Que el\nartículo 50 de la Constitución Política establece que el Estado debe procurar\nel mayor bienestar a todos los habitantes del país; y garantizar y preservar el\nderecho de las personas a un ambiente sano y ecológicamente equilibrado,\npromoviendo el mayor desarrollo en armonía con éste, lo que conlleva una\nactividad de planificación programática para el cumplimiento de metas y de\nfines a los que está llamado.\n\nII. Que de\nconformidad con lo establecido en el inciso f) del artículo 11 del Decreto\nEjecutivo N° 41187-MP-MIDEPLAN, y sus reformas, la Rectoría del sector\nAmbiente, Energía y Mares es ejercida por el Ministro de Ambiente y Energía, de\nigual forma, en el inciso h) del artículo 11 establece que la Rectoría del\nsector Infraestructura y Transporte es ejercida por el Ministro de Obras\nPúblicas y Transportes, por tanto, les corresponde la potestad junto con el\nPresidente de la República, de coordinar, articular y conducir las actividades\nde sus sectores. De igual manera, el artículo 2, b) en relación con el 4, b)\nestablecen las áreas de articulación Presidencial de ordenamiento territorial,\ninfraestructura y movilidad, que tiene como objetivo generar condiciones de\nplanificación urbana, para el logro de espacios urbanos y rurales resilientes,\nsostenibles e inclusivos, integrada entre otros, por el MINAE y el MOPT, cuyos\nJerarcas son Ministros Rectores de sus Sectores y deben coordinar lo necesario\npara el cumplimento de los objetivos propuestos, que incluyen los contenidos en\nel PNTE. Entre sus funciones está la de validar y suscribir las políticas\npúblicas correspondientes a sus competencias para lo cual deben asegurarse que\néstas sean cumplidas conforme a las orientaciones del Plan Nacional de\nDesarrollo y de Inversión Pública.\n\nCon fundamento en\nlas potestades conferidas en los artículos 50, 130, 140 incisos 3), 8) y 18),\n141) y 146) de la Constitución Política; los artículos 25 inciso 1), 27 inciso\n1), 28 inciso 2) acápite b) de la Ley General de la Administración Pública, Ley\nN° 6227 del 2 de mayo de 1978; artículos 1 y 2 inciso a) de la Ley Orgánica del\nMinisterio de Ambiente y Energía, Ley N° 7152 del 5 de junio de 1990 y sus\nreformas; La Ley de Planificación Nacional, N° 5525 de 2 de mayo de 1974;\nartículos 1, 3, 4 incisos a) y h), 6 y Transitorio I de la Ley de Incentivos y\nPromoción para el Transporte Eléctrico, Ley N° 9518 del 6 de febrero de 2018;\nartículos 8, 20 incisos j) y k) y 21 inciso f) del Reglamento General del\nSistema Nacional de Planificación, Decreto Ejecutivo N° 37735 de 06 de mayo de\n2013; y los artículos 2 inciso b), 4 inciso b), 11 inciso f) del Reglamento\nOrgánico del Poder Ejecutivo, Decreto Ejecutivo N°41187-MP-MIDEPLAN del 20 de\njunio del 2018.\n\nIII. Que la\nRectoría del sector de Ambiente, Energía y Mares tiene reglamentada la\norganización del Subsector Energía mediante el Decreto Ejecutivo N° 35991-\nMINAET Reglamento de Organización del Subsector Energía y sus reformas.\n\nEste subsector\nestá constituido entre otras, por el Consejo Subsectorial de Energía (CSE) y la\nSecretaría de Planificación del Subsector Energía (SEPSE), según el artículo 6,\nlos cuales brindan apoyo al Ministro (a) Rector.\n\nIV. Que el\nMinistro (a) Rector del sector Infraestructura y Transporte cuenta con la\nSecretaría de Planificación Sectorial como órgano de asesoría y apoyo técnico,\nsegún se establece en el artículo 3 del Decreto Ejecutivo Nº39173-MOPT\nReorganización estructural del proceso de planificación sectorial e\ninstitucional del Ministerio de Obras Públicas y Transportes del año 2015.\n\nV. Que la Ley de\nIncentivos y Promoción para el Transporte Eléctrico N° 9518, establece en el\nTransitorio I, que el Ministerio de Ambiente y Energía (MINAE), en coordinación\ncon el Ministerio de Obras Públicas y Transportes (MOPT), elaborarán el Plan\nNacional de Transporte Eléctrico en un plazo máximo de seis meses a partir de\nla publicación de la citada Ley.