A las ocho horas con diez minutos del cuatro de\njunio del dos mil diecinueve.\n\nResultando:\n\nI.-Que en reunión de personal del ACOPAC del día 26 de marzo del 2019, y\nsegún minuta levantada de dicha reunión, en el punto 5. \"Traslado de la Sede\nRegional a Orotina\", se toma el acuerdo de conformar una comisión que trabaje\nen los insumos legales y técnicos para establecer formalmente otra oficina\nsubregional, que asuma la atención de los cantones Orotina, San Mateo y\nGarabito, lo anterior debido a la necesidad institucional que se cuenta con el\nmanejo que se refleja por parte de la Oficina Subregional Esparza- Orotina, en\nla atención y operaciones que abarca territorialmente de seis cantones.\n\nII.-Que según oficio SINAC-ACOPAC-D-145-2019, el director de ACOPAC\nnombra oficialmente la comisión y les detalla las tareas a realizar.\n\nIII.-Que el 10 de abril del 2019, se reúne la comisión, según consta en\nla minuta levantada para tal efecto, donde se analiza la necesidad\ninstitucional de creación de la nueva oficina y se define el contenido de la\npropuesta.\n\nIV.-Que el día 06 de mayo del 2019 se reúne el Comité Científico Técnico\ndel ACOPAC, con el fin de conocer la propuesta técnica para la creación de la\nnueva oficina subregional, emitiendo las siguientes recomendaciones:\n\n\"Recomendación 01-01-2019: conocida la propuesta elaborada por la\ncomisión nombrada mediante oficio SINAC-ACOPAC-D-145-2019 y en la cual se\nfundamenta técnicamente la creación de una nueva sub-unidad territorial en Área\nde Conservación Pacífico Central (ACOPAC) la cual tendrá a cargo el\ncumplimiento de las obligaciones conferidas a esta área de conservación por la\nlegislación vigente, en los cantones de Garabito, Orotina y San Mateo y al\namparo de lo estipulado por el artículo 26 del Reglamento a la Ley de\nBiodiversidad 7788, Decreto Ejecutivo N° 34433, el Comité Científico Técnico\ndel ACOPAC recomienda a la Dirección Regional la creación de la nueva\nsub-unidad territorial descrita. Para ello, deberá realizar la publicación de\nla resolución de creación respectiva en el Diario Oficial\n\nLa Gaceta y remitir borrador de decreto ejecutivo ante el Ministerio de\nAmbiente y Energía, a efectos de modificar el decreto de creación de las\noficinas subregionales en lo correspondiente a la actual Oficina Subregional de\nEsparza Orotina y además, modificar el nombre de la Oficina Subregional Aguirre\nParrita a Oficina Subregional Quepos Parrita\".\n\n\"Recomendación 02-01-2019: una vez creada la subunidad\nterritorial indicada en la Recomendación 01-01- 2019, la Dirección Regional del\nÁrea de Conservación Pacífico Central (ACOPAC) deberá dotar al nuevo centro de\ntrabajo los recursos materiales, financieros y humanos adecuados para un buen\nfuncionamiento, proceso en el cual podrá considerar las plazas vacantes existentes\nen el área de conservación y realizar traslados de personal de otros centros de\ntrabajo del ACOPAC, que se considere idóneo\".\n\nV.-Que mediante oficio SINAC-ACOPAC-D-265-2019, el director del área, le\ninforma a la Secretaria Ejecutiva del Sistema Nacional de Áreas de\nConservación, las recomendaciones del Comité Científico Técnico del ACOPAC, así\ncomo un cronograma con las acciones, responsable y plazo para su cumplimiento.\n\nVI.-Que ha solicitud a la Dirección Ejecutiva del SINAC, se remite el\noficio SINAC- ACOPAC-D-284-2019, que contiene la justificación de la propuesta\nde constitución de la nueva subunidad territorial en el Área de Conservación\nPacífico Central (ACOPAC).\n\nVII.-Que tanto la propuesta técnica que justifica la creación de esta\nnueva oficina subregional y los demás documentos generados constan en el\nexpediente administrativo denominado \"Expediente de creación nueva Sub- Unidad\nTerritorial\" N° SINAC-ACOPACD- EXP-14-2019.\n\nConsiderando:\n\n1º-Que el artículo 22 de la Ley de Biodiversidad, crea el Sistema\nNacional de Áreas de Conservación, con personería jurídica instrumental, como\nun sistema de gestión coordinación institucional descentrada y participativa\nque integra las competencias del ministerio en materia forestal, vida silvestre\ny Áreas Protegidas.\n\n2º-Que el artículo 28 de la Ley de Biodiversidad, establece que el\nSistema Nacional de Áreas de Conservación, estará constituido por unidades\nterritoriales denominadas Áreas de Conservación, siendo cada Área de\nConservación una unidad territorial del país delimitada administrativamente,\nregida por una misma estrategia de desarrollo y administración, debidamente\ncoordinada con el resto del sector público.\n\n3º-Que el artículo 24 del Reglamento a la Ley de Biodiversidad manifiesta que las AC podrán\nestablecer las oficinas Subregionales necesarias para asegurar la provisión de los servicios que se\nderiven de la aplicación de la Ley de Biodiversidad y leyes conexas, en relación a lo establecido\nigualmente el en numeral 20 el cual expresa que Las Áreas de Conservación podrán dividirse en\nsubunidades territoriales denominadas Subregiones de las Áreas de Conservación, con base en los\nestudios técnicos respectivos,  manteniendo el principio de dirección y coordinación administrativa.