artículos 6 y 7 de la Ley Orgánica del\nMinisterio de Seguridad Pública, N° 5482 de 24 de diciembre de 1973.\n\nConsiderando:\n\nI.-Que el artículo 28, inciso 2), subinciso a), de\nla Ley General de la Administración Pública, establece que el Ministro es el\nórgano jerárquico superior del respectivo Ministerio y le corresponde de manera\nexclusiva, dirigir y coordinar todos los servicios del Ministerio.\n\nII.-Que mediante Acuerdo N° 24-MSP de 02 de marzo\ndel 2016, publicado en el Alcance N° 59 a La Gaceta N° 55 del 16 de marzo del 2012, se dispuso la\nCreación de la Comisión Institucional para la elaboración de Programas de Gestión Ambiental del\nMinisterio de Seguridad Pública.\n\nIII.-Que la Ley para la Gestión Integral de\nResiduos, N° 8839 del 24 de junio del 2010, publicada en La Gaceta N° 135 del 13 de julio del 2010,\nestablece potestades a la Administración para adquirir bienes y servicios\namigables con el ambiente, incluyendo porcentajes en las metodologías de\ncalificación para valorar el cumplimiento de estas características,\nrefiriéndose además a las dependencias a las que les compete elaborar los\ncarteles de licitación o de compra directa, establecer criterios ambientales y\nde ciclo de vida de los productos para evaluar las licitaciones, de conformidad\ncon los criterios establecidos en el Reglamento de la Ley de cita.\n\nIV.-Que el Ministerio de Hacienda a través de la Dirección General de Administración de Bienes y\nContratación Administrativa adoptó el Programa de Fortalecimiento de Capacidades para las compras\nPúblicas Sustentables, promovido por el Programa de las Naciones Unidas sobre el Medioambiente del\ncual nuestro país es plan piloto y es coordinado por la Dirección de Gestión de la Calidad Ambiental\ndel MINAET como uno de los temas de mayor relevancia en el Plan Estratégico de Modernización de las\nCompras Públicas.\n\nV.-Que de conformidad con lo preceptuado en el artículo 1 de la Directriz N° 031-MINAE de 25 de mayo\ndel 2015, publicada en La Gaceta N° 193 del 05 de octubre de 2015 y las obligaciones establecidas en\nReglamento para la Elaboración de Programas de Gestión Ambiental Institucional en el Sector Público\nde Costa Rica, Decreto Ejecutivo N° 36499, todas las instituciones que conforman el Gobierno Central\ndeben: a) contar con una Comisión Ambiental\n\nInstitucional\nactiva; No se sesionará en forma ordinaria o\nextraordinaria si quince minutos después de la hora fijada no hay quórum.\n\nEn todos aquellos casos en que se dé el empate en\nla votación de algún asunto entre los miembros de la Comisión, el Presidente\ntendrá, en razón de su condición, doble voto, para dirimir el conflicto\nexistente.\n\nArtículo 4°-Funciones y atribuciones de los\nmiembros. Serán funciones y atribuciones del Presidente y de los\nintegrantes de la Comisión, las siguientes:\n\n1. Presidente. Le corresponde lo siguiente:\n\n1) Coordinar con la Comisión Técnica Evaluadora\n(CTE) del Ministerio de Ambiente, Energía lo concerniente a visitas.\n\n2) Presidir las reuniones de la comisión.\n\n3) Convocar a sesiones ordinarias, extraordinarias\ny de trabajo.\n\n4) Elaborar y proponer el orden del día de las sesiones\nordinarias, guardando un orden prioritario en procura del interés institucional\ny someterlo a la aprobación de la Comisión inmediatamente después de comprobar\nel quórum para la sesión.\n\n5) Declarar abiertas las sesiones a la hora\nseñalada y terminarlas después de haber tratado los asuntos que dispusieron\nconocer.\n\n6) Cuando lo considere procedente, por motivos de conveniencia\ny oportunidad, podrá disponer la suspensión de la sesión.\n\n7) Dirigir las discusiones orientando el debate\nhacia los puntos fundamentales y exigir que se observe el orden debido y el\nrespeto mutuo entre los participantes.\n\n8) Conceder permiso a los miembros para ausentarse\nde la sesión, si con ello no se rompe el quórum.\n\n9) Representar a la comisión en reuniones con los\njerarcas de la institución, convirtiéndose en el vocero del mismo con respecto\na los planeamientos y propuestas elaboradas por el órgano, sin perjuicio de\nque, por conveniencia, se delegue esa representación para el caso concreto.\n\n10) Designar las comisiones necesarias para el\nestudio o realización de trabajos específicos, acorde con el programa de\ntrabajo que se haya dispuesto, en un afán de hacer más efectiva la labor de la\nComisión.\n\n11) Dar seguimiento y actualizar el plan de Gestión\nAmbiental Institucional y elaborar el Cuadro Resumen del Programa de Gestión\nAmbiental Institucional.\n\n12) Designar un miembro de la Comisión para que\nocupe la presidencia en su ausencia temporal.\n\n13) Tendrá además todas aquellas otras funciones\nque le otorgue la comisión.