  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 41594\n\n                        Creación del Sistema de Reconocimientos Ambientales (SIREA)\n\nN° 41594-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA Y\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nEn ejercicio de las facultades que les confieren los artículos 50, 140,\nincisos 3) y 18) y 146 de la Constitución Política; artículos 27 inciso 1) y 28\ninciso 2) acápite b) de la Ley General de Administración Pública Nº 6227 del 2\nde mayo de 1978; artículos 1, 2, 3, 4, 5 y el transitorio II de la Ley Orgánica\ndel Ambiente Nº 7554 del 4 de octubre de 1995 y el Decreto Ejecutivo Nº\n41032-PLAN-MINAE-RE, Oficialización de la Política Nacional de Producción y\nConsumo Sostenible 2018-2030.\n\nConsiderando:\n\n1 º- Que según lo establecido en el artículo 1 del párrafo primero de la\nLey Orgánica del Ambiente Nº7554, corresponde al Estado dotar a los\ncostarricenses de los instrumentos necesarios para conseguir un ambiente sano y\necológicamente equilibrado.\n\n2 º- Que el Ministerio de Ambiente y Energía ha hecho esfuerzos por reconocer\na las empresas privadas y a las instituciones públicas, sus acciones en\nbeneficio del ambiente, más allá del cumplimiento de la normativa asociada;\nasimismo, ha tratado de armonizar todos los instrumentos de premiación y\ngalardones ambientales existentes, así como nuevas iniciativas en este tema.\n\n3 °- Que mediante el Decreto Ejecutivo Nº 37109 del 13 de febrero de 2012, el\nMINAE oficializó el \"Reglamento del sistema de reconocimientos ambientales\n(SIREA) y derogatoria del decreto ejecutivo Nº 33525-MINAE, Reglamento para\notorgar el certificado Bandera Ecológica, del 27 de noviembre de 2006\",\nque tenía como objetivo crear el Sistema de Reconocimientos Ambientales, con el\nfin de reconocer públicamente a aquellas organizaciones que se han destacado\npor provocar un cambio significativo en el campo ambiental del país;\ncontribuyendo al logro de los objetivos del Plan Nacional de Desarrollo y a una\nestrategia nacional de desarrollo sostenible a largo plazo.\n\n4°- Que en aras de una mejora continua y respondiendo a los\nrequerimientos de los sectores productivos, se ha determinado por parte del\nMINAE, la necesidad de actualizar las disposiciones existentes en el Decreto\nEjecutivo Nº 37109, identificadas como producto de seis años de vigencia de\ndicho reglamento.\n\n5°- Que en mayo del 2018, mediante el Decreto Ejecutivo Nº\n41032-PLAN-MINAE-RE, se oficializó la Política Nacional de Producción y Consumo\nSostenible 2018-2030; en la cual se incorporó el eje estratégico denominado\n\"Producción sostenible\" y en donde se incluye como una de sus\nacciones estratégicas el fortalecimiento de los mecanismos oficiales de reconocimientos\na organizaciones, tanto con enfoque ambiental como social, que buscan\ndiferenciar aquellas que han logrado alcanzar un destacado desempeño en\nsostenibilidad.\n\n6° - Que se procedió a llenar el Formulario de Evaluación Costo Beneficio en\nla Sección I denominada Control Previo de Mejora Regulatoria, siendo que el\nmismo dio resultado negativo y que la propuesta no contiene trámites ni\nrequisitos.\n\nPor Tanto:\n\nDECRETAN:\n\n\"Creación del Sistema de Reconocimientos Ambientales (SIREA)\"\n\nArtículo 1°- Objetivo principal. Créase el Sistema de Reconocimientos\nAmbientales (en adelante SIREA), que tiene como objetivo integrar los\nreconocimientos de carácter ambiental que existan en el país, de acuerdo con\nlos requerimientos definidos en el presente Reglamento, para que cuenten con el\naval del Estado.\n\nArtículos 2° -Objetivos específicos. Los objetivos específicos del SIREA son los siguientes:\n\na) Constituirse en el sistema de reconocimiento Estatal en materia\nambiental.\n\nb) Promover la mejora continua de los reconocimientos que formen parte del sistema,\nesto en aspectos como procedimientos de evaluación, comunicación, divulgación y\ntransparencia.\n\nc) Contribuir a mejorar la calidad ambiental mediante la adopción de buenas\nprácticas, en los sectores público y privado.\n\nd) Dar a conocer e impulsar las experiencias novedosas y de impacto\npositivo en el ambiente.\n\nArtículo 3°- Principios. Los principios generales de gestión que\nenmarcan y orientan la operación del SIREA son los siguientes:\n\na) Rendición de cuentas: responsabilidad de una Organización u\nOrganizador de ofrecer respuestas a los órganos de gobierno, autoridades\nestatales y a otras partes interesad as, respecto a sus decisiones y acciones.\n\nb) Comportamiento ético: comportamiento que es coherente con los\nprincipios de buena conducta generalmente aceptados en el contexto de una\nsituación determinada y que es concordante con la normativa nacional e\ninternacional relacionada con el tema.