  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 010\n\n                        Delimitación de zona pública de un sector de estero/manglar de Puerto\nJiménez\n\nTexto Completo acta: 1305A8\n\nINSTITUTO\nGEOGRÁFICO NACIONAL\n\nDEPARTAMENTO\nTOPOGRÁFICO\n\nY\nOBSERVACIÓN DEL TERRITORIO\n\nAVISO N°\n2019-010\n\nZONA\nMARÍTIMA TERRESTRE\n\nDELIMITACIÓN\nDE ZONA PÚBLICA DE UN SECTOR\n\nDE ESTERO/\nMANGLAR DE PUERTO JIMÉNEZ\n\nCon fundamento en\nlas facultades que confiere el artículo 140 y artículo 240 inciso 1 de la Ley\nN° 6227 General de la Administración Pública, y en lo dispuesto en la Ley N° 59\nde creación del Instituto Geográfico Nacional, la Ley N° 8905 de traslado del\nInstituto Geográfico Nacional al Registro Nacional, la Ley Nº 6043 sobre la\nZona Marítimo Terrestre, del 2 de marzo de 1977, y su respetivo reglamento.\n\nConsiderando:\n\n1°-Que mediante\nLey N° 8905, se establece el Instituto Geográfico Nacional, como una\ndependencia del Registro Nacional y que la Junta Administrativa del Registro\nNacional administrará el presupuesto del Instituto, suscribirá los contratos y\nconvenios necesarios para el ejercicio de sus funciones. Asimismo, se establece\nque el Instituto Geográfico Nacional será la dependencia científica y técnica rectora\nde la cartografía nacional, destinada a la ejecución del Mapa básico oficial y\nla Descripción básica geográfica de la República de Costa Rica y a los\nestudios, las investigaciones o labores y el desarrollo de políticas nacionales\nde carácter cartográfico, geográfico, geodésico, geofísico y de índole similar\nque tenga relación con dichas obras, con el fin de apoyar los procesos de\nplanificación.\n\n2º-Que la Ley de\nCreación del Instituto Geográfico Nacional, N° 59, lo constituye de manera\npermanente y en representación del Estado, como la autoridad oficial en materia\ngeodésica y de la representación espacial de la geografía de la República, extendiéndose\nsu autoridad a las actividades de cualquier orden que tengan por origen los\ntrabajos confiados a su cargo.\n\n3°-Que de\nconformidad con la Ley de Creación del Instituto Geográfico Nacional (IGN), N°\n59, en el artículo 62 del Reglamento a la Ley N° 6043, se reconoce la\ncompetencia del Instituto Geográfico Nacional para la delimitación de la zona pública\nde la Zona Marítimo Terrestre, y su oficialización a través de publicación en\nel Diario Oficial La Gaceta, mientras que el artículo 63 del mismo Reglamento, señala que. \"El\nInstituto Geográfico Nacional deberá publicar aviso en el\nDiario Oficial, de cada porción de la zona marítimo-terrestre en que haya demarcado\nla zona pública\".\n\n4°-Que en el\nDecreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\", se establece\nsegún el artículo 18° que para la delimitación de la zona pública de la Zona Marítimo\nTerrestre, el IGN podrá acudir a dos metodologías de ejecución, que se indican\nen los artículos 19 y 20, correspondientes a la delimitación de la zona pública\nde la Zona Marítimo Terrestre a través de la colocación de mojones y/o a la\ndelimitación digital georreferenciada, esto con el fin de agilizar las\ndelimitaciones y proporcionar mayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros aspectos determina, a la Red\nGeodésica Nacional de Referencia Horizontal CR05, y su proyección cartográfica asociada CRTM05, como\nel sistema oficial al cual deben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando específicamente en artículo\n11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y el sistema de proyección\ncartográfica CRTM05, constituirán el único sistema oficial de coordenadas para la República de Costa\nRica a partir del cual se debe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona o entidad\nprivada nacional o extranjera.\"; mientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el Instituto Geográfico\nNacional publicará por los medios adecuados aquella información que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo N° 40962-MJP \"Actualización del Sistema Geodésico de Referencia\nHorizontal Oficial para Costa Rica\" declara que: \"El sistema geodésico de referencia horizontal\noficial para Costa Rica, denominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia horizontal oficial para la\nRepública de Costa Rica,.