\n\n3. Integrantes. Corresponde a los demás\nintegrantes de la Comisión, lo siguiente:\n\n1) Asistir puntualmente a las sesiones ordinarias, extraordinarias\ny de trabajo para los cuales sean citados y, en caso de no poder asistir,\nremitir al presidente la justificación correspondiente.\n\n2) Proponer a la presidencia la inclusión de\nasuntos a tratar en el orden del día de las sesiones ordinarias, y aprobar esta\ncomo acto inicial de la reunión.\n\n3) Desempeñar las comisiones que el presidente\ndesigne e informar por escrito de los resultados en el plazo convenido.\n\n4) Pedir al presidente la palabra, para referirse a\nasuntos puestos en discusión.\n\n5) Solicitar la revisión de los acuerdos de la\nComisión y la revocatoria o modificación de los mismos.\n\n6) Dar su voto, positivo o negativo, sobre los\nasuntos que se sometan a su conocimiento.\n\n7) Formular proyectos, proposiciones y mociones que\ncrean oportunos.\n\n8) Procurar y estudiar la información necesaria,\nconsultar actas, libros o correspondencia, referente a la materia ambiental, y\notros afines, a efectos de tener mejor criterio sobre los asuntos resueltos o\nque deben resolverse en las sesiones.\n\n9) Participar en todas aquellas actividades en que\ntenga interés el ministerio en materia ambiental.\n\n10) Llamar al orden al presidente, cada vez que en\nel ejercicio de su cargo se separe de las actividades que esta normativa le\notorguen.\n\n11) Solicitar al secretario que se hagan constar\nsus palabras en el acta cuando lo considere necesario.\n\n12) Las demás facultades que la comisión les\notorgue mediante acuerdo.\n\n13) Entregar en tiempo y forma los reportes y\ndocumentos solicitados por la comisión.\n\nArtículo 5°-Se deja sin efecto el Acuerdo 24-MSP de\n02 de marzo de 2016, publicado en el Alcance N° 59 a La Gaceta N° 75 de\n26 de abril del 2016.\n\nArtículo 6°-Rige a partir de su publicación.\n\nDado en el Despacho del Ministro de Seguridad\nPública. and d) submit\nprogress reports every six months.\n\nVI.-That, in order to comply with the ordered, it is necessary to restructure the\nEnvironmental Commission of the Ministry of Public Security and expand its scope through\nthe participation of representatives of the Programs and Subprograms that comprise the Ministry,\nthus seeking better coverage for the attention of the Institutional Environmental Management Program.\n\nTherefore,\n\nAGREES:\n\nArticle 1.-The Institutional Commission of the\nEnvironmental Management Program of the Ministry of Public Security is created, which\nwill be composed of the persons holding the following positions in the\nMinistry:\n\n1) Institutional Environmental Manager (Gestor (a) Ambiental Institucional), who\nwill chair the Commission.\n\n2) Director of Institutional Procurement (Director (a) de Proveeduría Institucional) or their\nalternate.\n\n3) Director of Transportation (Director (a) de Transportes) or their alternate.\n\n4) Head of the Infrastructure Projects Department (Jefe (a) del Departamento de proyectos de\ninfraestructura) or their alternate.\n\n5) Head of the Occupational Health Department (Jefe (a) del Departamento de Salud Ocupacional) or\ntheir alternate.\n\n6) Head of the Support Services Department (Jefe (a) del Departamento de Servicios de Apoyo)\nor their alternate.\n\n7) Head of the Institutional Planning Office (Jefe (a) de la Oficina de Planificación\nInstitucional) or their alternate.\n\n8) Representative of the Administrative Vice-Ministry.\n\n9) Director General of the Public Force (Director (a) General de la Fuerza Pública) or their\nalternate.\n\n10) Director of the National Police Academy (Director (a) de la Academia Nacional de Policía)\nor their alternate.\n\n11) Director of the Border Police (Director (a) de la Policía de Fronteras) or their\nalternate.\n\n12) Director of the Air Surveillance Service (Director (a) del Servicio de Vigilancia Aérea) or\ntheir alternate.\n\n13) Director of the National Coast Guard Service (Director (a) del Servicio Nacional de\nGuardacostas) or their alternate.\n\n14) Director of the Drug Control Police (Director (a) de la Policía de\nControl de Drogas) or their alternate.\n\nArticle 2.-Functions. The Commission will have\nthe following functions:\n\n1) Carry out the diagnostics or evaluations of the\ninstitution's facilities necessary to know the state in which they are\nfound, regarding the qualification axes of the Institutional Environmental\nManagement Program.\n\n2) Formulate and disseminate the institutional environmental\npolicy.\n\n3) Prepare the Institutional Environmental Management Program (PGAI)\nto present it to the Directorate of Environmental Quality\nManagement of MINAE.\n\n4) Prepare and submit the reports requested by\nMINAE.\n\n5) Establish the internal quantifiable\nindicators that allow measuring, verifying, and reporting the degree of progress of the\nPGAI, based on the instruments established by MINAE.