\n\nc) Mejora continua: estrategia o metodología de la calidad basada en la\nbúsqueda y aplicación continúa de oportunidades de mejora.\n\nd) Transparencia: apertura en cuanto a las decisiones y actividades\nque afectan a la sociedad y al medioambiente y voluntad de comunicar éstas de\nmanera clara, exacta y completa.\n\nArtículo 4°- Definiciones. Para efectos de este Reglamento se entenderá\npor:\n\na) Alcance: se refiere a las áreas de la organización que van a\nser evaluadas, así como a los procesos incluidos en la evaluación para obtener\nun reconocimiento.\n\nb) Criterios de evaluación: parámetros verificables correspondientes a\natributos o variables de carácter cuantitativo, empleados en un proceso de\nevaluación.\n\nc) Evaluador: persona competente designada por el Organizador de\nun reconocimiento, para realizar la evaluación de una Organización que aplica a\nun reconocimiento.\n\nd) Organización: para efectos del presente Reglamento se entenderá\npor Organización a todas las personas fisicas y jurídicas, públicas y. privadas\nque opten por un reconocimiento.\n\ne) Organizador: es un ente público o privado encargado de gestionar\nlos procesos técnicos y logísticos de algún reconocimiento del SIREA.'\n\nf) Reconocimiento: galardón entregado a una o más organizaciones que\nevidencien logros específicos, sistemáticos y exitosos en procura del\ndesarrollo sostenible. Se otorga a una Organización que, habiéndose sometido a\nun proceso de evaluación, cumple con los criterios que la hace merecedora de\ndicho galardón.\n\ng) SIREA: Sistema de Reconocimientos Ambientales de carácter Estatal que integra los\nreconocimientos ambientales del país.\n\nArtículo 5°- Comité Técnico Consultivo del SIREA. Crease el Comité\nTécnico Consultivo del SIREA (en adelante CTC-SIREA), el cual velará por la\nimplementación del presente Reglamento, y estará conformado por un represente y\nun suplente de las siguientes instancias del MINAE:\n\na) Dirección de Gestión de Calidad Ambiental (DIGECA, quien coordinará).\n\nb) Dirección de Cambio Climático (DCC).\n\nc) Dirección de Energía (DE).\n\nd) el Sistema Nacional de Áreas de Conservación (SINAC).\n\nLo anterior, sm detrimento que se pueda convocar para casos específicos,\na cualquier otra instancia pública o privada o a expertos técnicos para el\nasesoramiento en las materias que se requieran e inclusive constituir comisiones\nad hoc.\n\nLa CTC-SIREA para su organización interna, procedimientos de trabajo,\nconvocatoria y acuerdos, se regirá por lo dispuesto en Libro I, Título II,\nCapítulo III de la Ley General de la Administración Pública Nº 6227, en lo\nreferente a órganos colegiados.\n\nArtículo 6°- Facultades y responsabilidades del CTC-SIREA. Son\npotestades y responsabilidades del CTC-SIREA, las siguientes:\n\na) Realizar las evaluaciones de los reconocimientos que deseen incorporarse\nal SIREA.\n\nb) Someter a conocimiento del ministro del MINAE:\n\nb.1. Los instrumentos normativos y procedimentales que se requieran para la efectiva\nimplementación del presente Reglamento.\n\nb.2. Las recomendaciones de incorporación de reconocimientos al SIREA.\n\ne) Crear y mantener actualizado el registro de reconocimientos incorporados\nal SIREA, con sus respectivos organizadores. Este registro estará disponible en\nel sitio web www.digeca.go.cr.\n\nd) Informar a los organizadores, el resultado de las evaluaciones\nrealizadas para el ingreso de sus reconocimientos al SIREA.\n\ne) Apoyar a los organizadores con:\n\ne.1. El mejoramiento continuo de sus procedimientos aplicados.\n\ne.2. La divulgación ante la ciudadanía de casos exitosos.\n\nf) Verificar que los reconocimientos que formen parte del SIREA cumplan los\nrequisitos establecidos en este Reglamento.\n\ng) Recomendar al Ministro de Ambiente y Energía el retiro del uso del\ndistintivo del SIREA a aquellos organizadores de reconocimientos que incumplan\ncon lo establecido en este Reglamento, de conformidad con lo que se señala en\nlos artículos 17º y 18 °.\n\nh) Hacer de conocimiento público el retiro del uso del distintivo del\nSIREA.\n\ni) Cualquier otra que sea necesaria para la debida implementación de\neste reglamento.\n\nArtículo 7°- Deber de incorporación de los reconocimientos ambientales\nal SIREA. Los reconocimientos de carácter ambiental existentes en el país al\nmomento de publicación del presente Reglamento, así como los que se creen a\nfuturo, cuyo organizador sea una institución del sector público, deberán\nincorporarse al SIREA, para ello deberán cumplir con los requisitos señalados\nen este Reglamento.