  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 010\n\n                        Establece el límite de gasto al Fondo Nacional de Financiamiento Forestal,\npara proyectos nuevos a financiar por actividades y determinar los montos de pago por actividad\n\nTexto Completo acta: 12ED1A\n\nMINISTERIO DE AMBIENTE Y ENERGÍA\n\nR-010-2019-MINAE.-MINISTERIO DE AMBIENTE Y ENERGÍA San José, a las\nquince horas con veintisiete minutos del catorce de enero del dos mil\ndiecinueve.\n\nSe establece al Fondo Nacional de Financiamiento Forestal la cantidad de\nhectáreas a financiar por actividad en el Programa de Pago por Servicios\nAmbientales y el monto a pagar con base en los recursos asignados en el\nPresupuesto Nacional y aprobados por la Contraloría General de la República al\ncitado Fondo, las Políticas Nacionales de Conservación y los criterios de\npriorización definidos por el Sistema Nacional de Áreas de Conservación y\noficializados por el Poder Ejecutivo.\n\nRESULTANDO\n\nÚNICO: Que el presupuesto asignado para la formalización de nuevos contratos en\nel Programa de Pago por Servicios Ambientales para el año 2019, es por la suma\nde ¢3.570.042.934, lo cual está incluido en el Plan-Presupuesto 2019 aprobado\npor la Contraloría General de la República, mediante el oficio DFOE-AE-0566 del\n06 de noviembre del 2018.\n\nCONSIDERANDO\n\nPRIMERO: Que el artículo 38 del Reglamento a la Ley Forestal N° 7575, Decreto\nEjecutivo N° 25721-MINAE, del 17 de octubre de 1996 y sus reformas, dispone que\nel Ministro de Ambiente y Energía como Jerarca del Ministerio de Ambiente y\nEnergía, en funciones de la Administración Forestal del Estado, emitirá\nanualmente mediante Resolución Ministerial, las actividades a financiar en el\nPrograma de Pago por Servicios Ambientales y los montos a pagar con base en los\nrecursos asignados en el Presupuesto Nacional para el ejercicio del año fiscal\n2019.\n\nSEGUNDO: Que bajo este principio, los instrumentos financieros deben orientarse a\napoyar los pilares del Plan Nacional de Desarrollo y de Inversión Pública del\nBicentenario 2019-2022; no estableciendo discriminación, sino la orientación\nprioritaria a las organizaciones de productores que apoyan los pequeños y\nmedianos productores forestales; y quienes se ubican en los cantones de mayor\nrezago social, considerando los objetivos de la creación del Fondo Nacional de\nFinanciamiento Forestal según la citada Ley Forestal, sin dejar de lado los\ncriterios de orden técnico establecidos.\n\nTERCERO: Que el Plan Nacional de Desarrollo citado, considera como una de las\nmetas nacionales el mantener bajo el Programa de Pago por Servicios\nAmbientales, al menos trescientas mil hectáreas, en sus diferentes actividades.\n\nCUARTO: Que, debido al esquema y requisitos establecidos para la ejecución del\nPrograma de Pago por Servicios Ambientales, los proyectos de las actividades de\nProtección de Bosque, Reforestación, Regeneración y Sistemas Agroforestales y\npor la forma de tenencia de la tierra en el país, que principalmente está\ncompuesta por pequeños propietarios, cuyas fincas tienen áreas menores a 10\nhectáreas, se hacen poco rentables, desmotivando a todos los actores\npropietarios, ingenieros forestales y organizaciones de productores, es\nnecesario innovar mecanismos de fomento, a fin de que estos tengan acceso al\nprograma; para tal fin, se está fomentando para este año, un incremento en las\nactividades de proyectos en Sistemas Mixtos y Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF), de manera que\nse aumente el número de participantes en proyectos forestales pequeños.\n\nQUINTO: Que, en virtud de lo anterior, esta Resolución establece entre otras\nactividades tradicionales, una propuesta de escalar a nivel del país un\nmecanismo para incentivar que el programa de pago por servicios ambientales\nintegre a los pequeños productores en áreas menores a 10 hectáreas.\n\nPOR TANTO:\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nRESUELVE\n\nArtículo 1°. Establecer el límite de gasto al Fondo Nacional de Financiamiento\nForestal, para proyectos nuevos a financiar por actividades y determinar los\nmontos de pago por actividad.\n\n1. Actividades a financiar: Para el año 2019, se considerarán dos\nmodalidades a financiar; a-Recuperación de la Cobertura Forestal, que\nincluye las actividades de Reforestación, Regeneración y Sistemas\nAgroforestales y b-Mantenimiento de la Cobertura Forestal, que incluye\nProtección de bosque y Protección post cosecha.\n\nPara tal fin, se establece la siguiente\ndistribución:\n\n \n\n| Modalidades de PSA | Actividad | Cantidad |  |  |  | | --- | --- | --- | --- | --- | --- | |\nRecuperación de la Cobertura Forestal* | Reforestación con especies de rápido crecimiento | 875\nhectáreas |  |  |  | | Reforestación crecimiento | con | especies | de | mediano | 2.735 hectáreas |\n|  | Plantaciones Forestales con Turnos de Rotación Reducidos (PFTRR) | 2.000 hectáreas |  |  |  | |\nRegeneración Natural | 3.000 hectáreas |  |  |  |  | | Establecimiento de árboles en Sistemas\nAgroforestales | 450.000 árboles |  |  |  |  | | Sistemas Agroforestales establecidos en\nPlantaciones de Aprovechamiento Forestal (PPAF) | 50.000 árboles |  |  |  |  | | Sistemas Mixtos en\nAgroforestería para micro productores | 50.400 árboles |  |  |  |  | | Mantenimiento de la Cobertura\nForestal | Protección de Bosque | 36.424 hectáreas |  |  |  | | Protección de Bosque para el\nresguardo del Recurso Hídrico | 3.600 hectáreas |  |  |  |  | | Protección post cosecha** | 200\nhectáreas |  |  |  |  |\n\n \n\n*: El Fonafifo dará trámite a todas las\nsolicitudes de ingreso que se presenten en las sub  actividades de Reforestación por 600\nhectáreas y Sistemas Agroforestales, con especies contenidas en los decretos\nejecutivos de veda y especies amenazadas o en peligro de extinción (Decreto N°\n25663-MINAE y Decreto N° 25700-MINAE y sus reformas).\n\n**: Se refieren a todas las solicitudes de ingreso con fincas en las\ncuales se ha finalizado el plan de manejo forestal.\n\nEl Fondo Nacional de Financiamiento Forestal, podrá variar la distribución\nestablecida e el cuadro anterior, de acuerdo con la\noferta, según las solicitudes recibidas por cada una de las actividades;\nsiempre y cuando, no sobrepasen el presupuesto aprobado para el Programa de\nPago por Servicios Ambientales.