REPÚBLICA\n\nY LA\nMINISTRA DE JUSTICIA Y PAZ\n\nCon fundamento en\nlo dispuesto en los artículos 140, inciso 18) y 146 de la Constitución\nPolítica, en el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de\n1939 y los artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N°\n29496-J, publicado en La Gaceta N° 96 del 21 de mayo del 2001, así como lo\nestablecido en el artículo 3, inciso eh) de la Ley de Impuesto sobre la Renta\nN° 7092 y en los artículos 103 y 104 de Código de Normas y Procedimientos\nTributarios N° 4755.\n\nConsiderando:\n\nI.-El artículo 32\nde la Ley de Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas,\nconfiere al Poder Ejecutivo la\npotestad de declarar de utilidad pública a las asociaciones simples, federadas\no confederadas, cuyo desarrollo y actividades sean particularmente útiles para\nlos intereses del Estado y que por ello contribuyan a solventar una necesidad\nsocial.\n\nII.-La Asociación\nAdministradora Acueducto Rural de Santa Eduviges San Diego de Santa Cruz de\nTurrialba, cédula de persona jurídica N° 3-002-330512, se inscribió en el\nRegistro de Asociaciones del Registro Nacional, desde el 16 de setiembre del\n2002, bajo el expediente 14659, tomo 505 y asiento 15982.\n\nIII.-Los fines que persigue la Asociación Administradora Acueducto Rural de Santa Eduviges San Diego\nde Santa Cruz de Turrialba, cédula de persona jurídica N° 3-002-330512, según sus estatutos son: \"A)\nAdministrar, operar, dar mantenimiento, desarrollo y conservar en buenas condiciones el acueducto de\nagua potable, de conformidad con las disposiciones y reglamentos que al respecto emite el Instituto\nCostarricense de Acueductos y Alcantarillados que serán de acatamiento obligatorio, B) Obtener la\nparticipación efectiva de la comunidad, en la construcción, operación, mantenimiento y desarrollo\ndel acueducto, C) Colaborar en los programas y campañas de índole educativa que se emprendan; I))\nAyudar a explicar y divulgar en la comunidad las disposiciones y reglamentos del Instituto\nCostarricense de Acueductos y Alcantarillados; E) Cooperar con los planes, proyectos y obras que\nemprenda el Instituto Costarricense de Acueductos y Alcantarillados en la comunidad; k) Participar\nen asuntos relativos a la administración, conservación y explotación racional de las aguas; control\nde su contaminación o alteración, definición de las medidas y acciones necesarias para la protección\nde las cuencas hidrográficas y la estabilidad ecológica; G) Velar porque todos los sistemas sus\ninstalaciones de acueductos y alcantarillados sanitarios, cumplan los principios básicos del\nservicio público, tanto en calidad, cantidad, cobertura, eficiencia, racionalización de gastos,\netc.; H) Otorgar los servicios públicos, en forma eficiente, igualitaria y oportuna a todos sus\nusuarios, sin distinciones de ninguna naturaleza.\"\n\nIV.-Tales fines solventan una necesidad social de\nprimer orden, por lo cual\nmerecen el apoyo del Estado costarricense. Por tanto,\n\nDecretan:\n\nDECLARATORIA\nDE UTILIDAD PÚBLICA PARA LA\n\nASOCIACIÓN\nADMINISTRADORA ACUEDUCTO\n\nRURAL DE\nSANTA EDUVIGES SAN DIEGO\n\nDE SANTA\nCRUZ DE TURRIALBA\n\nArtículo\n1º-Declárese de utilidad pública para los intereses del Estado la Asociación\nAdministradora Acueducto Rural de Santa Eduviges San Diego de Santa Cruz de\nTurrialba, cédula de persona jurídica N° 3-002-330512.\n\nArtículo 2º-Es\ndeber de la Asociación rendir anualmente un informe de gestión ante el\nMinisterio de Justicia y Paz, de conformidad con lo indicado en el artículo 32\ndel Reglamento a la Ley de Asociaciones.\n\nArtículo 3º-Los\ningresos y el patrimonio de la asociación que se destinen en su totalidad y en\nforma exclusiva para fines públicos o de beneficencia y que en ningún caso se\ndistribuyan directa o indirectamente\nentre sus integrantes, se encontrarán exonerados del impuesto sobre la renta,\npor el contrario, aquella parte que no tenga este destino, o quede repartido de\nalguna manera entre sus asociados, estará sujeto a la imposición de este\nimpuesto.\n\nArtículo 4º-Le corresponde a la Administración Tributaria controlar y fiscalizar el correcto\ncumplimiento de las obligaciones tributarias de la asociación, de conformidad con lo establecido en\nlos artículos 103 y 104 del Código de Normas y Procedimientos Tributarios.\n\nArtículo 5º-Una\nvez publicado este decreto los interesados deberán protocolizar y presentar el\nrespectivo testimonio ante el Registro de Asociaciones del Registro Nacional,\npara su respectiva inscripción.\n\nArtículo 6º-Rige\na partir de su publicación.\n\nDado en la\nPresidencia de la República.