Que mediante la resolución RE-0213-JD-2018, de las 11:30 horas del 04\nde diciembre del 2018, publicada en el Alcance Digital N° 214 a La Gaceta del\n18 de diciembre de 2018, esta Junta Directiva estableció la \"Metodología\ntarifaria para la protección del recurso hídrico (MTPRH)\".\n\nII.-Que mediante el OF-0125-CDR-2019 del 25 de marzo del 2019, la\nDirección General Centro de Desarrollo de la Regulación (CDR), recomendó\ncorregir el error material identificado en la referencia al número de\nexpediente en el cual se tramitó la \"Metodología tarifaria para la protección\ndel recurso hídrico (MTPRH)\". De ese oficio se extrae lo siguiente:\n\n\"En el encabezado de la resolución se consignó en forma errónea el\nnúmero de expediente en el que se han llevado a cabo todas las diligencias para\nla audiencia pública en la cual se tramitó la aprobación de la \"Metodología\ntarifaria para la protección del recurso hídrico (MTPRH)\", siendo que es un expediente\npúblico al que se remite toda la documentación referente a ese tema, con el fin de no afectar a\nlos administrados, lo que corresponde es corregir el número de\nexpediente para que\nen lugar de OT-193-2018 se lea OT-193-2015.\n\nAsimismo, para efectos de actualizar el expediente corresponde solicitar\nal CDR que revise si existe documentación relacionada al expediente que no haya\nsido incorporada por este error y proceda a realizar ante el Departamento de Gestión\nDocumental las gestiones de corrección respectivas.\"\n\nIII.-Que la Ley General de la Administración Pública, en el numeral 157,\ndispone que, en cualquier tiempo, podrá la Administración rectificar los\nerrores materiales o de hecho y los aritméticos.\n\nIV.-Que, de conformidad con lo expuesto, habiéndose ofrecido las\nexplicaciones de lo ocurrido, lo procedente es corregir dicho error material,\ntal y como se dispone.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Full Text of Norm 0085\n\n                        Tariff Methodology Reform for the Protection of Water Resources\n\nPUBLIC SERVICES REGULATORY AUTHORITY\n\nResolution RE-0085-JD-2019.—Escazú, at eleven hours and fifteen minutes on the twenty-third of April of two thousand nineteen.—\n\nCorrection of a material error in resolution RE-0213-JD-2018, of 11:30 hours on December 4, 2018.\n\nBy agreement 12-20-2019, from the minutes of ordinary session 20-2019, held on April 23, 2019, the Board of Directors of Aresep resolved: to rectify the material error detected in the case file number indicated in the heading of resolution RE-0213-JD-2018, of December 4, 2018. (Case File OT-193-2015).\n\nConsidering:\n\nI. That by resolution RE-0213-JD-2018, of 11:30 hours on December 4, 2018, published in Digital Supplement No. 214 to La Gaceta of December 18, 2018, this Board of Directors established the \"Tariff Methodology for the Protection of Water Resources (Metodología tarifaria para la protección del recurso hídrico, MTPRH)\".\n\nII.—That by official communication OF-0125-CDR-2019 of March 25, 2019, the General Directorate Center for Regulatory Development (Centro de Desarrollo de la Regulación, CDR), recommended correcting the material error identified in the reference to the case file number under which the \"Tariff Methodology for the Protection of Water Resources (MTPRH)\" was processed. The following is extracted from that communication:\n\n\"The heading of the resolution erroneously recorded the case file number in which all the proceedings for the public hearing where the approval of the 'Tariff Methodology for the Protection of Water Resources (MTPRH)' was processed have been carried out, and since it is a public case file to which all documentation related to that matter is referred, in order not to affect the regulated parties, the appropriate course is to correct the case file number so that instead of OT-193-2018 it reads OT-193-2015.\n\nLikewise, for purposes of updating the case file, it is appropriate to request that the CDR review whether there is documentation related to the case file that has not been incorporated due to this error and to proceed before the Document Management Department with the respective correction procedures.\"\n\nIII.—That the General Law of Public Administration, in article 157, provides that, at any time, the Administration may rectify material or factual errors and arithmetic errors.\n\nIV.—That, in accordance with the foregoing, the explanations of what occurred having been offered, the appropriate course is to correct said material error, as is hereby ordered.
