Asimismo, se establece\nque el Instituto Geográfico Nacional será la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a\nlos estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los\nprocesos de planificación.\n\n2º-Que la Ley de\nCreación del Instituto Geográfico Nacional, Nº 59, lo constituye de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República,\nextendiéndose su autoridad a las actividades de cualquier orden que tengan por\norigen los trabajos confiados a su cargo.\n\n3º-Que de\nconformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº\n59, en el artículos 62 del Reglamento a la Ley Nº 6043, se reconoce la\ncompetencia del Instituto Geográfico Nacional para la delimitación de la zona\npública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta, mientras que el artículo 63\ndel mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4º-Que en el\nDecreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\", se establece\nsegún el artículo 18° que para la delimitación de la zona pública de la Zona\nMarítimo Terrestre, el IGN podrá acudir a dos metodologías de ejecución, que se\nindican en los artículos 19 y 20, correspondientes a la delimitación de la zona\npública de la Zona Marítimo Terrestre a través de la colocación de mojones y/o\na la delimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5º-Que en el\nDecreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a\nla Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección\ncartográfica asociada CRTM05, como el sistema oficial al cual deben estar\nreferidas las coordenadas de todos los trabajos geodésicos, cartográficos y\ncatastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública,\npersona o entidad privada nacional o extranjera.\"; mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\n6º-Que la\ngeorreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes reguladores,\nel visado de planos de agrimensura, el otorgamiento de concesiones en la Zona\nRestringida y otros aspectos de ordenamiento territorial costero.\n\n7º-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT).\n\n8º-Que la\nGeodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en\naplicación de la regulación establecida por: a) el Decreto Ejecutivo Nº 7841-P\n\"Reglamento a la Ley Nº 6043 sobre la Zona Marítimo Terrestre\",\n\nb) el Decreto\nEjecutivo Nº 33797-MJ-MOPT \"Declara como datum horizontal oficial para Costa\nRica, el CR05, y su proyección cartográfica asociada, CRTM05\", y c) el Decreto\nEjecutivo Nº 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para la\nDelimitación de la zona pública de la Zona Marítimo Terrestre\".\n\n9°-Que el\nartículo 16° de la Ley Forestal, Ley Nº7575 del 13 de febrero de 1996,\nestablece que el Ministerio del Ambiente y Energía delimitará en el terreno los\nlinderos de las áreas que conforman el Patrimonio Natural del Estado.\n\n10.-El Instituto\nGeográfico Nacional, utilizó la metodología de \"Delimitación Digital\nGeorreferenciada\" para delimitar la zona pública de la Zona Marítimo Terrestre\nen nueve sectores de costa en el distrito 03 Sierpe, cantón 05 Osa;\nprovincia 06 Puntarenas.\n\n11.-Que la\ndelimitación realizada cuenta con aval técnico interno conforme al oficio N°\nDIG-TOT-0210-2019 del 28 de mayo de 2019, emitido por el Subproceso de Limites\nOficiales del Departamento Topográfico y Observación del Territorio del\nInstituto Geográfico Nacional.\n\n12.-Que el\nartículo 140 de la Ley Nº 6227 General de la Administración Pública señala que\n\"el acto administrativo producirá su efecto después de comunicado al\nadministrado, excepto si le concede únicamente derechos, en cuyo caso lo\nproducirá desde que se adopte\", disposición que necesariamente debe\nrelacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define\nel instrumento idóneo para comunicar actos de naturaleza genérica al señalar\nque: \"Se comunicaran por publicación los actos generales y por notificación,\nlos concretos\".\n\nCOMUNICA:\n\n1º-Que en los\nmeses de abril a junio de 2019 el Instituto Geográfico Nacional utilizó la\n\"Delimitación Digital Georreferenciada\" al sistema nacional de coordenadas,\npara delimitar nueve sectores de la zona pública de la Zona Marítimo Terrestre\ndel distrito 03 Sierpe, cantón 05 Osa; Likewise, it is established\nthat the Instituto Geográfico Nacional will be the scientific and technical dependency\ngoverning national cartography, responsible for the execution of the official Basic Map\nand the basic geographic Description of the Republic of Costa Rica, and for\nthe studies, research, or work and the development of national\npolicies of a cartographic, geographic, geodetic, geophysical, and\nsimilar nature related to such works, in order to support\nplanning processes.\n\n2º-That the Law Creating the Instituto Geográfico Nacional, No. 59, establishes it on a permanent basis\nand in representation of the State, as the official authority in geodetic\nmatters and in the spatial representation of the geography of the Republic,\nits authority extending to activities of any nature that have their\norigin in the work entrusted to it.