lineamientos para realizar el reconocimiento de la equivalencia del certificado de\nacreditación, otorgado por un organismo de acreditación diferente al ECA y que es signatario de un\nAcuerdo de Reconocimiento Multilateral - IAF (MLA) y acuerdo de reconocimiento Multilateral - ILAC\n(MRA).\n\n \n\n2                   \nALCANCE\n\n \n\nAplica a todos los interesados que soliciten al ECA el reconocimiento de la equivalencia del\ncertificado de acreditación otorgado por un organismo de acreditación signatario de un Acuerdo de\nReconocimiento Multilateral (IAF- MLA / ILAC - MRA).\n\n \n\n3                   \nDEFINICIONES\n\n \n\n-  \nECA: Ente Costarricense de Acreditación.\n\n-   Equivalencia del certificado de acreditación: Aceptación de la semejanza de las actividades\ndentro del alcance de acreditación emitido por un OA con Acuerdo de Reconocimiento\n\nMultilateral.\n\n-  \nIAAC: Cooperación Interamericana de Acreditación.\n\n-  \nIAF: Foro Internacional de Acreditación.\n\n-  \nILAC: Cooperación Internacional de Laboratorios.\n\n-  \nILAC: Cooperación Internacional de Laboratorios.\n\n-   Interesado: Usuario de los servicios de acreditación de un OEC acreditado con acuerdo de\nreconocimiento multilateral o un OEC acreditado con acuerdo de reconocimiento multilateral.\n\n-  \nVerificador: Asistente para trámites de evaluación de la conformidad.\n\n-  \nMLA: Acuerdo de Reconocimiento Multilateral - IAF.\n\n-  \nMRA: Acuerdo de Reconocimiento Multilateral - ILAC.\n\n-  \nOA: Organismo Acreditador.\n\n-   OEC: Organismos de Evaluación de la Conformidad (laboratorios, organismos de inspección u\norganismos de certificación).\n\n-  \nSA: Secretaría\nde\nAcreditación.\n\n \n\n4                   \nGENERALIDADES\n\n \n\n4.1.1        El reconocimiento de la equivalencia del certificado de acreditación se otorga a\nsolicitud expresa del interesado con una vigencia de:\n\n□                       \n3 meses calendario.\n\n□                       \n12 meses calendario.\n\n \n\nEn ambos casos, el ECA realiza revisiones periódicas para confirmar que se mantiene el estado\nbajo el cual el OEC fue reconocido;\nel\ncertificado de acreditación.\n\n \n\nEn los casos en que la vigencia de la acreditación o en los casos de certificaciones de sistemas o\nproductos, si el plazo es menor a los indicados, el reconocimiento se otorgará por el plazo indicado\nen los documentos de acreditación.\n\n \n\n4.1.2        Los interesados pueden solicitar reconocimiento de la equivalencia del certificado de\nacreditación en los alcances con Acuerdo de Reconocimiento Multilateral en ILAC o IAF.\n\n \n\n4.1.3        Todo interesado que desee obtener el reconocimiento de la equivalencia del certificado\nde acreditación debe cumplir lo establecido en este documento y los requisitos de las normas o guías\nde acreditación en su versión vigente. Esto incluye adaptarse a los cambios que ECA publique con\nversiones posteriores.\n\n \n\n4.1.4        Toda la información suministrada al ECA es tratada de manera confidencial. ECA mantiene\ntodas las solicitudes que se presenten resguardadas de forma segura.\n\n \n\n4.1.5        Solamente se reconocen las acreditaciones otorgadas por un OA signatario del MLA o MRA\ncon ILAC, IAF o IAAC.\n\n \n\n4.1.6       \nLa presentación de un trámite no\nimplica la obtención del reconocimiento de la equivalencia del certificado de acreditación.\n\n \n\n4.1.7        Una vez vencida la vigencia del reconocimiento de la equivalencia del certificado de\nacreditación, el ECA no garantiza que la acreditación del OEC emitida por un OA se mantenga vigente.\n\n \n\n4.1.8        En los casos en que no sea posible emitir el reconocimiento de la equivalencia del\ncertificado de  acreditación,  sea  por  incumplimiento  de  las  prevenciones  realizadas  o\n porque  la verificación de la información resulta negativa, el ECA no reembolsará el costo de la\npresentación de la solicitud.\n\n \n\n4.1.9        Finalizada la vigencia del reconocimiento y si el interesado requiere mantener su\nvigencia, debe iniciar el proceso para un nuevo reconocimiento de la equivalencia del certificado de\nacreditación, con la correspondiente presentación  de la solicitud y cancelar las tarifas vigentes.\n\n \n\n5                   \nREQUISITOS PARA EL RECONOCIMIENTO DE LA EQUIVALENCIA DEL CERTIFICADO DE ACREDITACIÓN.\n\n \n\n5.1.1       \nLa acreditación debe ser otorgada\npor un Organismo de Acreditación firmante de MLA en el alcance que solicita.