\n\nAsimismo, los organizadores de reconocimientos ambientales del sector\nprivado, podrán formar parte del SIREA, siempre que cumplan con todas las\ndisposiciones señaladas en el presente Reglamento.\n\nArtículo 8°- Convocatoria al proceso de incorporación de un\nreconocimiento al SIREA. Durante todo el año la CTC del SIREA, recibirá\nsolicitudes de aquellos organizadores para la incorporación de sus\nreconocimientos ambientales al sistema por medio del formulario indicado en el\nartículo 9° inciso a) de este Reglamento.\n\nArtículo 9°- Solicitud por parte del Organizador para la incorporación\ndel reconocimiento ,al SIREA. Los organizadores que aspiren a incorporar al SIREA\nel reconocimiento a su cargo deberán:\n\na) Llenar el formulario oficial de inscripción disponible en el sitio web www.digeca.go.cr\ny presentarlo ante esta instancia.\n\nb) Someterse a un proceso de evaluación por parte CTC-SIREA, en el que\nse verificará el cumplimiento de los requisitos básicos establecidos en los\nartículos 10°· y 11 º.\n\nArtículo 10 ° - Requisitos básicos para la admisión de reconocimientos\nal SIREA. Cada reconocimiento que forme parte del SIREA deberá de:\n\na) Tratar sobre la temática ambiental.\n\nb) Contar con un Organizador con capacidad para cumplir las funciones\ndescritas en el presente Reglamento.\n\nc) Tener un sistema de evaluación transparente y objetivo en el cual\nexistan criterios claros, verificables y cuantificables.\n\nd) Disponer de un grupo de evaluadores capacitados en la temática que\nevalúan y que cumplan con el perfil generado para tal fin.\n\nArtículo 11 º- Criterios a considerar por la CTC-SIREA en el proceso de\nevaluación para la incorporación de reconocimientos al SIREA. Para la\nincorporación de un reconocimiento al SIREA, el Organizador deberá de someterse\na un proceso de evaluación por parte de la CTC-SIREA en donde se consideren los\nsiguientes criterios generales como mínimo, sin detrimento de que existan otros\ncriterios específicos:\n\na) Experiencia del Organizador en la temática de su reconocimiento.\n\nb) Disponibilidad de registros (solicitudes de inscripción, evaluadores,\norganizaciones evaluadas, organizaciones reconocidas y vigencia de los\nreconocimientos dados a las organizaciones).\n\nc) Implementación de procedimientos que aseguren como mínimo las siguientes\netapas del proceso: inscripción, evaluación (incluyendo criterios técnicos de\nevaluación con verificación en sitio), entrega y retiro del reconocimiento\ncuando esto proceda y la atención de acciones recursivas.\n\nd) Perfil de los evaluadores que sean atinentes a la temática del\nreconocimiento.\n\nEl instrumento de evaluación que consigna los criterios generales y\nespecíficos con sus respectivos pesos de calificación se publicará en el sitio\nweb www.digeca.go.cr.\n\nArtículo 12 ° -Reconocimientos cuya evaluación de las organizaciones se\nrealiza por medio del Sistema Nacional de la Calidad. Para el caso de\nlos reconocimientos cuyo proceso de evaluación se realiza por medio del Sistema\nNacional de la Calidad, en donde exista una norma específica emitida por el\nEnte Nacional de Normalización, para efectos de incorporación al SIREA,\núnicamente el Organizador deberá de cumplir con lo establecido en el artículo 9\ninciso a), 1 O y 15 inciso a), b ), c ), f), g) y h) de este Reglamento.\n\nArtículo 13°- Plazos de respuesta a las solicitudes de incorporación de reconocimientos\nal SIREA. El Ministro del MINAE, en un plazo de 60 días hábiles a partir de la\npresentación de los requisitos consignados en los artículos 9 °, 10° , 11 º y 12º\nde este Reglamento, otorgará respuesta a las solicitudes de incorporación de\nreconocimiento al SIREA, previa recomendación emitida por la CTC-SIREA.\n\nArtículo 14 ° - Recursos o reclamos administrativos de los\norganizadores. Los organizadores en desacuerdo con los resultados de la evaluación,\npodrán presentar los recursos o reclamos administrativos al Ministro de\nAmbiente y Energía, de conformidad con lo establecido en la Ley General de la\nAdministración Pública Nº 6227.\n\nArtículo 15° -Facultades y responsabilidades de los organizadores\nde los reconocimientos incorporados al SIREA. Además de cumplir con lo\nindicado en el artículo 9° de este Reglamento, son responsabilidades de los\norganizadores de los reconocimientos incorporados al SIREA, las siguientes:\n\na) Suministrar la información requerida a solicitud de la CTC-SIREA en los\ntemas vinculados con la implementación de este Reglamento.\n\nb) Mantener un registro actualizado en su sitio web de las\norganizaciones reconocidas, así como de Evaluadores. Este registro deberá de\nmantenerse actualizado.\n\nAdicionalmente en dicho sitio deberá de existir un cronograma\nactualizado donde se indiquen los períodos de inscripción, evaluación y entrega\nde reconocimientos.