Guabos\n\nCon fundamento en las facultades que confiere el artículo 140 y artículo\n240 inciso 1 de la Ley Nº 6227 General de la Administración Pública, y en lo\ndispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley\nNº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la\nLey Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su\nrespectivo reglamento.\n\nConsiderando:\n\n1°-Que mediante Ley Nº 8905, se establece el Instituto Geográfico\nNacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones así mismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo\nde políticas nacionales de carácter cartográfico, geográfico, geodésico,\ngeofísico y de índole similar que tenga relación con dichas obras, con el fin\nde apoyar los procesos de planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley de Creación del Instituto Geográfico\nNacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se\nreconoce la competencia del Instituto Geográfico Nacional para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta, mientras que el artículo\n63 del mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4°-Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en artículo 11 que: \"La Red Geodésica Nacional de Referencia\nHorizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República\nde Costa Rica a partir del cual se debe referenciar todos los levantamientos y\nactividades cartográficos y geodésicos que desarrollen en el Territorio\nNacional toda dependencia pública, persona o entidad privada nacional o\nextranjera.\"; mientras que el artículo 7 indica que \"Conforme se\nproduzcan datos cartográficos en el nuevo sistema de proyección\ncartográfica CRTM05, el Instituto Geográfico Nacional publicará por los\nmedios adecuados aquella información que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo Nº 40962-MJP \"Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica\" declara que: \"El\nsistema geodésico de referencia horizontal oficial para Costa Rica,\ndenominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica,.\", mientras que \"El\nsistema de proyección cartográfica CRTM05 seguirá siendo el oficial para\nla representación cartográfica del territorio nacional continental.\" Por\nsu parte, el artículo 12 del decreto de cita, refuerza la aplicación de la\nproyección cartográfica CRTM05 como el sistema nacional de coordenadas oficial\na la cual se deben referenciar en el territorio continental de nuestro país, al\nseñalar que \".todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el territorio nacional toda dependencia\npública, persona o entidad privada, nacional o extranjera, que emprendan\no contraten trabajos geodésicos y cartográficos, contribuyéndose a\nevitar el gasto público y obteniendo, por otra parte, información\ngeográfica confiable, uniforme y comparable, que sea de utilidad general y que\napoye la toma de decisiones en los distintos niveles del Estado.\"\n\n7°-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8°-Que la información digital georreferenciada sobre delimitación de la\nzona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico\nNacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n9°-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el\nDecreto Ejecutivo Nº 7841-P \"Reglamento a la Ley Nº 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05\", c) el Decreto delimitación realizada cuenta con aval técnico interno\nconforme al oficio DIG-TOT-0241-2019 del 09 de julio de 2019, emitido por el\nSubproceso de Limites Oficiales del Departamento Topográfico y Observación del\nTerritorio del Instituto Geográfico Nacional.\n\n13.-Que la delimitación realizada contó con el acompañamiento del Área\nde Conservación Osa, Sistema de Áreas de Conservación, para la demarcación de\nla zona pública en el sector de ecosistema de manglar, de acuerdo con el oficio\nSINACACOSA- D-077-2019, de fecha 01 de marzo de 2019.\n\n14.-Que el artículo 140 de la Ley Nº 6227 General de la Administración\nPública señala que \"el acto administrativo producirá su efecto\ndespués de comunicado al administrado, excepto si le concede únicamente\nderechos, en cuyo caso lo while Article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish by appropriate means that information which has been officialized.\"\n\n6°—That Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\" declares that: \"The official horizontal geodetic reference system for Costa Rica, denominated as CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.,\" while \"The cartographic projection system CRTM05 shall continue to be the official system for the cartographic representation of the continental national territory.\" For its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that \".all surveys and cartographic and geodetic activities developed in the national territory by any public agency, person or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoid public expenditure and obtaining, on the other hand, reliable, uniform, and comparable geographic information, of general utility and that supports decision-making at the different levels of the State.\"\n\n7°—That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, approving survey plans, granting concessions in the Restricted Zone and other aspects of coastal territorial planning.\n\n8°—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN, is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9°—That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares CR05 and its associated cartographic projection, CRTM05, as the official horizontal datum for Costa Rica\", c) Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\"; and d) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\n10.—That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy will delimit on the ground the boundaries of the areas that constitute the State's Natural Heritage.\n\n11.—The National Geographic Institute together with the Tempisque Conservation Area, used the methodology of \"Georeferenced Digital Delimitation\" to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos, located in district 03 Sierpe, canton 05 Osa, province 06 Puntarenas, this in accordance with proceedings carried out by Mrs. Sonia Carvajal González, identification number 5-0252-0351 before the National Geographic Institute.\n\n12.—That the delimitation carried out has internal technical endorsement in accordance with official communication DIG-TOT-0241-2019 of July 09, 2019, issued by the Official Limits Sub-process of the Topographic and Territory Observation Department of the National Geographic Institute.\n\n13.—That the delimitation carried out had the accompaniment of the Osa Conservation Area, System of Conservation Areas, for the demarcation of the public zone in the mangrove ecosystem sector, in accordance with official communication SINAC-ACOSA-D-077-2019, dated March 01, 2019.\n\n14.—That Article 140 of Law No. 6227 General Public Administration Act states that \"the administrative act shall produce its effect after it is communicated to the administered party, except if it only grants them rights, in which case it shall produce it from the moment it is adopted\", a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication and concrete acts by notification\".\n\nCOMMUNICATES:\n\nFirst.—That on the days of November 05 to 14, 2018, and December 04 and 05, 2018, the digital georeferencing delimitation and establishment of boundary markers (mojones) to the national coordinate system was carried out to delimit the public zone of the Maritime Terrestrial Zone in a mangrove sector in Bahía Guabos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas. Second.—The works for the determination of the public zone of the Maritime Terrestrial Zone were carried out on December 04 and 05, 2018, accompanied by the Osa Conservation Area; this delimitation corresponds to a mangrove sector whose coordinates of georeferenced surveyed points (vertices) (GU), are indicated below, in the official cartographic projection system of Costa Rica CRTM05 and on Map MBCR- 1/50.000 Rincón, namely:\n\n \n\n \n\n \n\nThird.—The official technical data of the delimitation of the mangrove sector of the public zone of the Maritime Terrestrial Zone of Bahía Guabos, have been registered in the Georeferenced Digital Geodatabase of the Maritime Terrestrial Zone (ZMT) of the IGN.\n\nCurridabat, September 06, 2019." }
