(ESPH, S.A) y al Servicio Nacional de Aguas\nSubterráneas, Riego y Avenamiento (SENARA), correspondiente a los servicios\npúblicos de acueductos, alcantarillados, hidrantes riego y piscicultura.\nAsimismo, solicitó a la Dirección General de Atención al Usuario (DGAU), la\nconvocatoria a consulta pública para exponer el estudio extraordinario\ntarifario de oficio de referencia. (Folio 01).\n\nIII- La Autoridad Reguladora publicó la convocatoria a consulta pública\nen los siguientes periódicos: La Extra y La Teja del 06 de diciembre del 2019 y\nen el Alcance N°272 de La Gaceta Nº233 del 06 de diciembre del 2019. (Folio\n21).\n\nIV- La consulta pública finalizó el 11 de diciembre del 2019 a las 12:00\nhoras. Según el informe de la Direccion General de Atención al Usuario\nN°IN-2257- DGAU-2019, no se recibieron oposiciones ni coadyuvancias. (Mismo que\ncorre agregado a los autos).\n\nV- El 12 de diciembre de 2019, mediante el oficio OF-1125-IA-2019, la Intendencia\nde Agua emitió el informe denominado \"Ajuste extraordinario en la tarifa por\nefecto de los cánones de los servicios públicos de Acueducto, Alcantarillado,\nHidrantes, Riego y Piscicultura para el año 2020. Expediente ET-104-2019\".\n(Mismo que corre agregado a los autos).\n\nVI- En los plazos y procedimientos se han cumplido las prescripciones de\nLey.\n\nCONSIDERANDO\n\nI- Del oficio OF-1125-IA-2019 del 12 de diciembre de 2019, que sirve de\nbase a esta resolución y que será notificado a las partes, conviene extraer las\nsiguientes conclusiones y recomendaciones:\n\n\"(.) IV. La tarifa de hidrantes para el servicio\nmedido pasa de ₡26 a ₡24,1 por metro cúbico y en servicio fijo de\n₡555 a ₡515,4 colones.\n\n5- Para el servicio el servicio de Hidrantes brindado por la ESPH S.A,\nse debe aumentar la tarifa en el mes de enero de 2020.La tarifa de hidrantes para\nel servicio medido pasa de ₡25,81 a ₡26,83 por metro\ncúbico y para el servicio fijo de ₡617,83 a ₡642,29.\n\n6- Para el servicio de riego y piscicultura la tarifa debe aumentarse en\nun 8,29% con fundamento en los cálculos realizados con base al cultivo del 2019\ny estará vigente para todo el año de 2020.\n\nV. Recomendaciones\n\n1. No ajustar las tarifas de acueducto y alcantarillado del AyA, sino\nque se hará durante el año 2020.\n\n2. Fijar un aumento del 1,10% para el servicio de acueducto y del 0,94%\npara el servicio de alcantarillado en todas las categorías, en esta ocasión se\nhizo genérico ya no en los consumos altos; brindado por la ESPH, S.A, a partir\ndel mes de enero 2020.\n\n3. Estas tarifas rigen a partir del 1 de enero de 2020 hasta el 31 de\nenero de 2020. A partir del 01 de febrero de 2020, se volverán a aplicar las\ntarifas fijadas según la resolución RIA-006-2015 del 09 de julio del 2015,\npublicada en La Gaceta Nº135, del 14 de julio del 2015 y la resolución\nRIA-003-2015 del 19 de marzo del 2015, publicada en La Gaceta Nº61, del 27 de\nmarzo del 2015.\n\n4. Fijar las siguientes tarifas para el servicio de hidrantes\nsuministrado por el AyA y la ESPH S.A. Para el AyA en el servicio medido, ₡24,1\ncolones por metro cúbico y para el servicio fijo ₡515,40. Para la\nESPH, S.A, en el servicio medido ₡26,83 por metro cúbico y para el\nservicio fijo ₡642,29.\n\n5. Para el servicio de hidrantes suministrado por el AyA y la ESPH, S.A.\nlas tarifas indicadas serán para el mes de enero 2020. A partir del 01 de\nfebrero de 2020 se volverán a aplicar las tarifas establecidas en la resolución\nRIA-002-2016 del 03 de febrero del 2016, publicada en la Gaceta N°28 del 10 de\nfebrero del 2016 para AyA; y para la ESPH aplicará la resolución RIA-005-2015\ndel 24 de abril de 2015, publicada en la Gaceta N°82 del 29 de abril de 2015 en\nel alcance N°28.\n\n6. Fijar para los servicios de riego y piscicultura del SENARA una\ntarifa de ₡2,61 por metro cubico para todos sus usuarios, aplicara en los\nmeses de enero a diciembre 2020. El 01 de enero 2021 se volverán a aplicar las\ntarifas fijadas según la resolución RIA-009-2015 del 8 de setiembre de 2015,\npublicada en La Gaceta N°180 del 16 de septiembre del 2015, o la que esté\nvigente a esa fecha(.)