de 1997.\n\nConsiderando\n\n1º- Que la Ley de Protección Fitosanitaria\nestablece expresamente, en el artículo 25, que toda persona física o jurídica\nque registre, importe, exporte, reempaque y reenvase sustancias químicas,\nbiológicas o afines y equipos de aplicación para uso agrícola deberá\ninscribirse en el registro que llevará el Servicio Fitosanitario del Estado,\nprevio cumplimiento de los requisitos señalados en el respectivo reglamento.\n\n2º- Que la Ley de Protección Fitosanitaria,\npárrafo segundo del artículo 27, establece que toda persona física o jurídica\nque registre, importe, exporte, reempaque y reenvase sustancias químicas,\nbiológicas o afines y equipos de aplicación para uso agrícola deberá\ninscribirse en el registro de establecimientos agropecuarios del Colegio de\nIngenieros Agrónomos y cancelarle la tasa anual que el Poder Ejecutivo, por\nmedio del Ministerio de Agricultura y Ganadería, establezca para la\nadministración y el control de estas actividades, por lo que corresponderá a\nese colegio profesional establecer los requisitos y procedimientos para la\noperación y funcionamiento del registro de establecimientos.\n\n3º- Que la capacitación sobre el manejo seguro,\neficaz y racional de las sustancias químicas, biológicas o afines de uso en la\nagricultura, contribuye a evitar eventos que pongan en riesgo la salud de las\npersonas y el ambiente por el uso de este tipo de sustancias.\n\n4º- Que corresponde al Ministerio de Agricultura\ny Ganadería, por medio del Servicio Fitosanitario del Estado, el\nestablecimiento de un programa de educación agrícola a nivel nacional, sobre el\nmanejo seguro, eficaz y racional de las sustancias químicas, biológicas o\nafines de uso en la agricultura, especialmente al personal de despacho y ventas\nde los agroservicios y comercios autorizados para la venta de agroquímicos.\n\n5º- Que el Servicio Fitosanitario del Estado,\ndesde el año 1998, imparte una capacitación al personal de despacho y ventas de\nlos agroservicios, sobre el manejo seguro, eficaz y racional de las sustancias\nquímicas, biológicas o afines de uso en la agricultura, que ha resultado\nexitosa y que conviene actualizar y mejorar, a efecto de permitir un mayor\nacceso a esta herramienta didáctica.\n\n6º-Que la Ley General de la Administración\nPública dispone expresamente que las competencias institucionales están\nreguladas y conferidas por ley siempre que contenga potestades de imperio y que\nestas y su ejercicio, así como los deberes públicos y su cumplimiento, serán\nirrenunciables, intransmisibles e imprescriptibles y solo por ley podrán\nestablecerse compromisos para no ejercer una potestad de imperio.\n\n7º- Que la Ley de Protección al Ciudadano del\nExceso de Requisitos y Trámites Administrativos y sus reformas dispone\nexpresamente que la información que presenta un administrado ante una entidad,\nórgano o funcionario de la Administración Pública, no podrá ser requerida de\nnuevo por estos, para ese mismo trámite en esa misma entidad u órgano y que\nademás todo trámite o requisito, con independencia de su fuente normativa, para\nque pueda exigirse al administrado deberá constar en una ley, un decreto\nejecutivo o un reglamento y estar publicado en el diario oficial La Gaceta\njunto con el procedimiento a seguir, los instructivos, manuales, formularios y\ndemás documentos correspondientes y estar ubicado en un lugar visible dentro de\nla institución o que dichos trámites o requisitos sean divulgados en medios\nelectrónicos.\n\n8º- Que se procedió a llenar el Formulario de\nEvaluación Costo Beneficio, Sección I, denominada Control Previo de Mejora\nRegulatoria, siendo que el mismo dio un resultado negativo y la propuesta no\ncontiene trámites ni requisitos.\n\nPor tanto,\n\nDECRETAN:\n\nEstablecimiento\nde un Programa de Educación Agrícola a nivel nacional sobre el\n\nmanejo\nseguro, eficaz y racional de las sustancias químicas, biológicas o afines de\nuso\n\nen la agricultura\n\nArtículo 1°-Se establece un programa de educación\nagrícola a nivel nacional sobre el manejo seguro, eficaz y racional de las\nsustancias químicas, biológicas o afines de uso en la agricultura.\n\nArtículo 2°-El Programa tendrá como objetivo general\ncapacitar a las personas físicas, que laboren en el despacho y venta al público\nde los establecimientos que expenden agroquímicos, sobre manejo seguro, eficaz,\ny racional de sustancias químicas, biológicas o afines de uso en la agricultura\na efecto de que brinden información veraz sobre el uso racional y responsable\nde estas sustancias y como objetivos específicos, facilitar el aprendizaje de\nlos usuarios a través de un curso presencial o virtual que esté accesible en\ncualquier momento, para los interesados, así como uniformar los temas a\nimpartir en cada una de las diferentes regiones del país.