\n\nVI. Que la Ley\nN°9518 Incentivos y promoción para el transporte eléctrico del 06 de febrero\ndel 2018, en el artículo 4 establece que el Ministerio de Ambiente y Energía\n(MINAE) es el rector para la aplicación de esta ley con potestades de\ndirección, monitoreo, evaluación y control.\n\nVII. Que la Ley\nde Incentivos y Promoción para el Transporte Eléctrico N° 9518, establece en el\nartículo 19, que la administración pública, las empresas públicas y las\nmunicipalidades, pueden realizar la inversión necesaria para aquellas obras de\ninfraestructura dirigidas al fortalecimiento y a la promoción del transporte\neléctrico.\n\nVIII. Que el Plan\nNacional de Transporte Eléctrico (PNTE) tiene como objetivo promover la\ntransición hacia una mayor participación de las energías renovables en la\nmatriz energética nacional, mediante la electrificación del transporte en todos\nsus modos, en busca de lograr impactos en la reducción de las emisiones de\ngases de efecto invernadero (GEI) y en la mejora de la calidad del aire en\nzonas urbanas que se verá reflejado directamente en la salud humana. Para este\npropósito es necesario integrar los esfuerzos de diferentes actores en el\nsector público, en el sector privado y la sociedad civil.\n\nIX. Que el\ndesarrollo del transporte eléctrico responde a las políticas energéticas\ncontenidas en el VII Plan Nacional de Energía (PNE), al compromiso país de\navanzar hacia la descarbonización de la economía establecido en el Plan de\nAcción de la Estrategia Nacional de Cambio Climático (ENCC) y en la\nContribución Nacionalmente Determinada de Costa Rica (NDC, por sus siglas en\ninglés).\n\nX. Que el Plan\nNacional de Descarbonización establece como ejes para revertir el crecimiento\nde gases de efecto invernadero la transformación de la flota de vehículos a\ncero emisiones nutridos de energías renovables, no de origen fósil y el\ndesarrollo de un sistema de movilidad basado en transporte público seguro,\neficiente y renovable, y en esquemas de movilidad activa y compartida.\n\nXI. Que la Ley de\nPlanificación Nacional, Nº 5525 establece un Sistema de Planificación Nacional\nque tiene como objetivos, intensificar el crecimiento de la producción y de la\nproductividad del país, promover la mejor distribución del ingreso y de los\nservicios sociales que presta el Estado y propiciar la participación de los\nciudadanos en la solución de los problemas económicos y sociales; para los\ncuales se establece la creación de sectores integrado por instituciones que\ntrabajen en un mismo campo de actividad.\n\nXII. Que el\nReglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo\nNº37735-PLAN, tiene por objeto, regular la constitución, organización,\nfunciones y relaciones del Sistema Nacional de Planificación (SNP), como\nconjunto articulado de instituciones públicas, subsistemas y normativa. Entre\nlos órganos del sistema, encontramos a los Consejos Sectoriales, Ministros\nRectores Sectoriales y Secretarías Sectoriales entre otros, para los que se\nestablecen sus funciones respectivas, siendo que la Administración Pública se\norganizara por sectores para facilitar la coordinación de instituciones con\nactividades afines.\n\nXIII. Que el\nReglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo No.\n37735-PLAN, tiene por objeto regular la constitución, organización, funciones y\nrelaciones del Sistema Nacional de Planificación (SNP), como conjunto\narticulado de instituciones públicas, subsistemas y normativa. Entre los\nórganos del sistema encontramos a los Consejos Sectoriales, Ministros Rectores\nSectoriales y Secretarías Sectoriales entre otros, para los que se establecen\nsus funciones respectivas, siendo que la Administración Pública se organizara\npor sectores para facilitar la coordinación de instituciones con actividades\nafines.\n\nXIV. Que el\nReglamento General del Sistema Nacional de Planificación, Decreto Ejecutivo\nN°37735-PLAN, establece en su artículo 8, que los instrumentos de\nplanificación, tales como los planes, políticas, programas y proyectos, entre\notros, serán emitidos por decreto ejecutivo.