\".\n\nII- También, en el en el oficio OF-1125-IA del 12 de diciembre de 2019, que\nsirve de base a esta resolución, no se recibieron oposiciones ni coadyuvancias.\n\nIII- De conformidad con los resultandos y considerandos que preceden y de\nacuerdo con el mérito de los autos, lo procedente es realizar el ajuste\nextraordinario tarifario de oficio por efecto del cálculo de los cánones de\nregulación para el año 2020, para los servicios públicos de acueducto,\nalcantarillado, hidrantes, riego y piscicultura que prestan el AyA, la ESPH\nS.A. y SENARA, tal y como se dispone.\n\nPOR TANTO\n\nCon fundamento en las facultades conferidas en la Ley N° 7593 y sus\nreformas, en la Ley General de la Administración Pública N° 6227, en el Decreto\nEjecutivo 29732-MP, que es el Reglamento a la Ley N° 7593, y en el Reglamento\nInterno de Organización y Funciones de la Autoridad Reguladora de los Servicios\nPúblicos y sus Órganos Desconcentrados,\n\nEl INTENDENTE DE AGUA\n\nRESUELVE\n\nI. Fijar para los servicios de acueducto y de alcantarillado que brinda\nla Empresa de Servicios Públicos de Heredia, S.A., las siguientes tarifas:\n\n \n\n \n\n \n\n \n\nEstas tarifas rigen a partir del 1 de enero de 2020 hasta el 31 de enero\nde 2020. A partir del 01 de febrero de 2020, se volverán a aplicar las tarifas\nfijadas según la resolución RIA-006-2015 del 09 de julio del 2015, publicada en\nLa Gaceta Nº135, del 14 de julio del 2015 y la resolución RIA-003-2015 del 19\nde marzo del 2015, publicada en La Gaceta Nº61, del 27 de marzo del 2015.\n\nII. Conclusions\n\n1- The Contraloría General de la República, through official letter\nDFOE-ED-0564 of July 30, 2010, orders that ARESEP must adjust, in\nthe same execution period of each regulatory activity, the corresponding regulatory fee (canon)\nfor the regulated activities, as approved.\n\n2- Upon reviewing the amount authorized by the Contraloría General de la\nRepública in the estimates of the regulatory fee (canon por regulación) for the year 2020, it\nwas determined that AyA's revenues would require a tariff decrease for\nthe water supply (acueductos) and sewerage (alcantarillado) services of 0.34% and 0.37%. With\nrespect to ESPH, S.A., revenue needs would increase by 0.08%\nfor both services, water supply (acueducto) and sewerage (alcantarillado).\n\n3- In order to consider the adjustment, which are reductions in the regulatory fee (canon de regulación)\nof AyA for the water supply (acueducto) and sewerage (alcantarillado) services, these will be\nadjusted ordinarily in their tariff studies during the year 2020 or ex officio\nextraordinarily, given that the water resource protection tariff is in process under\nfile ET-087-2019.\n\n4- For the hydrant service provided by AyA, the\ntariff must be reduced in the month of January 2020. The hydrant tariff for the metered\nservice changes from ₡26 to ₡24.1 per cubic meter and for the fixed service from\n₡555 to ₡515.4 colones.\n\n5- For the hydrant service provided by ESPH S.A.,\nthe tariff must be increased in the month of January 2020. The hydrant tariff for\nthe metered service changes from ₡25.81 to ₡26.83 per cubic\nmeter and for the fixed service from ₡617.83 to ₡642.29.\n\n6- For the irrigation (riego) and fish farming (piscicultura) service, the tariff must be increased by\n8.29% based on calculations made on the basis of the 2019 crop\nand will be in effect for the entire year of 2020.\n\nV. Recommendations\n\n1. Do not adjust the water supply (acueducto) and sewerage (alcantarillado) tariffs of AyA; rather, this\nwill be done during the year 2020.\n\n2. Set an increase of 1.10% for the water supply (acueducto) service and 0.94%\nfor the sewerage (alcantarillado) service in all categories—on this occasion it was\nmade generic and not only for high consumption—provided by ESPH, S.A., starting\nfrom the month of January 2020.