N° 6009.-Se tienen por recibidos los oficios\nSENARA-GG-0836-2019-2019 de fecha 11/09/2019 de la Gerencia General y\nSENARA-DIGH-0176-2019 de fecha 11/09/2019 de la Dirección de Investigación y\nGestión Hídrica (DIGH).\n\nConsiderando:\n\n1 Que el Decreto Nº 41851-MP-MINAE-MAG fue publicado en el Alcance\nNo.167 a La Gaceta No.139 del 24 de julio de 2019.\n\n2 Que en el Artículo 1º se señala que \"tiene por objeto establecer el\nprocedimiento para la Inscripción y registro regulado de pozos perforados sin\npermiso de perforación y el trámite respectivo para la obtención de la\nconcesión de aprovechamiento de aguas\".\n\n3 Que el Artículo 2º permite la inscripción de pozos que se hayan\nperforado sin autorización antes de abril 2010 y solicitar la respectiva\nconcesión de aprovechamiento de aguas.\n\n4 Que el Artículo 4º permite la inscripción y la respectiva concesión de\naprovechamiento de aguas por un plazo de seis (6) meses entre el 24 de\nsetiembre 2019 y el 24 de marzo 2020.\n\n5 Que el Artículo 4° señala como requisito de la solicitud de\ninscripción del pozo y concesión, en su inciso \"f) Comprobante de depósito\nde costos fijados por SENARA\".\n\n6 Que el Artículo 5° señala que \"La solicitud se pasará a audiencia\nde SENARA (...) para que en el plazo de 10 días de notificado se pronuncien al\nrespecto\".\n\n7 Que el Artículo 12° señala que \"SENARA determinará una tarifa\ndiferenciada para la inscripción de los pozos de los pequeños y medianos\nproductores considerando la clasificación del decreto No. 37911-MAG Sistema de\nRegistro del Ministerio de Agricultura y Ganadería, para Certificar la\ncondición de pequeño y mediano productor agropecuario (PYMPA), en aplicación\ndel requisito f) del Artículo 4.\n\n8 Que en el Alcance No.11 a La Gaceta del 19 de enero de 2018, el SENARA\npublica el Acuerdo No.5556 de ajuste tarifario por los servicios que brinda en\nmateria de aguas subterráneas.\n\n9 Que las tarifas vigentes para la y se detallan en el artículo 7 del Reglamento Para Regular la Prestación\nde Servicios En Materia De Aguas Subterráneas, publicado en el diario oficial La\nGaceta Nº 6 del 9 enero del 2007.\n\n12 Que dentro de los servicios que SENARA brinda se encuentra el\nsiguiente:\n\n-Elaboración de dictámenes para el trámite de solicitudes de perforación\nde pozos y concesiones por parte del Departamento de Aguas del MINAE y\nparticulares a partir de la información que el Departamento de Aguas del MINAE\nremite al SENARA para la valoración y pronunciamiento de los casos.\n\n13 Que a fin de cumplir con el establecimiento de tarifas diferenciadas\naplicables a la inscripción de los pozos que se acojan a la amnistía citada, se\nhace necesario aprobar un ajuste a la tarifa que corresponde a la emisión de\ndictámenes para solicitud de servicios de inscripción de pozos y concesión de\naprovechamiento de aguas según se dispone a continuación, estableciendo una\ndisminución de un 50% de la tarifa para FINANCIERA\n\nAgreement No. 6009.-The official communications\nSENARA-GG-0836-2019-2019 dated 11/09/2019 from the General Management and\nSENARA-DIGH-0176-2019 dated 11/09/2019 from the Dirección de Investigación y\nGestión Hídrica (DIGH) are deemed received.\n\nConsidering:\n\n1 That Decree No. 41851-MP-MINAE-MAG was published in Supplement\nNo. 167 to La Gaceta No. 139 of July 24, 2019.\n\n2 That Article 1 states that \"its purpose is to establish the\nprocedure for the registration and regulated recording of wells drilled without\na drilling permit and the respective process for obtaining the\nwater use concession (concesión de aprovechamiento de aguas).\"\n\n3 That Article 2 permits the registration of wells that were\ndrilled without authorization before April 2010 and to request the respective\nwater use concession.\n\n4 That Article 4 permits the registration and the respective water use\nconcession for a period of six (6) months between September 24,\n2019 and March 24, 2020.\n\n5 That Article 4 indicates as a requirement for the application for\nwell registration and concession, in its subsection \"f) Proof of deposit\nof costs established by SENARA.\"\n\n6 That Article 5 states that \"The application shall be submitted for a hearing\nby SENARA (...) so that they may pronounce on the matter within a period of 10 days from notification.\"\n\n7 That Article 12 states that \"SENARA shall determine a differentiated\nfee for the registration of wells of small and medium-sized\nproducers considering the classification of decree No. 37911-MAG Registration\nSystem of the Ministry of Agriculture and Livestock, to Certify the\ncondition of small and medium-sized agricultural producer (PYMPA), in application\nof requirement f) of Article amnesty, it\nis necessary to approve an adjustment to the fee corresponding to the issuance of\nopinions for the application of well registration and water use concession\nservices as set forth below, establishing a\n50% reduction of the fee for medium-sized producers and a 75% reduction for\nsmall producers, established according to the criteria of experts of the Institution.\n\nTherefore,\n\nBased on the provisions of subsection f) of Article 4 of\nDecree No. 41851-MP-MINAE-MAG, published in Supplement No. 167 to La Gaceta\nNo. 139 of July 24, 2019, and the technical recommendation of official communication SENARA-DIGH-0176-2019\ndated 11/09/2019, the following differentiated fee is established for the\nregistration of wells of small and medium-sized