\n\nXV. Que siendo\nque la normativa existente contempla a Consejos y Secretarias ya existentes y\nfuncionando, se hace necesario crear un mecanismo de coordinación y dirección\npara que atiendan la implementación de un instrumento de planificación\nintersectorial como el PNTE, que ha sido creado por ley y que obliga a MINAE y\nal MOPT a trabajar de manera conjunta.\n\nPor tanto,\n\nDecretan:\n\nOFICIALIZACIÓN\nDEL PLAN NACIONAL DE TRANSPORTE ELÉCTRICO\n\nArtículo 1º-. Oficialización\n\nSe oficializa el\n\"Plan Nacional de Transporte Eléctrico (PNTE)\", en cumplimiento a lo\ndispuesto en la Ley de Incentivos y Promoción del Transporte Eléctrico\", Ley\nnúmero 9518 del 06 de febrero de 2018.\n\nEste Plan estará\ndisponible en el sitio web de la Secretaría de Planificación del Subsector\nEnergía (SEPSE), en la dirección electrónica https://sepse.go.cr/. Se\napoyará en la Secretaría de Planificación del Subsector Energía (SEPSE), en el\nConsejo Subsectorial de Energía (CSE) y en las instituciones que lo conforman,\ncomo los encargados y supervisores de gestionar el cumplimiento y la ejecución\ndel PNTE.\n\nEl Ministro del\nMOPT en su calidad de Rector del sector de Infraestructura y Transporte y en su\ncalidad de jerarca institucional, coordinará con el Ministro del MINAE la implementación\ndel PNTE. En esta labor, se apoyará en las instituciones que conforman al sector\nInfraestructura y Transporte y en la Secretaría de Planificación Sectorial\n(SPS) como encargados para colaborar en la gestión de cumplimiento y de\nejecución del PNTE.\n\nLas instancias en\nel MINAE liderarán el proceso de cumplimiento y ejecución del PNTE y coordinarán\ndirectamente con las instancias en el MOPT.\n\nArtículo 3°.- Coordinación y acción de las\nautoridades vinculadas\n\nLas instancias\ntendrán las siguientes funciones:\n\na. El CSE en\ncoordinación con el Rector del Sector de Infraestructura y Transporte y las\ninstituciones que lo integran, serán los orientadores políticos y los tomadores\nde decisiones para articular el PNTE de conformidad con normativas, políticas,\nplanes e instrumentos vigentes.\n\nb. El Ministro\nRector del Sector Ambiente, Energía y Mares y el Ministro Rector del Sector de\nInfraestructura y Transporte, convocarán al CSE y las instituciones del sector\nde Infraestructura y Transporte para realizar sesiones de trabajo en forma\nordinaria, al menos una vez al año, o bien, en forma extraordinaria las veces\nque sean necesarias, quedando sujeto a la necesidad de avanzar con el Plan.\n\nc. El Ministro\nRector del Sector Ambiente, Energía y Mares y el Ministro Rector del Sector de\nInfraestructura y Transporte podrán convocar de manera consultiva a Ministros o\nMinistras, Jerarcas de instituciones o representantes de empresas públicas o\nprivadas a participar de estas sesiones de trabajo.\n\nd. La SEPSE y la\nSPS serán los coordinadores y los enlaces para la implementación del PNTE, por\nlo que orientarán las acciones, monitorearán y darán seguimiento al\ncumplimiento y a la ejecución del PNTE. Estas instancias mantendrán una\ncomunicación y una coordinación constante y fluida.\n\ne. La SEPSE y la\nSPS deberán organizar reuniones de planificación y seguimiento para la\nejecución del PNTE.\n\nArtículo 4°.-\nResponsabilidades de las instancias\n\nPara el adecuado\ncumplimiento del PNTE, las instancias tendrán bajo su responsabilidad:\n\n1. El CSE y el Ministro Rector del Sector de Infraestructura\ny Transporte y las instituciones que lo integran tendrán las siguientes\nresponsabilidades:\n\na. Conocer y\nproponer los ajustes convenientes para el PNTE.\n\nb. Emitir las\ndisposiciones generales para la articulación del PNTE.\n\nc. Promover la\npuesta en práctica de las políticas, los planes, los programas y proyectos del\nPNTE.\n\nd. Coordinar los\nplanes, programas y proyectos del PNTE con los actores fundamentales del PNTE.\n\ne. Tomar\ndecisiones inherentes a la implementación del PNTE.