\n\nDe disponer de una mayor asignación de recursos, según el artículo 5 de\nla Ley de Simplificación y Eficiencia Tributarias N° 8114 publicada en La\nGaceta N° 131, del día 9 de julio de 2001 y otros recursos financieros que\ncapte el Fonafifo para el Pago por Servicios Ambientales,\nse distribuirán según el criterio de los financiadores y del Fonafifo.\n\nEn todo caso, los recursos utilizados para estos fines, deberán ser\nincorporados en el presupuesto institucional y ser aprobados por la Contraloría\nGeneral de la República.\n\n2. De los montos de pago por actividad y otras condiciones:\n\n2.1. Actividad de Reforestación: Las condiciones que regirán para el trámite\nde solicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Reforestación, son las siguientes:\n\na) El monto a pagar para las especies de rápido crecimiento referidas a: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis y Vochysia hondurensis, será de seiscientos noventa y nueve mil\nveinticuatro colones con 00/100 (¢699.024) por hectárea, desembolsados durante un período de cinco\naños. Los pagos serán distribuidos de la siguiente forma: 50% el primer año, 20% el segundo año, 15%\nel tercer año, 10% el cuarto año y 5% el quinto año.\n\nb) El monto a pagar para las especies de mediano crecimiento referidas\na: Tectona grandis,\nPinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp y Cedrela odorata, será de\nsetecientos ochenta y ocho mil ciento sesenta y seis colones con 00/100\n(¢788.166) por hectárea, desembolsados durante un período de cinco años.\nLos pagos serán distribuidos de la siguiente forma: 50% el primer año,\n20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el quinto\naño.\n\nc) El monto a pagar para especies nativas contenidas en los Decretos\nEjecutivos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, será de un millón ciento ochenta y dos mil doscientos\ncincuenta colones (¢1.182.250) por hectárea, desembolsados durante un período\nde cinco años. Los pagos serán distribuidos de la siguiente forma: 50% el\nprimer año, 20% el segundo año, 15% el tercer año, 10% el cuarto año y 5% el\nquinto año.\n\nd) El monto a pagar para las Plantaciones Forestales con Turnos de\nRotación Reducidos (PFTRR) para especies de rápido crecimiento para embalaje,\nserá de trecientos setenta y seis mil cien colones 00/100 (¢376.100) colones\ncon 00/100) por hectárea. Los pagos serán distribuidos de la siguiente forma:\n50% el primer año, 25% el segundo año y 25% el cuarto año.\n\ne) Plantaciones Forestales establecidas con recursos propios para pago\npor resultados. Los montos a pagar serán los establecidos, en los incisos a, b,\ny c anteriores. Los montos serán distribuidos de la siguiente forma: con la\nfirma del contrato un 50%, doce, veinticuatro, treinta y seis y 48 meses\ndespués de dicha firma un 20%, 15%, 10% y 5% respectivamente. Los contratos\ntendrán la vigencia prevista en el artículo 2 incisos a y b de esta resolución,\npero se reconocerán los años de existencias de estas plantaciones; hasta un\nmáximo de 3 años de establecidas.\n\nf) Las personas físicas o jurídicas que deseen reforestar en áreas\nmayores al tope establecido en el Reglamento a la Ley Forestal, Decreto\nN°25721-MINAE y sus Reformas, podrán aplicar en un esquema especial de\nfinanciamiento de pago por resultados, pudiendo duplicar el tope de 750\nhectáreas, siempre y cuando los recursos disponibles no sean utilizados por los\npequeños productores. El pago será por año vencido. Los montos a pagar serán\nlos establecidos, en los incisos a, b, y c anteriores. Los montos serán\ndistribuidos de la siguiente forma: doce meses después de la firma del contrato\nun 50%, veinticuatro, treinta y seis y cuarenta y ocho meses después de dicha\nfirma un 20%, 15%, 10% y 5% respectivamente.\n\n(*)g) Se instruye al Fondo Nacional de Financiamiento\nForestal para que incorpore en los contratos de Pago por Servicios Ambientales\nen la actividad de Reforestación y Sistemas Agroforestales en bloque, los\nvalores de referencia mínimos aceptables para realizar los pagos.\n\nLos\nvalores de referencia mínimos (VRM) para el diámetro y altura total, requeridos\npara proceder a los pagos de cada año, son los siguientes:\n\nCuadro\n1. Dichos\npagos corresponden al total de años del plazo convenido; no obstante, a fin de\npermitir el establecimiento de la plantación y su mantenimiento, se adelantará\ndurante los primeros cinco años.\n\nj) El Fonafifo podrá modificar cuando así se solicite, aquellos contratos suscritos antes del año\n2009, que demuestren haber alcanzado una producción mínima de 13 metros cúbicos de incremento medio\nanual por hectárea. Para tales efectos, el Fonafifo podrá solicitar la información que considere\npertinente.\n\n(Así reformado el inciso anterior por resolución\nR-167-2019-MINAE del 3 de julio de 2019)\n\n2.2. Actividad de Regeneración Natural: Las condiciones que regirán para el trámite\nde solicitudes, para el reconocimiento de los servicios ambientales en la\nactividad de Regeneración Natural, que se desarrollen en áreas denudadas, sin\ncobertura forestal, con fuentes semilleras cercanas,\nen áreas en proceso de regeneración que no cumplen con la definición de bosque\ny libres de pastoreo; se detallan a continuación.\n\na) El monto a pagar en Regeneración Natural, será de ciento trece mil\nquinientos tres colones con 00/100 (¢113.503) por hectárea, desembolsados en\ncinco pagos anuales de 20% durante un período de cinco años.\n\n2.3. Actividad de Sistemas Agroforestales: Las condiciones\nque regirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Sistemas Agroforestales, se detallan a\ncontinuación.\n\na) El monto a pagar será de novecientos sesenta y ocho colones con\n00/100 (¢968) por árbol, integrados a Sistemas Agroforestales y desembolsados\ndurante un período de cinco años. Los pagos serán distribuidos de la siguiente\nforma: 50% el primer año, 25% el tercero año y 25% el año quinto.