en\nel artículo 169 de la Constitución Política, el artículo 9 del Código Municipal,\ny según acuerdos municipales, de las Sesiones Ordinarias Nº 115 del 28 de\nseptiembre de 2017 del Concejo Municipal de La Unión, Nº 079 del 27 de octubre\nde 2017 del Concejo Municipal de Curridabat, Nº 091 del 23 enero de 2018 del\nConcejo Municipal de San José y Nº 02 del 07 de febrero de 2018 del Concejo\nMunicipal de Montes de Oca, se decreta el Reglamento Interno para el\nFuncionamiento de la Agencia Intermunicipal Subcuenca Río María Aguilar, el\ncual regirá por las siguientes disposiciones:\n\nConsiderando:\n\nI.-Que el\nartículo 50° de la Constitución Política reconoce el derecho de toda persona a\ngozar de un ambiente sano y ecológicamente equilibrado, así como el deber del\nEstado de garantizar, defender y preservar dicho derecho.\n\nII.-Que de\nconformidad con el artículo 169° de la Constitución Política, corresponde a la\nMunicipalidad la administración de los intereses y servicios locales.\n\nIII.-Que de\nconformidad con el artículo 3° del Código Municipal, las municipalidades podrán\ninvertir fondos públicos con otras municipalidades e instituciones de la\nAdministración Pública para el cumplimiento de fines locales, regionales o\nnacionales.\n\nIV.-Que el\nartículo 9° del Código Municipal, establece la facultad de las municipalidades\npara pactar convenios entre sí cuya finalidad sea facilitar y posibilitar el\ncumplimiento de sus objetivos.\n\nV.-Que el 7 de\nmarzo de 2018, los alcaldes de las municipalidades de los cantones de San José,\nMontes de Oca, Curridabat y La Unión, suscribieron un Convenio Cooperativo\nIntermunicipal mediante el cual se creó la Agencia Intermunicipal de la\nSubcuenca del río María Aguilar, cuyo objetivo es su gestión integrada para\nincorporar nueva infraestructura que permita retardar, infiltrar, contener,\nreusar, drenar estas aguas y que regule el uso del agua potable para consumo\nhumano.\n\nVI.-Que el\nacuerdo tercero del Convenio Cooperativo Intermunicipal estableció un Consejo\nde la Agencia, el cual es un órgano directivo colegiado conformado por los\nalcaldes de las municipalidades signatarias.\n\nVII.-Que este\nReglamento formará parte y se integrará al sistema normativo aplicable a la\ngestión de la Subcuenca río María Aguilar, el cual está integrado por otras\nnormas e instrumentos legales tales como el Plan Nacional de Desarrollo, el\nPlan Regional de Ordenamiento Territorial de la Gran Área Metropolitana - Plan\nGAM 2013-2030, otros instrumentos de planificación del Ministerio de Vivienda y\nAsentamientos Humanos (MIVAH), el Plan del Corredor Biológico Interurbano Río\nMaría y Aguilar, etc.\n\nVIII.-Que el acuerdo\ncuarto del Convenio Cooperativo Intermunicipal facultó al Consejo de la Agencia\npara elaborar y aprobar un Reglamento interno, con el propósito de regular las\nfunciones de los órganos de la Agencia, así como su gestión operativa y\nfinanciera.\n\nPor lo tanto,\n\nDecreta:\n\nREGLAMENTO\nINTERNO PARA EL FUNCIONAMIENTO\n\nDE LA\nAGENCIA INTERMUNICIPAL SUBCUENCA\n\nRÍO MARÍA\nAGUILAR\n\nCAPÍTULO 1\n\nDisposiciones\ngenerales\n\nArtículo 1º-Objeto.\nEste reglamento tiene por objeto regular en forma integral la Agencia\nIntermunicipal de la Subcuenca del Río María Aguilar. Por lo tanto, establece\nlas normas y procedimientos para su funcionamiento.\n\nArtículo 2º-Alcance.\nEste reglamento tendrá su mandato de acción en el territorio comprendido entre\nlos límites siguientes:\n\n1. El punto más\nalto de la subcuenca del río María Aguilar se localiza en Alto Pizote a 1640\nm.s.n.m, coordenadas geográficas 9°56'19\" latitud N y 83°58'22\" longitud O, entre\nlos distritos San Ramón del cantón La Unión y Dulce Nombre del cantón La Unión;\nademás, colinda con el sector Sur-Oeste de la Zona Protectora del Río Tiribí.\nEl límite Norte de la subcuenca se desplaza 4.4 km en dirección Este-Oeste por\nla ruta nacional 202 en un recorrido que pasa por las urbanizaciones Valle\nEscondido, Limburgia y el residencial Las Cumbres, el centro de San Ramón hasta\nllegar a San Rafael de Montes de Oca, en un punto cuya altitud es de 1355\nm.s.n.m. A continuación, la ruta nacional 202 cambia su dirección en sentido\nNoroeste en un ángulo de 147°, luego continúa una distancia cercana a los 600\nmetros, pasando por la entrada principal del Parque del Este, hasta la cota de\nelevación de 1335 m.s.n.m. al Sur de la iglesia católica de San Rafael de\nMontes de Oca. Esta trayectoria sigue 800 metros hacia el Oeste en dirección\nparalela a la ruta nacional 202 pasando por la ruta 203. Luego continúa, 350\nmetros hacia el Noroeste, en un ángulo de 136°, hasta el Seminario San Agustín,\nen Sabanilla de Montes de Oca.\n\nDespués de este\npunto el límite cambia su dirección hacia el Suroeste en un recorrido de 2.5\nkm, atravesando Cedros de Sabanilla, continuando por avenida 17 hasta llegar al\nlímite distrital de San Pedro con Sabanilla (de Montes de Oca), sobre la\ndiagonal 11 llegando al punto donde la calle 77 se cruza con la línea\nferroviaria. Continúa por 2 Km hacia el Oeste, pasando por el Colegio José\nJoaquín Vargas Calvo, sobre la ruta nacional 39 (circunvalación), 100 m al norte\nde la Rotonda de la Hispanidad. Posteriormente se traza una línea recta, hasta\nla sede de la Universidad Estatal a Distancia (frente a calle 37), entrando al\ncantón San José.