artículos 1, 2,\n3, 4, 5, 6 y 12 del Decreto Ejecutivo \"Actualización del Sistema Geodésico de Referencia Horizontal\nOficial para Costa Rica\", Decreto N° 40962-MJP de fecha 24 de enero de 2018; y artículos 1,2, 3 y 5\ndel Decreto Ejecutivo \"Creación del Sistema Nacional de Información Territorial\", Decreto N°\n37773-JP-H-MINAE-MICITT de fecha 07 de mayo de 2013.\n\nConsiderando:\n\n1º-Que la\nOrganización de las Naciones Unidas y el Instituto Panamericano de Geografía e\nHistoria de la Organización de Estados Americanos, recomendó a sus miembros la\ncreación de infraestructuras nacionales de datos espaciales, al constituirse en\nun mecanismo intergubernamental para la toma de decisiones, permitiendo\nestablecer directrices en relación con la producción, disponibilidad\ny uso de información geográfica en el marco de las políticas nacionales.\n\n2º-Que la\nmodernización del Estado se sustenta, entre otros pilares, en la observancia de\nlos principios de transparencia, colaboración entre las instituciones,\ndescentralización y desconcentración, mediante la participación de los\nciudadanos en las zonas urbanas y rurales.\n\n3º-Que para la toma de decisiones en la función pública, es fundamental considerar la información\ngeográfica, a efecto de satisfacer las necesidades, procurando así la óptima utilización de los\nrecursos.\n\n4º-Que por imperativo legal, el Instituto\nGeográfico Nacional del Registro Nacional (IGN), es la instancia oficial,\ncientífica y técnica, rectora\nde la cartografía, la geografía, la geodesia, la geofísica y temas afines, que\ndetermina y oficializa las normas técnicas de información geográfica,\ngarantizando la producción, el uso y la gestión de información geográfica\nfundamental, temática y general,\ncon estándares que aseguran su interoperabilidad y debida publicación.\n\n5º-Que la\nRepública de Costa Rica, suscribió con el Banco Interamericano de Desarrollo,\nel Convenio de Préstamo N° 1284/0C-CR para la ejecución del denominado\n\"Programa de Regularización del\nCatastro y Registro de la Propiedad Inmueble de Costa Rica\", aprobado por la\nLey N° 154 de fecha 27 de noviembre de 2001.\n\n6º-Que las Normas\nGenerales, anexo A, apartado 2.06 del Convenio de Préstamo Ley N° 8154\nestablecen la creación del Sistema Nacional de Información Territorial, el cual\ncomprende el diseño final e instalación, para gestionar la\nbase de datos oficial catastral\nregistral del país, y en cuya capa básica se enlazan los sistemas\nde información geográficos interconectados de entidades públicas y privadas, o profesionales en el\nejercicio de sus funciones, que al efecto generen información geográfica.\n\n7º-Que de conformidad con lo establecido en el artículo 1 del Decreto Ejecutivo N° 37773-JP-H-MINAE-\nMICITT, de fecha 07 de mayo de 2013, se crea el Sistema Nacional de Información Territorial (SNIT),\ncomo un sistema que publica en forma integral la información geográfica temática debidamente\nestandarizada, georreferenciada y compatibilizada con la información geográfica fundamental y\noficial existente en el Registro Nacional.\n\n8º-Que en atención a la finalización del \"Programa de Regularización del Catastro y el Registro de\nla Propiedad Inmueble de Costa Rica\", el ION administra a partir del mes de abril de 2014, el\ngeoportal del SNIT, conforme al artículo 4, del Decreto Ejecutivo N° 37773-JP-H-MINAE-MICITT.\n\n9º-Que en aras de garantizar el acceso a la información geográfica de forma igualitaria, oportuna y\nexpedita a los ciudadanos, entidades públicas y privadas; existe la necesidad de articular una\ninfraestructura de datos espaciales, estableciendo un marco común para el desarrollo de dicha\ninformación, mediante la coordinación de todas las instancias, que permita promover políticas y\ngeneración de estándares para su acopio, procesamiento y publicación.\n\n10.-Que el\ndesarrollo de las infraestructuras de información geográfica\nrequiere ajustarse a protocolos y especificaciones normalizadas emitidas por el IGN, de manera\nque las actuaciones llevadas a cabo por los agentes generadores de dicha\ninformación se integren en un ámbito amplio con el fin de lograr\nla interoperabilidad y su\npublicidad.\n\n11.-Que en\natención a lo dispuesto en el ordenamiento jurídico, al IGN le corresponde\nadministrar, direccionar, operativizar y promover el establecimiento de la\ninfraestructura nacional de datos espaciales, procurando así la implementación\ny seguimiento del presente Decreto, mediante controles de gestión que al efecto\nse establezcan.