\n\n6) Coordinate with the internal instances of the\ninstitution what corresponds to the preparation, development, implementation, dissemination\nof the PGAI, as well as the training of officials regarding environmental\nmanagement issues inherent to the institutional work.\n\n7) Develop the technical criteria to support the\ninstitutional policies for saving and consumption of electricity, water, fuel,\nand paper.\n\nArticle 3.-Quorum. The formation quorum and\nthe voting quorum for the sessions will be half plus one of the total\nmembers. The number of these will be verified at the place designated to hold\nthe session at the beginning of the same. No ordinary or\nextraordinary session will be held if, fifteen minutes after the set time, there is no quorum.\n\nIn all cases where there is a tie\nin the voting on any matter among the members of the Commission, the President\nwill have, by reason of their condition, a double vote, to resolve the existing\nconflict.\n\nArticle 4.-Functions and powers of the\nmembers. The functions and powers of the President and the\nmembers of the Commission will be the following:\n\n1. President. The following corresponds to them:\n\n1) Coordinate with the Technical Evaluation Committee\n(CTE) of the Ministry of Environment and Energy concerning visits.\n\n2) Preside over the meetings of the commission.\n\n3) Convene ordinary, extraordinary,\nand work sessions.\n\n4) Prepare and propose the agenda for ordinary\nsessions, keeping a priority order in pursuit of institutional interest\nand submit it to the approval of the Commission immediately after verifying\nthe quorum for the session.\n\n5) Declare the sessions open at the indicated\ntime and close them after having dealt with the matters they decided\nto address.\n\n6) When deemed appropriate, for reasons of convenience\nand opportunity, may order the suspension of the session.\n\n7) Direct the discussions, guiding the debate\ntowards the fundamental points and demanding that due order and\nmutual respect be observed among the participants.\n\n8) Grant permission to members to be absent\nfrom the session, if this does not break the quorum.\n\n9) Represent the commission in meetings with the\nhierarchs of the institution, becoming the spokesperson for it regarding\nthe approaches and proposals developed by the body, without prejudice to\nthe fact that, for convenience, this representation may be delegated for a specific case.\n\n10) Appoint the necessary commissions for the\nstudy or execution of specific works, in accordance with the work\nprogram that has been arranged, in an effort to make the work of the\nCommission more effective.\n\n11) Follow up and update the Institutional Environmental\nManagement plan and prepare the Summary Table of the Institutional\nEnvironmental Management Program.\n\n12) Designate a member of the Commission to\noccupy the presidency in their temporary absence.\n\n13) Will also have all those other functions\ngranted by the commission.\n\n3. Members. The following corresponds to the other\nmembers of the Commission:\n\n1) Attend punctually the ordinary, extraordinary,\nand work sessions for which they are summoned and, in case of not being able to attend,\nsend the corresponding justification to the president.\n\n2) Propose to the presidency the inclusion of\nmatters to be addressed on the agenda for ordinary sessions, and approve this\nas the initial act of the meeting.\n\n3) Carry out the tasks that the president\ndesignates and report in writing on the results within the agreed term.\n\n4) Ask the president for the floor, to refer to\nmatters put up for discussion.\n\n5) Request the review of the Commission's agreements\nand their revocation or modification.\n\n6) Cast their vote, positive or negative, on the\nmatters submitted for their consideration.\n\n7) Formulate proposals, propositions, and motions that\nthey deem timely.\n\n8) Seek and study the necessary information,\nconsult minutes, books, or correspondence, regarding environmental matters,\nand other related ones, in order to have better judgment on the matters resolved or\nthat must be resolved in the sessions.\n\n9) Participate in all those activities in which\nthe ministry has an interest in environmental matters.\n\n10) Call the president to order, whenever in the\nexercise of their position they deviate from the activities that this regulation\ngrants them.\n\n11) Request the secretary to have their\nwords recorded in the minutes when they deem it necessary.\n\n12) The other powers that the commission grants\nthem through agreement.\n\n13) Deliver in a timely manner the reports and\ndocuments requested by the commission.\n\nArticle 5.-Agreement 24-MSP of\nMarch 2, 2016, published in Supplement No. 59 to La Gaceta No. 75 of\nApril 26, 2016, is hereby repealed.\n\nArticle 6.-Takes effect upon its publication.\n\nGiven at the Office of the Minister of Public\nSecurity.