\n\n \n\n5.1.2        La acreditación emitida por el OA en el país de origen debe estar vigente al momento de\nsolicitar el reconocimiento de la equivalencia del certificado de acreditación y sin ninguna\nsuspensión de la acreditación.\n\n \n\n5.1.3        Presentación completa del trámite de reconocimiento de la equivalencia del certificado\nde acreditación con todos los documentos requeridos.\n\n \n\n5.1.4        Cuando el documento es emitido por un OA en un idioma diferente al español o inglés, se\ndebe presentar una traducción oficial al idioma español.\n\n \n\n6              \nPROCESO GENERAL\n DE\n RECONOCIMIENTO\n DE\n LA  EQUIVALENCIA  DEL CERTIFICADO DE ACREDITACIÓN\n\n \n\n6.1.1       \nEl proceso de presentación de documentos se realiza de manera digital en el sitio web\n\neco.eca.or.cr.\n\n \n\n6.1.2        El Verificador revisa la solicitud y verifica que se presenten todos los anexos\nsolicitados y el pago correspondiente, si el trámite de reconocimiento de la equivalencia del\ncertificado de acreditación, NO se encuentra completo el Verificador debe retornar el trámite al\ninteresado, para lo cual cuenta con 5 días hábiles.\n\n \n\n6.1.3        El interesado debe subsanar las deficiencias encontradas para continuar con el proceso\nde reconocimiento de la equivalencia del certificado de acreditación y se vuelve a iniciar la\nrevisión del trámite.\n\n \n\n6.1.5        Si el  trámite de reconocimiento  de la equivalencia  del certificado de acreditación, \nse encuentra completa; el Verificador confirma la validez de la información en 7 días hábiles,\ncomprobando si la acreditación se encuentra vigente y si fue otorgada por un OA firmante del MLA en\nIAAC, ILAC o IAF, según aplique.\n\n \n\n6.1.6        Si durante el proceso de la verificación de la información el Verificador considera\nnecesarias aclaraciones por parte del interesado, ésta las traslada al solicitante. De no realizar\nlas aclaraciones necesarias, se procede al archivo definitivo del trámite.\n\n \n\n6.1.7        Si la verificación realizada resulta positiva, el Verificador completa el formulario\nECA-MC- MA-P05-F03 Reconocimiento de la equivalencia del certificado de acreditación y gestiona las\nfirmas respectivas, para lo que cuenta con 3 días hábiles.\n\n \n\nNota. El reconocimiento de la equivalencia del certificado de acreditación debe estar acompañado con\nla copia fiel del certificado o informe que respalde los resultados de evaluación de conformidad, el\nalcance de acreditación del organismo de acreditación de origen y el certificado de acreditación\ncuando sea posible.\n\n \n\n6.1.8       \nConfirmada la\n información  el\n Verificador  traslada\n los  resultados\n de  la  investigación al Aprobador, quien debe proceder en un plazo de 3 días hábiles,\n\n \n\n6.1.9        El Verificador notifica al interesado, el reconocimiento otorgado y solicita el pago\ncorrespondiente.\n\n \n\n6.1.10    Posterior al pago de las tarifas respectivas, el Aprobador sube a la plataforma\neco.eca.or.cr, el reconocimiento de la equivalencia del certificado de acreditación, para lo que\ncuenta con 1 día hábil.\n\n \n\n6.1.11    Se realizan revisiones periódicas para lo cual, el Verificador, confirma que las\ncondiciones bajo  las cuales el OEC fue reconocido se mantiene invariable. La información de estas\nrevisiones se conserva en los registros de cada OEC reconocido.\n\n \n\n6.1.12    Si durante las revisiones periódicas se detecta que el OEC reconocido está suspendido,\nretirado o con su acreditación vencida, de manera inmediata se cancela el reconocimiento otorgado,\nse informa a la gestoría de Calidad para que retire la información de la página web del ECA y se\ninforma al interesado.\n\n \n\n6.1.13    El ECA hará esta información de conocimiento público y no reintegrará ningún monto por el\nplazo restante del reconocimiento otorgado.\n\n \n\n7                   \nLISTADO DE RECONOCIMIENTOS DE LA EQUIVALENCIA DEL CERTIFICADO DE ACREDITACION\n\n \n\n7.1.1        El ECA mantiene el ECA-MC-MA-P05-F02 listado de reconocimiento de la equivalencia del\ncertificado de acreditación con la siguiente información:\n\n-           \nNúmero de Reconocimiento\n\n-           \nNombre del OEC que obtuvo el certificado de acreditación\n\n \n\n-           \nAlcance de la Acreditación Reconocida\n\n-           \nFecha de emisión del reconocimiento\n\n-           \nVigencia - (por tres meses o por doce meses)\n\n-           \nOrganismo de acreditación emisor de la acreditación\n\n-           \nNombre del interesado.