\n\n12.-Que de conformidad con lo dispuesto en el artículo 12 bis del Reglamento a la Ley de Protección\nal Ciudadano del Exceso de Requisitos y Trámites Administrativos, Decreto Ejecutivo N° 37045-MP-\nMEIC, de fecha 23 de marzo de 2012, se procedió a completar el formulario de evaluación, costo-\nbeneficio, de la Dirección de Mejora Regulatoria, siendo que el mismo dio resultado negativo, en\ntanto esta Directriz no contiene trámites ni requisitos en los términos y condiciones que establece\nel Ministerio de Economía Industria y Comercio. Por tanto,\n\nDecretan:\n\nCREACIÓN DE\nLA INFRAESTRUCTURA DE DATOS\n\nESPACIALES\nDE COSTA RICA\n\nArtículo 1º-Sobre\nla Infraestructura de Datos Espaciales de Costa Rica (IDECORI). Es un\nmecanismo de coordinación interinstitucional que integra la\ninformación geográfica, considerando el marco legal, las políticas y\nlos recursos del sector público, privado y educación superior\nuniversitaria, productoras y usuarias de información\ngeográfica del territorio continental y marino nacional.\n\nArtículo 2º-Objetivo\ngeneral. Promover la gestión de datos e información geográfica de\ninterés nacional de calidad, para\nfortalecer la toma de decisiones en todos los campos de la política pública y\nprivada; así como articular, armonizar, disponer, reutilizar la generación de\nproductos, geoservicios y publicación de datos fundamentales, temáticos y\ngenerales, debidamente estandarizados, georreferenciados y compatibilizados.\n\nArtículo 3º-Objetivos\nespecíficos. El IGN como responsable de la IDECORI tiene los\nsiguientes objetivos específicos:\n\na) Liderar\nacuerdos entre los productores y usuarios de información geográfica de interés\nnacional que garanticen el soporte\na procesos de toma de decisiones económicas, sociales y ambientales del país\nmediante el establecimiento de métodos, herramientas y servicios para la\nadministración de datos geográficos.\n\nb) Normalizar la información geográfica nacional; así como la adquisición, procesamiento, análisis,\nacceso, precisión y su transferencia mediante diferentes formatos digitales o análogas entre los\nusuarios, sistemas y ubicaciones.\n\nc) Implementar\nmecanismos de operación y sostenibilidad del Plan Nacional de Información\nGeográfica.\n\nd) Desarrollar las competencias de ley en cuanto a la oficialización de estándares y normas técnicas\nde información geográfica fundamental, temática y general dentro del Plan Nacional de Información\nGeográfica.\n\ne) Promover en el\nsector público y privado el cumplimiento de normas técnicas de información\ngeográfica, políticas,\nlineamientos, protocolos, manuales y guías en torno a la gestión\nde la información geográfica de interés nacional que estos producen, para asegurar su calidad,\nactualización y disponibilidad.\n\nf) Asesorar al\nsector público y privado en la implementación de plataformas de sistemas de\ninformación geográfica, gestión\nde datos geográficos, así como en infraestructuras de datos espaciales específicos.\n\ng) |Incentivar a\nlos diferentes sectores que producen información geográfica, a que los recursos\ndestinados a la generación de\ninformación geográfica fundamental y temática, sean utilizados de forma eficiente y\neficaz, con el fin de que no se\ndupliquen esfuerzos en la captura y mantenimiento de los datos\ngeográficos, con lo cual se optimice su producción y uso.\n\nh) Contar con la información geográfica que producen los diferentes sectores respetando sus\ncompetencias, con el propósito de alimentar el SNIT, de conformidad con la normativa aplicable.\n\ni) Implementar\nesquemas de trabajo que garanticen la integración, interoperabilidad y\nsostenibilidad de recursos para la producción de información geográfica de\ninterés nacional.\n\nj) Estimular la cooperación, intercambio e investigación de infraestructuras de datos espaciales\ninternacionales, con el fin de ampliar el conocimiento sobre la gestión, producción, y publicación\nde información geográfica nacional.\n\nArtículo 4.-Ámbito\nde aplicación. La información geográfica que se produzca, es\nconsiderada de interés nacional y\nfundamental para fortalecer la toma de decisiones, por lo tanto el sector\npúblico está obligado a acatar el presente Decreto.