\" , mientras que \" El sistema de proyección cartográfica CRTM05 seguirá\nsiendo el oficial para la representación cartográfica del territorio nacional continental.\" Por su\nparte, el artículo 12 del decreto de cita, refuerza la  aplicación de la proyección cartográfica\nCRTM05 como el sistema nacional de coordenadas oficial a la cual se deben referenciar en el\nterritorio continental de nuestro país, al señalar que \".todos los levantamientos y actividades\ncartográficos y geodésicos que desarrollen en el territorio nacional toda dependencia pública,\npersona o entidad privada, nacional o extranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos, contribuyéndose a evitar el gasto público y obteniendo, por otra parte, información\ngeográfica confiable, uniforme y comparable, que sea de utilidad general y que apoye la toma de\ndecisiones en los distintos niveles del Estado.\"\n\n7°-Que la\ngeorreferenciación al sistema nacional de coordenadas como mecanismo para\ndelimitar la zona pública de la Zona Marítimo Terrestre, posibilita la correcta\ndelimitación de la zona pública a los efectos de la elaboración de planes\nreguladores, el visado de planos de agrimensura, el otorgamiento de concesiones\nen la Zona Restringida y otros aspectos de ordenamiento territorial costero.\n\n8°-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT).\n\n9°-Que la\nGeodatabase Digital Georreferenciada (GDG) del Instituto Geográfico Nacional\n(IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta técnicamente en\naplicación de la regulación establecida por: a) el Decreto Ejecutivo N° 7841-P \"Reglamento\na la Ley N° 6043 sobre la Zona Marítimo Terrestre\",\n\nb) el Decreto\nEjecutivo N° 33797-MJ-MOPT \"Declara como datum horizontal oficial para Costa\nRica, el CR05, y su proyección cartográfica asociada, CRTM05\", c) el Decreto\nEjecutivo N°  40962-MJP \"Actualización\ndel Sistema Geodésico de Referencia Horizontal Oficial para Costa Rica\"; y d)\nel Decreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones\npara la Delimitación de la zona pública de la Zona Marítimo Terrestre\".\n\n10.-Que el\nartículo 16° de la Ley Forestal, Ley N° 7575 del 13 de febrero de 1996,\nestablece que el Ministerio del Ambiente y Energía delimitará en el terreno los\nlinderos de las áreas que conforman el Patrimonio Natural del Estado.\n\n11.-El Instituto\nGeográfico Nacional junto con el Área de Conservación Osa, utilizó la\nmetodología de \"Delimitación Digital Georreferenciada\" para delimitar la zona\npública de la Zona Marítimo Terrestre en un sector de estero/manglar en Puerto\nJiménez en el distrito 02 Puerto Jiménez, cantón 07 Golfito; provincia 06 Puntarenas,\nesto conforme diligencias realizadas por MINAE, Poder Judicial, y Procuraduría\nGeneral de la República, ante el Instituto Geográfico Nacional.\n\n12.-Que la\ndelimitación realizada cuenta con aval técnico interno conforme al oficio N°\nDIG-TOT-0260-2019 del 24 de julio de 2019, emitido por el Subproceso de Límites\nOficiales del Departamento Topográfico y Observación del Territorio del\nInstituto Geográfico Nacional.\n\n13.-Que la\ndelimitación realizada por el Área de Conservación Osa del Sistema de Áreas de\nConservación del MINAE para la demarcación de la zona pública en el sector de\necosistema de manglar se realizó de acuerdo con los oficios\nSINAC-ACOSA-D-369-2019 de fecha 19 de julio 2019, SINAC-ACOSA-POT-PNE-2019 del 21\nde mayo de 2019. SINAC-ACOSA-PNE-AD-102-2019, de fecha 29 de marzo de 2019,\nSINAC-ACOSA-D-163-2019 de fecha 09 de abril de 2019. y el oficio\nSINAC-ACOSA-DRFVS-SRPIT- 031-2019 del 27 de abril del 2019.\n\n14.-Que el artículo 140 de la Ley N° 6227 General de la Administración Pública señala que \"el acto\nadministrativo producirá su efecto después de comunicado al administrado, excepto si le concede\núnicamente derechos, en cuyo caso lo producirá desde que se adopte\", disposición que necesariamente\ndebe relacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define el instrumento\nidóneo para comunicar actos de naturaleza genérica al señalar que: \"Se comunicaran por publicación\nlos actos generales y por notificación, los concretos\".