Acápite\nb) de la Ley N° 6227 del 2 de mayo de 1978, Ley General de la Administración\nPública, los artículos 2, 3, incisos j) y o) del artículo 4 de la Ley N° 4895\ndel 16 de noviembre de 1971, Ley de la Corporación Bananera Nacional, y Ley Nº\n5515 de 19 de abril de 1974; Impuesto sobre Exportación de Cajas o Envases de\nBanano.\n\nConsiderando:\n\nI.-Que la actividad bananera, es la principal actividad agrícola de\nexportación costarricense, de gran aporte al valor agregado agropecuario, y que\nademás es una de las ramas agrícolas que más mano de obra utiliza por hectárea,\nespecialmente en zonas del país que no han contado con otras actividades\nproductivas y que, como la bananera, coadyuven tan determinantemente en su\ndesarrollo.\n\nII.-Que en la actividad bananera, Costa Rica se ha caracterizado por los esfuerzos realizados en los\ncampos de la eficiencia productiva, ecológico y social, pues, es el país bananero que tiene la mayor\neficiencia por hectárea en producción y el que ostenta las mejores condiciones socio- laborales y\nambientales de producción, lo cual el Gobierno desea que se mantenga, dadas las ventajas que ello\nbrinda a la población laboral de dicha actividad y a las poblaciones aledañas a las fincas, en favor\nde las futuras generaciones.\n\nIII.-Que con los recursos de la Ley Nº 5515 de 19 de abril de 1974, se\nautoriza al Poder Ejecutivo para destinar una parte del impuesto bananero al\nproductor.\n\nIV.-Que la ley Nº 4895 y sus reformas, establece que la Corporación\nBananera Nacional (CORBANA), tiene como objetivo fundamental el desarrollo\nbananero nacional, y la autoriza para otorgar créditos a los productores\nbananeros, según su reglamentación interna.\n\nV.-Que en el Decreto Nº 16563-MAG de 24 de setiembre de 1985, artículo 12, se estableció las bases\npara la creación de la Junta Administradora del Fondo de Contingencias Bananeras, y en el Decreto Nº\n16564-P-H-MEC, de 24 de setiembre de 1985, artículo 5, se estableció la fuente de los recursos que\nconstituirían dicho Fondo. Posteriormente, en el Decreto Nº 17890-H-MAG de 29 de setiembre de 1987\nse reguló el Fondo de Contingencias Bananeras, mientras que los Decretos Ejecutivos Nº 22668 MAG-H y\nNº 29594 MAG-H, definieron los objetivos de este, con el fin de dar financiamiento a aquellos\nproductores bananeros que necesiten atender emergencias o las consecuencias de las emergencias,\nprovocadas por desastres naturales.\n\nPosteriormente, diferentes elementos de este fondo fueron modificados o ampliados en otros decretos\nque se indicarán, los cuales se propone dejar sin efecto por cuanto han cumplido con los alcances y\nobjetivos para los que fueron establecidos en su momento.\n\nVI.-Que durante las décadas de 1940 y 1950 el hongo causante de la\nmarchitez por Fusarium (Fusarium oxysporum f.sp. cubense: Foc raza 1) provocó\nabandono de plantaciones con grandes pérdidas económicas y sociales y obligó a\nque se sustituyera en las plantaciones para exportación el cultivar ´Gros\nMichel´ por cultivares del subgrupo Cavendish que son naturalmente resistentes\na Foc raza 1, pero susceptibles a la raza 4 tropical de este patógeno (Foc\nR4T).\n\nVII.-Que existe desde 1989 en adelante en el sureste Asiático (primero\nMalasia, Filipinas, Indonesia, Taiwán, China), Asia Central (Pakistán), Oceanía\n(Australia), Oriente Medio (Jordania, Líbano, Omán) y África (Mozambique),\nColombia (América, agosto 2019) una variante del hongo Fusarium oxysporum f.sp.\ncubense denominada \"raza 4 Tropical (Foc R4T)\" que afecta a los cultivares de\nbanano del subgrupo Cavendish y a otra gran cantidad de variedades de bananos y\nplátanos de importancia económica y social.\n\nVIII.-Que Costa Rica ha venido adoptando una serie de medidas como la\nelaboración de la Ficha Técnica Foc R4T para dar inicio a la solicitud de un\nAnálisis de Riesgo de Plagas (ARP) en el año 2015; en el año 2016 el Servicio\nFitosanitario del Estado adoptó el SFE-ARP 004-2016; el Poder Ejecutivo\npromulgó el Decreto Ejecutivo Nº 40364-MAG correspondiente a las Disposiciones\nGenerales para la prevención del hongo Fusarium Oxysporum f.sp Cubense Raza 4\nTropical (Foc R4T) agente causal de la marchitez por fusarium en cultivares\ncavendish y otras musáceas de importancia Económica y Social; las medidas del\ndecreto anterior entraron en vigencia el 5 de junio de 2018 una vez\ntranscurrido el plazo para observación y una vez\nnotificado a la OMC.