la Ley Nº 7472 de 20 de diciembre de 1994, de Promoción\nde la Competencia y Defensa Efectiva del Consumidor; la Ley Nº 7473 de 20 de\ndiciembre de 1994, Ejecución de los Acuerdos de la Ronda Uruguay de\nNegociaciones Comerciales Multilaterales.\n\nConsiderando:\n\n1º-Que la agricultura orgánica es de suma importancia para el país en\nrelación con la salud de la población, la conservación del ambiente, la\ngeneración de fuentes de empleo y el mejoramiento de la calidad de vida de los\nseres humanos.\n\n2º-Que el Decreto Ejecutivo Nº 29782-MAG de 21 de agosto del 2001\n\"Reglamento de Agricultura Orgánica\" tiene como finalidad\nestablecer la regulación de la producción, elaboración y comercialización de\nproductos agropecuarios orgánicos en Costa Rica, así\ncomo definir la normativa para las diferentes etapas de los procesos de\nproducción y certificación de los mismos.\n\n3º-Que es necesaria una adecuación parcial del Reglamento de agricultura orgánica, para lograr de\nuna manera más eficaz y eficiente el fomento de la actividad de agricultura orgánica, para lo cual\nse hace necesario reformar los artículos 75,79,80 y 85 del Decreto Ejecutivo 29782-MAG, para\neliminar el costo del pago de la anualidad para las personas productoras que se registran en periodo\nde transición y a su vez facilitar la simplificación de trámite con el uso de la tecnología.\n\n4º-Que de conformidad a la Directriz N° 052-MP-MEIC denominada\n\"Moratoria a la creación de nuevos Trámites, Requisitos o Procedimientos al\nciudadano para la obtención de permisos, licencias o autorizaciones\" de fecha\n19 de junio del año 2019 y Decreto Ejecutivo N° 41795-MP-MEIC \"Sobre La\nAgilización de los Trámites en las Entidades Públicas, Mediante el Uso de la\nDeclaración Jurada y la CIRCULAR Nº 001-2019-MEIC-MP del 17 de julio del 2019,\nsobre la aplicación de la Directriz N° 052-MPMEIC, no se incorpora ningún nuevo\nrequisito.\n\n5º-Que el artículo 8 de la Ley de Protección al Ciudadano del exceso de\nrequisitos y trámites administrativos, N° 8220, establece el procedimiento de\ncoordinación inter-institucional para\nobtener fotocopias, constancias, certificaciones, mapas o cualquier información\nrequerida para resolver gestiones de los ciudadanos.\n\n6º-Que de conformidad con el artículo 12 bis párrafos segundo y tercero\ndel Reglamento a la Ley de Protección al Ciudadano del Exceso de Requisitos y\nTrámites Administrativos, Decreto Ejecutivo N° 37045-MP-MEIC del 22 de febrero\nde 2012, publicado en al Diario\nOficial La Gaceta N° 60 del 23 de marzo de 2012; se procedió a llenar la Sección I\ndenominada \"Control Previo de Mejora Regulatoria\" del \"Formulario de Evaluación\nCosto Beneficio\". De la evaluación de la\npropuesta normativa en comentario, es importante destacar que su resultado fue negativo, es\ndecir, que no contiene trámites, requisitos ni procedimientos, por lo que se\ndeterminó la conformidad de ésta con la Ley de Protección al ciudadano del\nexceso de requisitos y trámites administrativos, Ley N° 8220 del 04 de marzo de\n2002 y su Reglamento. Por tanto;\n\nDecretan:\n\nREFORMA PARCIAL\n\nAL DECRETO EJECUTIVO 29782-MAG,\n\nDENOMINADO\n\n\"REGLAMENTO DE AGRICULTURA ORGÁNICA\"\n\nArtículo 1º-Refórmese los artículos 75, 79, 80 y 85 del Decreto\nEjecutivo Nº 29782-MAG, para que en adelante se lean así:\n\n\"Artículo 75.-Requisitos comunes del registro. En caso de no ser el propietario registral. acreditar el derecho que\nle asiste para producir en ese inmueble\".\n\n\"Artículo 85.-Todo registro tiene una vigencia de un año contado\na partir de su inscripción.\"\n\nArtículo 2º-Que en lo demás se mantiene incólume el Decreto Ejecutivo Nº\n29782-MAG de 21 de agosto del 2001.\n\nArtículo 3º-Rige a partir de su publicación.\n\nDado en la Presidencia de la República, a los catorce días del mes de\noctubre del dos mil diecinueve.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Norm 42050\n\n Amendment to the Organic Agriculture Regulation\n\nComplete Text of Act: 1322FE\n\nN° 42050-MAG\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF AGRICULTURE AND LIVESTOCK\n\nIn exercise of the powers and attributions conferred upon them by numerals 46, 50 and 140, subsections 3) and 18) of the Political Constitution, articles 25.1, 27.1 of the General Law of Public Administration, Nº 6227 of May 2, 1978; the Law for the Promotion of Agricultural and Livestock Production, which incorporates the Organic Law of the Ministry of Agriculture and Livestock, Nº 7064 of April 29, 1987; Law 7664 of April 8, 1997, Phytosanitary Protection Law, Law Nº 7554 of November 13, 1995, Organic Environmental Law; Law Nº 7472 of December 20, 1994, on the Promotion of Competition and Effective Consumer Defense; Law Nº 7473 of December 20, 1994, Implementation of the Agreements of the Uruguay Round of Multilateral Trade Negotiations.