\n\nb) El monto a pagar será de mil cuatrocientos treinta y cinco colones\ncon 00/100 (¢1.435) por árbol, integrados a Sistemas Agroforestales,\nestrictamente con especies nativas contenidas en los Decretos Ejecutivos N°\n25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de noviembre de\n1996, desembolsados durante un período de cinco años. Los pagos serán\ndistribuidos de la siguiente forma: 50% el primer año, 25% el tercero año y 25%\nel año quinto.\n\nc) El monto a pagar será de mil cuatrocientos treinta y cinco colones\ncon 00/100 (¢1.435) por árbol bajo la actividad de Sistemas Agroforestales\nestablecidos en Plantaciones de Aprovechamiento Forestal (PPAF), financiados\nmediante el crédito forestal. Los pagos serán distribuidos de la siguiente\nforma: 80% a la firma del contrato, una vez que los árboles hayan alcanzado los\n36 meses de edad y 20% restante en el año quinto del proyecto cuando los\nárboles hayan alcanzado los 60 meses de edad.\n\nd) Sistemas Mixtos\nen Agroforestería para pequeños productores:\n\nLas condiciones para\nesta modalidad son: Cuando realicen actividades de protección de bosque, un\npago de treinta y cinco mil cuatrocientos treinta y cinco colones (¢35.435) por\nhectárea por año durante un periodo de cinco años, (aquí de ser necesario se\ncalcularán las fracciones de hectáreas existentes, hasta el primer decimal.\nCuando sean áreas denudadas o en proceso de regeneración un reconocerá un pago\nde veintidós mil setecientos colones (¢22.700) por año durante un periodo de\ncinco años. Cuando realice actividades de reforestación de especies maderables\no de uso múltiple fuera del área boscosa un pago de doscientos ochenta y siete\ncolones por árbol (¢287) por año; se reconocerá una cantidad mínima de\ndoscientos árboles plantados o árboles\nexistentes identificados hasta un máximo de mil seiscientos árboles. En esta sub -\nactividad podrá realizarse un solo contrato que comprenda las diferentes\nactividades y el plazo será de cinco años contados a partir de la firma del contrato.\n\n(Así reformado el inciso anterior por resolución\nR-167-2019-MINAE del 3 de julio de 2019)\n\n2.4. Actividad de Protección de Bosque: Las condiciones que\nregirán para el trámite de solicitudes, para el reconocimiento de los servicios\nambientales en la actividad de Protección de Bosque, se detallan a\ncontinuación:\n\na) El monto a pagar será de trescientos cincuenta y cuatro mil trescientos cincuenta colones con\n00/100 (¢354.350) desembolsados en diez pagos anuales de 10% durante un período de diez años. Cuando\nse trate de solicitudes que se ubiquen dentro de las zonas de importancia hídrica, identificadas por\nel Instituto Costarricense de Acueductos y Alcantarillados, la Dirección de Aguas y el Fonafifo, se\nreconocerá un monto adicional de ochenta y ocho mil quinientos noventa y dos colones (¢88.592)\ncolones por hectárea, desembolsados en diez pagos anuales de 10% durante un período de diez años.\n\nEste monto adicional\nse aplicará hasta agotar el presupuesto asignado en esta actividad.\n\n(Así reformado el inciso a) anterior por resolución\nR-167-2019-MINAE del 3 de julio de 2019)\n\nb) El monto a pagar en proyectos de Protección Post Cosecha será de\nciento treinta y ocho mil cuatrocientos veinte colones con 00/100 (¢138.420)\npor hectárea, desembolsados en cinco pagos anuales de 20% durante un período de\ncinco años.\n\n3. Actualización de los montos a pagar. Los montos establecidos por actividad\ndentro del Programa de Pago por Servicios Ambientales, se actualizarán\nanualmente con el Índice de Precios al Consumidor (IPC), calculado por el\nInstituto Nacional de Estadística y Censo (INEC), al cierre del período del año\nanterior.\n\nArtículo 2°. Se instruye al Fondo Nacional de Financiamiento Forestal para que\nincorpore en los contratos de Pago por Servicios Ambientales las siguientes\ncondiciones:\n\n1. De los plazos de vigencia de los contratos: Los plazos de vigencia\nde los contratos de Pago por Servicios Ambientales, generados por las sub\nactividades que corresponden a las modalidades de recuperación y/o\nmantenimiento de cobertura forestal serán los siguientes:\n\na) Los contratos correspondientes a la actividad de Reforestación\nmediante el establecimiento de las especies de rápido crecimiento, tendrán una\nvigencia de diez años a partir de su firma.\n\nb) Los contratos correspondientes a la actividad de Reforestación que\nincorporen especies de mediano crecimiento y las especies nativas contenidas en\nlos Decretos N° 25663-MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15 de\nnoviembre de 1996, su vigencia será de dieciséis años, a partir de su firma;\nincluyendo los contratos de reforestación con recursos propios y los contratos\nde reforestación que superen el tope establecido.\n\nc) Los contratos correspondientes a la sub actividad de Plantaciones\nForestales con Turnos de Rotación Reducidos (PFTRR), tendrán una vigencia de\nseis años.\n\nd) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales con especies de rápido, mediano y con las\nespecies nativas contenidas en los Decretos N° 25663-MINAE del 8 de octubre de\n1996 y N° 25700-MINAE del 15 de noviembre de 1996, tendrán una vigencia de\ncinco años a partir de su firma.\n\ne) Los contratos correspondientes a la sub actividad de Sistemas\nAgroforestales establecidos en Plantaciones de Aprovechamiento Forestal (PPAF)\ntendrán una vigencia de 5 años; sin embargo, dado que ya están plantados se les\nreconocerán retroactivamente tres años por su establecimiento previo.\n\nf) Los contratos correspondientes a la sub actividad de Sistemas Mixtos\nen Agroforestería para micro productores tendrán una vigencia de 5 años a\npartir de su firma\n\ng) Los contratos correspondientes a la actividad de establecimiento de\nárboles en Sistemas Agroforestales relacionados a convenios u otros donantes o\nsocios tendrán una vigencia de cinco años a partir de su firma.\n\nh) Los contratos correspondientes a la actividad de Regeneración Natural\ntendrán una vigencia de cinco años a partir de su firma.\n\ni) Los contratos correspondientes a la actividad de Protección post\nCosecha, tendrán una vigencia de cinco años a partir de su firma. De previo a\nla firma del contrato, deberá constar en el expediente la certificación de que\nfue aprobado el plan de manejo, según los Estándares de Sostenibilidad para\nManejo de Bosques Naturales: Principios, Criterios e Indicadores, Código de\nPrácticas y Manual de Procedimientos, Decreto Ejecutivo N° 27388-MINAE\npublicado el 2 de noviembre de 1998, y el Decreto Ejecutivo N° 34559- MINAE\npublicado en La Gaceta N° 115, del día 16 de junio de 2008.