\n\ne) Informar al MINAE la realización del acto protocolario de entrega de reconocimientos.\n\nd) Contar con mecanismos de control, registro, custodia y resguardo de confidencialidad\nde toda la documentación vinculada con los procesos de evaluación de las\norganizaciones, para efectos de transparencia y seguimiento por parte de la\nCTC-SIREA.\n\ne) Atender las cornmltas, recursos o reclamos según correspondan, que\npuedan surgir por parte de las organizaciones durante el proceso de evaluación,\nresultados de evaluación y vigencia del reconocimiento a su cargo.\n\nf) Cumplir con la frecuencia de entrega del reconocimiento que organiza.\n\ng) lndicar en el distintivo que se le entrega a las Organizaciones el\nalcance y la vigencia del reconocimiento.\n\nh) Cumplir con todas las disposiciones que le sean aplicables de este\nReglamento en su función de organizador.\n\nArtículo 16°- Beneficios de los reconocimientos incorporados al SIREA. Aquellos reconocimientos\nincorporados al SIREA contarán con los siguientes beneficios:\n\n1. Un distintivo para uso publicitario que destaca a la Organización\ncomo parte del SIREA.\n\n2. Ser parte del Registro Nacional de Reconocimientos Ambientales.\n\n3. La promoción e información que realice el Ministerio de Ambiente y\nEnergía por medios oficiales.\n\n4. Aquellos que se deriven de los procedimientos de contratación del Estado\ndebidamente avalados por el ente competente en compra pública.\n\nArtículo 17º- Vigencia de la incorporación del reconocimiento. Una vez que el reconocimiento\nse haya incorporado al SIREA, el plazo de permanencia de éste dentro del sistema,\nserá de cinco años, siempre y cuando cumpla con lo establecido en el presente Reglamento\ny en los instrumentos de evaluación. Para estos efectos la CTC-SIREA estará facultada\npara realizar evaluaciones periódicas posteriores a su incorporación en aras de\nverificar dicho cumplimiento.\n\nEn caso de incumplimiento se excluirá el reconocimiento del sistema,\nprevio seguimiento del debido proceso.\n\nArtículo 18°- Distintivos del SIREA. En el marco del SIREA, el Ministro de\nAmbiente y Energía otorgará un distintivo que identifique a aquellos\nreconocimientos que han sido incorporados en el SIREA.\n\nEl derecho y uso del distintivo del SIREA y su alcance se establecerán\nvía resolución administrativa emitida por el Ministro del MINAE.\n\nArtículo 19º- Sobre la publicidad y comercialización. Las\norganizaciones que hayan sido galardonas con algún reconocimiento que forme\nparte del SIREA, podrán hacer uso del distintivo del reconocimiento para hacer\npublicidad, siempre y cuando éste se encuentre vigente, se especifique el tipo\nde reconocimiento obtenido, el alcance físico y los procesos evaluados para el\nreconocimiento, así como su vigencia.\n\nEl organizador del reconocimiento deberá de velar por el cumplimiento de\nlas anteriores disposiciones por parte de las organizaciones reconocidas, en el\ncaso de que alguna incurra en la violación de lo dispuesto en este artículo\ndeberá de tomar las medidas necesarias para el retiro inmediato del distintivo.\n\nArtículo 20°- Derogatorias. Deróguese los siguientes instrumentos:\n\na. Los artículos 2 y 4 del Decreto Ejecutivo Nº 34204 \"Derogación\ndel Decreto Ejecutivo Nº 27485-MINAE, y de los incisos· A) y B) del artículo 10\ndel Decreto Ejecutivo Nº 30077- MINAE, y Modificación del artículo 20 del\nDecreto Ejecutivo Nº 33525-MINAE, publicado en la Gaceta N º 31 del 13 de\nfebrero de 2007\" del 23 de noviembre de 2007 publicado en La Gaceta N º08\ndel 11 de enero de 2008.\n\nb. El Decreto Ejecutivo N º 37109 \"Reglamento del Sistema de\nreconocimientos ambientales (SIREA) y derogatoria del decreto ejecutivo Nº\n33525-MINAE, Reglamento para otorgar el certificado Bandera Ecológica, del 27\nde noviembre de 2006\" del 13 de febrero de 2012, publicado en el Alcance\nNº67 de La Gaceta Nº99 del 23 de mayo de 2012.\n\nc.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 41594\n\n                        Creation of the Environmental Recognition System (Sistema de Reconocimientos Ambientales, SIREA)\n\nNo. 41594-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC AND\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred upon them by Articles 50, 140, subsections 3) and 18), and 146 of the Political Constitution; Articles 27 subsection 1) and 28 subsection 2) paragraph b) of the General Law of Public Administration No. 6227 of May 2, 1978; Articles 1, 2, 3, 4, 5, and Transitory Provision II of the Organic Law of the Environment No. 7554 of October 4, 1995, and Executive Decree No. 41032-PLAN-MINAE-RE, Officialization of the National Policy for Sustainable Production and Consumption 2018-2030.