\n\n3º-That in accordance with the Law Creating the Instituto Geográfico Nacional (IGN), No.\n59, Article 62 of the Regulations to Law No. 6043, recognizes the\ncompetence of the Instituto Geográfico Nacional for the delimitation of the public\nzone of the Maritime Terrestrial Zone, and its officialization through\npublication in the Official Gazette La Gaceta, while Article 63\nof the same Regulations states that \"The Instituto Geográfico Nacional must\npublish a notice in the Official Gazette, for each portion of the\nmaritime-terrestrial zone where it has demarcated the public zone.\"\n\n4º-That Executive Decree No. 36642-MP-MOPTMINAET \"Regulations on Specifications for\nthe Delimitation of the public zone of the Maritime Terrestrial Zone,\" establishes\nunder Article 18° that for the delimitation of the public zone of the Maritime\nTerrestrial Zone, the IGN may resort to two execution methodologies, as indicated\nin Articles 19 and 20, corresponding to the delimitation of the public\nzone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or\nthe georeferenced digital delimitation, in order to expedite the\ndelimitations and provide greater technical certainty to interested parties.\n\n5º-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines,\nthe National Geodetic Horizontal Reference Network CR05, and its\nassociated cartographic projection CRTM05, as the official system to which the\ncoordinates of all geodetic, cartographic, and cadastral works executed in our\ncountry must be referenced, specifically stating in Article 11 that: \"The\nNational Geodetic Horizontal Reference Network CR05 and\nthe cartographic projection system CRTM05 shall constitute the only official\ncoordinate system for the Republic of Costa Rica, from which\nall cartographic and geodetic surveys and activities carried out in\nthe National Territory by any public agency, private national or foreign\nperson or entity must be referenced.\"; while Article 7\nindicates that \"As cartographic data is produced in the new\ncartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish by\nappropriate means that information that has been made official.\"\n\n6º-That georeferencing to the national coordinate system as a mechanism for\ndelimiting the public zone of the Maritime Terrestrial Zone, enables the correct\ndelimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores),\nthe approval of survey plans (planos de agrimensura), the granting of concessions in the Restricted\nZone, and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\n7º-That the georeferenced digital information on the delimitation of the public zone of\nthe Maritime Terrestrial Zone held by the IGN, is called the Georeferenced Digital Geodatabase\n(Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the\nMaritime Terrestrial Zone (ZMT).\n\n8º-That the Georeferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional\n(IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the\napplication of the regulations established by: a) Executive Decree No. 7841-P\n\"Regulations to Law No. 6043 on the Maritime Terrestrial Zone\",\n\nb) Executive\nDecree No. 33797-MJ-MOPT \"Declares as the official horizontal datum for Costa\nRica, CR05, and its associated cartographic projection, CRTM05\", and c) Executive\nDecree No. 36642-MP-MOPT-MINAET \"Regulations on Specifications for the\nDelimitation of the public zone of the Maritime Terrestrial Zone\".\n\n9°-That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996,\nestablishes that the Ministry of Environment and Energy will demarcate on the ground the\nboundaries of the areas that make up the Natural Heritage of the State.\n\n10.-The Instituto\nGeográfico Nacional used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone\nin nine coastal sectors in district 03 Sierpe, canton 05 Osa;\nprovince 06 Puntarenas.\n\n11.-That the\ndelimitation carried out has internal technical endorsement according to official letter No.\nDIG-TOT-0210-2019 of May 28, 2019, issued by the Official Limits Sub-process\nof the Topographic and Territory Observation Department of the\nInstituto Geográfico Nacional.\n\n12.-That\nArticle 140 of Law No. 6227, the General Public Administration Act, states that\n\"the administrative act shall produce its effect after it has been communicated to the\nadministered party, except if it grants only rights, in which case it\nshall produce it from the time it is adopted\", a provision that must necessarily\nbe related to numeral 204) of the same regulatory body, which defines\nthe suitable instrument for communicating acts of a general nature by stating\nthat: \"Acts of a general nature shall be communicated by publication and specific acts,\nby notification.\"\n\nCOMMUNICATES:\n\n1º-That in the\nmonths of April to June 2019, the Instituto Geográfico Nacional used the\n\"Georeferenced Digital Delimitation\" to the national coordinate system,\nto delimit nine sectors of the public zone of the Maritime Terrestrial Zone\nin district 03 Sierpe, canton 05 Osa;