\n\nf. Facilitar y/o\ngestionar recursos financieros-económicos para el desarrollo del PNTE.\n\ng. Coordinar con\nlos actores fundamentales del PNTE la vinculación del Plan con los planes\nestratégicos e institucionales de las diferentes organizaciones.\n\nh. Evaluar y dar\nseguimiento del PNTE.\n\ni. Conformar los\ncomités consultivos que se consideren necesarios.\n\nj. Convocar a\nactores que se precisen, a fin de recibir recomendaciones y asesorías técnicas.\n\nk. Informar al\nConsejo Nacional Ambiental (CNA) sobre el avance del PNTE.\n\n2. La SEPSE y la SPS tendrán las siguientes\nresponsabilidades:\n\na. Coordinar con las instituciones, empresas y\nactores la implementación del PNTE.\n\nb. Coordinar la conformación de comités\nconsultivos que se requieran.\n\nc. Dar seguimiento periódico y controlar el\navance en la implementación del PNTE, consolidando los insumos del avance.\n\nd. Gestionar y sistematizar la información y\nreportar los avances y riesgos que se presenten en el cumplimiento del PNTE.\n\ne. Elaborar los informes de avance del PNTE que\ntendrán una periodicidad semestral.\n\nf. Elaborar los informes técnicos por solicitud\ndel Ministro Rector o por acuerdo del CNA.\n\ng. Gestionar las evaluaciones del PNTE.\n\nh. Article\n50 of the Political Constitution establishes that the State must procure\nthe greatest well-being for all inhabitants of the country; and guarantee and preserve\nthe right of individuals to a healthy and ecologically balanced environment,\npromoting greater development in harmony with it, which entails\nprogrammatic planning activity for the fulfillment of goals and\npurposes to which it is called.\n\nII. That in\naccordance with the provisions of subsection f) of Article 11 of the Executive\nDecree N° 41187-MP-MIDEPLAN, and its amendments, the Stewardship of the Environment, Energy, and Seas sector\nis exercised by the Minister of Environment and Energy; likewise,\nsubsection h) of Article 11 establishes that the Stewardship of the\nInfrastructure and Transport sector is exercised by the Minister of Public\nWorks and Transport, therefore, they hold the power, together with the\nPresident of the Republic, to coordinate, articulate, and direct the activities\nof their sectors. Similarly, Article 2, b) in relation to 4, b)\nestablishes the Presidential articulation areas of territorial planning,\ninfrastructure, and mobility, which aim to generate conditions of\nurban planning, to achieve resilient,\nsustainable, and inclusive urban and rural spaces, integrated, among others, by MINAE and MOPT, whose\nHeads are the Steward Ministers of their Sectors and must coordinate whatever is necessary\nfor the fulfillment of the proposed objectives, which include those contained in\nthe PNTE. Among their functions is that of validating and endorsing public\npolicies corresponding to their competencies, for which they must ensure\nthese are complied with according to the guidelines of the National\nDevelopment and Public Investment Plan.\n\nBased on\nthe powers conferred in Articles 50, 130, 140 subsections 3), 8) and 18),\n141) and 146) of the Political Constitution; Articles 25 subsection 1), 27 subsection\n1), 28 subsection 2) paragraph b) of the General Law of Public Administration, Law\nN° 6227 of May 2, 1978; Articles 1 and 2 subsection a) of the Organic Law of the\nMinistry of Environment and Energy, Law N° 7152 of June 5, 1990, and its\namendments; the National Planning Law, N° 5525 of May 2, 1974;\nArticles 1, 3, 4 subsections a) and h), 6, and Transitory Provision I of the Law of Incentives and\nPromotion for Electric Transportation, Law N° 9518 of February 6, 2018;\nArticles 8, 20 subsections j) and k), and 21 subsection f) of the General Regulation of the\nNational Planning System, Executive Decree N° 37735 of May 6,\n2013; and Articles 2 subsection b), 4 subsection b), 11 subsection f) of the Organic\nRegulation of the Executive Branch, Executive Decree N° 41187-MP-MIDEPLAN of June 20,\n2018.