  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 005\n\n                        Delimitación de zona pública de un sector costero de playa San Josecito\n\nTexto Completo acta: 12F33E\n\nINSTITUTO\nGEOGRÁFICO NACIONAL\n\nDEPARTAMENTO\nTOPOGRÁFICO\n\nY\nOBSERVACIÓN DEL TERRITORIO\n\nAVISO Nº\n2019-005\n\nZONA\nMARÍTIMA TERRESTRE\n\nDelimitación\nde zona pública de un sector\n\ncostero\nde playa San Josecito\n\nCon fundamento en\nlas facultades que confiere el artículo 140 y artículo 240 inciso 1) de la Ley\nNº 6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59\nde creación del Instituto Geográfico Nacional, la Ley Nº 8905 de traslado del\nInstituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la\nZona Marítimo Terrestre, del 02 de marzo de 1977, y su respetivo reglamento.\n\nConsiderando:\n\n1º-Que mediante\nLey Nº 8905, se establece el Instituto Geográfico Nacional, como una\ndependencia del Registro Nacional y que la Junta Administrativa del Registro\nNacional administrará el presupuesto del Instituto, suscribirá los contratos y\nconvenios necesarios para el ejercicio de sus funciones. Asimismo, se establece\nque el Instituto Geográfico Nacional será la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a\nlos estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2º-Que la Ley de\nCreación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3°-Que de\nconformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº\n59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la\ncompetencia del Instituto Geográfico Nacional para la delimitación de la zona\npública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta, mientras que el artículo 63\ndel mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4°-Que en el\nDecreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\", se establece\nsegún el artículo 18 que para la delimitación de la zona pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se\nindican en los artículos 19 y 20, correspondientes a la delimitación de la zona\npública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o\na la delimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el\nDecreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a\nla Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección\ncartográfica asociada CRTM05, como el sistema oficial al cual deben estar\nreferidas las coordenadas de todos los trabajos geodésicos, cartográficos y\ncatastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\";   "body_en_text": "throughout the entire text\n\n-\n\nComplete Text of Standard 005\n\nDelimitation of the public area of a coastal sector of San Josecito beach\n\nComplete Text of record: 12F33E\n\nNATIONAL GEOGRAPHIC INSTITUTE\n\nTOPOGRAPHIC AND TERRITORY OBSERVATION DEPARTMENT\n\nNOTICE No. 2019-005\n\nMARITIME TERRESTRIAL ZONE\n\nDelimitation of the public area of a coastal sector of San Josecito beach\n\nBased on the powers conferred by Article 140 and Article 240, subsection 1) of Law No. 6227, General Law of Public Administration, and the provisions of Law No. 59 creating the National Geographic Institute, Law No. 8905 transferring the National Geographic Institute to the National Registry, Law No. 6043 on the Maritime Terrestrial Zone, dated March 2, 1977, and its respective regulation.\n\nConsidering:\n\n1°-That by Law No. 8905, the National Geographic Institute is established as a dependency of the National Registry, and that the Administrative Board of the National Registry shall administer the Institute's budget and execute the contracts and agreements necessary for the performance of its functions. Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographic description of the Republic of Costa Rica, as well as for studies, research, or work, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.\n\n2°-That Law No. 59 Creating the National Geographic Institute establishes it permanently and on behalf of the State as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature that originate from the tasks entrusted to it.\n\n3°-That in accordance with Law No. 59 Creating the National Geographic Institute (IGN), Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public area of the Maritime Terrestrial Zone and its formalization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public area.\"\n\n4°-That in Executive Decree No. 36642-MP-MOPTMINAET, \"Regulation of Specifications for the Delimitation of the public area of the Maritime Terrestrial Zone,\" it is established, according to Article 18, that for the delimitation of the public area of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public area of the Maritime Terrestrial Zone through the placement of survey markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical certainty to interested parties.\n\n5°-That in Executive Decree No. 33797-MJ-MOPT, which, among other aspects, designates the National Geodetic Network Horizontal Reference CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral work executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Network Horizontal Reference CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public entity, person, or national or foreign private entity must be referenced.\"; while Article 7° indicates that \"As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, through appropriate means, that information which has been formalized.\"\n\n6°-That georeferencing to the national coordinate system as a mechanism to delimit the public area of the Maritime Terrestrial Zone enables the correct delimitation of the public area for the purposes of preparing regulatory plans, approving survey plans, granting concessions in the Restricted Zone, and other aspects of coastal land-use planning.\n\n7°-That the georeferenced digital information on the delimitation of the public area of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n8°-That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\",\n\nb) Executive Decree No. 33797-MJ-MOPT \"Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public area of the Maritime Terrestrial Zone.\"\n\n9°-That Article 16 of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit, on the ground, the boundaries of the areas that make up the State Natural Heritage.\n\n10.-The National Geographic Institute used the methodology of \"Georeferenced Digital Delimitation\" to delimit the public area of the Maritime Terrestrial Zone in several sectors of Punta Guapinol located in district 06 Bahía Drake, canton 05 Osa, province 06 Puntarenas.\n\n11.-That the inputs generated from the Program for the Regularization of the Cadastre and Registry, Loan Contract 1284/OC-CR, for the sector subject to this notice were used.\n\n12.-That the delimitation carried out has internal technical endorsement in accordance with official communication No. DIG-TOT-0168-2019 of May 21, 2019, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the National Geographic Institute.\n\n13.-That Article 140 of Law No. 6227, General Law of Public Administration, states that \"the administrative act shall take effect after it is communicated to the administered party, except if it grants only rights, in which case it shall take effect from the time it is adopted,\" a provision that must necessarily be related to subsection 204) of the same regulatory body, which defines the appropriate instrument for communicating acts of a generic nature by stating: \"General acts shall be communicated by publication, and specific acts by notification.\"\n\nCOMMUNICATES:\n\n1°-The National Geographic Institute used the \"Georeferenced Digital Delimitation\" to the national coordinate system to delimit the public area of the Maritime Terrestrial Zone in a coastal sector of San Josecito beach, district 06 Bahía Drake, canton 05 Osa, province 06 Puntarenas.\n\n2°-The public area of the Maritime Terrestrial Zone in a coastal sector of San Josecito beach, district 06 Bahía Drake, canton 05 Osa, province 06 Puntarenas, determined in the official cartographic projection system of Costa Rica, CRTM05, from Map MBCR-1/50,000 Sheet Llorona, corresponds to:\n\nSector of georeferenced digital line\n\n\n\n| San Josecito Beach: |  |  |  |\n| --- | --- | --- | --- |\n| Sector | Coordinates | North | East |\n| 1 | CRTM05 | 955625.9016 | 529797.3744 |\n| CRTM05 | 956163.0940 | 531348.6020 |  |\n\n\n\n3°-The coastal sectors of San Josecito beach, district 06 Bahía Drake, canton 05 Osa, province 06 Puntarenas, that currently have a delimitation of the public area of the Maritime Terrestrial Zone through the placement of survey markers (mojones) and their respective publication in the Official Gazette La Gaceta, maintain their official status.\n\n5°-The official technical data of the \"Georeferenced Digital Delimitation\" of the public area of the Maritime Terrestrial Zone of San Josecito beach, district 06 Bahía Drake, canton 05 Osa, province 06 Puntarenas, have been recorded in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN, and in file 101C of the IGN's ZMT registry.-Curridabat, June 21, 2019."
