ENCARGADO DE NEGOCIOS A. I.\n\nREPÚBLICA FEDERAL\nDE ALEMANIA\n\n6. El\ncompromiso del Gobierno de la República Federal ele Alemania para el proyecto\nquedará sin efecto si el contrato ele ejecución y, si procede, de financiación\nmencionado en el párrafo 5 no se concierta dentro de un plazo de cuatro años\ncontado a partir del año de la entrada en vigor del presente Acuerdo. Para el\nmonto en cuestión el plazo concluirá el 31 de diciembre de 2022.\n\n7. El Gobierno\nele la República ele Costa Rica eximirá a los materiales, vehículos,\nbienes y equipos importados para el proyecto por encargo y a expensas del.\nGobierno ele la República Federal de Alemania) así como a los respectivos\nrepuestos que se utilicen para el proyecto mencionado en el párrafo 1, ele\ntodos los derechos ele importación y exportación, así como de licencias, tasas\nportuarias, derechos de almacenaje y demás gravámenes públicos, y asegurará que\npasen aduana sin demora.\n\n8. El Gobierno\nde la República de Costa Rica eximirá a la GJZ ele todos los impuestos directos\nque se devenguen en la República ele Costa Rica en relación con la concertación y\nejecución del contrato ele ejecución y, si procede, ele financiación mencionado\nen el párrafo 5.\n\n9. El Gobierno ele la República de Costa Rica reembolsará a solicitud de la. GIZ el impuesto sobre\nel valor añadido u otros impuestos indirectos similares que hayan sido aplicados en la República de\nCosta Rica sobre objetos adquiridos y servicios utilizados en relación con la concertación y\nejecución del contrato de ejecución y, si procede, de financiación mencionado en el párrafo 5. Los\nimpuestos especiales al consumo que se hayan aplicado en este contexto serán asumidos por el\nGobierno de la República ele Costa Rica siguiendo una solicitud.\n\n10. El presente Acuerdo se aplicará tanto\nal proyecto mencionado en el párrafo 1 como a futuras medidas de seguimiento\ncon el mismo título en caso de que nuestros dos Gobiernos deseen continuar el\nfomento del proyecto. Los compromisos del Gobierno ele la República Federal de\nAlemania relativos a la concesión de fomento respecto a medidas de seguimiento\ndel proyecto mencionado en el _párrafo 1 se transmitirán mediante comunicado\noficial del Gobierno de la República Federal ele Alemania en. el que se hará\nreferencia explícita al _presente Acuerdo.\n\n11. Por lo\ndemás se aplicarán también al presente Acuerdo las disposiciones del Convenio\nsobre Cooperación Técnica del 23 de Julio de 1 965 y ele los Protocolos ele\nEnmienda del 13 ele marzo de 1986 y del 18 ele diciembre de 2006 mencionados al\ninicio .\n\n12. El\npresente Acuerdo se concierta en alemán y español, siendo ambos textos\nigualmente auténticos.\n\nEn caso de que\nel Gobierno ele la República de Costa Rica se declare conforme con las\npropuestas contenidas en los\npárrafos 1 a 12, esta Nota y la Nota de respuesta de Vuestra. Los detalles\ndel proyecto y ele las prestaciones y obligaciones respectivas se fijarán en un\ncontrato ele ejecución y, si procede, ele financiación que habrá de ser\nconcertado entre la GIZ y la institución a la que el Gobierno ele la República\nele Costa Rica encargue la ejecución del proyecto y que estará sujeto a las\ndisposiciones legales vigentes en la República Federal de Alemania.\n\n6. El compromiso\ndel Gobierno ele la República Federal de Alemania para el proyecto quedará sin\nefecto si el contrato ele ejecución y, si procede, ele financiación mencionado\nen el párrafo 5 no se concierta dentro ele un plazo de cuatro años, contado a\npartir del año de la entrada en vigor del presente Acuerdo. Para el monto en\ncuestión el plazo concluirá el 31 ele diciembre ele 2022.\n\n7. El Gobierno\nele la República ele Costa Rica eximirá a los materiales, vehículos, bienes y\nequipos importados para el proyecto por encargo y a expensas del Gobierno de la\nRepública Federal de Alemania, así como a los respectivos repuestos que se\nutilicen para el proyecto mencionado en el párrafo 1, de todos los derechos ele\nimportación y exportación, así como ele licencias, tasas portuarias, derechos\nele almacenaje y demás gravámenes públicos, y asegurará que pasen aduana sin\ndemora.\n\n8. El Gobierno\nele la República ele Costa Rica eximirá a la GIZ ele tocios los impuestos\ndirectos que se devenguen en la República ele Costa Rica en relación con la\nconcertación y ejecución del contrato ele ejecución y, si procede, ele\nfinanciación mencionado en el párrafo 5.\n\n9. El Gobierno de\nla República de Costa Rica reembolsará a solicitud ele la GIZ el impuesto sobre\nel valor añadido u otros impuestos indirectos similares que hayan siclo\naplicados en la República de Costa Rica sobre objetos adquiridos y servicios\nutilizados en relación con la concertación y ejecución del contrato ele\nejecución y, si procede, ele financiación mencionado en el párrafo 5. Los\nimpuestos especiales al consumo que se hayan aplicado en este contexto serán\nasumidos por el Gobierno ele la República de Costa Rica siguiendo una\nsolicitud.\n\n10. El presente\nAcuerdo se aplicará tanto al proyecto mencionado en el párrafo 1 como a futuras\nmedidas ele seguimiento con el mismo título en caso ele que nuestros dos\nGobiernos deseen continuar el fomento del proyecto. Therefore,\n\nTHEY DECREE:\n\n\"Promulgation\nof the present Agreement under the Exchange of Notes modality between the\n\nRepublic of\nCosta Rica and the Federal Republic of Germany on the project\n\n\"Climate\nchange and transportation in Costa Rica\".