basados en Organismo para la Evaluación de la Conformidad (OEC)\npara los productos incluidos en el ámbito de aplicación del presente reglamento\ntécnico, se podrá presentar un documento emitido ya sea por el ente oficial\ncompetente para otorgar autorizaciones para el uso de sellos de conformidad en\nla materia, o por una entidad de carácter privado que cuente con la investidura\noficial otorgada para tales fines, como alternativa a los certificados emitidos\npor OEC, en cuyo caso el ECA verificará que efectivamente en el país de origen\nno se utilizan sistemas de evaluación de la conformidad basados en OEC.\n\n(Así adicionado el inciso\nanterior por el artículo 2° del decreto ejecutivo N° 42507 del 29 de julio del\n2020, que lo traspaso del antiguo apartado 6) al 7)\n\n7.1.5. Los certificados indicados en el numeral\n7.1.1 podrán incluir varias familias o tipos de llantas, siempre que hagan\nreferencia a único fabricante, país y planta de producción.\n\n(Así adicionado el inciso\nanterior por el artículo 2° del decreto ejecutivo N° 42507 del 29 de julio del\n2020, que lo traspaso del antiguo apartado 6) al 7)\n\n7.2 Previo a la colocación del producto en el mercado\n\nTanto los productores como importadores de los productos sujetos a este\nreglamento técnico, deben cumplir con lo estipulado en el inciso 5.1 del\nApartado 5 Procedimiento para la Demostración de la Conformidad, del Decreto\nEjecutivo N° 37662-MEIC-H-MICIT del 12 de diciembre del 2012, Procedimiento\npara la Demostración de la Evaluación de la Conformidad de los Reglamentos\nTécnicos, conforme el procedimiento que publique el ECA en el Diario Oficial La\nGaceta y en su página web, a más tardar a la entrada en vigencia del presente\nreglamento técnico.\n\n7.3 Posterior a la colocación del producto en el mercado\n\nPara los efectos de este reglamento se deberá cumplir con lo estipulado\nen el inciso 5.2 del Apartado 5 Procedimiento para la Demostración de la\nConformidad, del Decreto Ejecutivo N° 37662 MEIC-HMICIT del 12 de diciembre del\n2012, Procedimiento para la demostración de la evaluación de la conformidad de\nlos Reglamentos Técnicos.\n\n8. OTRAS OBLIGACIONES\n\n(Así modificada la\nnumeración del apartado anterior por el artículo 1° del decreto ejecutivo N°\n42507 del 29 de julio del 2020, que lo traspaso del antiguo apartado 7) al 8)\n\n8.1 Será responsabilidad del importador, del productor nacional, del\ndistribuidor y comercializador, contar con los documentos que soportan la\nDeclaración de Conformidad, los cuales deberá conservar copia por un periodo no\nmenor de 5 años, de conformidad con la legislación nacional vigente en materia\nde comercio. Para lo anterior, el productor nacional o el importador, según sea\nel caso, deben facilitar copias de dichos documentos a los distribuidores y a\nlos comercializadores.\n\n(Así reformado el inciso\nanterior por el artículo 3° del decreto ejecutivo N°42507 del 29 de julio del\n2020)\n\n8.2 Con el fin de constatar la validez de los Certificados de Conformidad\naportados, el MEIC, podrá solicitar copia de dichos documentos, sea al\nproductor nacional, al importador o al agente de aduanas que representa a este\núltimo.\n\n9. And\n\nConsidering:\n\nI─ That it is an essential function of the State to ensure consumer safety and information.\n\nII─ That the process of trade liberalization the country is experiencing tends to achieve greater competition among products offered in the market, both nationally manufactured and imported.\n\nIII─ That within the context of this liberalization, it is necessary to protect the consumer against practices that may induce error or deception.\n\nIV─ That the State must take measures aimed at guaranteeing the population access to industrial products that comply with internationally recognized technical characteristics, especially in those cases where products lack the required quality and safety parameters and could endanger the lives of persons, animals, and materials.\n\nV─ That there is a need to control certain goods by means of declarations of conformity, in order to guarantee to the population that the products marketed in the market comply with the requirements defined in the technical regulations.