140 y artículo 240 inciso 1 de la Ley Nº\n6227 General de la Administración Pública, y en lo dispuesto en la Ley Nº 59 de creación del\nInstituto Geográfico Nacional, la Ley Nº 8905 de traslado del Instituto Geográfico Nacional al\nRegistro Nacional, la Ley Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su\nrespetivo reglamento.\n\nConsiderando:\n\n1º-Que mediante Ley Nº 8905, se establece el Instituto Geográfico Nacional, como una dependencia del\nRegistro Nacional y que la Junta Administrativa del Registro Nacional administrará el presupuesto\ndel Instituto, suscribirá los contratos y convenios necesarios para el ejercicio de sus funciones.\nAsimismo, se establece que el Instituto Geográfico Nacional será la dependencia científica y técnica\nrectora de la cartografía nacional, destinada a la ejecución del Mapa básico oficial y la\nDescripción básica geográfica de la República de Costa Rica y a los estudios, las investigaciones o\nlabores y el desarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico,\ngeofísico y de índole similar que tenga relación con dichas obras, con el fin de apoyar los procesos\nde planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico\nNacional, Nº 59, lo constituye\nde manera permanente y en representación del Estado, como la autoridad\noficial en materia geodésica y de\nla representación espacial de la geografía de la República, extendiéndose su\nautoridad a las actividades de cualquier orden que tengan\npor origen los trabajos confiados a su cargo.\n\n3º-Que de conformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), Nº 59, en el\nartículo 62 del Reglamento a la Ley Nº 6043, se reconoce la competencia del Instituto Geográfico\nNacional para la delimitación de la zona pública de la Zona Marítimo Terrestre, y su oficialización\na través de publicación en el Diario Oficial La Gaceta, mientras que el artículo 63 del mismo\nReglamento, señala que \"El Instituto Geográfico Nacional deberá publicar aviso en el Diario Oficial,\nde cada porción de la zona marítimo-terrestre en que haya demarcado la zona pública\".\n\n4º-Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para la\nDelimitación de la zona pública de la Zona Marítimo Terrestre\", se establece según el artículo 18º\nque para la delimitación de la zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la colocación de mojones\ny/o a la delimitación digital georreferenciada, esto con el fin de agilizar las delimitaciones y\nproporcionar mayor seguridad técnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como\nel sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo\n11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad\nprivada nacional o extranjera.\" ; mientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico\nNacional publicará por los medios adecuados aquella información que se ha oficializado.\"\n\n6º-Que la\ngeorreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n7º-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, aimed at the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica and at the studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical and similar nature related to said works, in order to support planning processes.\n\n2º-That the Law Creating the National Geographic Institute, No. 59, establishes it permanently and on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the work entrusted to it.\n\n3º-That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4º-That in Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,\" it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may use two execution methodologies, as indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, in order to expedite delimitations and provide greater technical security to interested parties.\n\n5º-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities carried out in the National Territory by any public agency, person, or private national or foreign entity must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new CRTM05 cartographic projection system, the National Geographic Institute shall publish, by appropriate means, that information which has been made official.\"\n\n6º-That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans (planes reguladores), the approval of survey plans (planos de agrimensura), the granting of concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\n7º-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n8º-That the Digital Georeferenced Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by:\n\na) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\",\n\nb) Executive Decree No. 33797-MJ-MOPT \"Declares the CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.\"\n\n9º-That Article 16 of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit the boundaries on the ground of the areas that make up the Natural Heritage of the State.\n\n10.-The National Geographic Institute, together with the Tempisque Conservation Area (Área de Conservación Tempisque), used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Playa Coyote; located in district 06 Bejuco, canton 09 Nandayure; province 05 Guanacaste, in accordance with proceedings carried out by José Miguel Valverde Rodríguez, ID number 5-0199-0696 and Fabián Jesús Bonilla Salguero, ID number 1-1282-0908 before the National Geographic Institute.\n\n11.-That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0230-2019 of June 20, 2019, issued by the Official Limits Subprocess of the Topographic Department and Territory Observation of the National Geographic Institute.\n\n12.-That the delimitation carried out had the accompaniment of the Tempisque Conservation Area, National System of Conservation Areas (Sistema Nacional de Áreas de Conservación), for the demarcation of the public zone in the mangrove ecosystem sector, in accordance with official letter ACT-OR-DR-684-19 dated June 3, 2019.\n\n13.-That Article 140 of the General Public Administration Law No. 6227 states that \"the administrative act shall produce its effect after it has been communicated to the administered party, except if it grants only rights, in which case it shall produce it from the moment it is adopted,\" a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating: \"General acts shall be communicated by publication, and specific ones, by notification.\"\n\nHEREBY NOTIFIES:\n\nFirst.-That on May 15, 2019, the \"Georeferenced Digital Delimitation to the national coordinate system to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Playa Coyote; located in district 06 Bejuco, canton 09 Nandayure; province 05 Guanacaste\" was carried out.\n\nSecond.-The work for determining the public zone of the Maritime Terrestrial Zone was carried out on May 15, 2019, with the accompaniment of the Tempisque Conservation Area;