\n\nConsidering:\n\n1st- That, as established in Article 1, first paragraph, of the Organic Law of the Environment No. 7554, it is the responsibility of the State to provide Costa Ricans with the necessary instruments to achieve a healthy and ecologically balanced environment.\n\n2nd- That the Ministry of Environment and Energy has made efforts to recognize private companies and public institutions for their actions benefiting the environment, beyond mere compliance with associated regulations; likewise, it has sought to harmonize all existing environmental award and recognition instruments, as well as new initiatives on this matter.\n\n3rd- That through Executive Decree No. 37109 of February 13, 2012, MINAE officialized the \"Regulation of the environmental recognition system (Sistema de Reconocimientos Ambientales, SIREA) and repeal of Executive Decree No. 33525-MINAE, Regulation for granting the Ecological Flag certificate, of November 27, 2006,\" which aimed to create the Environmental Recognition System, with the purpose of publicly recognizing those organizations that have stood out for bringing about a significant change in the country's environmental field; contributing to the achievement of the objectives of the National Development Plan and a long-term national sustainable development strategy.\n\n4th- That for the sake of continuous improvement and responding to the requirements of the productive sectors, MINAE has determined the need to update the existing provisions in Executive Decree No. 37109, identified as a result of six years of said regulation being in effect.\n\n5th- That in May 2018, through Executive Decree No. 41032-PLAN-MINAE-RE, the National Policy for Sustainable Production and Consumption 2018-2030 was officialized; in which the strategic axis called \"Sustainable Production\" was incorporated and where one of its strategic actions includes strengthening the official recognition mechanisms for organizations, with both an environmental and social focus, which seek to differentiate those that have managed to achieve outstanding performance in sustainability.\n\n6th- That the Cost-Benefit Evaluation Form was completed in Section I called Prior Control of Regulatory Improvement, with the result being negative and the proposal containing no procedures or requirements.\n\nTherefore:\n\nTHEY DECREE:\n\n\"Creation of the Environmental Recognition System (Sistema de Reconocimientos Ambientales, SIREA)\"\n\nArticle 1- Main objective. The Environmental Recognition System (hereinafter SIREA) is created, whose objective is to integrate the environmental recognitions existing in the country, in accordance with the requirements defined in this Regulation, so that they have the endorsement of the State.\n\nArticle 2- Specific objectives. The specific objectives of SIREA are the following:\n\na) To become the State recognition system in environmental matters.\n\nb) To promote the continuous improvement of the recognitions that form part of the system, in aspects such as evaluation procedures, communication, dissemination, and transparency.\n\nc) To contribute to improving environmental quality through the adoption of good practices in the public and private sectors.\n\nd) To publicize and promote innovative experiences with a positive impact on the environment.\n\nArticle 3- Principles. The general management principles that frame and guide the operation of SIREA are the following:\n\na) Accountability: responsibility of an Organization or Organizer to offer answers to governing bodies, state authorities, and other interested parties, regarding its decisions and actions.\n\nb) Ethical behavior: behavior that is consistent with the generally accepted principles of good conduct in the context of a specific situation and that is concordant with national and international regulations related to the matter.\n\nc) Continuous improvement: quality strategy or methodology based on the continuous search for and application of improvement opportunities.\n\nd) Transparency: openness regarding decisions and activities that affect society and the environment, and willingness to communicate these in a clear, accurate, and complete manner.\n\nArticle 4- Definitions. For the purposes of this Regulation, the following definitions shall apply:\n\na) Scope: refers to the areas of the organization that are to be evaluated, as well as the processes included in the evaluation to obtain a recognition.\n\nb) Evaluation criteria: verifiable parameters corresponding to attributes or variables of a quantitative nature, used in an evaluation process.\n\nc) Evaluator: competent person designated by the Organizer of a recognition to carry out the evaluation of an Organization applying for a recognition.