\n\n-           \nCorreo electrónico\n\n \n\n7.1.2        El ECA mantendrá informado a solicitud de cualquier entidad del gobierno, el estado de\nlos reconocimientos de equivalencias del certificado de acreditación otorgados, su vigencia y nombre\ndel solicitante.\n\n \n\n7.1.3        Para suministrar información adicional sobre los reconocimientos de las equivalencias\ndel certificado de acreditación, el interesado debe comunicarse al correo exoneracion@eca.or.cr\n\n \n\n8                   \nTARIFAS\n\n \n\n8.1             \nConsultar las tarifas vigentes al correo exoneracion@eca.or.cr\n\n \n\nNota 1: Se aplican las mismas tarifas aprobadas para el proceso de evaluación y acreditación. Las\ncuales se actualizan de manera automática semestralmente, por lo que regirá la tarifa vigente al\nmomento del trámite.\n\n \n\n8.2              El interesado puede solicitar la revalidación del reconocimiento otorgado por el\nECA, siempre que lo solicite por escrito y realice el pago correspondiente al reconocimiento a los\nrubros II o III del cuadro 1 según aplique. La revalidación se otorgará siempre que se mantengan las\ncondiciones de la solicitud inicial y las acreditaciones se mantengan vigentes, por lo que no se\nrequiere presentar nuevamente la solicitud y los documentos anexos. the certificate of accreditation.\n\n \n\nIn cases where the validity of the accreditation or in cases of system or product certifications, if the term is shorter than those indicated, the recognition will be granted for the term indicated in the accreditation documents.\n\n \n\n4.1.2 Interested parties may request recognition of the equivalence of the certificate of accreditation in the scopes with a Multilateral Recognition Agreement in ILAC or IAF.\n\n \n\n4.1.3 Any interested party wishing to obtain the recognition of the equivalence of the certificate of accreditation must comply with the provisions of this document and the requirements of the accreditation standards or guides in their current version. This includes adapting to changes that ECA publishes with subsequent versions.\n\n \n\n4.1.4 All information provided to ECA is treated confidentially. ECA keeps all submitted applications stored securely.\n\n \n\n4.1.5 Only accreditations granted by an AB signatory to the MLA or MRA with ILAC, IAF, or IAAC are recognized.\n\n \n\n4.1.6 The submission of an application does not imply obtaining the recognition of the equivalence of the certificate of accreditation.\n\n \n\n4.1.7 Once the validity of the recognition of the equivalence of the certificate of accreditation has expired, ECA does not guarantee that the CAB's accreditation issued by an AB remains valid.\n\n \n\n4.1.8 In cases where it is not possible to issue the recognition of the equivalence of the certificate of accreditation, whether due to non-compliance with the required remediations or because the verification of the information is negative, ECA will not refund the cost of submitting the application.\n\n \n\n4.1.9 Once the validity of the recognition has ended and if the interested party needs to maintain its validity, they must initiate the process for a new recognition of the equivalence of the certificate of accreditation, with the corresponding submission of the application and payment of the current fees.\n\n \n\n5 REQUIREMENTS FOR THE RECOGNITION OF THE EQUIVALENCE OF THE CERTIFICATE OF ACCREDITATION.\n\n \n\n5.1.1 The accreditation must be granted by an Accreditation Body signatory to the MLA in the requested scope.\n\n \n\n5.1.2 The accreditation issued by the AB in the country of origin must be valid at the time of requesting the recognition of the equivalence of the certificate of accreditation and without any suspension of the accreditation.\n\n \n\n5.1.3 Complete submission of the application for recognition of the equivalence of the certificate of accreditation with all required documents.\n\n \n\n5.1.4 When the document is issued by an AB in a language other than Spanish or English, an official translation into Spanish must be submitted.\n\n \n\n6 GENERAL PROCESS FOR THE RECOGNITION OF THE EQUIVALENCE OF THE CERTIFICATE OF ACCREDITATION\n\n \n\n6.1.1 The document submission process is carried out digitally on the website eco.eca.or.cr.\n\n \n\n6.1.2 The Verifier reviews the application and verifies that all requested annexes and the corresponding payment are submitted. If the application for recognition of the equivalence of the certificate of accreditation is NOT complete, the Verifier must return the application to the interested party, for which they have 5 business days.