Asimismo, se establece que el\nInstituto Geográfico Nacional será la dependencia científica y técnica rectora\nde la cartografía nacional, destinada a la ejecución del Mapa básico oficial y\nla Descripción básica geográfica de la República de Costa Rica y a los\nestudios, las investigaciones o labores y el desarrollo de políticas nacionales\nde carácter cartográfico, geográfico, geodésico, geofísico y de índole similar\nque tenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación.\n\n2º-Que la Ley de Creación\ndel Instituto Geográfico Nacional, N° 59, lo constituye de manera permanente y\nen representación del Estado, como la autoridad oficial en materia geodésica y\nde la representación espacial de la geografía de la República, extendiéndose su\nautoridad a las actividades de cualquier orden que tengan por origen los\ntrabajos confiados a su cargo.\n\n3º-Que de conformidad con\nla Ley de Creación del Instituto Geográfico Nacional (IGN), N° 59, en el\nartículo 62 del Reglamento a la Ley N° 6043, se reconoce la competencia del\nInstituto Geográfico Nacional para la delimitación de la zona pública de la\nZona Marítimo Terrestre, y su oficialización a través de publicación en el\nDiario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que. \"El Instituto Geográfico\nNacional deberá publicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4º-Que en el Decreto\nEjecutivo N° 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para la\nDelimitación de la zona pública de la Zona Marítimo Terrestre\", se establece\nsegún el artículo 18° que para la delimitación de la zona pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se\nindican en los artículos 19 y 20, correspondientes a la delimitación de la zona\npública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o\na la delimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto\nEjecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica\nasociada CRTM05, como el sistema oficial al cual deben estar referidas las\ncoordenadas de todos los trabajos geodésicos, cartográficos y catastrales que\nse ejecuten en nuestro país, señalando específicamente en artículo 11 que: \"La\nRed Geodésica Nacional de Referencia\nHorizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el\núnico sistema oficial de coordenadas para la República de Costa Rica a partir\ndel cual se debe referenciar todos los levantamientos y actividades\ncartográficos y geodésicos que desarrollen en el Territorio Nacional toda\ndependencia pública, persona o entidad privada nacional o extranjera.\" ;\nmientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6º-Que la\ngeorreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes reguladores,\nel visado de planos de agrimensura, el otorgamiento de concesiones en la Zona\nRestringida y otros aspectos de ordenamiento territorial costero.\n\n7°-Que la información\ndigital georreferenciada sobre delimitación de la zona pública de la Zona\nMarítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase Digital\nGeorreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la Zona\nMarítimo Terrestre (ZMT).\n\n8º-Que la Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT) se fundamenta técnicamente en aplicación de la\nregulación establecida por: a) el Decreto Ejecutivo N° 7841-P\n\"Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre\", b) el\nDecreto Ejecutivo N° 33797-MJ-MOPT \"Declara como datum horizontal oficial para\nCosta Rica, el CR05, y su proyección cartográfica asociada, CRTM05\", y c) el\nDecreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\".\n\n9º-Que el artículo 16° de\nla Ley Forestal, Ley N° 7575 del 13 de febrero de 1996, establece que el\nMinisterio del Ambiente y Energía delimitará en el terreno los linderos de las\náreas que conforman el Patrimonio Natural del Estado.\n\n10.-El Instituto Geográfico\nNacional, utilizó la metodología de \"Delimitación Digital Georreferenciada\"\npara delimitar la zona pública de la Zona Marítimo Terrestre en varios sectores\nde Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El\nTorno; ubicada en distrito 04 Santa Elena, cantón 10 La Cruz; provincia 05\nGuanacaste.\n\n11.-Que se utilizó los\ninsumos generados a partir del Programa de Regularización del Catastro y\nRegistro Contrato Préstamo 1284/OC-CR\" del sector objeto del presente aviso.\n\n12.-Que la delimitación\nrealizada cuenta con aval técnico interno conforme al oficio N°\nDIG-TOT-0033-2019 del 04 de febrero de 2019, emitido por el Subproceso de\nLimites Oficiales del Departamento Topográfico y Observación del Territorio del\nInstituto Geográfico Nacional.\n\n13º-Que el artículo 140 de\nla Ley N° 6227 General de la Administración Pública señala que \"el acto\nadministrativo producirá su efecto después de comunicado al administrado,\nexcepto si le concede únicamente derechos, en cuyo caso lo producirá desde que\nse adopte\", disposición que Jicote, Bahía\n\nLa Virgen, Bahía El Torno\n\nBased on the powers conferred by Article 140 and Article 240, subsection 1 of Law No. 6227, the General Law of Public Administration, and on the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its respective regulations.\n\nConsidering:\n\n1°—That by means of Law No. 8905, the National Geographic Institute is established as a unit of the National Registry and that the Administrative Board of the National Registry shall administer the Institute's budget and shall sign the contracts and agreements necessary for the exercise of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical unit governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for the studies, investigations or tasks and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\n2º—That the Law Creating the National Geographic Institute, No. 59, constitutes it on a permanent basis and in representation of the State, as the official authority on geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any order originating from the works entrusted to it.\n\n3º—That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation indicates that: \"The National Geographic Institute must publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4º—That in Executive Decree No. 36642-MP-MOPTMINAET, \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,\" it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5º—That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically indicating in Article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, based on which all cartographic and geodetic surveys and activities developed in the National Territory by any public entity, person, or national or foreign private entity must be referenced.\"; while Article 7 indicates that \"As cartographic data are produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish through appropriate means that information which has been officialized.\"\n\n6º—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, the stamping (visado) of survey plans, the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning.\n\n7°—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n8º—That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P, \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone,\" b) Executive Decree No. 33797-MJ-MOPT, \"Declares as official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05,\" and c) Executive Decree No. 36642-MP-MOPT-MINAET, \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.\"\n\n9º—That Article 16° of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.\n\n10.—The National Geographic Institute used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno; located in district 04 Santa Elena, canton 10 La Cruz; province 05 Guanacaste.\n\n11.—That the inputs generated from the Cadastre and Registry Regularization Program, Loan Contract 1284/OC-CR\" for the sector subject to this notice were used.\n\n12.—That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0033-2019 of February 4, 2019, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.\n\n13º—That Article 140 of Law No. 6227, the General Law of Public Administration, indicates that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce it from the time it is adopted,\" a provision that must necessarily be related to numeral 204) of the same normative body, which defines the ideal instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication and specific ones by notification.\"\n\nCOMMUNICATES:\n\n1º—The National Geographic Institute used the \"Georeferenced Digital Delimitation\" and georeferencing of boundary markers to the national coordinate system to delimit the public zone of the Maritime Terrestrial Zone in various sectors of Punta Calavera, Playa Guaria, Bahía El Jicote, Bahía La Virgen, Bahía El Torno;