\n\nj) Los contratos correspondientes a la actividad de Protección de Bosque\ny Recurso Hídrico tendrán una vigencia de diez años a partir de su firma, con\nposibilidad de prórroga según la disposición de recursos en su momento.\n\n2. Consideraciones Especiales. Condiciones establecidas para los montos\ny actividades de las solicitudes PSA:\n\n2.1. Se faculta al Fondo Nacional de Financiamiento Forestal a establecer\nactividades y montos diferenciados a los señalados en esta resolución, de\nconformidad con acuerdos, convenios o contratos o proyectos específicos con\nentidades, que aporten recursos financieros al Programa de Pago por Servicios\nAmbientales, que reconozcan montos y condiciones diferentes a los establecidos\npara los diferentes servicios ambientales; para estos proyectos no aplicarán\nlos criterios de priorización que se detallaron anteriormente, sino los pactados\nen cada convenio. Los pagos se realizarán siempre y cuando se tenga\ndisponibilidad presupuestaria para cubrir los compromisos adquiridos mediante\nel Programa de Pago por Servicios Ambientales.\n\n2.2. Los montos pendientes por pagar para los contratos de años anteriores,\nse regirán según lo establecido en los Decretos Ejecutivos y Resoluciones\nAdministrativas correspondientes para cada año.\n\n2.3. Para cubrir el costo de inscripción del contrato ante el Registro\nPúblico, el Fondo Nacional de Financiamiento Forestal retendrá en el primer\ndesembolso del monto total del contrato un 0,6%.\n\n2.4. Los recursos recuperados en virtud de los incumplimientos de contratos\nde pago por servicios ambientales o las devoluciones o finiquitos, serán\ntransferidos al Fideicomiso 544 FONAFIFO/BNCR y serán presupuestados para la\nejecución de nuevas actividades de fomento de pequeños y medianos productores.\n\n2.5. El beneficiario del proyecto deberá contar durante todo el plazo del\ncontrato, con un regente forestal debidamente inscrito en el Colegio de\nIngenieros Agrónomos. Salvo en aquellos casos que se haya determinado que el\nproyecto será supervisado directamente por el Fondo Nacional de Financiamiento\nForestal.\n\n2.6. Sin perjuicio de otras disposiciones, el o los beneficiarios deberán aportar\nuna certificación anual o informe de regencia anual emitido por un regente\nforestal para el trámite de pago. Adicionalmente, para los contratos de\nReforestación de rápido crecimiento, deberá presentar los informes de visita,\ndonde certifique el estado de los proyectos en los años 8 y 10 a partir de su\nfecha de plantación; para los proyectos de mediano crecimiento y otras especies\ndeberán presentar dichos informes al año 8, 12 y 16, a partir de su fecha de\nplantación.\n\n2.7. Sin perjuicio de otras acciones que representen incumplimiento a las\nobligaciones del contrato, para los contratos de Reforestación de rápido\ncrecimiento o bloques a partir de los 12 meses y para las plantaciones de\nmediano crecimiento o bloques a partir de los 24 meses de establecida la\nplantación, se considera incumplido el contrato si la plantación no presenta el\ncrecimiento mínimo establecido en el artículo 1, punto 2.1 inciso g de esta\nresolución, o el indicado de previo en el estudio técnico respectivo para otras\nespecies. Como consecuencia de este incumplimiento, el productor no recibirá el\npago correspondiente a este año, siendo que el Fondo Nacional de Financiamiento\nForestal debe suspender los pagos respectivos y dar por terminado el contrato\ncon responsabilidad para el beneficiario previo cumplimiento del debido\nproceso.\n\n2.8. Como principio general, serán motivo de eximente de responsabilidad por\nincumplimiento del contrato, el caso fortuito, la fuerza mayor, el hecho de un\ntercero como eximentes generales debidamente comprobadas y valoradas a juicio\ndel Fonafifo. De igual forma, se procederá cuando el propietario de la\nplantación demuestre que una plaga o enfermedad afectó la plantación y que las\nacciones oportunamente realizadas no lograron erradicarla, siempre y cuando estén\ndocumentadas en el expediente de PSA y tengan el aval de la Oficina Regional.\nSe procederá de igual manera cuando el daño sea producto de un incendio que no\npudo ser controlado a pesar de las medidas preventivas reportadas.\n\n2.9. No podrán ejecutarse proyectos en fincas que hayan sido objetos de\nplagas, enfermedades, o incendios; en tal supuesto la finca no podrá ser sujeto\nde contratos en Reforestación y/o Sistemas Agroforestales, en un plazo de 3\naños, a partir del último contrato finalizado por esta causa.\n\n2.10.En relación a las plagas y enfermedades que afecten las plantaciones\nforestales, la Junta Directiva de Fonafifo, determinará lineamientos para\nabordar y resolver estos supuestos.\n\n2.11. El Fonafifo, será el responsable de monitorear las plantaciones\nforestales que ingresen al Programa, debiendo no solo hacer un seguimiento a\nnivel regional, sinoun protocolo de control, mediante un mecanismo aleatorio de\nvisitas según su capacidad técnica y administrativa. De igual forma, deberá\ncustodiar la información de las parcelas permanentes de mediciones de las\nplantaciones, a fin de sustentar los pagos y respaldar las fijaciones de\ncarbono y otros gases de efecto invernadero.\n\n2.12. Para uniformizar la información requerida de las parcelas permanentes de\nplantaciones y bloques, el Fonafifo emitirá el formato del contenido de la base\nde datos en Excel, que se remitirá anualmente con los datos individuales.\n\n2.13. En caso de que en las solicitudes presentadas se determinara la\nexistencia de traslapes o desplazamiento entre ellas y/o con otras fincas, el\nFonafifo valorará de acuerdo a criterios técnicos y legales la aprobación o no\nde las solicitudes de ingreso.\n\n2.14. En el caso de las solicitudes de ingreso en la actividad de Protección que\nson valoradas según la Matriz de Valoración y que presenten varias fincas; la\ncalificación dependerá de la finca de mayor tamaño que se incluya en la\nsolicitud.