\n\nd) Organization: for the purposes of this Regulation, Organization shall be understood as all public and private physical and legal persons that opt for a recognition.\n\ne) Organizer: a public or private entity responsible for managing the technical and logistical processes of a SIREA recognition.\n\nf) Recognition: award given to one or more organizations that demonstrate specific, systematic, and successful achievements in pursuit of sustainable development. It is granted to an Organization that, having undergone an evaluation process, meets the criteria that make it deserving of said award.\n\ng) SIREA: State Environmental Recognition System that integrates the country's environmental recognitions.\n\nArticle 5- Technical Advisory Committee of SIREA. The Technical Advisory Committee of SIREA (hereinafter CTC-SIREA) is created, which will ensure the implementation of this Regulation, and will be composed of a representative and an alternate from the following MINAE bodies:\n\na) Directorate of Environmental Quality Management (Dirección de Gestión de Calidad Ambiental, DIGECA, which will coordinate).\n\nb) Directorate of Climate Change (Dirección de Cambio Climático, DCC).\n\nc) Directorate of Energy (Dirección de Energía, DE).\n\nd) the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación, SINAC).\n\nThe foregoing, without prejudice that any other public or private body or technical experts may be convened for specific cases, for advice on required matters, and even to constitute ad hoc commissions.\n\nFor its internal organization, working procedures, convening, and agreements, the CTC-SIREA shall be governed by the provisions of Book I, Title II, Chapter III of the General Law of Public Administration No. 6227, regarding collegiate bodies.\n\nArticle 6- Powers and responsibilities of the CTC-SIREA. The powers and responsibilities of the CTC-SIREA are the following:\n\na) To carry out the evaluations of the recognitions that wish to be incorporated into SIREA.\n\nb) To submit for the knowledge of the MINAE minister:\n\nb.1. The normative and procedural instruments required for the effective implementation of this Regulation.\n\nb.2. The recommendations for the incorporation of recognitions into SIREA.\n\nc) To create and maintain an updated registry of recognitions incorporated into SIREA, with their respective organizers. This registry will be available on the website www.digeca.go.cr.\n\nd) To inform the organizers of the results of the evaluations carried out for the admission of their recognitions into SIREA.\n\ne) To support the organizers with:\n\ne.1. The continuous improvement of their applied procedures.\n\ne.2. The public dissemination of successful cases.\n\nf) To verify that the recognitions that form part of SIREA meet the requirements established in this Regulation.\n\ng) To recommend to the Minister of Environment and Energy the withdrawal of the use of the SIREA seal (distintivo) from those organizers of recognitions that fail to comply with the provisions of this Regulation, in accordance with what is indicated in Articles 17 and 18.\n\nh) To make public knowledge the withdrawal of the use of the SIREA seal (distintivo).\n\ni) Any other action necessary for the proper implementation of this regulation.\n\nArticle 7- Duty to incorporate environmental recognitions into SIREA. Environmental recognitions existing in the country at the time of publication of this Regulation, as well as those created in the future, whose organizer is a public sector institution, must be incorporated into SIREA, and for this they must comply with the requirements indicated in this Regulation.\n\nLikewise, organizers of private sector environmental recognitions may form part of SIREA, provided they comply with all the provisions indicated in this Regulation.\n\nArticle 8- Call for the process of incorporating a recognition into SIREA. Throughout the year, the CTC of SIREA will receive applications from organizers for the incorporation of their environmental recognitions into the system by means of the form indicated in Article 9, subsection a) of this Regulation.\n\nArticle 9- Application by the Organizer for the incorporation of the recognition into SIREA. Organizers aspiring to incorporate into SIREA the recognition under their charge must:\n\na) Complete the official registration form available on the website www.digeca.go.cr and present it to this body.\n\nb) Undergo an evaluation process by the CTC-SIREA, in which compliance with the basic requirements established in Articles 10 and 11 will be verified.\n\nArticle 10- Basic requirements for the admission of recognitions into SIREA. Each recognition that forms part of SIREA must:\n\na) Address the environmental theme.