\n\nVI─ That this Executive Decree complies with the principles of regulatory improvement according to Report No. DMR-DAR-INF-004-16, issued by the Department of Regulatory Analysis of the Directorate of Regulatory Improvement.\n\nTherefore,\n\nTHEY DECREE:\n\nArticle 1.- To approve the following Technical Regulation:\n\nRTCR 486: 2016 Technical Regulation for Pneumatic Tires.\n\n1. OBJECTIVE\n\nTo establish the technical and marking requirements that pneumatic tires marketed within the national territory must meet.\n\n(*)2. SCOPE OF APPLICATION. DEFINITIONS\n\n3. 1 tire section width: Width of the tire, mounted on a measuring rim, inflated to the measuring pressure, without load. It does not include bars, ribs, or ornaments that protrude from the normal profile of the sidewall.\n\n3. 2 overall width (W): Width of the cross-section of the pneumatic tire that includes bars, ribs, or the most protruding ornaments on the outer surface of the sidewalls.\n\n3. 3 bus: Rigid vehicle conceived and built for the transport of persons with a capacity greater than 44 seats, including the driver.\n\n3. 4 automobile: Vehicle conceived and built for the transport of persons and with a capacity of up to 9 seats, including the driver.\n\n3. 5 tread: Also known as the tread band or running surface, it is the part of a pneumatic tire that comes into contact with the ground and protects the tire structure from mechanical damage.\n\n3. 6 heavy-duty truck: Vehicle conceived and built for the transport of cargo whose gross weight is at least 8000 kilograms.\n\n3. 7 Light Truck/Pick Up: Vehicle conceived for the transport of light cargo less than 8000 kilograms.\n\n3. 8 load capacity (LR: load range): Term expressed with a letter of the alphabet included in the tire description, used to relate a tire to its inflation pressure and load range.\n\n3. 9 ply rating (PR): Number that represents the strength of the casing. Under its maximum recommended load, in a specific type of service. It does not represent the actual number of plies in the tire.\n\n3. 10 plies: Layer of parallel cords covered with rubber.\n\n3. 11 casing: The structure of the tire without the tread and the sidewall rubber, which, when inflated, supports the load.\n\n3. 12 sidewall rubber: Layer of rubber on the sidewall of the pneumatic tire and over the casing, which may include ornamental or protective ribs and related lines.\n\n3. 13 bead (or flange): Part of the tire consisting of steel wires, in the form of rings, covered with fabric layers and special elastomers, which provide the appropriate shape for the correct seating of the tire on the rim.\n\n3. 14 certificate of conformity: third-party attestation that certifies compliance with technical regulations.\n\n3. 15 product certification: it is a procedure by which a third party grants a written guarantee that a product complies with technical specifications.\n\n3. 16 construction code: indicates the internal construction of the tire. In tires of radial construction, the cords of the plies that form the tire's inner shell or framework are arranged in the form of \"radii\" from one side of the tire to the other. Other letters used as indicators are D, for diagonal construction, and B, for bias-belted construction.\n\n3. 17 belt (Overlay): Layer of material beneath the tread, placed substantially in the direction of the tread centerline that circumferentially restricts the casing, present in some tires.\n\n3. 18 cord: Textile or non-textile strand (threads) used in various components of the pneumatic tire casing, plies, belts, reinforcements.\n\n3. 19 bead unseating: Dislodgement of the pneumatic tire from the rim flange as a result of a lateral load, resulting in loss of air.\n\n3. 20 normative document: International, regional, and national standards approved by standardization bodies that have adopted the Code of Good Practice for the Preparation, Adoption and Application of Standards of the Technical Barriers to Trade Agreement, or the technical regulations of other countries or regions and their parts.\n\n3. 21 competent official entity: Authority or any body designated as such in the State, according to the legal system of the country where the product is manufactured.\n\n3. 22 tread grooves: Space between the adjacent ribs or blocks in the tread design.\n\n3. 