\n\n2.15. En el caso de las solicitudes de ingreso de Reforestación y Sistemas\nAgroforestales que involucren mezclas de especies de rápido, mediano y/o en\nvías de extinción, se deberá generar contratos separados, en virtud de las\ndiferencias de crecimiento que se presentan entre estos grupos de especies.\nAdemás, los proyectos que estén conformados por especies nativas contenidas en\nlos Decretos N° 25663- MINAE del 8 de octubre de 1996 y N° 25700-MINAE del 15\nde noviembre de 1996, deberá contener el 100% de los árboles de las especies\ncontenidas en los mencionados decretos; de lo contrario tendrá un valor en\nfunción del monto menor establecido para Reforestación.\n\n2.16. Los proyectos financiados con los recursos de convenios u otros donantes\no socios tendrán los servicios de regencia financiados con recursos de este\nconvenio, o los que se establezcan con otros donantes o socios.\n\n2.17. En el caso de las solicitudes de ingreso que se presenten para acceder\nal Programa de Pago por Servicios Ambientales, deben de contener la información\nde contacto (correo electrónico, número de teléfono, dirección) del dueño o\ndueños del inmueble. Sin esta información la administración estimará como\nincompleta la solicitud y procederá a su archivo. Dicha información es\nfundamental para el proceso de notificación del PPSA.\n\n2.18. Las plantaciones forestales y árboles individuales de especies en\npeligro de extinción sembrados con financiamiento de contratos de servicios\nambientales podrán ser aprovechados con fundamento en el artículo 28 de la Ley\nForestal.\n\nArtículo 3°. Se instruye a la Junta Directiva del Fondo Nacional de Financiamiento\nForestal para que en el año 2019 promueva y amplié el mecanismo de fomento y/o\nfinanciamiento, que permita a los propietarios de fincas con áreas menores a 10\nhectáreas, participar en el Programa de Servicios Ambientales en sus diferentes\nmodalidades.\n\nArtículo 4°.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 010\n\n                        Establishes the spending limit for the National Forest Financing Fund,\nfor new projects to be financed by activity and determines payment amounts per activity\n\nComplete Text of Record: 12ED1A\n\nMINISTRY OF ENVIRONMENT AND ENERGY\n\nR-010-2019-MINAE.- MINISTRY OF ENVIRONMENT AND ENERGY, San José, at\nfifteen hours and twenty-seven minutes on January fourteenth, two thousand\nnineteen.\n\nThe National Forest Financing Fund is hereby established with the number of\nhectares to be financed per activity in the Payment for Environmental Services\nProgram and the amount to be paid based on the resources allocated in the\nNational Budget and approved by the Comptroller General of the Republic for the\naforementioned Fund, the National Conservation Policies, and the prioritization\ncriteria defined by the National System of Conservation Areas and made official\nby the Executive Branch.\n\nWHEREAS\n\nONLY: That the budget allocated for the formalization of new contracts in\nthe Payment for Environmental Services Program for the year 2019, is the sum\nof ¢3,570,042,934, which is included in the 2019 Budget-Plan approved\nby the Comptroller General of the Republic, through official letter DFOE-AE-0566 of\nNovember 6, 2018.\n\nCONSIDERING\n\nFIRST: That Article 38 of the Regulations to the Forest Law (Ley Forestal) No. 7575, Executive\nDecree No. 25721-MINAE, of October 17, 1996, and its amendments, stipulates that\nthe Minister of Environment and Energy, as Head of the Ministry of\nEnvironment and Energy, acting as the State Forestry Administration, shall issue\nannually by Ministerial Resolution, the activities to be financed in the\nPayment for Environmental Services Program and the amounts to be paid based on\nthe resources allocated in the National Budget for the fiscal year 2019\nexercise.\n\nSECOND: That under this principle, financial instruments must be oriented to\nsupport the pillars of the Bicentennial National Development and Public Investment\nPlan 2019-2022; not establishing discrimination, but rather the priority\norientation to producer organizations that support small and\nmedium forest producers; and those located in the cantons of greatest\nsocial lag, considering the objectives of the creation of the National Forest\nFinancing Fund according to the cited Forest Law, without disregarding the\nestablished technical criteria.\n\nTHIRD: That the cited National Development Plan considers as one of the\nnational goals to maintain under the Payment for Environmental Services\nProgram, at least three hundred thousand hectares, in its different activities.\n\nFOURTH: That, due to the scheme and requirements established for the execution of the\nPayment for Environmental Services Program, the projects for the activities of\nForest Protection (Protección de Bosque), Reforestation (Reforestación), Regeneration (Regeneración), and Agroforestry Systems (Sistemas Agroforestales), and\ndue to the form of land tenure in the country, which is mainly\ncomposed of small landowners, whose farms have areas of less than 10\nhectares, become unprofitable, discouraging all involved actors—\nlandowners, forest engineers, and producer organizations— it is\nnecessary to innovate promotion mechanisms, so that they have access to the\nprogram; to that end, for this year, an increase is being promoted in the\nactivities of projects in Mixed Systems (Sistemas Mixtos) and Agroforestry Systems (Sistemas Agroforestales)\nestablished in Forest Harvesting Plantations (Plantaciones de Aprovechamiento Forestal, PPAF), so that\nthe number of participants in small forest projects is increased.\n\nFIFTH: That, by virtue of the foregoing, this Resolution establishes, among other\ntraditional activities, a proposal to scale at the national level a\nmechanism to encourage the payment for environmental services program to\nintegrate small producers in areas of less than 10 hectares.\n\nTHEREFORE:\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nRESOLVES\n\nArticle 1. Establish the spending limit for the National Forest Financing\nFund, for new projects to be financed by activity, and determine the\npayment amounts per activity.