\n\nConsidering:\n\n1º-That organic agriculture (agricultura orgánica) is of utmost importance for the country in relation to public health, environmental conservation, job creation, and the improvement of human beings' quality of life.\n\n2º-That Executive Decree Nº 29782-MAG of August 21, 2001, \"Organic Agriculture Regulation\" (\"Reglamento de Agricultura Orgánica\"), has the purpose of establishing regulations for the production, processing, and marketing of organic agricultural and livestock products in Costa Rica, as well as defining the standards for the different stages of their production and certification processes.\n\n3º-That a partial adaptation of the Organic Agriculture Regulation (Reglamento de agricultura orgánica) is necessary to achieve, in a more effective and efficient manner, the promotion of the organic agriculture activity, for which it is necessary to amend articles 75, 79, 80, and 85 of Executive Decree 29782-MAG, to eliminate the cost of the annual fee for producers who register during the transition period (periodo de transición) and, in turn, facilitate the simplification of procedures through the use of technology.\n\n4º-That in accordance with Directive N° 052-MP-MEIC called \"Moratorium on the creation of new Procedures, Requirements, or Formalities for citizens to obtain permits, licenses, or authorizations\" dated June 19, 2019, and Executive Decree N° 41795-MP-MEIC \"On the Streamlining of Procedures in Public Entities, Through the Use of the Sworn Statement\" and CIRCULAR Nº 001-2019-MEIC-MP of July 17, 2019, on the application of Directive N° 052-MPMEIC, no new requirements are being incorporated.\n\n5º-That article 8 of the Law for the Protection of Citizens from Excessive Administrative Requirements and Procedures, N° 8220, establishes the inter-institutional coordination procedure to obtain photocopies, certificates, attestations, maps, or any information required to resolve citizens' petitions.\n\n6º-That in accordance with article 12 bis, second and third paragraphs of the Regulation to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Executive Decree N° 37045-MP-MEIC of February 22, 2012, published in the Official Gazette La Gaceta N° 60 of March 23, 2012; Section I, called \"Prior Control of Regulatory Improvement\" of the \"Cost-Benefit Assessment Form\", was completed. From the evaluation of the proposed regulation under discussion, it is important to highlight that its result was negative, meaning that it contains no procedures, requirements, or formalities; therefore, it was determined that it conforms to the Law for the Protection of Citizens from the Excess of Administrative Requirements and Procedures, Law N° 8220 of March 4, 2002, and its Regulation. Therefore;\n\nDecrees:\n\nPARTIAL AMENDMENT\n\nTO EXECUTIVE DECREE 29782-MAG,\n\nENTITLED\n\n\"ORGANIC AGRICULTURE REGULATION\"\n\nArticle 1º-Amend articles 75, 79, 80, and 85 of Executive Decree Nº 29782-MAG, so that henceforth they shall read as follows:\n\n\"Article 75.-Common registration requirements. Documentation may be submitted in physical or digital format.\n\n1. Full name and identification of the natural or legal person requesting registration.\n\n2. Description of the activity requested to be registered.\n\n3. Identification document or current legal entity certification (personería jurídica).\n\n4. Exact address of the natural or legal person and telephone number.\n\n5. Email address for receiving notifications.\n\n6. In the case of a legal entity, it must present the identity card of the company's judicial and extrajudicial representative.\n\n7. Receipt for the payment of the annual fee for certified operators (operadores certificados), certifying agencies (agencias certificadoras), organic inspectors (inspectores orgánicos), and producer groups (grupo de productores, GPO), the latter paying a single fee covering all its members.\n\n8. Farms registered in the transition period for a maximum of three years shall not pay the annual fee.\"\n\n\"Article 79.-Requirements for registering organic farms.