\n\nb) Have an Organizer with the capacity to fulfill the functions described in this Regulation.\n\nc) Have a transparent and objective evaluation system in which there are clear, verifiable, and quantifiable criteria.\n\nd) Have a group of evaluators trained in the subject matter they evaluate and who meet the profile generated for that purpose.\n\nArticle 11- Criteria to be considered by the CTC-SIREA in the evaluation process for the incorporation of recognitions into SIREA. For the incorporation of a recognition into SIREA, the Organizer must undergo an evaluation process by the CTC-SIREA in which the following general criteria are considered at a minimum, without prejudice to the existence of other specific criteria:\n\na) Experience of the Organizer in the subject matter of its recognition.\n\nb) Availability of records (registration applications, evaluators, evaluated organizations, recognized organizations, and validity of the recognitions given to the organizations).\n\nc) Implementation of procedures that ensure at least the following stages of the process: registration, evaluation (including technical evaluation criteria with on-site verification), award and withdrawal of the recognition when applicable, and handling of appeals (acciones recursivas).\n\nd) Profile of the evaluators that are pertinent to the subject matter of the recognition.\n\nThe evaluation instrument that contains the general and specific criteria with their respective qualification weights will be published on the website www.digeca.go.cr.\n\nArticle 12- Recognitions whose evaluation of organizations is carried out through the National Quality System. In the case of recognitions whose evaluation process is carried out through the National Quality System (Sistema Nacional de la Calidad), where there is a specific standard issued by the National Standardization Body, for the purposes of incorporation into SIREA, the Organizer must only comply with the provisions of Article 9, subsection a), Article 10, and Article 15, subsections a), b), c), f), g), and h) of this Regulation.\n\nArticle 13- Deadlines for responses to applications for incorporation of recognitions into SIREA. The Minister of MINAE, within a period of 60 business days from the submission of the requirements set forth in Articles 9, 10, 11, and 12 of this Regulation, shall issue a response to the applications for incorporation of a recognition into SIREA, upon prior recommendation issued by the CTC-SIREA.\n\nArticle 14- Administrative appeals or claims by organizers. Organizers in disagreement with the evaluation results may file administrative appeals or claims with the Minister of Environment and Energy, in accordance with the provisions of the General Law of Public Administration No. 6227.\n\nArticle 15- Powers and responsibilities of the organizers of the recognitions incorporated into SIREA. In addition to complying with what is indicated in Article 9 of this Regulation, the responsibilities of the organizers of the recognitions incorporated into SIREA are the following:\n\na) To provide the information required at the request of the CTC-SIREA on matters related to the implementation of this Regulation.\n\nb) To maintain an updated registry on their website of the recognized organizations, as well as of Evaluators. This registry must be kept updated.\n\nAdditionally, said website must have an updated schedule indicating the periods for registration, evaluation, and awarding of recognitions.\n\nc) To inform MINAE of the holding of the ceremonial act for awarding recognitions.\n\nd) To have mechanisms for control, registry, custody, and safeguarding of the confidentiality of all documentation related to the evaluation processes of the organizations, for purposes of transparency and follow-up by the CTC-SIREA.\n\ne) To address consultations, appeals, or claims, as applicable, that may arise from the organizations during the evaluation process, evaluation results, and the validity of the recognition under their charge.\n\nf) To comply with the frequency of awarding the recognition they organize.\n\ng) To indicate on the seal (distintivo) given to the Organizations the scope and validity of the recognition.\n\nh) To comply with all applicable provisions of this Regulation in their function as organizer.\n\nArticle 16- Benefits of the recognitions incorporated into SIREA. Those recognitions incorporated into SIREA will have the following benefits:\n\n1. A seal (distintivo) for advertising use that highlights the Organization as part of SIREA.\n\n2. Being part of the National Registry of Environmental Recognitions.