\n\n1. Payment amounts per activity and other conditions:\n\n2.1. Reforestation Activity: The conditions that will govern the processing\nof applications, for the recognition of environmental services in the\nReforestation activity, are as follows:\n\na) The amount to be paid for fast-growing species referring to: Gmelina arborea, Acacia\nmangium, Vochysia guatemalensis, and Vochysia hondurensis, will be six hundred ninety-nine thousand\ntwenty-four colones with 00/100 (¢699,024) per hectare, disbursed over a period of five\nyears. Payments will be distributed as follows: 50% the first year, 20% the second year, 15%\nthe third year, 10% the fourth year, and 5% the fifth year.\n\nb) The amount to be paid for medium-growing species referring\nto: Tectona grandis,\nPinus sp, Cordia alliodora, Vochysia ferruginea, Eucalyptus sp, and Cedrela odorata, will be\nseven hundred eighty-eight thousand one hundred sixty-six colones with 00/100\n(¢788,166) per hectare, disbursed over a period of five years.\nPayments will be distributed as follows: 50% the first year,\n20% the second year, 15% the third year, 10% the fourth year, and 5% the fifth\nyear.\n\nc) The amount to be paid for native species contained in the Executive\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, will be one million one hundred eighty-two thousand two hundred\nfifty colones (¢1,182,250) per hectare, disbursed over a period\nof five years. Payments will be distributed as follows: 50% the\nfirst year, 20% the second year, 15% the third year, 10% the fourth year, and 5% the\nfifth year.\n\nd) The amount to be paid for Forest Plantations with Reduced Rotation\nCycles (PFTRR) for fast-growing species for packaging,\nwill be three hundred seventy-six thousand one hundred colones 00/100 (¢376,100) colones\nwith 00/100) per hectare. Payments will be distributed as follows:\n50% the first year, 25% the second year, and 25% the fourth year.\n\ne) Forest Plantations established with own resources for payment\nby results. The amounts to be paid will be those established, in subsections a, b,\nand c above. The amounts will be distributed as follows: upon\ncontract signing 50%, twelve, twenty-four, thirty-six, and 48 months\nafter said signing, 20%, 15%, 10%, and 5% respectively. The contracts\nwill have the term stipulated in Article 2, subsections a and b of this resolution,\nbut the years of existence of these plantations will be recognized; up to\na maximum of 3 years from establishment.\n\nf) Natural or legal persons wishing to reforest in areas\ngreater than the cap established in the Regulations to the Forest Law, Decree\nNo. 25721-MINAE and its Amendments, may apply under a special\npayment-by-results financing scheme, being able to double the cap of 750\nhectares, provided that the available resources are not used by\nsmall producers. Payment will be made in arrears per year. The amounts to be paid will\nbe those established, in subsections a, b, and c above. The amounts will be\ndistributed as follows: twelve months after contract signing\n50%, twenty-four, thirty-six, and forty-eight months after said\nsigning, 20%, 15%, 10%, and 5% respectively.\n\n(*)g) The National Forest Financing\nFund is instructed to incorporate into the Payment for Environmental Services\ncontracts for the Reforestation and Agroforestry Systems block activity, the\nminimum acceptable reference values for making payments.\n\nThe\nminimum reference values (MRV) for diameter and total height, required\nto proceed with payments each year, are as follows:\n\nTable\n1. Said\npayments correspond to the total years of the agreed term; however, in order to\nallow the establishment of the plantation and its maintenance, payment will be advanced\nduring the first five years.\n\nj) Fonafifo may modify, when so requested, those contracts signed before the year\n2009, that demonstrate having achieved a minimum production of 13 cubic meters of mean annual\nincrement per hectare. For such purposes, Fonafifo may request the information it deems\npertinent.\n\n(The preceding subsection was amended by Resolution\nR-167-2019-MINAE of July 3, 2019)\n\n2.2. Natural Regeneration Activity: The conditions that will govern the processing\nof applications, for the recognition of environmental services in the\nNatural Regeneration activity, that are developed in denuded areas, without\nforest cover, with nearby seed sources,\nin areas in the process of regeneration that do not meet the definition of forest\nand free from grazing; are detailed below.\n\na) The amount to be paid in Natural Regeneration, will be one hundred thirteen thousand\nfive hundred three colones with 00/100 (¢113,503) per hectare, disbursed in\nfive annual payments of 20% over a period of five years.\n\n2.3. Agroforestry Systems Activity: The conditions\nthat will govern the processing of applications, for the recognition of environmental\nservices in the Agroforestry Systems activity, are detailed\nbelow.\n\na) The amount to be paid will be nine hundred sixty-eight colones with\n00/100 (¢968) per tree, integrated into Agroforestry Systems, and disbursed\nover a period of five years. Payments will be distributed as follows: 50% the first year, 25% the third year, and 25% the fifth year.\n\nb) The amount to be paid will be one thousand four hundred thirty-five colones\nwith 00/100 (¢1,435) per tree, integrated into Agroforestry Systems,\nstrictly with native species contained in Executive Decrees No.\n25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, disbursed over a period of five years. Payments will be\ndistributed as follows: 50% the first year, 25% the third year, and 25%\nthe fifth year.\n\nc) The amount to be paid will be one thousand four hundred thirty-five colones\nwith 00/100 (¢1,435) per tree under the activity of Agroforestry Systems\nestablished in Forest Harvesting Plantations (PPAF), financed\nthrough forest credit. Payments will be distributed as follows:\n80% upon contract signing, once the trees have reached\n36 months of age, and the remaining 20% in the fifth year of the project when the\ntrees have reached 60 months of age.\n\nd) Mixed Systems\nin Agroforestry for small producers:\n\nThe conditions for\nthis modality are: When carrying out forest protection activities, a\npayment of thirty-five thousand four hundred thirty-five colones (¢35,435) per\nhectare per year for a period of five years, (here, if necessary,\nfractions of hectares existing will be calculated, up to the first decimal).