reunión preliminar de la\nConvención Marco de las Naciones Unidas sobre el Cambio Climático PRE-COP25\n\nN° 41924-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA\n\nY EL MINISTRO DE AMBIENTE Y ENERGÍA\n\nEn uso de las facultades que les\nconfieren los artículos 140 incisos 18), 20) y 146 de la Constitución Política;\nasí como los numerales 25 inciso 1), 27 inciso 1), 28 inciso 2) acápite b) de\nla Ley General de la Administración Pública, Ley número 6227 del 2 de mayo de\n1978, y;\n\nConsiderando:\n\nI.-Que la Convención Marco de las\nNaciones Unidas sobre el Cambio Climático, conocida como CMNUCC (UNFCCC en\ninglés) fue adoptada durante la Cumbre de la Tierra de Río de Janeiro en 1992,\nla cual entró en vigor el 21 de marzo de 1994 y ha sido ratificada por 196\nEstados, que constituyen las «Partes», de la Convención.\n\nII.-Que entre sus principios, la\nConvención reconoce la existencia de un cambio climático debido a la actividad\nhumana y atribuye a los países industrializados la responsabilidad principal\npara luchar contra este fenómeno.\n\nIII.-Que la Conferencia de las\nPartes (COP), es el principal órgano de gobernanza de la Convención y está\nconstituido por los representantes de los gobiernos que han ratificado la\nConvención y que se reúnen todos los años para abordar el problema global del\ncambio climático y alcanzar los objetivos de lucha contra este.\n\nIV.-Que en diciembre de 2015 se\naprobó el Acuerdo de París, que es el acuerdo multilateral en materia ambiental\ny de cambio climático más ambicioso que se haya firmado hasta ahora y que busca\nmantener el aumento de la temperatura media mundial muy por debajo de 2 2C con\nrespecto a los niveles preindustriales, y proseguir los esfuerzos para limitar\nese aumento de la temperatura a 1,5 °C.\n\nV.-Que en el año 2018, los Estados Parte de la Convención aprobaron el Programa de Trabajo del\nAcuerdo de París en Katowice, quedando pendiente lo referente al Artículo 6 sobre mercados de\ncarbono y otros elementos vinculados más granulares y operativos de diversos temas, sin embargo,\neste Programa de Trabajo representa un hito relevante para operacionalizar el Acuerdo de París.\n\nVI.-Que en octubre de 2019, Costa\nRica albergará la reunión preliminar de la vigésima quinta Conferencia de las\nPartes, misma que se conoce como Pre-COP25, dado que nuestro país trabajará\njunto con Chile para organizar la C0P25 que se celebrará en ese país\nsudamericano a finales de este año.\n\nVII.-Que con esta Pre-COP se\nbusca facilitar el proceso de negociación en el marco de un ambiente que\npromueva optimismo, ambición, e intercambios constructivos y además colaborar\ncon la Presidencia y la Secretaría de la Organización, para avanzar en aspectos\nestratégicos de la negociación asociados a: artículo 6, género, el Mecanismo\nInternacional de Varsovia para las pérdidas y los daños y otros temas\nrelevantes asociados a la ambición en la acción climática.\n\nVIII.-Que desde el ámbito internacional, esta PRE-COP25 busca contribuir con el proceso global de\nllamado a la ambición y acción climática, generar intercambios y debates de alto nivel que faciliten\nel trabajo conjunto entre gobiernos, sociedad civil y al sector privado para potenciar la acción\nclimática, así como facilitar el intercambio de buenas prácticas de cómo construir contribuciones\nnacionales determinadas (NDCs, por sus siglas en inglés) mejoradas que incluyan consideraciones en\náreas temáticas de interés asociadas a ciudades, movilidad sostenible, soluciones basadas en\nnaturaleza, océanos, género y derechos humanos, financiamiento.\n\nIX.-Que Costa Rica quiere una\nPRE-COP25 más orientada al proceso de acción climática y que no solo se centre\nen el proceso de negociación solamente, por lo que el país buscará contribuir\ncon el proceso global de llamado a la acción ya la ambición.\n\nX.-Que por lo anterior, se pretende desde el ámbito nacional, contribuir con el proceso nacional de\ngeneración de capacidades y condiciones habilitantes para la implementación del Plan de\nDescarbonización y Política Nacional de Adaptación, para así posicionar al país como líder y\nlaboratorio para la descarbonización y resiliencia.\n\nXI.-Que para alcanzar este fin,\nse plantea realizar en forma paralela a la sesión de negociación, una\nConferencia de alto nivel que reúna a: delegados que participan en el proceso\nde negociación, representantes de ministerios sectoriales, sector privado,\ngobiernos locales, comunidades y sociedad civil.\n\nXII.-Que en el marco de esta\nconferencia, se invitará a líderes del sector público, empresarial, financiero,\nsocial, formadores de opinión internacional y nacional que interactúen con\nactores varios y tomadores de decisión de diversos países.\n\nXIII.-Que tal congregación\npermitirá la co-creación colectiva de ideas y\nsoluciones, intercambio de experiencias en posibles soluciones para acelerar la\ndescarbonización y resiliencia\n\nde las economías de países miembros en tres áreas\ntemáticas sustantivas: a) ciudades-movilidad sostenible, b) soluciones basadas\nen naturaleza, c) economía azul, y dos áreas temáticas transversales: a) género\ny derechos humanos b) financiamiento y movilización de recursos financieros.\n\nXIV.-Que durante 3 días se\nrealizarán eventos de negociación y conferencias, por lo que se ha escogido\ncomo fecha para la realización de estos, los días 8, 9 y 10 de octubre de 2019.\n\nPor tanto,\n\nArtículo 1°-Se declara de interés\npúblico la celebración de   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 41924\n\n                        Declares of public interest the holding of the preliminary meeting of the\nUnited Nations Framework Convention on Climate Change PRE-COP25\n\nNo. 41924-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred upon them by articles 140, subsections 18), 20) and 146 of the Political Constitution; as well as numerals 25, subsection 1), 27, subsection 1), 28, subsection 2) paragraph b) of the General Law on Public Administration, Law number 6227 of May 2, 1978, and;\n\nWhereas:\n\nI.