\n\nSeguido cambia su\nrumbo hacia el noroeste en un ángulo de 138° por aproximadamente 600 metros,\nhasta calle 25, entre avenidas 9 y 11. Posteriormente, el límite toma una dirección\nsuroeste, en una distancia de 1.15 km, con un ángulo de 162°, atravesando el\nHospital Dr. Rafael Ángel Calderón Guardia y el parque España, llegando a un\npunto central de la manzana situada entre las avenidas 5 y 7 y calles 3 y 5. A\npartir de este sitio, el límite de la subcuenca gira su dirección 140° Sur,\natravesando La Catedral Metropolitana y hacia el Oeste ingresando al distrito\nHospital, hasta llegar al sector de la Escuela Porfirio Brenes, con un\nrecorrido total en este tramo de aproximadamente 850 metros. Luego, gira 125°\nSuroeste y extiende su ruta 950 metros camino hacia los tanques del Instituto\nCostarricense de Acueductos y Alcantarillados. En este punto, el límite de la\nsubcuenca vuelve a tomar rumbo hacia el Noroeste, recorriendo una distancia de\n1 km desde el cementerio General hasta el parque Beneméritos de la Patria. Ahí,\ncambia su rumbo al Suroeste y recorre 300 metros hasta llegar al Gimnasio Nacional,\nen el distrito de Mata Redonda. Inmediatamente el límite se traza hacia el\nNoroeste recorriendo una distancia de 1.4 Km que rodea el lago de la Sabana en\nsu sector Norte, y se desplaza hacia el Estadio Nacional. Después, recorre 500\nmetros hacia el Suroeste, en un ángulo de 138° pasando por el parque Rancho\nLuna hasta toparse con la autopista Próspero Fernández (ruta 27). Luego, se dirige\n650 metros hacia el Oeste donde se encuentra la zona recreativa de la\nurbanización Americana, conocido como \"Parque Holanda\"; en la parte baja\nsubcuencas coordenadas geográficas 9°55'57\" latitud N y -84°07,06\" longitud O.\nEl límite continúa, 500 metros al Sur, hacia el sector norte de Hatillo 7,\ndonde se da la confluencia entre los ríos María Aguilar y Tiribí en la corta de\nelevación de 1045 m.s.n.m.1 Después se desplaza 2,3 km al Sureste, cruzando\nHatillo 8, Hatillo 2 y Hatillo 1. El límite de la subcuenca gira en un ángulo\nde 133 0 hacia el Sur y se desplaza 1,8 km pasando por el parque de Hatillo\nCentro, hasta al sur de la clínica Solón Núñez a una altura de 1125 m.s.n.m.\nRecorre aproximadamente 900 metros hacia el Este, pasa por el Parque 25 de julio,\ny llega a la plaza de deportes de Colonia Kennedy, del distrito San Sebastián.\n\nLuego hace un\ngiro de 105° hacia el Sur y se desplaza 600 metros hasta llegar a la avenida 58\ny sigue 2,75 Km en dirección Este, cruzando la escuela República de Haití, el Seminario\nMayor y la urbanización Jardines de Cascajal, entra al distrito de San\nFrancisco de Dos Ríos y recorre una distancia de 250 metros hasta el barrio Los\nSauces.\n\nEntonces gira\n152° con dirección Noreste recorriendo 450 metros en dirección al Barrio\nHispano. Seguidamente varía su rumbo en 125° hacia el Sureste, recorriendo una distancia\nde 2,1 Km paralelo a la ruta nacional 211 hasta llegar al límite entre el\ndistrito San Francisco de Dos Ríos y el cantón Curridabat. El recorrido\ncontinua 2,5 Km por la avenida 56 del distrito de Curridabat, pasa al Norte de Barrio\nChapultepec, sur del parque la Troja y entre los Barrios de Hacienda Vieja y\nLomas del Sol con rumbo noreste hasta la autopista Florencio del Castillo (ruta\n252).\n\nA partir de este\npunto se dirige 350 metros en un ángulo de 153°, atravesando el distrito\nSánchez por Lomas de Ayarco Sur, para luego realizar un recorrido de 550 metros\nhasta llegar a la cota de elevación 1235 m.s.n.m; límite entre los distritos de\nSánchez (Curridabat) y San Juan (La Unión).\n\nContinúa 2 Km por\nla ruta nacional 251 de oeste a este, hasta llegar al colegio Saint Gregory\nSchool. Seguidamente toma rumbo Noreste 1,1 Km de distancia, pasando por la 1 A\npartir de este punto el límite de la subcuenca del río María Aguilar se dirige en\ndirección Oeste - Este. subestación del ICE de Tres Ríos, luego atraviesa el\ndistrito de Concepción hasta llegar a la ruta nacional 221 donde se encuentra\nel límite entre los distritos de Concepción y Dulce Nombre de La Unión. Por\núltimo, gira al noreste con un ángulo de 110° recorriendo 3,5 Km a través del distrito\nde Dulce Nombre, pasa por el templo católico de esta comunidad, continúa por la\nruta nacional 202, pasa la entrada al residencial Naturaleza de Este, y de\nnuevo se dirige hacia el sector Sur del Hospital Psiquiátrico Chacón Paút,\nhasta llegar a la parte alta de la subcuenca en la cota de elevación a 1640\nm.s.n.m, en el lugar conocido como Alto Pizote.\n\nArtículo 3º-Objetivos.\n\na) Velar por la\nsalud, la recreación y el bienestar de sus munícipes) Conservar y preservar el\nagua y los suelos de la subcuenca del Río María Aguilar. c)Construir nuevos paradigmas\npara el desarrollo urbano, que modifiquen sustancialmente la relación entre\nocupación urbana del territorio y manejo de las aguas pluviales, aguas\nresiduales, aguas potables y cuerpos de agua. \nd) Mejorar las normas de manejo de aguas pluviales para incorporar nueva\ninfraestructura que permita retardar, infiltrar, contener, reusar, drenar estas\naguas y que regule el uso del agua potable para consumo humano. e) Desarrollar\ncorredores y espacios de vida que mejoren la calidad de vida de los ciudadanos.