  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 41758\n\n                        Declaratoria de utilidad pública para los intereses del Estado la Asociación\nadministradora del acueducto y alcantarillado sanitario del Barrio La Unión y Rótulo Rita Pococí\nLimón\n\nTexto Completo acta: 1737DF\n\nN° 41758-MJP\n\n(Este decreto\nejecutivo se dejó sin efecto por el artículo 1° del decreto ejecutivo N° 44914\ndel 15 de enero del 2025)\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY LA MINISTRA DE JUSTICIA Y PAZ\n\nCon fundamento en lo dispuesto en los artículos 140, inciso 18) y 146 de\nla Constitución Política, en el artículo 32 de la Ley de Asociaciones número\n218 del ocho de agosto de 1939 y los artículos 27 y siguientes del Reglamento a\nla Ley de Asociaciones número 294964, publicado en La Gaceta número 96\ndel 21 de mayo del 2001, así como lo establecido en el artículo 3 inciso ch) de\nla Ley de Impuesto sobre la Renta número 7092 y en los artículos 103 y 104 de\nCódigo de Normas y Procedimientos Tributarios número 4755.\n\nConsiderando:\n\nI.-Que el artículo 32 de la Ley de Asociaciones número 218 de ocho de agosto de 1939 y sus reformas,\nconfiere al Poder Ejecutivo la potestad de declarar de utilidad pública a las Asociaciones simples,\nfederadas o confederadas, cuyo desarrollo y actividades sean particularmente útiles para los\nintereses del Estado, y que por ello contribuyan a solventar una necesidad social.\n\nII.-Que la Asociación Administradora del Acueducto y Alcantarillado\nSanitario de Barrio La Unión y Rótulo Rita Pococí Limón, cédula de persona\njurídica número 3-002-373861, se inscribió en el Registro de Asociaciones del\nRegistro Público al tomo 509 asiento 10503 desde el día 18 de junio de 2004.\n\nIII.-Que los fines que\npersigue la Asociación, según sus estatutos, son: \"[...] 1) Administrar,\noperar, dar mantenimiento, desarrollo y conservar en buenas condiciones el\nacueducto de conformidad con las disposiciones y reglamentos que al respecto\nemite el Instituto Costarricense de Acueductos y Alcantarillados que serán de\nacatamiento obligatorio. 2) Obtener la participación efectiva de las\ncomunidades, en la construcción, operación, mantenimiento y desarrollo del\nacueducto. 3) Colaboración en los programas y campañas de índole educativa que\nse emprendan. 4) Ayudar a explicar y divulgar en la comunidad las disposiciones\ny reglamentos del Instituto Costarricense de Acueductos y Alcantarillados. 5)\nCooperar con los planes, proyectos y obras que emprenda el Instituto\nCostarricense de Acueductos y Alcantarillados en la comunidad. 6) Participar en\nasuntos relativos a la administración, conservación y explotación racional de\nlas aguas; control de su contaminación o alteración, definición de las medidas\ny acciones necesarias para la protección de las cuencas hidrográficas y la\nestabilidad ecológica. 7) Velar por todos los sistemas, sus instalaciones de\nacueductos o alcantarillado sanitario cumplan los principios básicos del\nservicio público, tanto en calidad, cantidad, cobertura, eficiencia,\nracionalización de gastos, etc. 8) Otorgar los servicios públicos, en forma\neficiente, igualitaria y oportuna a todos sus usuarios, sin distinciones de\nninguna naturaleza. Therefore,\n\nThey decree:\n\nDECLARATION OF PUBLIC UTILITY\n\nOF THE ADMINISTRATIVE ASSOCIATION\n\nOF THE AQUEDUCT AND SANITARY SEWER\n\nOF BARRIO LA UNIÓN\n\nAND RÓTULO RITA POCOCÍ LIMÓN\n\nArticle 1.-Declare of Public Utility for the interests of the State the\nAdministrative Association of the Aqueduct and Sanitary Sewer of Barrio\nLa Unión and Rótulo Rita Pococí Limón, legal identification number\n3-002-373861.\n\nArticle 2.-It is the duty of the Association to annually render a management\nreport before the Ministry of Justice and Peace, in accordance with what is indicated in\nArticle 32 of the Regulation to the Law of Associations.\n\nArticle 3.-The income and assets of the association that are allocated entirely and exclusively\nfor public or charitable purposes and that in no case are distributed directly or\nindirectly among its members, shall be exempt from income tax; on the\ncontrary, that part which does not have this purpose, or is distributed in any way among its\nmembers, shall be subject to the imposition of this tax.\n\nArticle 4.-It is the responsibility of the Tax Administration to control and oversee the correct\nfulfillment of the tax obligations of the association, in accordance with the provisions of\nArticles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5.-Once this decree is published, the interested parties must\nformalize and present the respective testimonial copy before the Associations\nRegistry of the National Registry, for its respective registration.\n\nArticle 6.-It shall become effective upon its publication.\n\nIssued at the Presidency of the Republic.-San José, on the eight day of the\nmonth of March of two thousand nineteen."