—That the United Nations Framework Convention on Climate Change, known as UNFCCC, was adopted during the 1992 Rio de Janeiro Earth Summit, entered into force on March 21, 1994, and has been ratified by 196 States, which constitute the \"Parties\" to the Convention.\n\nII.—That among its principles, the Convention recognizes the existence of a climate change due to human activity and attributes to industrialized countries the main responsibility for combating this phenomenon.\n\nIII.—That the Conference of the Parties (COP) is the main governance body of the Convention and is composed of representatives of the governments that have ratified the Convention, who meet every year to address the global problem of climate change and achieve the objectives for combating it.\n\nIV.—That in December 2015, the Paris Agreement was approved, which is the most ambitious multilateral environmental and climate change agreement signed to date and which seeks to keep the increase in the global average temperature well below 2°C relative to pre-industrial levels, and to pursue efforts to limit that temperature increase to 1.5°C.\n\nV.—That in 2018, the States Parties to the Convention approved the Paris Agreement Work Program in Katowice, leaving pending matters concerning Article 6 on carbon markets and other more granular and operational linked elements of various topics; however, this Work Program represents a relevant milestone for operationalizing the Paris Agreement.\n\nVI.—That in October 2019, Costa Rica will host the preliminary meeting of the twenty-fifth Conference of the Parties, known as Pre-COP25, given that our country will work together with Chile to organize COP25, which will be held in that South American country at the end of this year.\n\nVII.—That this Pre-COP seeks to facilitate the negotiation process within a framework that promotes optimism, ambition, and constructive exchanges, and also to collaborate with the Presidency and the Secretariat of the Organization to advance strategic aspects of the negotiation associated with: article 6, gender, the Warsaw International Mechanism for Loss and Damage, and other relevant topics associated with ambition in climate action.\n\nVIII.—That from the international sphere, this PRE-COP25 seeks to contribute to the global process of the call for ambition and climate action, generate high-level exchanges and debates that facilitate joint work among governments, civil society, and the private sector to enhance climate action, as well as facilitate the exchange of best practices on how to build enhanced nationally determined contributions (NDCs) that include considerations in thematic areas of interest associated with cities, sustainable mobility, nature-based solutions, oceans, gender and human rights, and financing.\n\nIX.—That Costa Rica wants a PRE-COP25 more oriented toward the climate action process and not solely focused on the negotiation process; therefore, the country will seek to contribute to the global process of the call for action and ambition.\n\nX.—That for the foregoing reason, from the national sphere, the intention is to contribute to the national process of generating capacities and enabling conditions for the implementation of the Decarbonization Plan and National Adaptation Policy, in order to position the country as a leader and laboratory for decarbonization and resilience.\n\nXI.—That to achieve this end, it is proposed to hold, in parallel to the negotiation session, a high-level Conference bringing together: delegates participating in the negotiation process, representatives of sectoral ministries, the private sector, local governments, communities, and civil society.\n\nXII.—That within the framework of this conference, leaders from the public, business, financial, and social sectors, and international and national opinion makers, will be invited to interact with various stakeholders and decision-makers from diverse countries.\n\nXIII.—That such a gathering will allow the collective co-creation of ideas and solutions, and the exchange of experiences regarding possible solutions to accelerate the decarbonization and resilience\n\nof the economies of member countries in three substantive thematic areas: a) cities-sustainable mobility, b) nature-based solutions, c) blue economy, and two cross-cutting thematic areas: a) gender and human rights, b) financing and mobilization of financial resources.\n\nXIV.—That negotiation events and conferences will be held over 3 days; therefore, October 8, 9, and 10, 2019, have been chosen as the dates for holding them.\n\nTherefore,\n\nArticle 1.—The holding of the Preliminary Meeting of the United Nations Framework Convention on Climate Change, PRE-COP25, to be held in our country on October 8, 9, and 10, 2019, is hereby declared of public interest.\n\nArticle 2.—The Central Public Administration, the Presidential Council for Social Solidarity Economy, the autonomous institutions, and State enterprises are hereby empowered, within their competencies and in strict adherence to the legal system, to provide the cooperation and necessary facilities for the success of this activity.\n\nArticle 3.—This declaration of public interest does not entail any type of fiscal benefit.\n\nArticle 4.—This decree is effective from the date of its publication in the Official Gazette La Gaceta.\n\nIssued at the Presidency of the Republic, San José, on the twentieth day of August, two thousand nineteen."