\nf) Promover intervenciones para recuperar el Río María Aguilar como espacio\nbiodiverso, y como conector y corredor vivo del espacio urbano. g) Promover y\npropiciar el reconocimiento ambiental, social y económico del agua. h) fomentar\nel uso eficiente del agua.\n\nArtículo 4º-Definiciones.\nPara efectos de este reglamento se entenderá como:\n\na)   \nAgencia\nIntermunicipal del Río María Aguilar: AIRMA\n\nb)   \n Alcalde: Cualquiera de los cuatro alcaldes de\nlos municipios adherentes a este Acuerdo.\n\nc)     \n Unidad ejecutora (UNE): órgano operativo,\nnombrado por el Consejo de la Agencia, para desarrollar y ejecutar proyectos o\nprogramadas acordados por el Consejo de la Agencia.\n\nCAPÍTULO 2\n\nDe la\nestructura orgánica de la Agencia\n\nIntermunicipal\ndel Río María Aguilar\n\nArtículo 5º-De\nla organización de la Agencia Intermunicipal del Río María Aguilar. La\nAgencia estará conformada por los siguientes órganos: a) Consejo de Agencia. b)\nSecretaría Técnica. c) Consejo Asesor. d) Consejo de Participación Social.\nAdemás, podrán formar parte comisiones ad hoc para realizar estudios\nespeciales, proyectos o actividades específicas.\n\nArtículo 6º-De\nla conformación del Consejo de Agencia. El Consejo de Agencia estará\nintegrado por los cuatro alcaldes de las municipalidades miembro, así como el\ndirector de la Secretaría Técnica, los alcaldes pueden delegar su representación\nen cualquiera de sus Vicealcaldes.\n\nArtículo 7º-De\nlas funciones del Consejo de Agencia. El Consejo de la Agencia tendrá las\nsiguientes funciones: a) Tomar los acuerdos necesarios para cumplir con los\nobjetivos de la Agencia. b) Aprobar la integración y reglamentos de funcionamiento\nde los otros órganos de la Agencia. c) Designar y nombrar al director de la\nSecretaría Técnica. d)Aprobar la estructura orgánica de la Secretaría Técnica.\ne) Aprobar los planes de trabajo anuales de la Agencia. f) Aprobar el\npresupuesto anual de la Agencia. g) Aprobar las políticas sobre uso del suelo y\nla gestión de los recursos hídricos en la Subcuenca. h) Aprobar los convenios\nde cooperación con instituciones públicas o privadas, nacionales e\ninternacionales, que actúen sobre el territorio de la Subcuenca del Río María\nAguilar y de la Cooperación Internacional. i) Aprobar las normas de ejecución\npresupuestaria y de contratación, todo ello conforme a la normativa de\ncontratación pública pertinente. j) Promover la participación de las autoridades\nestatales, usuarios del agua y grupos interesados de la sociedad en la\nformulación, aprobación, seguimiento y evaluación de los planes de gestión\nhídrica de la subcuenca del Río María Aguilar. k) Conocer las observaciones\nrealizadas por el Consejo Asesor y el Consejo de Participación Social, a los\nplanes, políticas y proyectos que se ejecuten en el marco de la Agencia. l)\nFormar comisiones ad hoc para realizar estudios especiales, proyectos o\nactividades específicas.\n\nArtículo 8º-De\nlos acuerdos del Consejo de la Agencia Intermunicipal del Río María Aguilar.\nLos acuerdos relacionados con políticas de uso del suelo, de inversiones\nconjuntas, con convenios con otras entidades públicas (distintas a los cuatro municipios),\ncon agencias de cooperación serán tomados por unanimidad. Los demás acuerdos\nrequieren un mínimo de tres votos.\n\nArtículo 9º-De\nla Presidencia del Consejo de la Agencia. Se designará de su seno un\nPresidente, que representará al Concejo de Agencia, éste elaborará las agendas\nde las reuniones y presidirá las sesiones. El Presidente será electo por un periodo\nde un año y la presidencia deberá rotarse entre los alcaldes que lo componen.\nDeberá además informar al Consejo marcha de los proyectos y de los avances en\nla gestión de la subcuenca.\n\nArtículo 10.-De\nlas sesiones del Consejo de la Agencia. La Agencia sesionará ordinariamente\nuna vez por bimestre, en la fecha, hora y sede que fije su Presidente,\nsesionará extraordinariamente cuando sea convocado por el Presidente o dos de sus\nmiembros. Las convocatorias se realizarán a través de correo electrónico.\n\nArtículo 11.-De\nla Secretaría del Consejo de la Agencia. El Director de la Secretaría\nTécnica, será nombrado por los miembros del Consejo de la Agencia. El Director,\no quien este designe, tendrá las funciones de Secretaría del Consejo de la Agencia,\nasí mismo deberá asistir a las sesiones del Consejo de la Agencia con voz, pero\nsin voto.\n\nArtículo 12.-De\nlas funciones de la Secretaría Técnica.