\n\nArticle 1.-\nTo promulgate, holding as valid for internal and external purposes, the\npresent Agreement under the Exchange of Notes modality between the Republic of\nCosta Rica and the Federal Republic of Germany on the project \"Climate\nchange and transportation in Costa Rica\", whose literal text is as\nfollows:\n\n \n\nSan José, November 7, 2018\n\nDM-DGPE-0673-2018\n\nHonorable Sir:\n\nI have the honor of\naddressing Your Lordship, on the occasion of acknowledging receipt of your kind note\n404-468.40 /2-1 CRI TZ 5 dated September 24, 2018, which reads as\nfollows:\n\n\"Her Excellency Madam Minister:\n\nPursuant\nto the Convention on Technical Cooperation, concluded between our two\nGovernments on July 23, 1965, as well as the Amendment Protocols\nof March 13, 1986, and of December 18, 2006, I have the honor to\npropose to Your Excellency, on behalf of the Government of the Federal Republic\nof Germany, the following additional Agreement regarding the project 'Climate\nchange and transportation in Costa Rica', within the framework of the International\nInitiative for Climate Protection of the Federal Ministry for the Environment, Nature\nConservation and Nuclear Safety:\n\n1. The Government\nof the Federal Republic of Germany and the Government of the Republic of Costa\nRica will jointly continue with the promotion of the project 'Climate change\nand transportation in Costa Rica', if, after examination, it continues to be\neligible for support.\n\n2. The objective\nof the project is to contribute to climate protection and to sustainable development in the Republic of Costa Rica, through the promotion of measures for the\nmitigation of greenhouse gases.\n\n3. The Government\nof the Federal Republic of Germany will provide additional human resources and will make additional material contributions and, if applicable,\nadditional financial contributions for the project for a total amount of\nup to 2,500,000 euros\n(in words: two million five hundred thousand euros).\n\nIt will entrust the execution to the Deutsche\nGesellschaft für Internationale Zusammenarbeit (GIZ) GmbH.\n\n4. On the part\nof the Government of the Republic of Costa Rica, the Ministry of Environment and Energy will be responsible for the execution\nof the project.\n\n5. The\ndetails of the project and of the respective contributions and obligations will\nbe set out in an execution contract and, if applicable, a financing contract, which will have to be concluded between GIZ and the institution to which the Government\nof the Republic of Costa Rica entrusts the execution of the project and which will\nbe subject to the legal provisions in force in the Federal Republic of\nGermany.\n\nHONORABLE SIR\n\nANDRÉ SCHOLZ\n\n. The\ncommitment of the Government of the Federal Republic of Germany for the project\nwill cease to have effect if the execution contract and, if applicable, the financing contract\nmentioned in paragraph 5 is not concluded within a period of four\nyears counted from the year of the entry into force of the present Agreement. For the\namount in question, the period will conclude on December 31, 2022.\n\n7. The Government\nof the Republic of Costa Rica will exempt the materials, vehicles,\ngoods, and equipment imported for the project by order and at the expense of the\nGovernment of the Federal Republic of Germany, as well as the respective\nspare parts used for the project mentioned in paragraph 1, from\nall import and export duties, as well as licenses, port fees,\nstorage charges, and other public levies, and will ensure that they pass customs without delay.\n\n8. The Government\nof the Republic of Costa Rica will exempt GIZ from all direct taxes accruing in the Republic of Costa Rica in connection with the conclusion and\nexecution of the execution contract and, if applicable, the financing contract mentioned\nin paragraph 5.\n\n9. The Government of the Republic of Costa Rica will reimburse, at the request of GIZ, the value added tax or other similar indirect taxes that have been applied in the Republic of\nCosta Rica on items acquired and services used in connection with the conclusion and\nexecution of the execution contract and, if applicable, the financing contract mentioned in paragraph 5. The\nexcise taxes that have been applied in this context will be assumed by the\nGovernment of the Republic of Costa Rica following a request.\n\n10. The present Agreement will apply both\nto the project mentioned in paragraph 1 and to future follow-up measures\nwith the same title in the event that our two Governments wish to continue the\npromotion of the project. The commitments of the Government of the Federal Republic of\nGermany regarding the granting of promotion for follow-up measures of the project mentioned in\nparagraph 1 will be communicated by official communiqué of the Government of the Federal Republic of Germany, in which explicit reference will be made to the present Agreement.\n\n11. In all other respects,\nthe provisions of the Convention on Technical Cooperation of July 23, 1965, and of the Amendment Protocols\nof March 13, 1986, and of December 18, 2006, mentioned at the\nbeginning, will also apply to the present Agreement.\n\n12.