\n\nEn cuanto a la información geográfica producida por\nel sector privado, y que al efecto manifieste interés en integrarla al\ngeoportal del SNIT, debe\ncumplir con las normas técnicas de información geográfica, políticas,\nlineamientos, protocolos, manuales y guías oficializados por el IGN, dentro del\nmarco de la IDECORI.\n\nArtículo 5º-Condiciones\ntécnicas de la información geográfica. Estas son:\n\na) La georreferenciación del dato geográfico, para lo cual se basará en el sistema oficial de\nreferencia de coordenadas, para el territorio continental y para el territorio marino de Costa Rica,\nconforme lo determine y oficialice el IGN,\n\nb) La observancia\nde las normas técnicas de información geográfica, las políticas y los\nlineamientos oficializados por el\nIGN.\n\nArtículo 6º-Relación\nde otras infraestructuras de datos espaciales con la IDECORI. Las\ninfraestructuras de datos espaciales sectoriales, institucionales,\nregionales y locales que articulen estructuras virtuales integradas por\ndatos georreferenciados, podrán formar parte de la IDECORI, cumpliendo\ncon lo dispuesto en el artículo 5 del presente Decreto, así como con las\nnormas técnicas de información geográfica, políticas, lineamientos,\nprotocolos, manuales\ny guías oficializados por el IGN, dentro del marco de la IDECORI\n\nArtículo 7º-Sobre\nla interoperabilidad. Para asegurar la interoperabilidad entre la IDECORI y\nlas infraestructuras de datos espaciales sectoriales, institucionales,\nregionales y locales y entre éstos con los usuarios externos, las soluciones\ntecnológicas que se utilicen, deberán cumplir con las normas técnicas y\nestándares de información geográfica, políticas, lineamientos,\nprotocolos, manuales\ny guías oficializados por el IGN.\n\nArtículo 8º-Sobre\nla administración de la IDECORI. La dirección, organización, planeación Y\nel funcionamiento de la IDECORI es responsabilidad del ION, para lo cual\ncoordinará con los diferentes sectores productores de información\ngeográfica, en lo que\ncorresponda.\n\nArtículo 9º-Sobre\nel geoportal de la IDECORI. El SNIT creado mediante Decreto Ejecutivo N°\n37773-JP-H-MINAEMICITT, es administrado por el ION del Registro Nacional, y se constituye\nen el geoportal de la IDECORI.\n\nTransitorio único. Articles 1, 2, 3, 4, 5, 6, and 12 of the Executive Decree “Update of the Official Horizontal Geodetic Reference System for Costa Rica,” Decree No. 40962-MJP dated January 24, 2018; and Articles 1, 2, 3, and 5 of the Executive Decree “Creation of the National Territorial Information System,” Decree No. 37773-JP-H-MINAE-MICITT dated May 7, 2013.\n\nConsidering:\n\n1.—That the United Nations and the Pan American Institute of Geography and History of the Organization of American States recommended that their members create national spatial data infrastructures, as an intergovernmental mechanism for decision-making, enabling the establishment of guidelines regarding the production, availability, and use of geographic information within the framework of national policies.\n\n2.—That the modernization of the State is based, among other pillars, on the observance of the principles of transparency, collaboration between institutions, decentralization, and deconcentration, through the participation of citizens in urban and rural areas.\n\n3.—That for decision-making in public service, it is fundamental to consider geographic information in order to meet needs, thus ensuring the optimal use of resources.\n\n4.—That by legal imperative, the National Geographic Institute (Instituto Geográfico Nacional, IGN) of the National Registry is the official, scientific, and technical authority, governing cartography, geography, geodesy, geophysics, and related subjects, which determines and makes official the technical standards for geographic information, guaranteeing the production, use, and management of fundamental, thematic, and general geographic information, with standards that ensure its interoperability and proper publication.\n\n5.—That the Republic of Costa Rica signed Loan Agreement No. 1284/0C-CR with the Inter-American Development Bank for the execution of the so-called “Programa de Regularización del Catastro y Registro de la Propiedad Inmueble de Costa Rica,” approved by Law No. 154 dated November 27, 2001.\n\n6.