\n\nSerán funciones\nde la Secretaría Técnica, las siguientes: a) Ejecutar los acuerdos que tome el\nConsejo de la Agencia. b) Proponer al Consejo de la Agencia, las políticas, los\nproyectos y los planes de acción y operativos para cumplir con los fines y\nobjetivos de la agencia. c)Ejecutar el presupuesto acordado por el Consejo de\nla Agencia. d) Dar seguimiento a los proyectos y obras en ejecución de la\nagencia. e) Informar al Consejo de la Agencia sobre la aplicación de políticas,\nnormas, proyectos y presupuesto de la Agencia. g) Garantizar el buen\nfuncionamiento de los Consejos Asesor y de Participación Social. h) Deberá\nllevar el registro de organizaciones integrantes del Consejo de Participación\nSocial. i) Buscar la armonización de los planes de ordenamiento territorial y\nlas normas de uso del suelo que rigen en el territorio de la Subcuenca del Río\nMaría Aguilar. j) Fungirá como Secretaría del Concejo de Agencia. k) Crear y\nmantener actualizado un sistema de información que, entre otras cosas, recoja\nlas regulaciones urbanísticas y de uso del suelo de los cuatro municipios, la\nocupación actual del suelo y sus conflictos con la normativa, las regulaciones\nmunicipales y nacionales sobre la dinámica del Río María Aguilar y de sus\nafluentes, de las normas de manejo y aprovechamiento de las aguas pluviales y\nsobre la calidad de los vertidos a los cuerpos de agua de la subcuenca, sobre\nla ocupación del área de protección del Río María Aguilar y sus afluentes,\nsobre las concesiones de usos de agua, sobre la pluvialidad y clima en la\nsubcuenca y otras informaciones de interés para el cumplimiento de los\nobjetivos de la Agencia. l) Elaborar un informe anual sobre el estado de la\nsubcuenca que deberá ser conocido y aprobado por el Consejo de la Agencia. m)\nInformar al Consejo de la Agencia sobre las brechas existentes entre la\nnormativa de las municipalidades que la integran, así como de la brecha entre\nestas normativas y las que se requieren para el manejo integral de la\nsubcuenca.\n\nArtículo 13.-De\nlas responsabilidades del Director. Serán funciones del Director de la\nSecretaría Técnica, las siguientes:\n\na) Fungir como\nresponsable del personal y de la ejecución de los planes y actividades que se\nejecuten por este órgano. b) El Director será el responsable de los bienes al\nservicio de la Unidad Ejecutora y de la ejecución del presupuesto. c) El\nDirector propondrá al Consejo de la Agencia la estructura de la Unidad\nEjecutora. d) El Director asignará las responsabilidades a cada uno de los\nmiembros de la Unidad Ejecutora. e) El Director será el responsable de los\ninformes que la Unidad Ejecutora debe entregar al Consejo de la Agencia. f) Fungirá\ncomo secretaría del Concejo de Agencia. g) Informar al Consejo de Agencia sobre\nla marcha de los proyectos y de los avances en la gestión de la Subcuenca.\n\nArtículo 14.-Del\nConsejo Asesor. El Consejo de la Agencia nombrará un Consejo Asesor\nprocurando la participación de representantes de las entidades estatales,\nmunicipalidades suscritoras del convenio y centros universitarios que tengan relación\ncon el manejo de los recursos hídricos y con centros científicos y técnicos o\nindividuos, especializados en recurso hídricos, manejo de cuenca u ordenamiento\nurbano, además, dos representantes del Consejo de Participación Social.\n\nArtículo 15.-Del\nCoordinador del Consejo Asesor. El Consejo Asesor nombrará de su seno un\ncoordinador de sus sesiones, quién los convocará, con el apoyo de la UNE, y\npropondrá la agenda de sus reuniones.\n\nArtículo 16.-De\nlas sesiones del Consejo Asesor El Consejo Asesor se reunirá ordinariamente\ncada tres meses y extraordinariamente cuando lo convoque el Coordinador o el Consejo\nde la Agencia. El Consejo de la\nAgencia podrá modificar su contenido y alcance en cualquier momento, siguiendo\nel procedimiento y limitaciones establecidas en este documento y en el Convenio\nIntermunicipal.\n\nArtículo 24.-Vigencia.\nEste Reglamento rige a partir de su publicación en el Diario Oficial, La\nGaceta.", "body_en_text": "throughout the entire text\n\n -\n\n Complete Text of Norm 115\n\n Internal Regulations for the Operation of the Río María Aguilar Sub-basin Intermunicipal Agency\n\nComplete Text of Act: 131B06\n\nRÍO MARÍA\nAGUILAR\nSUBBASIN\nINTERMUNICIPAL AGENCY\n\nINTERNAL\nREGULATIONS FOR THE OPERATION\n\nOF THE\nRÍO MARÍA AGUILAR\nSUBBASIN\nINTERMUNICIPAL AGENCY\n\nBased on\nArticle 169 of the Political Constitution, Article 9 of the Municipal Code,\nand according to municipal agreements, from Ordinary Sessions No. 115 of September 28,\n2017 of the Municipal Council of La Unión, No. 079 of October 27,\n2017 of the Municipal Council of Curridabat, No. 091 of January 23, 2018 of the\nMunicipal Council of San José, and No. 02 of February 7, 2018 of the Municipal\nCouncil of Montes de Oca, the Internal Regulations for the\nOperation of the Río María Aguilar Sub-basin Intermunicipal Agency are hereby decreed, which\nshall be governed by the following provisions:\n\nWhereas:\n\nI.—That\nArticle 50 of the Political Constitution recognizes the right of every person to\nenjoy a healthy and ecologically balanced environment, as well as the duty of the\nState to guarantee, defend, and preserve said right.\n\nII.—That in\naccordance with Article 169 of the Political Constitution, the\nMunicipality is responsible for the administration of local interests and services.\n\nIII.