23 diagonal structure or construction (\"O\" or \"-\"): It is the pneumatic tire whose casing is constituted by fabric layers whose cords extend from bead to bead forming alternating angles of less than 90 degrees with respect to the tread centerline. Examples: LTS (Light Truck Bias) and TBS (Truck & Bus Bias).\n\n3. 24 diagonal structure or construction with belt (bias belted) (D, B or \"-\"): Pneumatic tire of diagonal construction, in which the casing is bounded by a belt (reinforcement or breaker) consisting of one or more layers of cords under the tread. Examples: LTS (Light Truck Bias) and TBS (Truck & Bus Bias).\n\n3. 25 radial structure or construction (R: radial): Pneumatic tire whose casing is constituted by one or more layers of fabric whose cords, arranged from bead to bead, are fundamentally placed at 90°, in relation to the tread centerline, this casing being stabilized by a circumferential belt consisting of two or more basically inextensible layers.\n\n3. 26 conformity assessment (conformity): demonstration that the specified requirements relating to a product, process, system, person, or body are fulfilled.\n\n3. 27 shoulder: Outer part of the tread at the intersections with the sidewalls.\n\n3. 28 ILAC: International Laboratory Accreditation Cooperation.\n\n3. 29 IND (industrial): letter (optional) placed immediately in front of the section width to identify an industrial tire.\n\n3. 30 tread wear indicators (TWI): Protruding parts, arranged within the tread grooves, that allow for visual inspection to assess whether the tire has reached the expected wear limit.\n\n3. 31 load index (LI): It is a numerical code associated with the maximum load that a pneumatic tire can support at a speed determined by its speed symbol.\n\n3. 32 speed index or symbol: It is a symbol that indicates the speed category (according to the technical books TRA, JATMA) at which a tire can be taken at a corresponding load index under specific service conditions.\n\n3. 33 official authority: Delegation of a function that corresponds to the competent authority, to act on its behalf and in order to fulfill state objectives, under one's own decision and in the exercise of power.\n\n3. 34 sidewall: Part of the tire comprised between the limits of the tread and the bead, visible when the same, fitted to a rim, is viewed from the side.\n\n3. 35 special tread tire (ET): Tire whose tread design is primarily to provide satisfactory performance under special service conditions (e.g., mixed use, on- and off-road, urban bus).\n\n3. 36 temporary use spare tire type T: Temporary use spare tire designed to be used at a higher inflation pressure than that established for standard and reinforced tires.\n\n3. 37 temporary use spare tire: Tire different from one intended to be fitted to a vehicle under normal driving conditions, and only intended for temporary use under restricted driving conditions.\n\n3. 38 pneumatic tire: Flexible component of the wheel assembly, made of rubber and reinforcing materials, which, inflated with pressurized gas, enables the wheel as part of the axle assembly to carry and transmit longitudinal and transverse forces. In an unloaded condition, the tire is essentially a toroid.\n\n3. 39 reinforced tire, extra load (XL): Passenger automobile tire designed for loads and at a higher inflation pressure than the standard version.\n\n3. 40 tire type II: Tires for passenger automobiles.\n\n3. 41 tire type III: Tires for vans, off-road vehicles, and other commercial vehicles such as light trucks (less than 5 tons of gross vehicle weight).\n\n3. 42 tire type IV: Tires for trucks, buses, trailers, semi-trailer trucks, and other multi-purpose on-road service vehicles.\n\n3. 43 MRA: Mutual Recognition Agreement.\n\n3. 44 Product certification body (certification body): body that has the technical competence to perform product certification. Such bodies may be of a public or private nature, national or foreign.\n\n3. 45 P: Letter (optional) placed immediately in front of the section width to identify a passenger car tire.\n\n3. 46 strength test: Determination of the breaking energy of the pneumatic tire under a penetration force applied to the tread by means of a solid cylinder with a hemispherical end of a determined diameter.\n\n3. 