\n\nLas Subregiones de las Áreas de Conservación serán regidas por la misma\nestrategia de desarrollo y administración de las Áreas de Conservación y\ntendrán una oficina.\n\n4º-Así mismo que el artículo 25 de este reglamento indica que serán\nfunciones del Director/a de Área de Conservación, todas las indicadas en el\nordenamiento jurídico y técnico vinculante con sus deberes como superior\njerárquico en el ámbito geográfico a su cargo; además, velará por el\nestablecimiento de la estructura administrativa del Área de Conservación,\ndebiendo considerar aquellos programas que sean propuestos por los CORAC como\nde acatamiento obligatorio y aprobados por el CONAC.\n\nEl Director(a) del AC podrá establecer las subunidades territoriales\nnecesarias para el buen desempeño del Área de Conservación, con fundamento en\nlos estudios técnicos respectivos y con la recomendación del Comité\nCientífico-Técnico correspondiente.\n\nCada Director/a deberá implementar, evaluar y sistematizar, en el AC,\nlas políticas, lineamientos, metodologías, normas y estrategias, asimismo ejecutará\nlas directrices emitidas por el CORAC respectivo, por el CONAC y por la\nSecretaría Ejecutiva.\n\nTambién, velará por la integración y el buen funcionamiento del Comité\nCientífico-Técnico y el Órgano de Administración Financiera, así como por la\ncapacitación, supervisión y bienestar del personal del área de conservación. National System of Conservation Areas. Central Pacific\nConservation Area. At eight hours ten minutes on the fourth of\nJune, two thousand nineteen.\n\nWhereas:\n\nI.-That in a staff meeting of ACOPAC on the 26th of March, 2019, and\naccording to the minutes prepared for said meeting, in point 5. \"Transfer of the Regional Headquarters to Orotina\", the agreement was adopted to form a commission to work\non the legal and technical inputs to formally establish another\nsubregional office, to assume responsibility for the cantons of Orotina, San Mateo and\nGarabito, due to the institutional need derived from the\nworkload reflected by the Esparza-Orotina Subregional Office, in\nthe service and operations that territorially cover six cantons.\n\nII.-That according to official communication SINAC-ACOPAC-D-145-2019, the director of ACOPAC\nofficially appoints the commission and details the tasks to be performed.\n\nIII.-That on the 10th of April, 2019, the commission met, as recorded in\nthe minutes prepared for that purpose, where the institutional\nneed for the creation of the new office was analyzed and the content of the\nproposal was defined.\n\nIV.-That on the 6th of May, 2019, the Scientific Technical Committee\nof ACOPAC met, in order to review the technical proposal for the creation of the\nnew subregional office, issuing the following recommendations:\n\n\"Recommendation 01-01-2019: having reviewed the proposal prepared by the\ncommission appointed via official communication SINAC-ACOPAC-D-145-2019 and which\ntechnically substantiates the creation of a new territorial sub-unit in the Central\nPacific Conservation Area (ACOPAC), which will be responsible for the\nfulfillment of the obligations conferred to this conservation area by the\ncurrent legislation, in the cantons of Garabito, Orotina and San Mateo, and under\nthe protection of the provisions of article 26 of the Regulation to the Biodiversity\nLaw 7788, Decreto Ejecutivo N° 34433, the Scientific Technical Committee\nof ACOPAC recommends to the Regional Directorate the creation of the new\nterritorial sub-unit described. To this end, it must proceed with the publication of\nthe respective creation resolution in the Official Gazette\n\nLa Gaceta and submit a draft executive decree to the Ministry of\nEnvironment and Energy, for the purpose of amending the decree creating the\nsubregional offices, in what corresponds to the current Esparza Orotina Subregional Office, and also, amending the name of the Aguirre Parrita Subregional Office to Quepos Parrita Subregional Office.\"\n\n\"Recommendation 02-01-2019: once the territorial sub-unit\nindicated in Recommendation 01-01-2019 is created, the Regional Directorate of the\nCentral Pacific Conservation Area (ACOPAC) must provide the new work\ncenter with the material, financial, and human resources adequate for proper\nfunctioning, a process in which it may consider the existing vacant positions\nin the conservation area and carry out personnel transfers from other\nwork centers of ACOPAC, deemed suitable.\"\n\nV.-That through official communication SINAC-ACOPAC-D-265-2019, the area director\ninforms the Executive Secretary of the National System of Conservation\nAreas of the recommendations of the Scientific Technical Committee of ACOPAC, as well\nas a timeline with the actions, responsible parties, and deadline for their fulfillment.