Bebedero\"\n\nTexto Completo acta: 12A094\n\nN° 41547-S\n\nEL SEGUNDO VICEPRESIDENTE\n\nEN EJERCICIO DE LAPRESIDENCIA DE LA REPÚBLICA,\n\nEL MINISTRO DE LA PRESIDENCIA Y EL MINISTRO DE SALUD\n\nEn ejercicio de las facultades que les confieren los artículos 11, 50, 140\nincisos 3), 18) y 146 de la Constitución Política, 25, inciso 1 ), 27 inciso 1\n), 28 incisos 1 y 2) literal b) Ley Nº 6227 de 2 de mayo de 1978 Ley General de\nla Administración Pública y sus reformas, 1, 7, 264 al 277 y concordantes de la\nLey Nº 5395 del 30 de octubre de 1973 \"Ley General de Salud\" y sus\nreformas, y los artículos 1, 2, 3 ,11, 21, 22, 23 de la Ley Nº2726 de 14 de\nabril de 1961 \"Ley Constitutiva del Instituto Costarricense de Acueductos\ny Alcantarillados\" y sus reformas.\n\nCONSIDERANDO\n\n1°.Que es función del Estado velar por la protección de la salud de la\npoblación y garantizar el bienestar de los ciudadanos.\n\n2°.Que la Constitución Política en su artículo 50 enuncia el derecho a\nun ambiente sano y ecológicamente equilibrado, el cual se logra, entre otros\nfactores, a través de la protección y conservación de la calidad y cantidad del\nagua para consumo y uso humano, para mantener el equilibrio ecológico en los\nhábitats de la flora y fauna, en general de la biosfera como patrimonio común\nde la humanidad.\n\n3°.Que la Salud de la población es un bien de interés público, tutelado\npor el Estado, asimismo, el abastecimiento de agua potable es un determinante\nde la salud pública y un derecho humano fundamental, así declarado por la\nOrganización de las Naciones Unidas y la jurisprudencia Constitucional\nNacional.\n\n4°.Que se debe brindar agilidad técnica y administrativa para buscar\nnuevas fuentes de agua a fin de sustituir las ya existentes en los acueductos\nafectados , reponer los sistemas deteriorados e interconectar sistemas cuando\nresulte viable, potabilizar las aguas entregadas a la población y adoptar las\nsoluciones tecnológicas que resulten necesarias.\n\n5°.Que el artículo Nº 1 de la Ley Constitutiva del Instituto\nCostarricense de Acueductos y Alcantarillados N º 2726 del 14 de abril de 1961,\nseñala:\" Con el objeto de dirigir, fijar políticas, establecer y aplicar\nnormas, realizar y promover el planeamiento, financiamiento y desarrollo y de\nresolver todo lo relacionado con el suministro de agua potable y recolección y\nevacuación de aguas negras y residuos industriales líquidos, lo mismo que el\naspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas,\npara todo el territorio nacional se crea el Instituto Costarricense de\nAcueductos y Alcantarillados, como institución autónoma del Estado.\n\n6°.Que mediante el Decreto Ejecutivo Nº 4l043-S-MINAE del 26 de enero\ndel 2018, el Poder Ejecutivo oficializó en Costa Rica la Política Nacional de\nAgua Potable, que establece el marco de acción que orientará las gestiones de\nla Administración Pública y demás actores sociales, en el corto, mediano y\nlargo plazo, mediante un plan de acción construido acorde con las condiciones\ndel país, para garantizar una gestión integral del agua potable.\n\n7°.Que mediante Decreto Ejecutivo Nº 38642-MP-MAG del 30 de setiembre\ndel 2014, se declara estado de emergencia la situación generada por la sequía\nque afecta a varias comunidades del Pacífico Norte y Pacífico Central entre las\nque se ubica el Cantón de Cañas, quien se ha visto afectado en el acceso al\nservicio público de agua potable en términos de cantidad y calidad.\n\n8°.Que el Instituto Costarricense de Acueductos y Alcantarillados con el\nfin de cumplir con la misión de normar y garantizar los servicios de agua\npotable, según los requerimientos de la Sociedad y contribuyendo al desarrollo\neconómico y social del país, se encuentra gestionando el proyecto denominado\n\"Reposición del abastecimiento del acueducto Cañas Bebedero\".\n\n9º.Que el Instituto Costarricense de Acueductos y Alcantarillados,\nsuscribió un convenio de cooperación con el Gobierno de la República Popular de\nChina, para el estudio de factibilidad técnica, diseño y construcción de las\nobras del proyecto \"Reposición del Abastecimiento del Acueducto Cañas- Bebedero\".\n\n10º.Que mediante donación del Gobierno de la República Popular de China,\nla Empresa Urban Construction Desing and Research Institute Co. Ltd, será la\nencargada de realizar el diseño y construcción de las obras, bajo la modalidad\nde llave en mano.