\n\n15.-Esta delimitación corresponde a un sector de la\ndemarcación oficial de las áreas del estero/manglar de Puerto Jiménez; con base\nen la Ley N° 6043 de la Zona Marítimo Terrestre en su artículo 11 en el cual se\nindica que los esteros/ manglares son parte de la zona pública de los bienes\ndel Estado. Likewise, it is established\nthat the Instituto Geográfico Nacional shall be the scientific and technical dependency governing\nnational cartography, aimed at the execution of the official Base Map and\nthe basic geographic Description of the Republic of Costa Rica and at\nthe studies, investigations or tasks and the development of national policies\nof a cartographic, geographic, geodetic, geophysical and similar nature\nrelated to said works, for the purpose of supporting planning\nprocesses.\n\n2º-That the Law Creating the Instituto Geográfico Nacional, No. 59, constitutes it on a permanent basis and in representation of the State, as the official authority in geodesy and the spatial representation of the geography of the Republic, its authority extending to activities of any nature that originate from the works entrusted to its charge.\n\n3°-That in\naccordance with the Law Creating the Instituto Geográfico Nacional (IGN), No.\n59, Article 62 of the Regulation to Law No. 6043 recognizes\nthe competence of the Instituto Geográfico Nacional for the delimitation of the public zone\nof the Zona Marítimo Terrestre, and its officialization through publication in\nthe Official Gazette La Gaceta, while Article 63 of the same Regulation states that: \"The\nInstituto Geográfico Nacional shall publish a notice in the\nOfficial Gazette, for each portion of the zona marítimo-terrestre in which it has demarcated\nthe public zone\".\n\n4°-That in\nExecutive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for\nthe Delimitation of the public zone of the Zona Marítimo Terrestre\", it is established\naccording to Article 18 that for the delimitation of the public zone of the Zona Marítimo\nTerrestre, the IGN may resort to two execution methodologies, indicated\nin Articles 19 and 20, corresponding to the delimitation of the public zone\nof the Zona Marítimo Terrestre through the placement of boundary markers (mojones) and/or\ngeoreferenced digital delimitation, this for the purpose of streamlining\ndelimitations and providing greater technical security to interested parties.\n\n5°-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica, from which all surveys and cartographic and geodetic activities carried out in the National Territory by any public agency, person or private entity, national or foreign, must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the Instituto Geográfico Nacional shall publish by appropriate means that information which has been officialized.\"\n\n6°-That Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\" declares that: \"The official horizontal geodetic reference system for Costa Rica, designated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.\", while \"The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the national continental territory.\" For its part, Article 12 of the cited decree reinforces the application of the cartographic projection CRTM05 as the official national coordinate system to which all surveys and cartographic and geodetic activities carried out in the national territory by any public agency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works, must be referenced, thus contributing to avoiding public expenditure and obtaining, in turn, reliable, uniform and comparable geographic information, of general utility and supporting decision-making at the different levels of the State.\n\n7°-That\ngeoreferencing to the national coordinate system as a mechanism for\ndelimiting the public zone of the Zona Marítimo Terrestre enables the correct\ndelimitation of the public zone for the purposes of drafting regulatory\nplans, approving survey plans, granting concessions\nin the Zona Restringida and other aspects of coastal land-use planning.\n\n8°-That\nthe georeferenced digital information on the delimitation of the public zone of\nthe Zona Marítimo Terrestre held by the IGN is called the Georeferenced Digital\nGeodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the\nZona Marítimo Terrestre (ZMT).