\n\n3. Promotion and information provided by the Ministry of Environment and Energy through official channels.\n\n4. Those derived from State contracting procedures, duly endorsed by the competent body in public procurement.\n\nArticle 17- Validity of the incorporation of the recognition. Once the recognition has been incorporated into SIREA, the term of its permanence within the system will be five years, provided it complies with the provisions of this Regulation and the evaluation instruments. For these purposes, the CTC-SIREA will be authorized to carry out periodic evaluations after its incorporation in order to verify said compliance.\n\nIn case of non-compliance, the recognition will be excluded from the system, following prior due process.\n\nArticle 18- SIREA seals (distintivos). Within the SIREA framework, the Minister of Environment and Energy will grant a seal (distintivo) that identifies those recognitions that have been incorporated into SIREA.\n\nThe right to and use of the SIREA seal (distintivo) and its scope will be established via an administrative resolution issued by the Minister of MINAE.\n\nArticle 19- On advertising and marketing. Organizations that have been awarded a recognition that forms part of SIREA may use the seal (distintivo) of the recognition for advertising, provided it is valid, the type of recognition obtained, the physical scope, and the processes evaluated for the recognition are specified, as well as its validity.\n\nThe organizer of the recognition must ensure compliance with the foregoing provisions by the recognized organizations; in the event that any organization incurs a violation of the provisions of this article, the organizer must take the necessary measures for the immediate withdrawal of the seal (distintivo).\n\nArticle 20- Repeals. The following instruments are repealed:\n\na. Articles 2 and 4 of Executive Decree No. 34204 \"Repeal of Executive Decree No. 27485-MINAE, and of subsections A) and B) of Article 10 of Executive Decree No. 30077-MINAE, and Modification of Article 20 of Executive Decree No. 33525-MINAE, published in La Gaceta No. 31 of February 13, 2007\" of November 23, 2007, published in La Gaceta No. 08 of January 11, 2008.\n\nb. Executive Decree No. 37109 \"Regulation of the Environmental Recognition System (SIREA) and repeal of Executive Decree No. 33525-MINAE, Regulation for granting the Ecological Flag certificate, of November 27, 2006\" of February 13, 2012, published in Supplement No. 67 to La Gaceta No. 99 of May 23, 2012.\n\nc. Executive Decree No. 37707-MINAE \"Regulation for establishing the registration and evaluation costs within the framework of the Environmental Recognition System\" of April 19, 2013, published in Supplement No. 106 to La Gaceta No. 111 of June 11, 2013.\n\nd. Administrative resolution R-425-2013-MINAE which approves the Procedure for call, admissibility, evaluation methodology, and awarding of the recognitions created in Article 10 of Executive Decree No. 37109.\n\nTransitory Provision I. MINAE, through DIGECA, within a period of three months from the publication of this Regulation in the Official Gazette La Gaceta, will make available to the public on its website www.digeca.go.cr, the administrative resolution that officializes the qualification instrument with its respective values, as indicated in Article 11 of this Regulation, and the official registration form indicated in Article 9, subsection a) of this Regulation.\n\nTransitory Provision II. MINAE will have a maximum period of six months from the publication of this Regulation in the Official Gazette La Gaceta to issue the administrative resolution mentioned in Article 18 of this Regulation regarding the right to and use of the SIREA seal (distintivo) and its scope.\n\nTransitory Provision III. All those recognitions incorporated into SIREA under Executive Decree No. 37109 \"Regulation of the environmental recognition system (SIREA) and repeal of Executive Decree No. 33525-MINAE, Regulation for granting the Ecological Flag certificate, of November 27, 2006\", will continue forming part of SIREA, according to the validity period established in Article 17, which will come into effect upon the publication of this Regulation in the Official Gazette La Gaceta.\n\nTransitory Provision IV. The MINAE bodies that make up the CTC-SIREA will have a period of fifteen days from the publication of this Regulation in the Official Gazette La Gaceta to appoint their representatives (principal and alternate).\n\nArticle 21- Effectiveness. It shall become effective upon its publication in the Official Gazette La Gaceta.\n\nDone at the Presidency of the Republic.- San José, on the fifteenth of January of the year two thousand nineteen."