\n\nArtículo 3°-El Servicio Fitosanitario del Estado,\nimpartirá el curso de capacitación, ya sea de forma virtual o presencial, dirigido\nal personal de ventas o despacho de agroquímicos al público, que laboren, o que\npretendan incorporarse como trabajadores, en los establecimientos agropecuarios\ninscritos en el registro que al efecto lleva el Colegio de Ingenieros Agrónomos\nconforme a lo que dispone el artículo 27 de la Ley de Protección Fitosanitaria;\nasí como a las personas físicas con interés en incorporarse a laborar en este\ntipo de establecimientos en actividades de venta y despacho de sustancias\nquímicas, biológicas o afines de uso en la agricultura.\n\nArtículo 4°-El curso cuenta con seis módulos en forma de\npresentaciones didácticas, las cuales pueden descargarse y leerse las veces que\nel interesado lo desee. Los módulos son los siguientes:\n\nMódulo #1: Tema 1. Generalidades de los plaguicidas.\nTema 2. Etiquetado de los plaguicidas.\n\nMódulo #2: Tema 1. Intoxicaciones y riesgos. Tema 2.\nEquipo de Protección Personal\n\nMódulo #3: Tema 1. Almacenamiento de las sustancias\nquímicas, biológicas o afines de uso en la agricultura. Tema 2. Transporte de\nlas sustancias químicas, biológicas o afines de uso en la agricultura.\n\nMódulo #4: Tema 1. Formulaciones y mezclas. Tema 2.\nTriple lavado y manejo de envases vacíos.\n\nMódulo #5: Tema 1. Legislación retenciones y decomisos.\nTema 2. Sistema de consulta en línea de los productos agroquímicos registrados\n\nMódulo #6: Tema único: Equipos de Aplicación.\n\nArtículo 5°- El curso virtual se encuentra disponible en\nla página web del Ministerio de Agricultura y Ganadería, durante los meses de\nfebrero a noviembre. Para activar los módulos y las evaluaciones el interesado\ndeberá enviar al administrador del curso (expendedores@sfe.go.cr) el pago\ncorrespondiente establecido conforme al Decreto de Tarifas del Servicio\nFitosanitario del Estado, de forma digital o escaneada.\n\nArtículo 6°- El SFE establecerá un curso de\nrefrescamiento anual el cual se estará impartiendo entre los meses de febrero y\nnoviembre de cada año para aquellos expendedores que se encuentren activos con\nel fin de actualizar conocimientos en materia de manejo seguro, eficaz y\nracional de las sustancias químicas, biológicas o afines de uso en la\nagricultura.\n\nArtículo 7°- El personal de ventas o despacho que\ncomercialice o expenda las sustancias químicas, biológicas o afines de uso en\nla agricultura, obtendrá, al realizar y aprobar el curso sobre el manejo seguro,\neficaz y racional de dichas sustancias, un carné que le acredita para laborar\nen los establecimientos agropecuarios que venden directamente al público\nsustancias químicas, biológicas o afines de uso agrícola. Este carné se\nexpedirá con una vigencia de cinco años, contados a partir de la fecha de\nexpedición y podrá ser renovado por los interesados presentando una solicitud\nen las oficinas centrales o regionales del Servicio Fitosanitario del Estado,\ncon al menos tres meses de antelación a la fecha de expiración del carnet. La\nsolicitud de renovación podrá ser enviada por vía electrónica a la dirección\nelectrónica: expendedores@sfe.go.cr.\n\nArtículo 8°- El representante legal del establecimiento\nremitirá vía electrónica al Servicio Fitosanitario del Estado, a la dirección\nelectrónica: expendedores@sfe.go.cr, una solicitud, en la que se expresará con\nclaridad el nombre y calidades, número de teléfono, medio o dirección\nelectrónica donde recibir notificaciones. También se indicará el nombre\ncompleto y calidades de las personas que llevarán el curso. Se adjuntará el\ncomprobante de pago de la tarifa establecida para el curso y que se encuentra\npublicada en el listado de tarifas del Servicio Fitosanitario del Estado.\n\nArtículo 9°- El curso también está accesible para las\npersonas que tengan interés en conocer sobre la materia o que tengan interés en\nincorporarse como trabajadores a los establecimientos y agroservicios que\ncomercializan sustancias químicas, biológicas o afines de uso en la\nagricultura. En este caso deberán remitir la solicitud, a la dirección\nelectrónica: expendedores@sfe.go.cr y el comprobante de pago, de la tarifa\nestablecida para el curso y que se encuentra publicada en el listado de tarifas\ndel Servicio Fitosanitario del Estado.\n\nArtículo 10°- El Ministerio de Agricultura y Ganadería\npromoverá convenios y acuerdos con el sector privado para fomentar el empleo de\njóvenes y mujeres, que hayan llevado el curso y obtenido el carnet que les\nautoriza para laborar en estos establecimientos.\n\nArtículo 11°- Los funcionarios del Servicio Fitosanitario\ndel Estado podrán solicitar durante las visitas de fiscalización a los\nestablecimientos el carnet respectivo al personal de ventas o despacho de\ndichos establecimientos, quienes deberán portarlo en un lugar visible.