\nWhen they are denuded areas or areas in the process of regeneration, a\npayment of twenty-two thousand seven hundred colones (¢22,700) per year will be recognized for a period of\nfive years. When carrying out reforestation activities with timber species\nor multiple-use species outside the forest area, a payment of two hundred eighty-\nseven colones per tree (¢287) per year; a minimum quantity of\ntwo hundred planted trees or existing identified trees will be recognized,\nup to a maximum of one thousand six hundred trees. In this sub-\nactivity, a single contract may be executed that includes the different\nactivities, and the term will be five years counted from the signing of the contract.\n\n(The preceding subsection was amended by Resolution\nR-167-2019-MINAE of July 3, 2019)\n\n2.4. Forest Protection Activity: The conditions that\nwill govern the processing of applications, for the recognition of environmental\nservices in the Forest Protection activity, are detailed\nbelow:\n\na) The amount to be paid will be three hundred fifty-four thousand three hundred fifty colones with\n00/100 (¢354,350) disbursed in ten annual payments of 10% over a period of ten years. When\ndealing with applications located within water-importance zones, identified by\nthe Costa Rican Institute of Aqueducts and Sewers, the Water Directorate, and Fonafifo,\nan additional amount of eighty-eight thousand five hundred ninety-two colones (¢88,592)\nper hectare will be recognized, disbursed in ten annual payments of 10% over a period of ten years.\n\nThis additional amount\nwill be applied until the budget allocated for this activity is exhausted.\n\n(Subsection a) above was amended by Resolution\nR-167-2019-MINAE of July 3, 2019)\n\nb) The amount to be paid in Post-Harvest Protection projects will be\none hundred thirty-eight thousand four hundred twenty colones with 00/100 (¢138,420)\nper hectare, disbursed in five annual payments of 20% over a period of\nfive years.\n\n3. Updating of payment amounts. The amounts established per activity\nwithin the Payment for Environmental Services Program, will be updated\nannually with the Consumer Price Index (CPI), calculated by the\nNational Institute of Statistics and Census (INEC), at the close of the previous\nyear's period.\n\nArticle 2. The National Forest Financing Fund is instructed to\nincorporate the following conditions into the Payment for Environmental Services\ncontracts:\n\n1. Contract term periods: The term periods\nof the Payment for Environmental Services contracts, generated by the sub-\nactivities that correspond to the modalities of recovery and/or\nmaintenance of forest cover will be as follows:\n\na) Contracts corresponding to the Reforestation activity\nthrough the establishment of fast-growing species, shall have a term\nof ten years from their signing.\n\nb) Contracts corresponding to the Reforestation activity that\nincorporate medium-growing species and the native species contained in\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, their term will be sixteen years, from their signing;\nincluding reforestation contracts with own resources and\nreforestation contracts exceeding the established cap.\n\nc) Contracts corresponding to the sub-activity of Forest\nPlantations with Reduced Rotation Cycles (PFTRR), shall have a term of\nsix years.\n\nd) Contracts corresponding to the activity of establishing\ntrees in Agroforestry Systems with fast-growing, medium-growing, and with\nnative species contained in Decrees No. 25663-MINAE of October 8,\n1996, and No. 25700-MINAE of November 15, 1996, shall have a term of\nfive years from their signing.\n\ne) Contracts corresponding to the sub-activity of Agroforestry Systems\nestablished in Forest Harvesting Plantations (PPAF)\nshall have a term of 5 years; however, since they are already planted, they will be\nrecognized three years retroactively for their prior establishment.\n\nf) Contracts corresponding to the sub-activity of Mixed Systems\nin Agroforestry for micro-producers shall have a term of 5 years from\ntheir signing.\n\ng) Contracts corresponding to the activity of establishing\ntrees in Agroforestry Systems related to agreements or other donors or\npartners shall have a term of five years from their signing.\n\nh) Contracts corresponding to the Natural Regeneration activity\nshall have a term of five years from their signing.\n\ni) Contracts corresponding to the Post-Harvest Protection activity,\nshall have a term of five years from their signing. Prior to\nthe signing of the contract, the file must contain certification that\nthe management plan was approved, according to the Sustainability Standards for\nNatural Forest Management: Principles, Criteria and Indicators, Code of\nPractices, and Procedures Manual, Executive Decree No. 27388-MINAE\npublished on November 2, 1998, and Executive Decree No. 34559-MINAE\npublished in La Gaceta No. 115, on June 16, 2008.\n\nj) Contracts corresponding to the Forest Protection and\nWater Resource activity shall have a term of ten years from their signing, with\nthe possibility of extension depending on the availability of resources at the time.\n\n2. Special Considerations. Conditions established for the amounts\nand activities of the PSA applications:\n\n2.1. The National Forest Financing Fund is authorized to establish\nactivities and amounts differentiated from those indicated in this resolution, in\naccordance with agreements, covenants, or contracts or specific projects with\nentities that contribute financial resources to the Payment for Environmental\nServices Program, which recognize amounts and conditions different from those established\nfor the different environmental services; for these projects, the\nprioritization criteria detailed above will not apply, but rather those agreed upon\nin each covenant. Payments will be made provided there is\nbudgetary availability to cover the commitments acquired through\nthe Payment for Environmental Services Program.\n\n2.2. The amounts pending payment for contracts from previous years,\nwill be governed by the provisions established in the corresponding Executive Decrees and Administrative\nResolutions for each year.