—That in\naccordance with Article 3 of the Municipal Code, municipalities may\ninvest public funds with other municipalities and Public Administration institutions\nfor the fulfillment of local, regional, or national purposes.\n\nIV.—That\nArticle 9 of the Municipal Code establishes the power of municipalities\nto enter into agreements among themselves whose purpose is to facilitate and enable the\nfulfillment of their objectives.\n\nV.—That on March 7,\n2018, the mayors of the municipalities of the cantons of San José,\nMontes de Oca, Curridabat, and La Unión signed an Intermunicipal Cooperative Agreement\nby which the Río María Aguilar Sub-basin Intermunicipal Agency was created,\nwhose objective is its integrated management to\nincorporate new infrastructure that allows for retarding, infiltrating, containing,\nreusing, and draining these waters, and that regulates the use of potable water for human\nconsumption.\n\nVI.—That the\nthird resolution of the Intermunicipal Cooperative Agreement established an Agency\nCouncil, which is a collegial directive body composed of the\nmayors of the signatory municipalities.\n\nVII.—That these\nRegulations shall form part of and be integrated into the regulatory system applicable to\nthe management of the Río María Aguilar Sub-basin, which is composed of other\nnorms and legal instruments such as the National Development Plan, the\nRegional Plan for Territorial Planning of the Greater Metropolitan Area - Plan\nGAM 2013-2030, other planning instruments of the Ministry of Housing and\nHuman Settlements (MIVAH), the Plan for the Río María y Aguilar Interurban Biological Corridor, etc.\n\nVIII.—That the fourth\nresolution of the Intermunicipal Cooperative Agreement empowered the Agency Council\nto prepare and approve internal Regulations, for the purpose of regulating\nthe functions of the Agency's bodies, as well as its operational and\nfinancial management.\n\nTherefore,\n\nIt is decreed:\n\nINTERNAL\nREGULATIONS FOR THE OPERATION\n\nOF THE\nRÍO MARÍA AGUILAR SUBBASIN\nINTERMUNICIPAL AGENCY\n\nCHAPTER 1\n\nGeneral\nProvisions\n\nArticle 1—Purpose.\nThe purpose of these regulations is to comprehensively regulate the Río María Aguilar Sub-basin\nIntermunicipal Agency. Therefore, it establishes\nthe norms and procedures for its operation.\n\nArticle 2—Scope.\nThese regulations shall have their mandate of action in the territory comprised within\nthe following limits:\n\n1. The highest\npoint of the Río María Aguilar sub-basin (subcuenca) is located at Alto Pizote at 1640\nm.a.s.l., geographic coordinates 9°56'19\" N latitude and 83°58'22\" W longitude, between\nthe districts of San Ramón of the canton of La Unión and Dulce Nombre of the canton of La Unión;\nin addition, it borders the South-West sector of the Río Tiribí Protective Zone.\nThe Northern limit of the sub-basin (subcuenca) extends 4.4 km in an East-West direction along\nnational route 202 on a path that passes through the Valle\nEscondido, Limburgia, and Las Cumbres residential developments, the center of San Ramón until\nreaching San Rafael de Montes de Oca, at a point whose elevation is 1355\nm.a.s.l. Next, national route 202 changes its direction heading\nNorthwest at an angle of 147°, then continues a distance close to 600\nmeters, passing by the main entrance of Parque del Este, up to the elevation\ncontour of 1335 m.a.s.l. South of the Catholic church of San Rafael de\nMontes de Oca. This trajectory follows 800 meters toward the West in a direction\nparallel to national route 202 passing by route 203. Then it continues, 350\nmeters toward the Northwest, at an angle of 136°, to the San Agustín Seminary,\nin Sabanilla de Montes de Oca.\n\nAfter this\npoint the limit changes its direction toward the Southwest over a distance of 2.5\nkm, crossing Cedros de Sabanilla, continuing along avenida 17 until reaching the\ndistrict limit of San Pedro with Sabanilla (of Montes de Oca), on\ndiagonal 11 reaching the point where calle 77 crosses the railway\nline. It continues for 2 Km toward the West, passing by the José\nJoaquín Vargas Calvo High School, on national route 39 (circunvalación), 100 m north\nof the Rotonda de la Hispanidad. Subsequently, a straight line is drawn to\nthe headquarters of the Universidad Estatal a Distancia (in front of calle 37), entering the\ncanton of San José.\n\nAfterward, it changes its\ncourse toward the northwest at an angle of 138° for approximately 600 meters,\nto calle 25, between avenidas 9 and 11. Subsequently, the limit takes a southwesterly\ndirection, over a distance of 1.15 km, at an angle of 162°, crossing the\nHospital Dr. Rafael Ángel Calderón Guardia and parque España, reaching a\ncentral point of the block situated between avenidas 5 and 7 and calles 3 and 5. From\nthis site, the Sub-basin (subcuenca) limit turns its direction 140° South,\ncrossing La Catedral Metropolitana and toward the West entering the\nHospital district, until reaching the area of the Escuela Porfirio Brenes, with a\ntotal distance covered in this section of approximately 850 meters. Then, it turns 125°\nSouthwest and extends its route 950 meters heading toward the tanks of the Instituto\nCostarricense de Acueductos y Alcantarillados. At this