\n\nArtículo 12°- El permiso o licencia, podrá ser cancelado\npor el Servicio Fitosanitario del Estado, previo dictado del acto\nadministrativo correspondiente, si se incumple con establishes that any natural or legal person\nwho registers, imports, exports, repacks, and refills chemical, biological, or related substances and application equipment for agricultural use must\nregister in the registry of agricultural establishments of the College of\nAgronomic Engineers and pay the annual fee that the Executive Branch, by\nmeans of the Ministry of Agriculture and Livestock, establishes for the\nadministration and control of these activities, therefore it shall be the responsibility of\nthat professional college to establish the requirements and procedures for the\noperation and functioning of the registry of establishments.\n\n3rd- That training on the safe, effective, and rational management of chemical, biological, or related substances for use in\nagriculture, contributes to preventing events that put the health of\npeople and the environment at risk due to the use of this type of substances.\n\n4th- That it is the responsibility of the Ministry of Agriculture\nand Livestock, by means of the State Phytosanitary Service (Servicio Fitosanitario del Estado), the\nestablishment of a national-level agricultural education program, on the\nsafe, effective, and rational management of chemical, biological, or related substances for use in agriculture, especially for the dispensing and sales personnel\nof agroservices and authorized businesses for the sale of agrochemicals.\n\n5th- That the State Phytosanitary Service (Servicio Fitosanitario del Estado),\nsince 1998, has provided training to the dispensing and sales personnel of\nagroservices, on the safe, effective, and rational management of chemical, biological, or related substances for use in agriculture, which has been\nsuccessful and which it is advisable to update and improve, in order to allow greater\naccess to this didactic tool.\n\n6th- That the General Law of the Public\nAdministration expressly provides that institutional competencies are\nregulated and conferred by law whenever they contain powers of authority and that\nthese and their exercise, as well as public duties and their fulfillment, shall be\ninalienable, non-transferable, and imprescriptible and only by law may\ncommitments be established not to exercise a power of authority.\n\n7th- That the Law for the Protection of Citizens from\nExcess of Administrative Requirements and Procedures and its amendments expressly\nprovides that the information submitted by a person before an entity,\nbody, or official of the Public Administration, may not be requested again from them by these, for that same proceeding in that same entity or body and that\nfurthermore, any procedure or requirement, regardless of its normative source, to\nbe demanded from the person must be contained in a law, an executive decree, or a regulation and be published in the official gazette La Gaceta\nalong with the procedure to follow, the instructions, manuals, forms, and\nother corresponding documents and be located in a visible place within\nthe institution or that said procedures or requirements be disseminated in electronic\nmedia.\n\n8th- That the Cost-Benefit Evaluation Form was completed, Section I, entitled Prior Control for Regulatory\nImprovement, with the result being negative and the proposal\ndoes not contain procedures or requirements.\n\nTherefore,\n\nTHEY DECREE:\n\nEstablishment\nof a National-Level Agricultural Education Program on the\n\nSafe,\nEffective, and Rational Management of Chemical, Biological, or Related Substances for\n\nUse in Agriculture\n\nArticle 1°- A national-level agricultural education program is established on the safe, effective, and rational management of\nchemical, biological, or related substances for use in agriculture.\n\nArticle 2°- The Program's general objective shall be to\ntrain natural persons, who work in the dispensing and sale to the public\nof establishments that sell agrochemicals, on the safe, effective,\nand rational management of chemical, biological, or related substances for use in agriculture\nin order for them to provide truthful information on the rational and responsible\nuse of these substances, and its specific objectives shall be to facilitate the learning of\nusers through an in-person or virtual course that is accessible at\nany time to those interested, as well as to standardize the topics to\nbe taught in each of the different regions of the country.\n\nArticle 3°- The State Phytosanitary Service (Servicio Fitosanitario del Estado),\nshall provide the training course, either virtually or in person, directed\nto the sales or dispensing personnel of agrochemicals to the public, who work, or who\nintend to join as workers, in the agricultural establishments\nregistered in the registry kept for that purpose by the College of Agronomic Engineers\nin accordance with the provisions of article 27 of the Law on Phytosanitary Protection;\nas well as to natural persons interested in joining the workforce in this\ntype of establishments in activities of sale and dispensing of chemical, biological, or related substances for use in agriculture.\n\nArticle 4°- The course consists of six modules in the form of\ndidactic presentations, which can be downloaded and read as many times as\nthe interested party wishes. The modules are the following:\n\nModule #1: Topic 1. General information on pesticides (plaguicidas).