\n\n9°-That the\nGeoreferenced Digital Geodatabase (GDG) of the Instituto Geográfico Nacional\n(IGN) on the Zona Marítimo Terrestre (ZMT) is technically based on\nthe application of the regulations established by: a) Executive Decree No. 7841-P \"Regulation\nto Law No. 6043 on the Zona Marítimo Terrestre\",\n\nb) Executive\nDecree No. 33797-MJ-MOPT \"Declares CR05 as the official horizontal datum for Costa\nRica, and its associated cartographic projection, CRTM05\", c) Executive\nDecree No. 40962-MJP \"Update\nof the Official Horizontal Geodetic Reference System for Costa Rica\"; and d)\nExecutive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications\nfor the Delimitation of the public zone of the Zona Marítimo Terrestre\".\n\n10.-That Article\n16 of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996,\nestablishes that the Ministry of Environment and Energy shall delimit in the field the\nboundaries of the areas that comprise the State's Natural Heritage.\n\n11.-The Instituto\nGeográfico Nacional, together with the Área de Conservación Osa, used the\nmethodology of \"Georeferenced Digital Delimitation\" to delimit the public zone\nof the Zona Marítimo Terrestre in a sector of estuary/mangrove in Puerto\nJiménez in district 02 Puerto Jiménez, canton 07 Golfito; province 06 Puntarenas,\nthis in accordance with proceedings carried out by MINAE, the Judiciary, and the\nProcuraduría General de la República, before the Instituto Geográfico Nacional.\n\n12.-That the\ndelimitation carried out has internal technical approval according to official letter No.\nDIG-TOT-0260-2019 of July 24, 2019, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the\nInstituto Geográfico Nacional.\n\n13.-That the\ndelimitation carried out by the Área de Conservación Osa of the Sistema de Áreas de\nConservación of MINAE for the demarcation of the public zone in the mangrove ecosystem sector was carried out in accordance with official letters\nSINAC-ACOSA-D-369-2019 dated July 19, 2019, SINAC-ACOSA-POT-PNE-2019 of May\n21, 2019. SINAC-ACOSA-PNE-AD-102-2019, dated March 29, 2019,\nSINAC-ACOSA-D-163-2019 dated April 9, 2019. and official letter\nSINAC-ACOSA-DRFVS-SRPIT- 031-2019 of April 27, 2019.\n\n14.-That Article 140 of Law No. 6227 General Law of Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce its effect from the time it is adopted,\" a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication, and specific acts by notification.\"\n\n15.-This delimitation corresponds to a sector of the\nofficial demarcation of the estuary/mangrove areas of Puerto Jiménez; based\non Law No. 6043 on the Zona Marítimo Terrestre in its Article 11, which\nindicates that estuaries/mangroves are part of the public zone of the State's assets.\nThe delimitation was carried out with unmanned precision positioning\nequipment in addition to site visits, soil sample analysis,\nhistorical studies of the existence of estuaries/mangroves in the sector and\ntopographic measurement equipment during the months of February and March 2019.\nFurthermore, within this ecosystem there is a road that connects the community\nof Puerto Jiménez, which is located on the estuary/mangrove ecosystem; this being\nsupported by Article 11 of the Regulation of Law No. 6043.\n\nCOMMUNICATES:\n\n1º-That during the months of February and March 2019, the\ngeoreferenced digital delimitation and establishment of boundary markers (mojones)\nreferenced to the national coordinate system was carried out to delimit the public zone of the Zona\nMarítimo Terrestre in a sector of estuary/mangrove in Puerto Jiménez located in\ndistrict 02 Puerto Jiménez, canton 07 Golfito, province 06 Puntarenas.\n\n2º-The works for determining the public zone\nof the Zona Marítimo Terrestre were carried out during the months of February and March\n2019 by the Área de Conservación Osa; this delimitation corresponds to a\nsector of estuary/mangrove whose point coordinates (vertices)\ngeoreferenced and surveyed (JIM) are indicated below, in the official\ncartographic projection system of Costa Rica CRTM05 and on
