Que con base en los requerimientos que\ndemanda el cumplimiento de la Convención CITES a nivel Internacional, en\nrelación con la comercialización de tiburón sedoso (CITES), se da una\nafectación directa en los tramites de exportación de los productos pesqueros\npor la gran demora en la tramitación de los permisos de parte de los\nimportadores, lo cual se traduce en una considerable cantidad de días de espera\npara los sector pesquero costarricense lo que se traduce en pérdidas\neconómicas, por ejemplo en el pago de servicios de transporte de los\ncontenedores así como el riesgo de que el producto pierda calidad y precio o\ninclusive provoque que del no todo no se pueda\nexportar.\n\n5. Que el problema de una retractación de las exportaciones traería como consecuencia inmediata una\nafectación a todos los eslabones que componen al sector pesquero nacional. 6-Que el mercado\ncostarricense es muy vulnerable por su tamaño tanto geográfico como poblacional y si no se busca la\nmanera de aumentar las oportunidades de colocación del producto y la producción nacional corre el\nriesgo de quedarse en nuestro territorio, aumentado la oferta de producto a nivel nacional lo que\npodría provocar una caída en los precios y por ende pérdidas económicas para los pescadores\ncostarricenses.\n\n6. Que por medio del oficio\nDM-004-2019, se refiere\na recomendaciones sobre procedimiento\npara \"exportaciones de productos pesqueros\nde especies CITES, planteado por las empresas\nexportadoras, ante demoras\nque actualmente se tienen para los tramites\ny permisos en CITES\".\n\n7. Que la Dirección General Técnica y la Asesoría\nJurídica del Incopesca, han atendido la solicitud de\nlas empresas exportadoras y por medio del oficio AL 18-02-19, recomiendan a la\nJunta Directiva el análisis para la aprobación del presente Manual de\nProcedimientos; razón por la cual la Junta Directiva, POR TANTO;\n\nAcuerda\n\n1. Aprobar el Manual de Procedimiento para\nExportaciones de Productos Pesqueros que Requieran Permiso Cites.\n\n2. El presente Manual se refiera al procedimiento para la exportación de productos pesqueros que\nrequieren permiso CITES y que ha sido acopiados previamente en Plantas de Almacenamiento,\ndebidamente autorizadas paras tal propósito.\n\n3-Se deberá seguir el siguiente Esquema de\nManipulación y Simplificación de trámites de Exportación para productos\npesqueros que requieran Permiso CITES.\n\nMANUAL DE\nPROCEDIMIENTO PARA EXPORTACIONES DE PRODUCTOS PESQUEROS QUE REQUIERAN PERMISOS\nCITES\n\nDescripción del Proceso\n\nRecibo en Planta: Es la etapa\ninicial del proceso, consiste en la entrada de los productos en planta. En esta\netapa, se realizan los chequeos organolépticos y de inocuidad del producto. Si\nel producto viene fresco pero no congelado, se le introduce a un túnel de frío\ncon el objetivo de que el producto lleve un golpe de frío y este se congele\nrápidamente y preservar la calidad del producto, cuando lo requiera.\n\nEn esta etapa, se le asigna un número de\nlote o código; lo que permite llevar la trazabilidad y control del producto\n(os).\n\nAlmacenamiento en\ncámaras de frío o bodegas: Una vez que los productos han pasado los chequeos\nprevios, se introduce a las cámaras de frío o bodegas, para que estos se\nmantengan hasta el momento del despacho.\n\nEs importante hacer énfasis que la planta de\nproceso, debe estar debidamente registrada ante SENASA y que se encuentra\nautorizada como exportadora.\n\nEn esta etapa, se comunica a las autoridades\ncompetentes y sanitarias sobre la decisión de exportar. That for the national fisheries sector it is of\ngreat importance to keep International Conventions current as well as\nto maintain price stability in the national and international\nmarket.\n\n2. That Incopesca, in accordance with Law 8436, the Fisheries and Aquaculture Law, is the\nexecuting authority thereof and the entity specialized in the matter, as determined by\nLaw 7384, the Law Creating the Costa Rican Institute of Fisheries and Aquaculture.\n\n3. That Incopesca, in accordance with Executive Decree 40379-MINAE-MAG, which reforms Article 1\nof the Decree on the Administrative Authority and Scientific Authorities of the\nConvention on International Trade in Endangered Species of Wild Flora and Fauna (CITES), is the CITES scientific authority (autoridad científica) in matters of Fisheries and\nAquaculture and the Ministry of Agriculture and Livestock is the administrative authority (autoridad administrativa), it being the case that the latter delegated\nthe responsibility to the National Animal Health Service, SENASA.\n\n4. That based on the requirements demanded by compliance with the CITES Convention at the international level, in\nrelation to the commercialization of silky shark (tiburón sedoso) (CITES), there is a\ndirect impact on the export procedures for fishery products due to the great delay in the processing of permits by\nimporters, which translates into a considerable number of days of waiting for\nthe Costa Rican fisheries sector, which translates into economic\nlosses, for example in the payment of container transportation\nservices as well as the risk that the product loses quality and price or\neven causes that not all of it can be exported.\n\n5. In this\nstage, organoleptic and food safety (inocuidad) checks of the product are carried out.