\n\nIX.-Que se requiere fortalecer el accionar del Estado, mediante el\nMinisterio de Agricultura y Ganadería y sus órganos desconcentrados, a cargo de\nla sanidad de animales y plantas, por lo que se propone trasladar los recursos\ndel fondo de contingencias bananeras cuyo origen fue fundamentalmente la Ley Nº\n5515 a un nuevo fondo que se denominará \"Fondo para la prevención, exclusión\ny combate del Fusarium oxysporum f. sp cubense raza 4 tropical y de\notras plagas y enfermedades que afecten el cultivo de banano\",\nadministrado por la Corporación Bananera Nacional; de esa forma, el fondo de\ncontingencias bananeras se liquidaría.\n\nX.-Que el nuevo Fondo para la prevención, exclusión y combate del Fusarium oxysporum f. sp cúbense\nraza 4 tropical y de otras plagas y enfermedades, se utilizará para apoyar al Estado en la\nconstrucción de infraestructura de prevención en puertos, aeropuertos, fronteras, carreteras\nnacionales, compra de materiales para la prevención, exclusión y eventual contención del Fusarium\noxysporum f. sp cubense raza 4 tropical de forma prioritaria, entrenamiento o capacitación de\nfuncionarios públicos, y una parte, para apoyar los esfuerzos de los productores bananeros\nprioritariamente en la atención de Fusarium oxysporum f. sp cubense raza 4 tropical y, de forma no\nprioritaria, en la atención de otras plagas y enfermedades que afecten el cultivo de banano,\nmediante créditos reembolsables según las disposiciones del Reglamento General de Préstamos a\nProductores de CORBANA. También podrán utilizarse los recursos de este fondo para apoyar la\nrealización de actividades nacionales e internacionales de coordinación o capacitación con el fin de\nrealizar acciones coordinadas con otros gobiernos o con organismos internacionales como OIRSA.\n\nXI.-Que de conformidad con los párrafos segundo y tercero del artículo\n12 bis del Reglamento a la Ley de Protección al Ciudadano del Exceso de\nRequisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del\n22 de febrero de 2012; se procedió a llenar la Sección I denominada \"Control\nPrevio de Mejora Regulatoria\" del\n\"Formulario de Evaluación Costo Beneficio\", siendo que la evaluación de la propuesta\nnormativa dio resultado negativo y que no contiene trámites, requisitos ni\nprocedimientos, por lo que se determinó que no se requería proseguir con el\nanálisis regulatorio de cita. Por tanto,\n\nDecretan:\n\nCREACIÓN DEL FONDO DE PREVENCIÓN, EXCLUSIÓN\n\nY COMBATE CONTRA EL FUSARIUM OXYSPORUM F.SP\n\nCUBENSE RAZA 4 TROPICAL Y DE OTRAS PLAGAS\n\nY ENFERMEDADES QUE AFECTEN EL CULTIVO\n\nDE BANANO Y DEROGATORIA DEL FONDO\n\nDE CONTINGENCIAS BANANERAS\n\nArtículo 1º-Creación y destino del nuevo fondo. Se autoriza el\ntraslado de los recursos que conforman actualmente el Fondo de Contingencias\nBananeras, a un nuevo fondo denominado: \"Fondo para la prevención, exclusión y\ncombate del Fusarium oxysporum f. sp cubense raza 4 tropical y de otras plagas\ny enfermedades que afecten el cultivo de banano\" que tiene por objetivo\nprioritario la prevención, exclusión y combate contra el Fusarium oxysporum f.\nsp cubense raza 4 tropical.\n\nEn forma no prioritaria, podrán destinarse parte de estos recursos para\nla atención de emergencias ocasionadas por otras plagas y enfermedades que\nafecten el cultivo de banano.\n\nArtículo 2º-Objetivos\ndel fondo. Este fondo tendrá como objetivo apoyar al Estado en la\nconstrucción de infraestructura, mantenimiento de esta, compra de materiales,\nequipos e insumos, entrenamiento o capacitación de funcionarios; en puertos,\naeropuertos, fronteras, carreteras nacionales, para la prevención y eventual\ncontención del Fusarium oxysporum f.sp. cubense raza 4 tropical.\n\nTambién podrán\nutilizarse los recursos de este fondo para apoyar la realización de actividades\nnacionales e internacionales de coordinación o capacitación con el fin de\nrealizar acciones coordinadas con otros gobiernos o con organismos\ninternacionales.