\n\n2.3. To cover the cost of registering the contract before the Public\nRegistry, the National Forest Financing Fund will withhold from the first\ndisbursement of the total contract amount 0.6%.\n\n2.4. The resources recovered by virtue of breaches of payment\nfor environmental services contracts, or refunds or settlements, will be\ntransferred to the Fideicomiso 544 FONAFIFO/BNCR and will be budgeted for the\nexecution of new promotion activities for small and medium producers.\n\n2.5. The project beneficiary must have, throughout the entire contract\nterm, a forest regent properly registered with the College of\nAgronomist Engineers. Except in those cases where it has been determined that the\nproject will be supervised directly by the National Forest Financing\nFund.\n\n2.6. Without prejudice to other provisions, the beneficiary or beneficiaries must provide\nan annual certification or annual regency report issued by a forest\nregent for the payment process. Additionally, for fast-\ngrowth Reforestation contracts, they must submit visit reports,\ncertifying the status of the projects at years 8 and 10 from their\nplanting date; for medium-growth projects and other species,\nthey must submit such reports at year 8, 12, and 16, from their\nplanting date.\n\n2.7. Without prejudice to other actions that represent a breach of\ncontractual obligations, for fast-\ngrowth Reforestation contracts or blocks, from 12 months, and for\nmedium-growth plantations or blocks, from 24 months after the\nplantation is established, the contract is considered breached if the plantation does not present the\nminimum growth established in Article 1, point 2.1, subsection g of this\nresolution, or that previously indicated in the respective technical study for other\nspecies. As a consequence of this breach, the producer will not receive the\npayment corresponding to that year, and the National Forest Financing\nFund must suspend the respective payments and terminate the contract\nwith liability for the beneficiary after compliance with due\nprocess.\n\n2.8. As a general principle, grounds for exemption from liability for\nbreach of contract will be fortuitous events, force majeure, and the act of a\nthird party as general exonerations, duly verified and assessed at the\ndiscretion of Fonafifo. The same procedure will apply when the owner of the\nplantation demonstrates that a pest or disease affected the plantation and that the\nactions taken in a timely manner failed to eradicate it, provided that these are\ndocumented in the PSA file and have the endorsement of the Regional Office.\nThe same procedure will apply when the damage is the product of a fire that\ncould not be controlled despite the reported preventive measures.\n\n2.9. Projects may not be carried out on farms that have been subject to\npests, diseases, or fires; in such an event, the farm may not be the subject\nof Reforestation and/or Agroforestry Systems contracts, for a period of 3\nyears, from the last contract terminated for this cause.\n\n2.10. In relation to pests and diseases affecting forest\nplantations, the Board of Directors of Fonafifo will determine guidelines to\naddress and resolve these situations.\n\n2.11. Fonafifo will be responsible for monitoring the forest\nplantations that enter the Program, and must not only follow up\nat the regional level, but also have a control protocol, through a random\nvisit mechanism according to its technical and administrative capacity. Likewise, it must\nsafeguard the information from the permanent measurement plots of the\nplantations, in order to support the payments and back the carbon\nand other greenhouse gas emission fixations.\n\n2.12. To standardize the information required from the permanent plots of\nplantations and blocks, Fonafifo will issue the format for the content of the Excel\ndatabase, which will be submitted annually with the individual data.\n\n2.13. In the event that the applications submitted show the\nexistence of overlaps or displacement among them and/or with other farms,\nFonafifo will assess, according to technical and legal criteria, the approval or not\nof the entry applications.\n\n2.14. In the case of entry applications for the Protection activity that\nare evaluated according to the Valuation Matrix and that present several farms, the\nqualification will depend on the largest farm included in the\napplication.\n\n2.15. In the case of entry applications for Reforestation and Agroforestry Systems\nthat involve mixtures of fast-growing, medium-growing, and/or\nendangered species, separate contracts must be generated, by virtue of the\ngrowth differences that occur between these groups of species.\nFurthermore, projects consisting of native species contained in\nDecrees No. 25663-MINAE of October 8, 1996, and No. 25700-MINAE of November 15,\n1996, must contain 100% of the trees of the species\ncontained in the aforementioned decrees; otherwise, it will have a value\nbased on the lower amount established for Reforestation.\n\n2.16. Projects financed with resources from agreements or other donors\nor partners will have the regency services financed with resources from this\nagreement, or those established with other donors or partners.\n\n2.17. In the case of entry applications submitted to access\nthe Payment for Environmental Services Program, they must contain the contact\ninformation (email address, phone number, address) of the owner or\nowners of the property. Without this information, the administration will consider\nthe application incomplete and will proceed to file it. Said information is\nessential for the PPSA notification process.\n\n2.18. Forest plantations and individual trees of species on the\nendangered list planted with financing from environmental services\ncontracts may be harvested based on Article 28 of the Forest Law (Ley\nForestal).\n\nArticle 3. The Board of Directors of the National Forest Financing\nFund is instructed to promote and expand, in 2019, the promotion and/or\nfinancing mechanism, allowing owners of farms with areas of less than 10\nhectares to participate in the Environmental Services Program in its different\nmodalities.\n\nArticle 4. Shall be effective upon its publication."
