Asimismo, se establece\nque el Instituto Geográfico Nacional será la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico\noficial y la Descripción básica geográfica de la República de Costa Rica y a\nlos estudios, las investigaciones o labores y el desarrollo de políticas\nnacionales de carácter cartográfico, geográfico, geodésico, geofísico y de\níndole similar que tenga relación con dichas obras, con el fin de apoyar los procesos\nde planificación.\n\n2º-Que la Ley de\nCreación del Instituto Geográfico Nacional, N° 59, lo constituye de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República, extendiéndose\nsu autoridad a las actividades de cualquier orden que tengan por origen los\ntrabajos confiados a su cargo.\n\n3°-Que de\nconformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N°\n59, en el artículos 62 del Reglamento a la Ley N° 6043, se reconoce la\ncompetencia del Instituto Geográfico Nacional para la delimitación de la zona\npública de la Zona Marítimo Terrestre, y su oficialización a través de\npublicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar\naviso en el Diario Oficial, de cada porción de la zona marítimo-terrestre en\nque haya demarcado la zona pública\".\n\n4°-Que en el\nDecreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\", se establece\nsegún el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo\nTerrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican\nen los artículos 19 y 20, correspondientes a la delimitación de la zona pública\nde la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el\nDecreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a\nla Red Geodésica Nacional de Referencia Horizontal CR05, y su proyección\ncartográfica asociada CRTM05, como el sistema oficial al cual deben estar\nreferidas las coordenadas de todos los trabajos geodésicos, cartográficos y\ncatastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema\noficial de coordenadas para la República de Costa Rica a partir del cual se\ndebe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona\no entidad privada nacional o extranjera.\"; mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\n6°-Que la\ngeorreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n7°-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT).\n\n8°-Que la\nGeodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en\naplicación de la regulación establecida por: a) el Decreto Ejecutivo N°\n7841-P \"Reglamento a la Ley N° 6043 sobre la Zona Marítimo Terrestre\",\n\nb) el Decreto Ejecutivo N° 33797-MJ-MOPT\n\"Declara como datum horizontal oficial para Costa Rica, el CR05, y su\nproyección cartográfica asociada, CRTM05\", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre\".\n\n9°- Que el\nartículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996,\nestablece que el Ministerio del Ambiente y Energía delimitará en el terreno\nlos linderos de las áreas que conforman el Patrimonio Natural del Estado.\n\n10.-El Instituto\nGeográfico Nacional, utilizó la metodología de \"Delimitación Digital\nGeorreferenciada\" para delimitar la zona pública de la Zona Marítimo Terrestre\nen nueve sectores de costa en el distrito 01 Golfito, cantón 07 Golfito; Likewise, it is established\nthat the National Geographic Institute shall be the scientific and technical dependency\ngoverning national cartography, responsible for the execution of the official Basic Map\nand the basic geographic Description of the Republic of Costa Rica, and for\nthe studies, investigations, or work and the development of national\npolicies of a cartographic, geographic, geodetic, geophysical, and\nsimilar nature related to said works, in order to support planning\nprocesses.\n\n2º-That the Law\nCreating the National Geographic Institute, No. 59, constitutes it permanently\nand on behalf of the State, as the official authority in geodetic matters\nand the spatial representation of the geography of the Republic, its\nauthority extending to activities of any kind originating from the\nworks entrusted to its charge.\n\n3°-That in\naccordance with the Law Creating the National Geographic Institute (IGN),\nNo. 59, Article 62 of the Regulation to Law No. 6043 recognizes the\ncompetence of the National Geographic Institute for the delimitation of the public\nzone of the Maritime Terrestrial Zone, and its officialization through\npublication in the Official Gazette La Gaceta, while Article 63 of the same\nRegulation states that \"The National Geographic Institute must publish\na notice in the Official Gazette, for each portion of the maritime-terrestrial zone in\nwhich it has demarcated the public zone.\"\n\n4°-That in\nExecutive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for\nthe Delimitation of the public zone of the Maritime Terrestrial Zone\", it is established\nunder Article 18 that for the delimitation of the public zone of the Maritime\nTerrestrial Zone, the IGN may resort to two execution methodologies, as indicated\nin Articles 19 and 20, corresponding to the delimitation of the public zone\nof the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or the\ngeoreferenced digital delimitation, this with the purpose of expediting\ndelimitations and providing greater technical security to interested parties.\n\n5°-That in\nExecutive Decree No. 33797-MJ-MOPT, which among other aspects designates\nthe National Geodetic Network of Horizontal Reference CR05, and its\nassociated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic, cartographic, and\ncadastral works executed in our country must be referenced, specifically stating in\nArticle 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and\nthe cartographic projection system CRTM05 shall constitute the sole official\ncoordinate system for the Republic of Costa Rica, from which\nall cartographic and geodetic surveys and activities carried out in the\nNational Territory by any public agency, person,\nor private national or foreign entity must be referenced.\"; while Article 7\nindicates that \"As cartographic data is produced in the new\ncartographic projection system CRTM05, the National Geographic Institute shall publish by\nappropriate means that information which has been officialized.\"\n\n6°-That\ngeoreferencing to the national coordinate system as a mechanism for\ndelimiting the public zone of the Maritime Terrestrial Zone enables the correct\ndelimitation of the public zone for the purposes of preparing regulatory\nplans, approving survey plans, granting concessions\nin the Restricted Zone, and other aspects of coastal land-use planning.\n\n7°-That the\ngeoreferenced digital information on the delimitation of the public zone of\nthe Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital\nDatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute\n(IGN) on the\nMaritime Terrestrial Zone (ZMT).\n\n8°-That the\nGeoreferenced Digital Database (GDG) of the National Geographic Institute\n(IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on\napplication of the regulations established by: a) Executive Decree\nNo. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\",\n\nb) Executive Decree No. 33797-MJ-MOPT\n\"Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica\",\nand c) Executive Decree No. 36642-MP-MOPT-MINAET\n\"Regulation of Specifications for the Delimitation of the public zone of the\nMaritime Terrestrial Zone\".\n\n9°- That Article\n16 of the Forestry Law, Law No. 7575 of February 13, 1996,\nestablishes that the Ministry of Environment and Energy shall delimit on the ground\nthe boundaries of the areas that make up the Natural Heritage of the State.\n\n10.-The National\nGeographic Institute used the \"Georeferenced Digital Delimitation\" methodology\nto delimit the public zone of the Maritime Terrestrial Zone\nin nine coastal sectors in district 01 Golfito, canton 07 Golfito;