\n\nVI.-That at the request of the Executive Directorate of SINAC, official\ncommunication SINAC-ACOPAC-D-284-2019 was submitted, containing the justification for the proposal\nto constitute the new territorial sub-unit in the Central Pacific Conservation Area (ACOPAC).\n\nVII.-That both the technical proposal justifying the creation of this\nnew subregional office and the other documents generated are contained in the\nadministrative file (expediente administrativo) called \"Expediente de creación nueva Sub-Unidad\nTerritorial\" N° SINAC-ACOPACD-EXP-14-2019.\n\nConsidering:\n\n1º-That article 22 of the Biodiversity Law creates the National\nSystem of Conservation Areas, with instrumental legal personality, as\na decentralized and participatory institutional coordination management system\nthat integrates the ministry's competencies in forestry, wildlife,\nand Protected Areas matters.\n\n2º-That article 28 of the Biodiversity Law establishes that the\nNational System of Conservation Areas will be constituted by territorial\nunits called Conservation Areas, each Conservation Area being\nan administratively delimited territorial unit of the country,\ngoverned by a single development and administration strategy, duly\ncoordinated with the rest of the public sector.\n\n3º-That article 24 of the Regulation to the Biodiversity Law states that the CAs may\nestablish the necessary Subregional offices to ensure the provision of the services\nderived from the application of the Biodiversity Law and related laws, in relation to what is also established\nin section 20 which expresses that The Conservation Areas may be divided into\nterritorial sub-units called Subregions of the Conservation Areas, based on the\nrespective technical studies, maintaining the principle of administrative direction and coordination.\n\nThe Subregions of the Conservation Areas will be governed by the same\ndevelopment and administration strategy as the Conservation Areas and\nwill have an office.\n\n4º-Likewise, that article 25 of this regulation indicates that the\nfunctions of the Director of the Conservation Area will be all those indicated in the\nlegal and technical framework binding on their duties as hierarchical superior\nin the geographical scope under their charge; furthermore, they will ensure the\nestablishment of the administrative structure of the Conservation Area,\nmust consider those programs proposed by the CORAC as\nmandatory compliance and approved by CONAC.\n\nThe Director of the CA may establish the necessary territorial sub-units\nfor the proper performance of the Conservation Area, based on\nthe respective technical studies and with the recommendation of the corresponding\nScientific-Technical Committee.\n\nEach Director must implement, evaluate, and systematize, in the CA,\nthe policies, guidelines, methodologies, norms, and strategies, and will also execute\nthe directives issued by the respective CORAC, by CONAC, and by the\nExecutive Secretariat.\n\nThey will also ensure the integration and proper functioning of the\nScientific-Technical Committee and the Financial Administration Body, as well as the\ntraining, supervision, and well-being of the conservation area's personnel. Therefore,\n\nTHE DIRECTOR\n\nOF THE CENTRAL PACIFIC CONSERVATION AREA\n\nRESOLVES:\n\nI.-To establish for the Central Pacific Conservation Area, the new\nTerritorial Subunit of Orotina, which shall exercise the functions that the Forestry Law (Ley Forestal)\nand its regulations establish for the State Forestry Administration.\nIn Wildlife matters, the provisions of the Wildlife Law and its Regulation shall continue to be observed, as shall all provisions and internal\nregulations issued by the Administration. Subregional Office is understood to mean the\nsame entity established herein.\n\nII.-The boundaries of the Esparza Subregional Office are modified,\nsegregating from it the cantons of Orotina, San Mateo and Garabito, in their entirety.\n\nIII.-The new Territorial Subunit shall be domiciled in the\ncanton of Orotina and for the purposes of nomenclature and taking into account\narticle 25 of the Regulation to the Biodiversity Law, it shall continue to be called the\nOrotina Subregional Office, in order not to cause confusion to the\ncitizens (administrados).\n\nIV.-The corresponding administrative departments are instructed\nto carry out the pertinent processes to provide the new work\ncenter with the material, financial, and human resources adequate for proper\nfunctioning, a process in which existing vacant positions\nin the conservation area may be considered and personnel transfers from other\nwork centers of ACOPAC deemed pertinent may be carried out.\n\nV.-It enters into force upon its signature.