\n\nDe igual forma,\npodrán utilizarse recursos para apoyar las investigaciones estratégicas para\nprevención, exclusión y combate del Fusarium oxysporum f.sp. cubense raza 4\ntropical.\n\nEn caso de que el\nFusarium oxysporum f.sp. cubense raza 4 tropical llegué a territorio nacional,\nel fondo podrá destinarse a actividades de combate de la plaga.\n\nTambién se autoriza\na COREANA, a utilizar parte de estos recursos para la atención de emergencias\nocasionadas por otras plagas y enfermedades relacionadas con el cultivo de\nbanano, según criterio fundamentado de la Junta Directiva de dicho ente.\n\nLos recursos de este\nfondo podrán utilizarse en aumentar, la capacidad diagnostica de los\nlaboratorios del SFE y COREANA.\n\nEl Servicio\nFitosanitario del Estado, el Servicio Nacional de Salud Animal, o cualquier\ndependencia del Estado, podrán solicitar recursos para cumplir con los\nobjetivos de este decreto, para lo cual dirigirán a COREANA una solicitud, que\nincluya un estudio técnico del proyecto y sus costos, con base en el cual\nCOREANA y teniendo en cuenta los recursos disponibles, procederá cuando\ncorresponda a su ejecución.\n\nEl 100% de los\nrecursos de este fondo se utilizará para las actividades descritas en este\nartículo, los cuales aplicará CORBANA a necesidades que se deban atender para\ncumplir los objetivos de este fondo.\n\n \n\n(Así\nreformado por el artículo 1° del decreto ejecutivo N° 44926 del 5 de febrero del\n2025)\n\nArtículo 3º-Derogatorias. Se derogan las siguientes disposiciones\nque regulan el fondo de Contingencias Bananeras:\n\na) Deróguese el artículo 11 y el inciso b) del artículo 12 del Decreto\nEjecutivo Nº 16563-MAG de 24 de setiembre de 1985, publicado en La Gaceta Nº\n186 de 01 de octubre de 1985.\n\nb) Deróguese el artículo 5 del Decreto Ejecutivo Nº 16564-P-HMEC, de 24\nde setiembre de 1985, publicado en La Gaceta Nº 186 de 01 de octubre de\n1985.\n\nc) Deróguese el Decreto Ejecutivo Nº 17890-H-MAG de 29 de setiembre de\n1987 publicado en La Gaceta Nº 32 de 16 de febrero de 1988.\n\nd) Deróguese el inciso b) del artículo 13 adicionado mediante el\nartículo 1 del Decreto Ejecutivo Nº 18224-MAG de 12 de abril de 1988, publicado\nen La Gaceta Nº 131 del 11 de julio de 1988.\n\ne) Deróguese los artículos 8 y 12 del Decreto Ejecutivo N°\n18995-P-MAG-MEC-H-MOPT, de 8 de mayo de 1989, publicado en La Gaceta Nº\n97 de 22 de mayo de 1989.\n\nf) Deróguese el Decreto Ejecutivo Nº 19705-MAG-H de 30 de marzo de 1990\npublicado en La Gaceta Nº 105 de 4 de junio de 1990.\n\ng) Deróguese los artículos 2 y 4 del Decreto Ejecutivo Nº\n19532-MAG-H-MEIC del 9 de marzo de 1990, publicado en La Gaceta Nº 52\ndel 14 de marzo 1990. Paragraph\nb) of Law N° 6227 of May 2, 1978, General Law of Public\nAdministration, articles 2, 3, subsections j) and o) of article 4 of Law N° 4895\nof November 16, 1971, Law of the National Banana Corporation, and Law Nº\n5515 of April 19, 1974; Tax on the Export of Boxes or Containers of\nBananas.\n\nConsidering:\n\nI.-That the banana activity is the main agricultural export\nactivity of Costa Rica, of great contribution to the agricultural added value, and that\nit is also one of the agricultural branches that uses the most labor per hectare,\nespecially in areas of the country that have not had other productive\nactivities and that, like the banana activity, so decisively contribute to their\ndevelopment.\n\nII.-That in the banana activity, Costa Rica has been characterized by the efforts made in the\nfields of productive, ecological and social efficiency, as it is the banana-producing country that has the highest\nefficiency per hectare in production and that boasts the best socio-labor and\nenvironmental production conditions, which the Government wishes to maintain, given the advantages this\nprovides to the working population of said activity and to the populations surrounding the farms, in favor\nof future generations.\n\nIII.-That with the resources of Law Nº 5515 of April 19, 1974, the\nExecutive Branch is authorized to allocate a part of the banana tax to the\nproducer.