\n\nIII. The\nStewardship of the Environment, Energy, and Seas sector has regulated the\norganization of the Energy Subsector through Executive Decree N° 35991-\nMINAET, Regulation for the Organization of the Energy Subsector, and its amendments.\n\nThis subsector\nis constituted, among others, by the Subsectoral Energy Council (Consejo Subsectorial de Energía, CSE) and the\nEnergy Subsector Planning Secretariat (Secretaría de Planificación del Subsector Energía, SEPSE), according to Article 6,\nwhich provide support to the Steward Minister.\n\nIV. The\nSteward Minister of the Infrastructure and Transport sector has the\nSectoral Planning Secretariat as an advisory and technical support body,\nas established in Article 3 of Executive Decree Nº 39173-MOPT,\nStructural Reorganization of the sectoral and institutional planning process of the\nMinistry of Public Works and Transport, of the year 2015.\n\nV. The Law of\nIncentives and Promotion for Electric Transportation N° 9518 establishes in\nTransitory Provision I that the Ministry of Environment and Energy (MINAE), in coordination\nwith the Ministry of Public Works and Transport (MOPT), shall prepare the National\nElectric Transportation Plan within a maximum period of six months from\nthe publication of the cited Law.\n\nVI. Law\nN° 9518, Incentives and Promotion for Electric Transportation, of February 6,\n2018, in Article 4 establishes that the Ministry of Environment and Energy\n(MINAE) is the steward for the application of this law with powers of\ndirection, monitoring, evaluation, and control.\n\nVII. The Law\nof Incentives and Promotion for Electric Transportation N° 9518 establishes in\nArticle 19 that the public administration, public enterprises, and\nmunicipalities may make the necessary investment for those infrastructure\nworks directed at strengthening and promoting electric\ntransportation.\n\nVIII. The National\nElectric Transportation Plan (Plan Nacional de Transporte Eléctrico, PNTE) aims to promote the\ntransition towards a greater share of renewable energies in the\nnational energy matrix, through the electrification of transport in all\nits modes, seeking to achieve impacts in the reduction of greenhouse\ngas (GHG) emissions and in the improvement of air quality in\nurban areas, which will be directly reflected in human health. For this\npurpose, it is necessary to integrate the efforts of different actors in\nthe public sector, the private sector, and civil society.\n\nIX. The\ndevelopment of electric transportation responds to the energy policies\ncontained in the VII National Energy Plan (PNE), to the national commitment to\nadvance towards the decarbonization of the economy established in the Action\nPlan of the National Climate Change Strategy (ENCC) and in Costa Rica's\nNationally Determined Contribution (NDC).\n\nX. The National\nDecarbonization Plan establishes, as axes to reverse the growth\nof greenhouse gases, the transformation of the vehicle fleet to\nzero emissions powered by renewable energies, not of fossil origin, and the\ndevelopment of a mobility system based on safe,\nefficient, and renewable public transport, and on active and shared\nmobility schemes.\n\nXI. The National\nPlanning Law, Nº 5525, establishes a National Planning System\nwhich has the objectives of intensifying the growth of the country's production and\nproductivity, promoting better distribution of income and\nsocial services provided by the State, and fostering the participation of\ncitizens in solving economic and social problems; for\nwhich the creation of sectors is established, composed of institutions that\nwork in the same field of activity.\n\nXII. The\nGeneral Regulation of the National Planning System, Executive Decree\nNº 37735-PLAN, aims to regulate the constitution, organization,\nfunctions, and relations of the National Planning System (SNP), as an\narticulated set of public institutions, subsystems, and regulations. Among\nthe organs of the system are the Sectoral Councils, Sectoral Steward\nMinisters, and Sectoral Secretariats, among others, for which their\nrespective functions are established, whereby the Public Administration shall\nbe organized by sectors to facilitate the coordination of institutions with\nrelated activities.