-San José, a los cuatro días del mes de noviembre\ndel dos mil diecinueve.", "body_en_text": "in the entirety of the text\n\n -\n\n Complete Text of Regulation 42096\n\n Declares of public utility for the interests of the State the Rural Aqueduct Administrative Association of Santa Eduviges San Diego de Santa Cruz de Turrialba\n\nComplete Text record: 17A721\n\nN° 42096-MJP\n\n(This executive decree was repealed by article 1 of executive decree N° 45186 of July 28, 2025)\n\nTHE PRESIDENT OF THE REPUBLIC\n\nAND THE MINISTER OF JUSTICE AND PEACE\n\nPursuant to the provisions of articles 140, subsection 18) and 146 of the Political Constitution, article 32 of the Law of Associations N° 218 of August 8, 1939 and articles 27 and following of the Regulation to the Law of Associations N° 29496-J, published in La Gaceta N° 96 of May 21, 2001, as well as the provisions of article 3, subsection eh) of the Income Tax Law N° 7092 and articles 103 and 104 of the Code of Tax Norms and Procedures N° 4755.\n\nConsidering:\n\nI.-Article 32 of the Law of Associations N° 218 of August 8, 1939 and its amendments, confers upon the Executive Branch the power to declare of public utility those simple, federated or confederated associations, whose development and activities are particularly useful for the interests of the State and which thereby contribute to meeting a social need.\n\nII.-The Rural Aqueduct Administrative Association of Santa Eduviges San Diego de Santa Cruz de Turrialba, legal entity identification number N° 3-002-330512, was registered in the Associations Registry of the National Registry, on September 16, 2002, under file 14659, volume 505 and entry 15982.\n\nIII.-The purposes pursued by the Rural Aqueduct Administrative Association of Santa Eduviges San Diego de Santa Cruz de Turrialba, legal entity identification number N° 3-002-330512, according to its bylaws are: \"A) To administer, operate, maintain, develop and conserve in good condition the potable water aqueduct, in accordance with the provisions and regulations issued in this regard by the Instituto Costarricense de Acueductos y Alcantarillados which shall be of mandatory compliance, B) To obtain the effective participation of the community, in the construction, operation, maintenance and development of the aqueduct, C) To collaborate in the educational programs and campaigns that are undertaken; I)) To help explain and disseminate in the community the provisions and regulations of the Instituto Costarricense de Acueductos y Alcantarillados; E) To cooperate with the plans, projects and works undertaken by the Instituto Costarricense de Acueductos y Alcantarillados in the community; k) To participate in matters relating to the administration, conservation and rational exploitation of waters; control of their contamination or alteration, definition of the measures and actions necessary for the protection of hydrographic basins and ecological stability; G) To ensure that all systems and their aqueduct and sanitary sewer installations comply with the basic principles of public service, in terms of quality, quantity, coverage, efficiency, rationalization of expenses, etc.; H) To provide public services, in an efficient, egalitarian and timely manner to all its users, without distinctions of any nature.\"\n\nIV.-Such purposes meet a social need of the highest order, for which reason they merit the support of the Costa Rican State. Therefore,\n\nDecree:\n\nDECLARATION OF PUBLIC UTILITY FOR THE\n\nRURAL AQUEDUCT ADMINISTRATIVE ASSOCIATION\n\nOF SANTA EDUVIGES SAN DIEGO\n\nDE SANTA CRUZ DE TURRIALBA\n\nArticle 1º-It is declared of public utility for the interests of the State the Rural Aqueduct Administrative Association of Santa Eduviges San Diego de Santa Cruz de Turrialba, legal entity identification number N° 3-002-330512.\n\nArticle 2º-It is the duty of the Association to submit an annual management report to the Ministry of Justice and Peace, in accordance with the provisions of article 32 of the Regulation to the Law of Associations.\n\nArticle 3º-The income and assets of the association that are allocated in their entirety and exclusively for public or charitable purposes and that in no case are distributed directly or indirectly among its members, shall be exempt from income tax; conversely, that portion that does not have this purpose, or is distributed in any way among its members, shall be subject to the imposition of this tax.\n\nArticle 4º-It is the responsibility of the Tax Administration to control and supervise the correct fulfillment of the tax obligations of the association, in accordance with the provisions of articles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5º-Once this decree is published, the interested parties must formalize by notarial protocol and present the respective certified copy before the Associations Registry of the National Registry, for its respective registration.\n\nArticle 6º-It shall be effective upon its publication.\n\nGiven at the Presidency of the Republic.-San José, on the fourth day of November of two thousand nineteen." }