\n\nIV.-That Law Nº 4895 and its amendments establish that the National Banana\nCorporation (CORBANA) has as its fundamental objective the national\nbanana development, and authorizes it to grant credits to banana\nproducers, according to its internal regulations.\n\nV.-That in Decree Nº 16563-MAG of September 24, 1985, article 12, the bases were established\nfor the creation of the Administrative Board of the Banana Contingency Fund, and in Decree Nº\n16564-P-H-MEC, of September 24, 1985, article 5, the source of the resources that\nwould constitute said Fund was established. Subsequently, in Decree Nº 17890-H-MAG of September 29, 1987,\nthe Banana Contingency Fund was regulated, while Executive Decrees Nº 22668 MAG-H and\nNº 29594 MAG-H defined its objectives, in order to provide financing to those\nbanana producers who need to attend to emergencies or the consequences of emergencies\ncaused by natural disasters.\n\nSubsequently, different elements of this fund were modified or expanded in other decrees\nthat will be indicated, which it is proposed to render without effect as they have fulfilled the scope and\nobjectives for which they were established at the time.\n\nVI.-That during the 1940s and 1950s, the fungus causing\nFusarium wilt (Fusarium oxysporum f.sp. cubense: Foc race 1) caused\nabandonment of plantations with great economic and social losses and forced\nthe substitution in export plantations of the 'Gros\nMichel' cultivar with cultivars of the Cavendish subgroup that are naturally resistant\nto Foc race 1, but susceptible to tropical race 4 of this pathogen (Foc\nTR4).\n\nVII.-That since 1989 onwards, in Southeast Asia (first\nMalaysia, Philippines, Indonesia, Taiwan, China), Central Asia (Pakistan), Oceania\n(Australia), the Middle East (Jordan, Lebanon, Oman) and Africa (Mozambique),\nColombia (America, August 2019), there exists a variant of the fungus Fusarium oxysporum f.sp.\ncubense called \"Tropical race 4 (Foc TR4)\" that affects banana\ncultivars of the Cavendish subgroup and a large number of other banana and\nplantain varieties of economic and social importance.\n\nVIII.-That Costa Rica has been adopting a series of measures such as the\npreparation of the Technical Sheet Foc TR4 to initiate the request for a\nPest Risk Analysis (PRA) in 2015; in 2016 the State\nPhytosanitary Service adopted the SFE-ARP 004-2016; the Executive Branch\npromulgated Executive Decree Nº 40364-MAG corresponding to the General\nProvisions for the prevention of the fungus Fusarium Oxysporum f.sp Cubense Tropical Race\n4 (Foc TR4) causal agent of Fusarium wilt in Cavendish\ncultivars and other Musaceae of Economic and Social importance; the measures of\nthe preceding decree came into effect on June 5, 2018, once\nthe period for observation had elapsed and once\nnotified to the WTO.\n\nIX.-That it is necessary to strengthen the actions of the State, through the\nMinistry of Agriculture and Livestock and its deconcentrated bodies, in charge of\nthe health of animals and plants, for which it is proposed to transfer the resources\nof the banana contingency fund, whose origin was fundamentally Law Nº\n5515, to a new fund to be called \"Fund for the prevention, exclusion\nand combat of Fusarium oxysporum f. sp cubense tropical race 4 and\nother pests and diseases affecting the cultivation of banana\",\nadministered by the National Banana Corporation; in this way, the banana contingency\nfund would be liquidated.\n\nX.-That the new Fund for the prevention, exclusion and combat of Fusarium oxysporum f. sp cubense\ntropical race 4 and other pests and diseases will be used to support the State in the\nconstruction of prevention infrastructure in ports, airports, borders, national\nroads, purchase of materials for the prevention, exclusion and eventual containment of Fusarium\noxysporum f. sp cubense tropical race 4 on a priority basis, training or instruction of\npublic officials, and a part, to support the efforts of banana producers\nprimarily in addressing Fusarium oxysporum f. sp cubense tropical race 4 and, on a non-priority\nbasis, in addressing other pests and diseases affecting the cultivation of banana,\nthrough reimbursable loans according to the provisions of the General Loan Regulations for\nProducers of CORBANA. The resources of this fund may also be used to support the\nrealization of national and international coordination or training activities in order to\ncarry out coordinated actions with other governments or with international organizations such as OIRSA.