pública de varios\n\nsectores costeros de Punta Guapinol\n\nCon fundamento en las\nfacultades que confiere el artículo 140 y artículo 240, inciso 1° de la Ley N° 6227\nGeneral de la Administración Pública, y en lo dispuesto en la Ley N° 59 de\ncreación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del\nInstituto Geográfico Nacional al Registro Nacional, la Ley N° 6043 sobre la\nZona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.\n\nConsiderando:\n\nI.-Que mediante Ley N°\n8905, se establece el Instituto Geográfico Nacional, como una dependencia del\nRegistro Nacional y que la Junta Administrativa del Registro Nacional\nadministrará el presupuesto del Instituto, suscribirá los contratos y convenios\nnecesarios para el ejercicio de sus funciones. Asimismo, se establece que el\nInstituto Geográfico Nacional será la dependencia científica y técnica rectora\nde la cartografía nacional, destinada a la ejecución del Mapa básico oficial y\nla Descripción básica geográfica de la República de Costa Rica y a los\nestudios, las investigaciones o labores y el desarrollo de políticas nacionales\nde carácter cartográfico, geográfico, geodésico, geofísico y de índole similar\nque tenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación.\n\nII.-Que la Ley de Creación\ndel Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y\nen representación del Estado, como la autoridad oficial en materia geodésica y de la representación\nespacial de la geografía de la República, extendiéndose su autoridad a las\nactividades de cualquier orden que tengan\npor origen los trabajos confiados a su cargo.\n\nIII.-Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el\nartículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del Instituto Geográfico\nNacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización\na través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial,\nde cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública\".\n\nIV.-Que en el Decreto\nEjecutivo N° 36642-MP-MOPTMINAET \"Reglamento\nde Especificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de la zona\npública de la Zona Marítimo Terrestre, el IGN\npodrá acudir a dos metodologías de ejecución, que se indican en los artículos\n19 y 20, correspondientes a la delimitación de la zona pública de la Zona\nMarítimo Terrestre a través de la colocación\nde mojones y/o a la delimitación digital georreferenciada, esto con el fin de\nagilizar las delimitaciones y proporcionar mayor seguridad técnica a los\ninteresados.\n\nV.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como\nel sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo\n11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad\nprivada nacional o extranjera.\"; mientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico\nNacional publicará por los medios adecuados aquella información que se ha oficializado.\".\n\nVI.-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y\notros aspectos de ordenamiento territorial costero.\n\nVII.-Que la información digital georreferenciada sobre delimitación de\nla zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del\nInstituto Geográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\nVIII.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN)\nsobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la regulación\nestablecida por: a) el Decreto Ejecutivo N° 7841-P \"Reglamento a la Ley N° 6043 sobre la Zona\nMarítimo Terrestre\", b) el Decreto Ejecutivo N° 33797-MJ-MOPT \"Declara como datum horizontal oficial\npara Costa Rica, el CR05, y su proyección cartográfica asociada, CRTM05\", y c) el Decreto Ejecutivo\nN° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para la Delimitación de la zona pública de\nla Zona Marítimo Terrestre\".\n\nIX.-Que el artículo 16° de\nla Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el Ministerio\ndel Ambiente y Energía delimitará en el\nterreno los linderos de las áreas que conforman el Patrimonio Natural del Estado.\n\nX.-El Instituto Geográfico\nNacional, utilizó la metodología de \"Delimitación Digital Georreferenciada\" para\ndelimitar la zona pública de la Zona Marítimo Terrestre en varios sectores de\nPunta Guapinol ubicada en distrito 01 Jacó, cantón 11 Garabito, provincia 06\nPuntarenas.\n\nXI.-Que se utilizó los insumos generados a partir del Programa de\nRegularización del Catastro Y Registro Contrato Préstamo\n1284/OC-CR\" del sector objeto del presente aviso.\n\nXII.-Que la delimitación realizada cuenta con aval técnico interno conforme al oficio N° DIG-\nTOT-0466-2018 del 15 de noviembre de 2018, emitido por el Subproceso de Limites Oficiales del\nDepartamento Topográfico y Observación del Territorio del Instituto Geográfico Nacional.\n\nXIII.-Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que \"el acto\nadministrativo producirá su efecto después de comunicado al administrado, excepto si le concede\núnicamente derechos, en cuyo caso lo producirá desde que se adopte\", disposición que necesariamente\ndebe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el sectors of Punta Guapinol\n\nBased on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Public Administration Act, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulation.\n\nConsidering:\n\nI.-That by means of Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry, and that the Administrative Board of the National Registry shall administer the Institute's budget and sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, destined for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\nII.-That the Law Creating the National Geographic Institute, No. 59, permanently constitutes it, representing the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to its charge.\n\nIII.-That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, in Article 62 of the Regulation to Law No. 6043, the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone is recognized, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that \"The National Geographic Institute shall publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\nIV.-That in Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\", it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may employ two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or digital georeferenced delimitation, in order to expedite delimitations and provide greater technical security to interested parties.\n\nV.-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects establishes the National Geodetic our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities undertaken in the National Territory by any public agency, person, or national or foreign private entity must be referenced.\"; while Article 7 indicates that \"As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by appropriate means, that information which has been officialized.\"\n\nVI.-That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of drafting regulatory plans, approving survey plans, granting concessions in the Restricted Zone, and other aspects of coastal territorial planning.\n\nVII.-That the digital georeferenced information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\nVIII.-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares CR05 and its associated cartographic projection CRTM05 as the official horizontal datum for Costa Rica\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\nIX.-That Article 16 of the Forestry Law, Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall demarcate on the ground the boundaries of the areas that constitute the State's Natural Heritage.\n\nX.-The National Geographic Institute used the \"Digital Georeferenced Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Guapinol, located in district 01 Jacó, canton 11 Garabito, province 06 Puntarenas.\n\nXI.-That the inputs generated from the \"Cadastre and Registry Regularization Program, Loan Contract 1284/OC-CR\" for the sector covered by this notice were used.\n\nXII.-That the delimitation carried out has internal technical endorsement pursuant to official letter No. DIG-TOT-0466-2018 of November 15, 2018, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the National Geographic Institute.\n\nXIII.-That Article 140 of Law No. 6227, the General Public Administration Act, states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted,\" a provision that must necessarily be related to numeral 204 of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication, and specific acts by notification.\"\n\nCOMMUNICATES:\n\n1.-The National Geographic Institute used \"Digital Georeferenced