\n\n \n\n6.1.3 The interested party must correct the deficiencies found to continue with the process of recognition of the equivalence of the certificate of accreditation, and the application review process restarts.\n\n \n\n6.1.5 If the application for recognition of the equivalence of the certificate of accreditation is complete, the Verifier confirms the validity of the information within 7 business days, verifying if the accreditation is valid and if it was granted by an AB signatory to the MLA in IAAC, ILAC, or IAF, as applicable.\n\n \n\n6.1.6 If during the information verification process the Verifier deems clarifications from the interested party necessary, they will forward them to the applicant. If the necessary clarifications are not made, the application will be definitively archived.\n\n \n\n6.1.7 If the verification performed is positive, the Verifier completes form ECA-MC- MA-P05-F03 Recognition of the equivalence of the certificate of accreditation and processes the respective signatures, for which they have 3 business days.\n\n \n\nNote. The recognition of the equivalence of the certificate of accreditation must be accompanied by a faithful copy of the certificate or report supporting the conformity assessment results, the scope of accreditation of the originating accreditation body, and the certificate of accreditation when possible.\n\n \n\n6.1.8 Once the information is confirmed, the Verifier transfers the results of the investigation to the Approver, who must proceed within a period of 3 business days.\n\n \n\n6.1.9 The Verifier notifies the interested party of the granted recognition and requests the corresponding payment.\n\n \n\n6.1.10 After payment of the respective fees, the Approver uploads the recognition of the equivalence of the certificate of accreditation to the platform eco.eca.or.cr, for which they have 1 business day.\n\n \n\n6.1.11 Periodic reviews are carried out for which the Verifier confirms that the conditions under which the CAB was recognized remain unchanged. The information from these reviews is kept in the records of each recognized CAB.\n\n \n\n6.1.12 If during the periodic reviews it is detected that the recognized CAB is suspended, withdrawn, or has its accreditation expired, the granted recognition is immediately canceled, the Quality Management Office is informed so that it removes the information from the ECA website, and the interested party is informed.\n\n \n\n6.1.13 ECA will make this information public knowledge and will not refund any amount for the remaining term of the granted recognition.\n\n \n\n7 LIST OF RECOGNITIONS OF THE EQUIVALENCE OF THE CERTIFICATE OF ACCREDITATION\n\n \n\n7.1.1 ECA maintains the ECA-MC-MA-P05-F02 list of recognition of the equivalence of the certificate of accreditation with the following information:\n\n- Recognition Number\n\n- Name of the CAB that obtained the certificate of accreditation\n\n \n\n- Scope of the Recognized Accreditation\n\n- Date of issuance of the recognition\n\n- Validity - (for three months or for twelve months)\n\n- Accreditation body issuing the accreditation\n\n- Name of the interested party.\n\n- Email address\n\n \n\n7.1.2 ECA will keep any government entity informed, upon request, of the status of the recognitions of equivalences of the certificate of accreditation granted, their validity, and the applicant's name.\n\n \n\n7.1.3 To provide additional information about the recognitions of the equivalences of the certificate of accreditation, the interested party must contact the email address exoneracion@eca.or.cr\n\n \n\n8 FEES\n\n \n\n8.1 Consult the current fees at the email address exoneracion@eca.or.cr\n\n \n\nNote 1: The same fees approved for the evaluation and accreditation process apply. These are updated automatically semi-annually, so the fee in effect at the time of the application will apply.\n\n \n\n8.2 The interested party may request the renewal of the recognition granted by ECA, provided they request it in writing and make the corresponding payment for the recognition under items II or III of table 1, as applicable. The renewal will be granted provided that the conditions of the initial application are maintained and the accreditations remain valid, therefore it is not necessary to resubmit the application and attached documents.