47 dimensional requirement: Each of the magnitudes of a set that serve to define the tire, includes section width, profile, rim diameter.\n\n3. 48 high speed resistance: ability to withstand the maximum speed limits for which the pneumatic tire was designed.\n\n3. 49 endurance of the pneumatic tire: Rolling of the pneumatic tire in contact with a steel wheel at constant speed subjected to variable loads for determined periods of time.\n\n3. 50 T: Letter placed immediately in front of the section width to identify a temporary use spare tire.\n\n(*)4. TESTING\n\nThe pneumatic tires for the vehicles indicated in this Regulation must comply with the following technical tests:\n\nTable 2. The positions of the tread wear indicators must be identified, according to internationally recognized manufacturing practices, for example, by means of the initials TWI (Tread Wear Indicator), by means of a triangle (▲) or another symbol that specifies this indicator. This indication must be engraved on the tire shoulder in a position adjacent to the indicator located within the tread grooves. The number of tread wear indicators must not be less than 3 on each side.\n\n2. The first two digits are to indicate the week and the other two for the year. E.g.: «1911», corresponds to a tire manufactured in the 19th week of 2011.\n\n3. The type of vehicle for which it was designed, the preferred rotation, special tread, the words \"TUBELESS\", \"REINFORCED\" or \"EXTRA LOAD\", \"BIAS BELTED\", RADIAL, P, IN, are used, as the case may be.\n\n5.2. The place for marking the load, speed characteristics, size, and construction must be on at least one sidewall of the tire. Notwithstanding the foregoing, the information may be added, prior to its placement on the market, by means of a supplementary label when the same is not in the Spanish language.\n\n(The preceding paragraph amended as such by article 3 of executive decree No. 42507 of July 29, 2020)\n\n6. EQUIVALENCE WITH OTHER NORMATIVE DOCUMENTS\n\n(The numbering of the previous section modified as such by article 1 of executive decree No. 42507 of July 29, 2020, which transferred it from the former section 5) to 6)\n\nThose normative documents that have been declared as equivalent to this technical regulation, in accordance with Executive Decree No. 38849-MEIC of January 6, 2015, Procedure to demonstrate equivalence with a technical regulation of Costa Rica (RTCR), shall be equivalent.\n\n7. DEMONSTRATION OF CONFORMITY\n\n(The numbering of the previous section modified as such by article 1 of executive decree No. 42507 of July 29, 2020, which transferred it from the former section 6) to 7)\n\n7.1 For the purposes of this regulation, Model 5, as set out in Table No. 1 of Section 4, Conformity Assessment Models to Demonstrate Compliance with Technical Regulations, of Executive Decree No. 37662-MEIC-H-MICIT of December 12, 2012, Procedure for the Demonstration of Conformity Assessment of Technical Regulations, shall be used.\n\nThis model is based on testing, evaluation, and surveillance of quality systems, in addition to continuous surveillance of products from the factory, the market, or both in accordance with the requirements specified in this technical regulation and that are evaluated to determine their conformity.\n\nThis certification model includes the implementation of the following stages:\n\na) The certification body requests product samples.\n\nb) Determination of the relevant product characteristics through testing (ISO/IEC 17025, current version) or evaluation.\n\nc) Initial audit of the production process and the quality system.\n\nd) Review of the test or evaluation report.\n\ne) Attestation of conformity.\n\nf) Issuance of a license to use the certificates or marks on the products.\n\ng) Surveillance of the production process or the quality system, or both.\n\nh) Surveillance through testing or inspection of samples from the factory, the open market, or both.