point, the Sub-basin (subcuenca)\nlimit again heads toward the Northwest, covering a distance of\n1 km from the Cementerio General to the parque Beneméritos de la Patria. There,\nit changes its course to the Southwest and travels 300 meters until reaching the Gimnasio Nacional,\nin the district of Mata Redonda. Immediately, the limit is drawn toward the\nNorthwest covering a distance of 1.4 Km that surrounds the Lago de la Sabana on\nits North sector, and moves toward the Estadio Nacional. Afterward, it travels 500\nmeters toward the Southwest, at an angle of 138° passing by the parque Rancho\nLuna until encountering the autopista Próspero Fernández (route 27). Then, it heads\n650 meters toward the West where the recreational zone of the Americana\nresidential development, known as \"Parque Holanda,\" is located; in the lower part\nof the sub-basin (subcuencas) geographic coordinates 9°55'57\" N latitude and -84°07.06\" W longitude.\nThe limit continues, 500 meters South, toward the northern sector of Hatillo 7,\nwhere the confluence between the María Aguilar and Tiribí rivers occurs at the elevation\ncontour of 1045 m.a.s.l.1 Afterward, it moves 2.3 km Southeast, crossing\nHatillo 8, Hatillo 2, and Hatillo 1. The Sub-basin (subcuenca) limit turns at an angle\nof 133° toward the South and moves 1.8 km passing by the park of Hatillo\nCentro, to the south of the Clínica Solón Núñez at an elevation of 1125 m.a.s.l.\nIt travels approximately 900 meters toward the East, passes by the Parque 25 de Julio,\nand reaches the sports plaza of Colonia Kennedy, in the district of San Sebastián.\n\nThen, it makes\na turn of 105° toward the South and moves 600 meters until reaching avenida 58\nand follows 2.75 Km heading East, crossing the Escuela República de Haití, the Seminario\nMayor, and the Jardines de Cascajal residential development, enters the district of San\nFrancisco de Dos Ríos, and travels a distance of 250 meters to the neighborhood of Los\nSauces.\n\nThen, it turns\n152° heading Northeast traveling 450 meters in the direction of Barrio\nHispano. Next, its course changes by 125° toward the Southeast, traveling a distance\nof 2.1 Km parallel to national route 211 until reaching the limit between the\ndistrict of San Francisco de Dos Ríos and the canton of Curridabat. The route\ncontinues 2.5 Km along avenida 56 of the district of Curridabat, passes to the North of Barrio\nChapultepec, south of parque La Troja, and between the Barrios Hacienda Vieja and\nLomas del Sol heading northeast to the autopista Florencio del Castillo (route\n252).\n\nFrom this\npoint it heads 350 meters at an angle of 153°, crossing the district of\nSánchez through Lomas de Ayarco Sur, to then travel a distance of 550 meters\nuntil reaching the elevation contour of 1235 m.a.s.l; limit between the districts of\nSánchez (Curridabat) and San Juan (La Unión).\n\nIt continues 2 Km along\nnational route 251 from west to east, until reaching the Saint Gregory\nSchool. Next, it heads Northeast 1.1 Km in distance, passing by the 1 Starting\nfrom this point the limit of the Río María Aguilar sub-basin (subcuenca) heads in\na West - East direction. ICE substation in Tres Ríos, then crosses the\ndistrict of Concepción until reaching national route 221 where\nthe limit between the districts of Concepción and Dulce Nombre de La Unión is found. By\nlast, it turns to the northeast at an angle of 110° traveling 3.5 Km through the district\nof Dulce Nombre, passes by the Catholic temple of this community, continues along\nnational route 202, passes the entrance to the Naturaleza de Este residential development, and\nagain heads toward the South sector of the Hospital Psiquiátrico Chacón Paút,\nuntil reaching the upper part of the sub-basin (subcuenca) at the elevation contour of 1640\nm.a.s.l, in the place known as Alto Pizote.\n\nArticle 3—Objectives.\n\na) To ensure the\nhealth, recreation, and well-being of its residents. b) To conserve and preserve the\nwater and soils of the Río María Aguilar Sub-basin (subcuenca). c) To build new paradigms\nfor urban development, which substantially modify the relationship between\nurban occupation of the territory and management of stormwater (aguas pluviales), wastewater (aguas\nresiduales), potable water, and bodies of water.\nd) To improve the standards for stormwater management (manejo de aguas pluviales) to incorporate new\ninfrastructure that allows for retarding, infiltrating, containing, reusing, and draining these\nwaters, and that regulates the use of potable water for human consumption. e) To develop\ncorridors and living spaces that improve the quality of life for citizens.\nf) To promote interventions to recover the Río María Aguilar as a biodiverse\nspace, and as a connector and living corridor of the urban space. g) To promote and\nfoster the environmental, social, and economic recognition of water. h) To promote\nthe efficient use of water.\n\nArticle 4—Definitions.\nFor the purposes of these regulations, the following shall be understood as:\n\na)   \nRío María Aguilar Intermunicipal Agency: AIRMA\n\nb)   \n Mayor: Any of the four mayors of\nthe municipalities adhering to this Agreement.