\n\nXI.-That in accordance with the second and third paragraphs of article\n12 bis of the Regulation to the Law for the Protection of the Citizen from the Excess of\nAdministrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of\nFebruary 22, 2012; Section I called \"Prior Control\nof Regulatory Improvement\" of the\n\"Cost-Benefit Assessment Form\" was completed, with the assessment of the regulatory\nproposal yielding a negative result and since it does not contain procedures, requirements, or\nproceedings, it was determined that it was not necessary to continue with the\naforementioned regulatory analysis. Therefore,\n\nDecree:\n\nCREATION OF THE FUND FOR PREVENTION, EXCLUSION\n\nAND COMBAT AGAINST FUSARIUM OXYSPORUM F.SP\n\nCUBENSE TROPICAL RACE 4 AND OTHER PESTS\n\nAND DISEASES AFFECTING THE CULTIVATION\n\nOF BANANA AND REPEAL OF THE BANANA\n\nCONTINGENCY FUND\n\nArticle 1º-Creation and destination of the new fund. The\ntransfer of the resources that currently make up the Banana Contingency\nFund to a new fund called: \"Fund for the prevention, exclusion and\ncombat of Fusarium oxysporum f. sp cubense tropical race 4 and other pests\nand diseases affecting the cultivation of banana\" is authorized, whose priority\nobjective is the prevention, exclusion and combat against Fusarium oxysporum f.\nsp cubense tropical race 4.\n\nOn a non-priority basis, part of these resources may be allocated for\naddressing emergencies caused by other pests and diseases that\naffect the cultivation of banana.\n\nArticle 2º-Objectives\nof the fund. This fund shall have the objective of supporting the State in the\nconstruction of infrastructure, maintenance thereof, purchase of materials,\nequipment and inputs, training or instruction of officials; in ports,\nairports, borders, national roads, for the prevention and eventual\ncontainment of Fusarium oxysporum f.sp. cubense tropical race 4.\n\nThe resources of this fund may also\nbe used to support the carrying out of national\nand international coordination or training activities in order to\ncarry out coordinated actions with other governments or with international\norganizations.\n\nLikewise,\nresources may be used to support strategic research for the\nprevention, exclusion and combat of Fusarium oxysporum f.sp. cubense tropical race\n4.\n\nIn the event that\nFusarium oxysporum f.sp. cubense tropical race 4 reaches national territory,\nthe fund may be allocated to pest combat activities.\n\nCORBANA is also authorized\nto use part of these resources for addressing emergencies\ncaused by other pests and diseases related to the cultivation of\nbanana, according to the reasoned criteria of the Board of Directors of said entity.\n\nThe resources of this\nfund may be used to increase the diagnostic capacity of the\nlaboratories of the SFE and CORBANA.\n\nThe State\nPhytosanitary Service, the National Animal Health Service, or any\nstate dependency, may request resources to fulfill the\nobjectives of this decree, for which they will direct a request to CORBANA, which\nincludes a technical study of the project and its costs, based on which\nCORBANA, and considering the available resources, will proceed when\nappropriate to its execution.\n\n100% of the\nresources of this fund shall be used for the activities described in this\narticle, which CORBANA shall apply to needs that must be addressed to\nfulfill the objectives of this fund.\n\n \n\n(As\namended by article 1 of executive decree N° 44926 of February 5,\n2025)\n\nArticle 3º-Repeals. It shall be effective from its publication in the Official Gazette.\n\nGiven at the Presidency of the Republic.-San José, on the eighth day of the\nmonth of November of the year 2019." }