\n\n3. These tariffs are in effect from January 1, 2020, until January 31,\n2020. Starting from February 1, 2020, the\ntariffs set by resolution RIA-006-2015 of July 9, 2015,\npublished in La Gaceta No. 135 of July 14, 2015, and resolution\nRIA-003-2015 of March 19, 2015, published in La Gaceta No. 61 of March 27,\n2015, will apply again.\n\n4. Set the following tariffs for the hydrant service\nsupplied by AyA and ESPH S.A. For AyA, for the metered service, ₡24.1\ncolones per cubic meter, and for the fixed service, ₡515.40. For\nESPH, S.A., for the metered service, ₡26.83 per cubic meter, and for the\nfixed service, ₡642.29.\n\n5. For the hydrant service supplied by AyA and ESPH, S.A.,\nthe indicated tariffs will be for the month of January 2020. Starting from February 1,\n2020, the tariffs established in resolution\nRIA-002-2016 of February 3, 2016, published in La Gaceta No. 28 of February 10,\n2016, will apply again for AyA; and for ESPH, resolution RIA-005-2015\nof April 24, 2015, published in La Gaceta No. 82 of April 29, 2015, in\nSupplement (Alcance) No. 28, will apply.\n\n6. Set for the irrigation (riego) and fish farming (piscicultura) services of SENARA a\ntariff of ₡2.61 per cubic meter for all its users; it will apply during the\nmonths of January to December 2020. On January 1, 2021, the\ntariffs set by resolution RIA-009-2015 of September 8, 2015,\npublished in La Gaceta No. 180 of September 16, 2015, or the one in\neffect at that date, will apply again (.).\"\n\nII- Also, in official letter OF-1125-IA of December 12, 2019, which\nserves as the basis for this resolution, no oppositions or coadjuvancies were received.\n\nIII- In accordance with the preceding whereas and whereupon clauses and\nwith the merit of the record, it is appropriate to make the ex officio extraordinary\ntariff adjustment due to the calculation of the regulatory fees (cánones de regulación) for the year\n2020, for the public services of water supply (acueducto),\nsewerage (alcantarillado), hydrants, irrigation (riego) and fish farming (piscicultura) provided by AyA, ESPH\nS.A. and SENARA, as ordered.\n\nTHEREFORE\n\nBased on the powers conferred by Law No. 7593 and its\nreforms, by the General Public Administration Law No. 6227, by Executive\nDecree 29732-MP, which is the Regulation to Law No. 7593, and by the\nInternal Regulation of Organization and Functions of the Autoridad Reguladora de los Servicios\nPúblicos and its Deconcentrated Bodies,\n\nTHE WATER INTENDANT\n\nRESOLVES\n\nI. Set the following tariffs for the water supply (acueducto) and sewerage (alcantarillado) services provided\nby the Empresa de Servicios Públicos de Heredia, S.A.:\n\n \n\n \n\n \n\n \n\nThese tariffs are in effect from January 1, 2020, until January 31,\n2020. Starting from February 1, 2020, the tariffs\nset by resolution RIA-006-2015 of July 9, 2015, published in\nLa Gaceta No. 135 of July 14, 2015, and resolution RIA-003-2015 of March 19,\n2015, published in La Gaceta No. 61 of March 27, 2015, will apply again.\n\nII. On January 1, 2021, the\ntariffs set in resolution RIA-009-2015 of September 8, 2015, published in\nLa Gaceta No. 180 of September 16, 2015, or the one in effect at that\ndate, will apply again.\n\nIn compliance with\nwhat is ordered by Article 245 in relation to Article 345 of the General Public Administration Law, it is reported that against this resolution the\nordinary remedies of revocation and appeal, and the extraordinary remedy of\nreview, are applicable.\n\nThe revocation remedy\nmay be filed before the Water Intendant, who is responsible for resolving it; the\nappeal and review remedies may be filed before the Board of Directors, which\nis responsible for resolving them.\n\nIn accordance with\nArticle 346 of the General Public Administration Law, the remedies of\nrevocation and appeal must be filed within a period of three days\ncounted from the business day following that of notification, and the\nextraordinary remedy of review, within the deadlines set forth in Article 354\nof the aforementioned Law.\n\nIV.