\n\nc)     \n Executing Unit (Unidad Ejecutora, UNE): operational body,\nappointed by the Agency Council, to develop and execute projects or\nprograms agreed upon by the Agency Council.\n\nCHAPTER 2\n\nOf the\nOrganic Structure of the Río María Aguilar\n\nIntermunicipal\nAgency\n\nArticle 5—On\nthe Organization of the Río María Aguilar Intermunicipal Agency. The\nAgency shall be composed of the following bodies: a) Agency Council. b)\nTechnical Secretariat. c) Advisory Council. d) Social Participation Council.\nIn addition, ad hoc commissions may form part to carry out special\nstudies, projects, or specific activities.\n\nArticle 6—On\nthe Composition of the Agency Council. The Agency Council shall be\ncomposed of the four mayors of the member municipalities, as well as the\ndirector of the Technical Secretariat; the mayors may delegate their representation\nto any of their Deputy Mayors.\n\nArticle 7—On\nthe Functions of the Agency Council. The Agency Council shall have the\nfollowing functions: a) To adopt the necessary resolutions to fulfill the\nobjectives of the Agency. b) To approve the integration and operating regulations\nof the other bodies of the Agency. c) To designate and appoint the director of the\nTechnical Secretariat. d) To approve the organic structure of the Technical Secretariat.\ne) To approve the annual work plans of the Agency. f) To approve the\nannual budget of the Agency. g) To approve the policies on land use and\nthe management of water resources in the Sub-basin (Subcuenca). h) To approve the cooperation\nagreements with public or private, national and international\ninstitutions, that act within the territory of the Río María Aguilar\nSub-basin (Subcuenca) and International Cooperation. i) To approve the budget execution\nand contracting norms, all in accordance with the pertinent public\ncontracting regulations. j) To promote the participation of state\nauthorities, water users, and interested groups of society in the\nformulation, approval, monitoring, and evaluation of the water management plans\nof the Río María Aguilar Sub-basin (subcuenca). k) To be aware of the observations\nmade by the Advisory Council and the Social Participation Council, to the\nplans, policies, and projects executed within the framework of the Agency. l) To\nform ad hoc commissions to carry out special studies, projects, or\nspecific activities.\n\nArticle 8—On\nthe Resolutions of the Río María Aguilar Intermunicipal Agency Council.\nResolutions related to land-use policies, joint\ninvestments, agreements with other public entities (other than the four municipalities),\nwith cooperation agencies shall be adopted by unanimity. Other resolutions\nrequire a minimum of three votes.\n\nArticle 9—On\nthe Presidency of the Agency Council. A President shall be designated from among its members,\nwho shall represent the Agency Council, shall prepare the agendas\nfor the meetings, and shall preside over the sessions. The President shall be elected for a period\nof one year, and the presidency must be rotated among the mayors that compose it.\nThey must also inform the Council of the progress of the projects and advancements in\nthe management of the sub-basin (subcuenca).\n\nArticle 10—On\nthe Sessions of the Agency Council. The Agency shall hold ordinary sessions\nonce per bimonthly period, on the date, time, and at the venue set by its President;\nit shall hold extraordinary sessions when convened by the President or two of its\nmembers. Calls to session shall be made via email.\n\nArticle 11—On\nthe Secretariat of the Agency Council. The Director of the Technical\nSecretariat shall be appointed by the members of the Agency Council. The Director,\nor whoever they designate, shall have the functions of Secretariat of the Agency Council;\nlikewise, they must attend the sessions of the Agency Council with voice, but\nwithout vote.\n\nArticle 12—On\nthe Functions of the Technical Secretariat.\n\nThe functions of\nthe Technical Secretariat shall be the following: a) To execute the resolutions adopted by the\nAgency Council. b) To propose to the Agency Council the policies,\nprojects, and action and operational plans to fulfill the purposes and\nobjectives of the agency. c) To execute the budget agreed upon by the Agency\nCouncil. d) To follow up on the projects and works under execution by the\nagency. e) To inform the Agency Council on the application of policies,\nnorms, projects, and budget of the Agency. g) To guarantee the proper\nfunctioning of the Advisory and Social Participation Councils. h) Must\nmaintain the registry of organizations that are members of the Social Participation\nCouncil. i) To seek the harmonization of territorial planning plans and\nland-use norms that govern the territory of the Río María Aguilar\nSub-basin (Subcuenca). j) Shall serve as Secretariat of the Agency Council. k) To create and\nkeep updated an information system that, among other things, collects\nthe urban planning and land-use regulations of the four municipalities, the\ncurrent land occupation and its conflicts with the regulations, the municipal\nand national regulations on