\n\n11º .Que las obras del Acueducto a desarrollar son una captación al\nembalse sandillal, por medio de un pozo tipo seco, que impulsará agua cruda de\ntipo II, al sitio de planta potabilizadora, donde se realizará un tratamiento\ncompleto, se conducirá el caudal ya potabilizado a los tanques existentes de\nCañas, hasta la planta de eliminación de arsénico en Bebedero. That it is the function of the State to ensure the protection of the population's health and to guarantee the well-being of citizens.\n\n2°. That the Political Constitution in its Article 50 proclaims the right to a healthy and ecologically balanced environment, which is achieved, among other factors, through the protection and conservation of the quality and quantity of water for human consumption and use, to maintain the ecological balance in the habitats of flora and fauna, in general of the biosphere as the common heritage of humanity.\n\n3°. That the Health of the population is a public interest asset, safeguarded by the State; likewise, the supply of potable water is a determinant of public health and a fundamental human right, as declared by the United Nations Organization and national Constitutional jurisprudence.\n\n4°. That technical and administrative agility must be provided to seek new water sources in order to replace those already existing in affected aqueducts, replace deteriorated systems and interconnect systems when viable, purify the water delivered to the population, and adopt the technological solutions that are necessary.\n\n5°. That Article Nº 1 of the Constitutive Law of the Costa Rican Institute of Aqueducts and Sewers Nº 2726 of April 14, 1961, states: \"For the purpose of directing, setting policies, establishing and applying standards, carrying out and promoting planning, financing, and development, and resolving everything related to the supply of potable water and the collection and evacuation of wastewater and liquid industrial waste, as well as the normative aspect of storm sewer systems in urban areas, for the entire national territory, the Costa Rican Institute of Aqueducts and Sewers is created, as an autonomous institution of the State.\n\n6°. That through Executive Decree Nº 41043-S-MINAE of January 26, 2018, the Executive Branch formalized in Costa Rica the National Potable Water Policy, which establishes the action framework that will guide the efforts of the Public Administration and other social actors, in the short, medium, and long term, through an action plan built in accordance with the country's conditions, to guarantee integrated management of potable water.\n\n7°. That through Executive Decree Nº 38642-MP-MAG of September 30, 2014, the situation caused by the drought affecting several communities of the North Pacific and Central Pacific is declared a state of emergency, among which is the Canton of Cañas, which has been affected in access to the public potable water service in terms of quantity and quality.\n\n8°. That the Costa Rican Institute of Aqueducts and Sewers, in order to fulfill the mission of regulating and guaranteeing potable water services, according to the requirements of Society and contributing to the economic and social development of the country, is managing the project called \"Replacement of the supply of the Cañas Bebedero aqueduct.\"\n\n9°. That the Costa Rican Institute of Aqueducts and Sewers signed a cooperation agreement with the Government of the People's Republic of China for the technical feasibility study, design, and construction of the works of the project \"Replacement of the Supply of the Cañas - Bebedero Aqueduct.\"\n\n10°. That through a donation from the Government of the People's Republic of China, the company Urban Construction Design and Research Institute Co. Ltd will be responsible for carrying out the design and construction of the works, under the turnkey modality.\n\n11°. That the Aqueduct works to be developed are an intake (captación) to the Sandillal reservoir, by means of a dry-type well, which will pump Type II raw water to the water treatment plant site, where complete treatment will be carried out; the already treated flow will be conveyed to the existing Cañas tanks, up to the arsenic removal plant in Bebedero. This project will provide service to a population by the year 2040 of 29,000 people (Cañas, Palmira, San Miguel, Bebedero, Porozal).\n\n12°. That by means of official communication GG-2019-00135, the General Management of the Costa Rican Institute of Aqueducts and Sewers requests that the project \"Replacement of the Supply of the Cañas - Bebedero Aqueduct\" be declared of Public and National Interest.\n\n13°.