\nTopic 2. Labeling of pesticides (plaguicidas).\n\nModule #2: Topic 1. Poisonings and risks. Topic 2.\nPersonal Protective Equipment.\n\nModule #3: Topic 1. Storage of chemical, biological, or related substances for use in agriculture. Topic 2. Transport of\nchemical, biological, or related substances for use in agriculture.\n\nModule #4: Topic 1. Formulations and mixtures. Topic 2.\nTriple washing and empty container management.\n\nModule #5: Topic 1. Legislation, withholdings, and seizures.\nTopic 2. Online consultation system for registered agrochemical products.\n\nModule #6: Single Topic: Application Equipment.\n\nArticle 5°- The virtual course is available on\nthe website of the Ministry of Agriculture and Livestock, during the months of\nFebruary to November. To activate the modules and the evaluations, the interested party\nmust send to the course administrator (expendedores@sfe.go.cr) the corresponding\npayment established according to the Fee Decree of the State Phytosanitary Service (Servicio Fitosanitario del Estado), in digital or scanned form.\n\nArticle 6°- The SFE shall establish an annual refresher\ncourse which shall be given between the months of February and\nNovember of each year for those dispensers who are active,\nin order to update knowledge regarding the safe, effective, and\nrational management of chemical, biological, or related substances for use in\nagriculture.\n\nArticle 7°- The sales or dispensing personnel who\nmarket or sell chemical, biological, or related substances for use in\nagriculture, upon completing and passing the course on the safe, effective, and rational management of such substances, shall obtain a card that accredits them to work\nin the agricultural establishments that sell directly to the public\nchemical, biological, or related substances for agricultural use. This card shall be\nissued with a validity of five years, counted from the date of\nissuance, and may be renewed by the interested parties by submitting a request\nat the central or regional offices of the State Phytosanitary Service (Servicio Fitosanitario del Estado),\nat least three months prior to the card's expiration date. The\nrenewal request may be sent electronically to the electronic\naddress: expendedores@sfe.go.cr.\n\nArticle 8°- The legal representative of the establishment\nshall send electronically to the State Phytosanitary Service (Servicio Fitosanitario del Estado), to the\nelectronic address: expendedores@sfe.go.cr, a request, in which shall be clearly stated the name and qualifications, telephone number, means or electronic\naddress where notifications are to be received. It shall also indicate the full\nname and qualifications of the persons who will take the course. The\nproof of payment of the established fee for the course, which is\npublished in the fee schedule of the State Phytosanitary Service (Servicio Fitosanitario del Estado), shall be attached.\n\nArticle 9°- The course is also accessible for\npersons who are interested in learning about the subject matter or who are interested in\njoining as workers the establishments and agroservices that\nmarket chemical, biological, or related substances for use in\nagriculture. In this case, they must send the request, to the electronic\naddress: expendedores@sfe.go.cr, and the proof of payment of the\nestablished fee for the course, which is published in the fee schedule\nof the State Phytosanitary Service (Servicio Fitosanitario del Estado).\n\nArticle 10°- The Ministry of Agriculture and Livestock\nshall promote agreements and accords with the private sector to foster the employment of\nyoung people and women, who have taken the course and obtained the card that\nauthorizes them to work in these establishments.\n\nArticle 11°- Officials of the State Phytosanitary Service (Servicio Fitosanitario del Estado)\nmay request during inspection visits to the establishments the respective card from the sales or dispensing personnel of\nsaid establishments, who must carry it in a visible place.\n\nArticle 12°- The permit or license may be canceled\nby the State Phytosanitary Service (Servicio Fitosanitario del Estado), after the issuance of the corresponding\nadministrative act, if any of the requirements\nindicated in this Decree are breached.\n\nArticle 13°- Non-compliance with what is ordered in\nthis Decree shall be sanctioned as indicated in Chapter VIII\n\"On Penal Provisions\" of the Law on\n\nPhytosanitary Protection.\n\nArticle 14°- Executive Decree No 27034-MAG,\nof January 5, 1998, and its amendments are hereby repealed.\n\nArticle 15°- This Decree comes into effect upon its publication.\n\nSole Transitory Provision. - The permits and\ncards granted prior to the entry into force of this executive\ndecree shall have full validity until their expiration.\n\nGiven at the Presidency\nof the Republic. - San José, on the eighteenth day of the month of November of the year\n2019." }