\n\nXIII. The\nGeneral Regulation of the National Planning System, Executive Decree No.\n37735-PLAN, aims to regulate the constitution, organization, functions, and\nrelations of the National Planning System (SNP), as an articulated\nset of public institutions, subsystems, and regulations. Among\nthe organs of the system are the Sectoral Councils, Sectoral Steward\nMinisters, and Sectoral Secretariats, among others, for which their\nrespective functions are established, whereby the Public Administration shall\nbe organized by sectors to facilitate the coordination of institutions with\nrelated activities.\n\nXIV. The\nGeneral Regulation of the National Planning System, Executive Decree\nN° 37735-PLAN, establishes in its Article 8 that the planning\ninstruments, such as plans, policies, programs, and projects, among\nothers, shall be issued by executive decree.\n\nXV. Given that\nthe existing regulations contemplate Councils and Secretariats already existing and\noperating, it is necessary to create a coordination and steering\nmechanism for them to address the implementation of an intersectoral planning\ninstrument such as the PNTE, which has been created by law and requires MINAE and\nMOPT to work jointly.\n\nTherefore,\n\nThey decree:\n\nFORMAL ADOPTION\nOF THE NATIONAL ELECTRIC TRANSPORTATION PLAN\n\nArticle 1.— Formal Adoption\n\nThe \"National Electric Transportation Plan (PNTE)\" is hereby formally adopted, in compliance with the provisions of the \"Law of Incentives and Promotion for Electric Transportation,\" Law number 9518 of February 6, 2018.\n\nThis Plan will be available on the website of the Energy Subsector Planning Secretariat (SEPSE), at the electronic address https://sepse.go.cr/. The path to the PDF document is https://sepse.go.cr/politica-nacional/politica-energetica/.\nAs well as on the website of the Sectoral Planning Secretariat of the Ministry of Public Works and Transport (MOPT)\nhttp://repositorio.mopt.go.cr:8080/xmlui/.\n\nThe printed version of the document will be kept in the custody of the Energy Subsector Planning Secretariat (SEPSE), on the fifth floor of the Ministry of Environment and Energy (MINAE), and at the Sectoral Planning Secretariat-MOPT.\n\n(Sinalevi Note: Due to the extensiveness of its content and type of format, the National Electric Transportation Plan can be consulted at the following link)\n\nArticle 2.— Management of the PNTE\n\nThe management of the PNTE shall be led by the Minister of MINAE, in his capacity as Steward of the Environment, Energy, and Seas sector and as institutional head of the ministry. He shall be supported by the Energy Subsector Planning Secretariat (SEPSE), the Subsectoral Energy Council (CSE), and the institutions that make it up, as those responsible for and supervisors of managing the fulfillment and execution of the PNTE.\n\nThe Minister of MOPT, in his capacity as Steward of the Infrastructure and Transport sector and in his capacity as institutional head, shall coordinate the implementation of the PNTE with the Minister of MINAE. In this task, he shall be supported by the institutions that make up the Infrastructure and Transport sector and by the Sectoral Planning Secretariat (SPS), as those responsible for collaborating in the management of fulfillment and execution of the PNTE.\n\nThe bodies within MINAE shall lead the process of compliance and execution of the PNTE and shall coordinate directly with the bodies within MOPT.\n\nArticle 3.— Coordination and action of the related authorities\n\nThe bodies shall have the following functions:\n\na. The CSE, in coordination with the Steward of the Infrastructure and Transport Sector and the institutions that make it up, shall be the policy guides and decision-makers for articulating the PNTE in accordance with current regulations, policies, plans, and instruments.