Se considerarán\ninfracciones leves, sin perjuicio de que constituya delito, las siguientes:\n\n[ ... ]\n\nd) Importar al territorio nacional o entregar envases, recipientes o\nempaques de poliestireno expandido en cualquier establecimiento comercial.\n\nTransitorio XIII- La prohibición contenida en el artículo 42 bis de esta\nley empezará a regir veinticuatro meses después de la entrada en vigencia de la\npresente ley.\n\nDentro de los veinticuatro meses mencionados en el presente artículo, el\nEstado promoverá e incentivará la reconversión productiva de las industrias\ndedicadas a la importación y fabricación de recipientes, envases o empaques\nelaborados con poliestireno expandido, fomentando el desarrollo de alternativas\nproductivas más amigables con el ambiente. Para estos fines, dichas industrias\ntendrán la posibilidad de acceder al crédito para su desarrollo, de conformidad\ncon lo establecido en el artículo 7 de la Ley N. º 8634, Sistema de Banca para\nel Desarrollo, de 23 de abril de 2008 y la banca comercial estatal, de\nconformidad con lo dispuesto en la Ley N.º 1644, Ley Orgánica del Sistema\nBancario Nacional, de 26 de setiembre de 1953.\n\nTransitorio XIV- Dentro de los seis meses posteriores a la publicación\nde esta reforma, el Ministerio de Salud deberá incluir en la política nacional\ny en el Plan Nacional de Gestión Integral de Residuos, un plan nacional para\nincentivar la sustitución paulatina de los recipientes, envases o empaques de\npoliestireno expandido por otros de materiales distintos. Dicho plan deberá\nincluir un componente de concienciación en industrias, comercios y población en\ngeneral, sobre la necesidad de dar este cambio, así como establecer incentivos\ne informar y educar a las personas consumidoras acerca del impacto de los\nproductos elaborados a base de poliestireno expandido sobre el ambiente y las\ndiversas alternativas disponibles, esto como parte de sus obligaciones, según\nel inciso g)del artículo 7 de la Ley N. º 8839, Ley de Gestión Integral de\nResiduos, de 24 de junio de 2010.\n\nTransitorio XV- Para el cumplimiento de lo dispuesto en el segundo\npárrafo del artículo 42 bis, que se adiciona mediante esta ley, el Poder\nEjecutivo tendrá un plazo hasta de seis meses.\n\nRige a partir de su publicación.\n\nDado en la Presidencia de la República, San José, a los quince días del\nmes de julio del año dos mil diecinueve.\n\nEjecútese y publíquese.",

The texts are as follows:\n\nArticle 42 bis- The importation into the national territory, the commercialization, and the provision of expanded polystyrene containers and receptacles in any commercial establishment are prohibited.\n\nThe following are exempted from this prohibition:\n\na) Cases in which, for reasons of conservation or protection of the products, the use of alternative materials is not environmentally viable.\n\nb) Packaging for household appliances and related items.\n\nc) Industrial uses.\n\nNotwithstanding the foregoing, the Executive Branch, through the regulation of this law, may define new cases of exception, based on technical criteria.\n\nArticle 50- Minor infractions and their penalties. The following shall be considered minor infractions, without prejudice to whether they constitute a crime:\n\n[ ... ]\n\nd) Importing into the national territory or providing expanded polystyrene containers, receptacles, or packaging in any commercial establishment.\n\nTransitory Provision XIII- The prohibition contained in article 42 bis of this law shall take effect twenty-four months after the entry into force of this law.\n\nWithin the twenty-four months mentioned in this article, the State shall promote and incentivize the productive reconversion of industries engaged in the importation and manufacture of receptacles, containers, or packaging made from expanded polystyrene, fostering the development of more environmentally friendly productive alternatives. For these purposes, such industries shall have the possibility of accessing credit for their development, in accordance with the provisions of article 7 of Law No. 8634, Development Banking System, of 23 April 2008, and state commercial banks, in accordance with the provisions of Law No. 1644, Organic Law of the National Banking System, of 26 September 1953.\n\nTransitory Provision XIV- Within six months after the publication of this reform, the Ministry of Health must include in the national policy and in the National Plan for Integrated Waste Management a national plan to incentivize the gradual substitution of expanded polystyrene receptacles, containers, or packaging with those made of different materials. Said plan must include a component of awareness-raising in industries, businesses, and the general population about the need to make this change, as well as establishing incentives and informing and educating consumers about the impact of products made from expanded polystyrene on the environment and the various available alternatives, this as part of its obligations, pursuant to subsection g) of article 7 of Law No. 8839, Law for Integrated Waste Management, of 24 June 2010.\n\nTransitory Provision XV- For compliance with the provisions of the second paragraph of article 42 bis, which is added through this law, the Executive Branch shall have a period of up to six months.\n\nIt shall be effective upon its publication.\n\nGiven at the Presidency of the Republic, San José, on the fifteenth day of the month of July of the year two thousand nineteen.\n\nLet it be executed and published."