\n\n7.1.1 For the point above, the Certificates of Conformity must be issued by a third-party Product Certification Body accredited under the international standard ISO 17065: current or its equivalent standard in force in the country of origin, by the Costa Rican Accreditation Entity (ECA) or by an accreditation body recognized by the ECA, through a multilateral recognition agreement (MLA) before the International Accreditation Forum (IAF), for the scopes required in this Regulation or that are alternatively accredited in the general scopes for the manufacturing of rubber products, according to the Statistical Classification of Economic Activities in the European Community (NACE, scope 22.1).\n\n(The preceding paragraph amended as such by article 3 of executive decree No. 42507 of July 29, 2020)\n\n7.1.2 The Certification Bodies must comply with the Criteria for the use of laboratories by product certification bodies, established by the Costa Rican Accreditation Entity (Code ECA-MC-C01 in its current version on its website)\n\n(The preceding paragraph amended as such by article 3 of executive decree No. 42507 of July 29, 2020)\n\n7.1.3 Notwithstanding the provisions in numerals 7.1.1 and 7.1.2, at the request of a country, the National Competent Authority may enter into negotiations aimed at: concluding mutual recognition agreements for the results of their respective conformity assessment procedures; or making recognition agreements for the conformity assessment procedures, even when these differ, provided there is a conviction that they are procedures that offer a degree of conformity with the technical regulation.\n\nFor the above, it may be necessary to hold prior consultations to reach a mutually satisfactory understanding.\n\n7.1.4. Notwithstanding the provisions in 7.1.1), when in the country of manufacture of the tires, conformity assessment schemes based on a Conformity Assessment Body (CAB) are not used for the products included in the scope of application of this technical regulation, a document issued either by the competent official entity for granting authorizations for the use of conformity marks in the matter, or by a private entity that has the official authority granted for such purposes, may be presented as an alternative to certificates issued by a CAB, in which case the ECA shall verify that indeed, in the country of origin, conformity assessment systems based on CAB are not used.\n\n(The preceding paragraph added as such by article 2 of executive decree No. 42507 of July 29, 2020, which transferred it from the former section 6) to 7)\n\n7.1.5. The certificates indicated in numeral 7.1.1 may include several tire families or types, provided they refer to a single manufacturer, country, and production plant.\n\n(The preceding paragraph added as such by article 2 of executive decree No. 42507 of July 29, 2020, which transferred it from the former section 6) to 7)\n\n7.2 Prior to placing the product on the market\n\nBoth producers and importers of the products subject to this technical regulation must comply with the provisions of subsection 5.1 of Section 5 Procedure for the Demonstration of Conformity, of Executive Decree No. 37662-MEIC-H-MICIT of December 12, 2012, Procedure for the Demonstration of Conformity Assessment of Technical Regulations, in accordance with the procedure published by the ECA in the Official Gazette La Gaceta and on its website, no later than the entry into force of this technical regulation.\n\n7.3 After placing the product on the market\n\nFor the purposes of this regulation, the provisions of subsection 5.2 of Section 5 Procedure for the Demonstration of Conformity, of Executive Decree No. 37662 MEIC-HMICIT of December 12, 2012, Procedure for the demonstration of conformity assessment of Technical Regulations, must be complied with.\n\n8. Criminal liability shall be sanctioned in accordance with current criminal legislation.\n\nArticle Tab\n\nTRANSITIONAL. Certification entities, to carry out the conformity assessment of this regulation, may use third-party or first-party laboratories not accredited for the specific scope of this technical regulation, provided that the certification body has evidence of compliance with the technical requirements of ISO/IEC 17025 in its current version by the laboratory. This condition is established for a period of one year, from the entry into force of this executive decree.\n\nArticle Tab\n\nTRANSITIONAL II. Both producers and importers of the products subject to this technical regulation, as of August 2, 2020, must comply with the provisions of section 7.2.