\n\nb. The Steward Minister of the Environment, Energy, and Seas Sector and the Steward Minister of the Infrastructure and Transport Sector shall convene the CSE and the institutions of the Infrastructure and Transport sector to hold working sessions on an ordinary basis, at least once a year, or, on an extraordinary basis, as many times as necessary, subject to the need to advance the Plan.\n\nc. The Steward Minister of the Environment, Energy, and Seas Sector and the Steward Minister of the Infrastructure and Transport Sector may, on a consultative basis, convene Ministers, Heads of institutions, or representatives of public or private companies to participate in these working sessions.\n\nd. The SEPSE and the SPS shall be the coordinators and liaisons for the implementation of the PNTE, and shall therefore guide the actions, monitor, and follow up on the fulfillment and execution of the PNTE. These bodies shall maintain constant and fluid communication and coordination.\n\ne. The SEPSE and the SPS shall organize planning and follow-up meetings for the execution of the PNTE.\n\nArticle 4.— Responsibilities of the bodies\n\nFor the proper fulfillment of the PNTE, the bodies shall have under their responsibility:\n\n1. The CSE and the Steward Minister of the Infrastructure and Transport Sector and the institutions that make it up shall have the following responsibilities:\n\na. To know and propose convenient adjustments for the PNTE.\n\nb. To issue the general provisions for the articulation of the PNTE.\n\nc. To promote the implementation of the policies, plans, programs, and projects of the PNTE.\n\nd. To coordinate the plans, programs, and projects of the PNTE with the fundamental actors of the PNTE.\n\ne. To make decisions inherent to the implementation of the PNTE.\n\nf. To facilitate and/or manage financial-economic resources for the development of the PNTE.\n\ng. To coordinate with the fundamental actors of the PNTE the linkage of the Plan with the strategic and institutional plans of the different organizations.\n\nh. To evaluate and follow up on the PNTE.\n\ni. To form advisory committees deemed necessary.\n\nj. To convene actors as required, in order to receive recommendations and technical advice.\n\nk. To inform the National Environmental Council (CNA) about the progress of the PNTE.\n\n2. The SEPSE and the SPS shall have the following responsibilities:\n\na. To coordinate with the institutions, companies, and actors the implementation of the PNTE.\n\nb. To coordinate the formation of advisory committees as required.\n\nc. To periodically follow up and control the progress in the implementation of the PNTE, consolidating the inputs on progress.\n\nd. To manage and systematize the information and report the progress and risks that arise in the fulfillment of the PNTE.\n\ne. To prepare the progress reports of the PNTE, which shall be semi-annual.\n\nf. To prepare technical reports at the request of the Steward Minister or by agreement of the CNA.\n\ng. To manage the evaluations of the PNTE.\n\nh. To support the efforts of the CSE and the institutions of the Infrastructure and Transport sector.\n\nThe progress reports prepared by the SEPSE and SPS shall be submitted to the Minister of MINAE in his capacity as steward, who shall determine the higher political-level bodies to which the results, findings, or recommendations are to be sent.\n\nArticle 5.— The public administration, public enterprises, and municipalities shall implement the Plan with its corresponding objectives, actions, and goals, for which they may carry out the necessary internal and external, budgetary, and administrative efforts to have the resources for fulfilling the PNTE and to reflect these in their annual institutional strategic and operational plans.\n\nArticle 6.— It shall be effective as of its publication.\n\nDone at the Presidency of the Republic.