—That General Norms, Annex A, Section 2.06 of Loan Agreement Law No. 8154 establish the creation of the National Territorial Information System (Sistema Nacional de Información Territorial, SNIT), which includes the final design and installation to manage the country's official cadastral-registry database, and whose basic layer links the interconnected geographic information systems of public and private entities, or professionals in the exercise of their functions, which generate geographic information for that purpose.\n\n7.—That in accordance with Article 1 of Executive Decree No. 37773-JP-H-MINAE-MICITT, dated May 7, 2013, the National Territorial Information System (SNIT) is created as a system that comprehensively publishes thematic geographic information that is duly standardized, georeferenced, and made compatible with the fundamental and official geographic information existing in the National Registry.\n\n8.—That following the completion of the “Programa de Regularización del Catastro y el Registro de la Propiedad Inmueble de Costa Rica,” the IGN has administered the SNIT geoportal since April 2014, in accordance with Article 4 of Executive Decree No. 37773-JP-H-MINAE-MICITT.\n\n9.—That in order to guarantee equal, timely, and expeditious access to geographic information for citizens and public and private entities, there is a need to articulate a spatial data infrastructure, establishing a common framework for the development of such information through the coordination of all bodies, making it possible to promote policies and the generation of standards for its collection, processing, and publication.\n\n10.—That the development of geographic information infrastructures requires adherence to protocols and standardized specifications issued by the IGN, so that the actions carried out by the agents generating said information are integrated within a broad scope to achieve interoperability and publicity.\n\n11.—That in accordance with the legal system, the IGN is responsible for administering, directing, operationalizing, and promoting the establishment of the national spatial data infrastructure, thus ensuring the implementation and follow-up of this Decree, through management controls established for that purpose.\n\n12.—That in accordance with Article 12 bis of the Regulation to the Law for the Protection of Citizens from Excessive Requirements and Administrative Procedures, Executive Decree No. 37045-MP-MEIC, dated March 23, 2012, the cost-benefit evaluation form from the Regulatory Improvement Directorate was completed, and it yielded a negative result, as this Directive does not contain procedures or requirements under the terms and conditions established by the Ministry of Economy, Industry, and Commerce. Therefore,\n\nThey Decree:\n\nCREATION OF THE SPATIAL DATA\nINFRASTRUCTURE OF COSTA RICA\n\nArticle 1.—On the Spatial Data Infrastructure of Costa Rica (Infraestructura de Datos Espaciales de Costa Rica, IDECORI). It is an inter-institutional coordination mechanism that integrates geographic information, considering the legal framework, policies, and resources of the public sector, private sector, and university higher education, which are producers and users of geographic information of the national continental and marine territory.\n\nArticle 2.—General Objective. To promote the management of quality geographic data and information of national interest, to strengthen decision-making in all fields of public and private policy; as well as to articulate, harmonize, make available, and reuse the generation of products, geoservices, and the publication of fundamental, thematic, and general data that are duly standardized, georeferenced, and made compatible.\n\nArticle 3.—Specific Objectives. The IGN, as the entity responsible for the IDECORI, has the following specific objectives:\n\na) Lead agreements among producers and users of geographic information of national interest that guarantee support for economic, social, and environmental decision-making processes in the country, through the establishment of methods, tools, and services for the administration of geographic data.\n\nb) Standardize national geographic information; as well as its acquisition, processing, analysis, access, accuracy, and transfer via different digital or analog formats among users, systems, and locations.\n\nc) Implement operating and sustainability mechanisms for the National Geographic Information Plan.\n\nd) Develop the legal competencies regarding the officialization of standards and technical norms for fundamental, thematic, and general geographic information within the National Geographic Information Plan.