the dynamics of the Río María Aguilar and its\ntributaries, the management and utilization norms for stormwater (aguas pluviales) and\non the quality of discharges into the bodies of water of the sub-basin (subcuenca), on\nthe occupation of the protection area of the Río María Aguilar and its tributaries,\non water use concessions, on rainfall and climate in the\nsub-basin (subcuenca), and other information of interest for the fulfillment of the\nobjectives of the Agency. l) To prepare an annual report on the state of the\nsub-basin (subcuenca) that must be known and approved by the Agency Council. m) To\ninform the Agency Council about the existing gaps between the\nregulations of the municipalities that compose it, as well as the gap between\nthese regulations and those required for the comprehensive management of the\nsub-basin (subcuenca).\n\nArticle 13—On\nthe Responsibilities of the Director. The functions of the Director of the\nTechnical Secretariat shall be the following:\n\na) To serve as\nresponsible for the personnel and the execution of the plans and activities\nexecuted by this body. b) The Director shall be responsible for the assets at\nthe service of the Executing Unit and for the execution of the budget. c) The\nDirector shall propose to the Agency Council the structure of the Executing Unit.\nd) The Director shall assign the responsibilities to each of the\nmembers of the Executing Unit. e) The Director shall be responsible for the\nreports that the Executing Unit must deliver to the Agency Council. f) Shall serve\nas secretariat of the Agency Council. g) To inform the Agency Council about\nthe progress of the projects and advancements in the management of the Sub-basin (Subcuenca).\n\nArticle 14—On the\nAdvisory Council. The Agency Council shall appoint an Advisory Council\nseeking the participation of representatives from state entities,\nmunicipalities that are signatories to the agreement, and university centers that are related\nto the management of water resources, and scientific and technical centers or\nindividuals specialized in water resources, basin management, or urban\nplanning, plus two representatives from the Social Participation Council.\n\nArticle 15—On the\nCoordinator of the Advisory Council. The Advisory Council shall appoint from among its members a\ncoordinator for its sessions, who shall convene them, with the support of the UNE, and\npropose the agenda for their meetings.\n\nArticle 16—On\nthe Sessions of the Advisory Council. The Advisory Council shall meet ordinarily\nevery three months and extraordinarily when convened by the Coordinator or the Agency\nCouncil. The call to session shall be made via email.\n\nArticle 17—On\nthe Functions of the Advisory Council. The functions of the Advisory Council shall be\nthe following: a) To be informed of all plans, policies, and projects executed\nwithin the framework of the Agency. b) To address all consultations made by the\nAgency Council.\n\nArticle 18—On\nthe Composition of the Social Participation Council. The Technical Secretariat\nshall establish a registry for voluntary registration of community\norganizations, non-governmental organizations, and secondary school student governments\nthat have an interest in joining the Social Participation Council and that\nhave a direct relation with the territory of the sub-basin (subcuenca). The Agency\nCouncil shall determine the composition and number of members of this Council.\n\nArticle 19—On\nthe Sessions of Social Participation. The Social Participation Council\nshall hold ordinary sessions twice a year and extraordinarily when\nconvened by the Agency Council. The call to session shall be made through email.\n\nArticle 20—On\nthe Functions of the Social Participation Council. The functions of the\nSocial Participation Council shall be the following: a) To be informed of all plans,\npolicies, and projects executed within the framework of the Agency. b) To address\nall consultations made by the Agency Council.\n\nCHAPTER 3\n\nOf the\nFinancing and Budget\n\nExecution\nof the Agency\n\nArticle 21—On\nFinancing. The Agency shall be financed with resources contributed by the\nmunicipalities that compose it, which shall include an item in their\nannual budgets. It may also receive and execute resources from\npublic or private, national and international institutions.\n\nArticle 22—On\nBudget Execution. The budget execution of the Agency\nshall be subject to the norms and principles established in the Municipal Code and\nother regulations in force in public law.\n\nCHAPTER 4\n\nOf the\nEffectiveness of the Regulations\n\nArticle 23—On\nthe Effectiveness of the Regulations. These regulations shall remain in effect\nas long as the Intermunicipal Agreement that created the Agency subsists, including\nthe extensions approved by agreement of the signatory parties. The Agency\nCouncil may modify its content and scope at any time, following\nthe procedure and limitations established in this document and in the Intermunicipal\nAgreement.\n\nArticle 24—Effectiveness.\nThese Regulations take effect upon their publication in the Official Gazette, La\nGaceta." }