\n\ne) Promote, in the public and private sectors, compliance with technical standards for geographic information, policies, guidelines, protocols, manuals, and guides regarding the management of the national-interest geographic information they produce, to ensure its quality, updating, and availability.\n\nf) Advise the public and private sectors on the implementation of geographic information system platforms, geographic data management, and specific spatial data infrastructures.\n\ng) Encourage the different sectors that produce geographic information to ensure that the resources allocated to the generation of fundamental and thematic geographic information are used efficiently and effectively, so that efforts in the capture and maintenance of geographic data are not duplicated, thereby optimizing their production and use.\n\nh) Have the geographic information produced by the different sectors, respecting their competencies, for the purpose of feeding the SNIT, in accordance with applicable regulations.\n\ni) Implement work schemes that guarantee the integration, interoperability, and sustainability of resources for the production of geographic information of national interest.\n\nj) Stimulate cooperation, exchange, and research regarding international spatial data infrastructures, in order to broaden knowledge about the management, production, and publication of national geographic information.\n\nArticle 4.—Scope of Application. The geographic information that is produced is considered of national interest and fundamental for strengthening decision-making; therefore, the public sector is obligated to comply with this Decree.\n\nAs for the geographic information produced by the private sector that expresses interest in integrating it into the SNIT geoportal, it must comply with the technical standards for geographic information, policies, guidelines, protocols, manuals, and guides made official by the IGN, within the framework of the IDECORI.\n\nArticle 5.—Technical Conditions of Geographic Information. These are:\n\na) The georeferencing of the geographic data, for which it shall be based on the official coordinate reference system for the continental territory and for the marine territory of Costa Rica, as determined and made official by the IGN.\n\nb) The observance of the technical standards for geographic information, the policies, and the guidelines made official by the IGN.\n\nArticle 6.—Relationship of Other Spatial Data Infrastructures with the IDECORI. Sectoral, institutional, regional, and local spatial data infrastructures that articulate virtual structures composed of georeferenced data may become part of the IDECORI, complying with the provisions of Article 5 of this Decree, as well as with the technical standards for geographic information, policies, guidelines, protocols, manuals, and guides made official by the IGN, within the framework of the IDECORI.\n\nArticle 7.—On Interoperability. To ensure interoperability between the IDECORI and sectoral, institutional, regional, and local spatial data infrastructures, and between these and external users, the technological solutions used must comply with the technical standards and geographic information standards, policies, guidelines, protocols, manuals, and guides made official by the IGN.\n\nArticle 8.—On the Administration of the IDECORI. The direction, organization, planning, and operation of the IDECORI is the responsibility of the IGN, for which it shall coordinate with the different sectors producing geographic information, as appropriate.\n\nArticle 9.—On the IDECORI Geoportal. The SNIT created by Executive Decree No. 37773-JP-H-MINAEMICITT is administered by the IGN of the National Registry, and constitutes the IDECORI geoportal.\n\nSole Transitory Provision. The agreements for the publication of thematic geographic information on the SNIT geoportal that are signed and in force between the Administrative Board of the National Registry and public and private entities shall remain effective until their completion date; thereafter, the provisions of this Decree shall apply to them.\n\nArticle 10.—On Validity. It enters into force upon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.—San José, Costa Rica, on the eighteenth day of November of the year two thousand nineteen." }
