  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 42185\n\n                        Declara de utilidad pública para los intereses del Estado la Asociación\nAcueducto Rural de Milano\n\nTexto Completo acta: 17706C\n\nN° 42185-MJP\n\n(Este decreto ejecutivo fue dejado sin efecto por\nel artículo 1° del decreto ejecutivo N° 45026 del 27 de marzo de 2025)\n\nEL PRESIDENTE DE LA\nREPÚBLICA\n\nY LA MINISTRA DE JUSTICIA Y\nPAZ\n\nCon fundamento en lo\ndispuesto en los artículos 140, inciso 18) y 146 de la Constitución Política,\nen el artículo 32 de la Ley de Asociaciones N° 218 del 8 de agosto de 1939 y\nlos artículos 27 y siguientes del Reglamento a la Ley de Asociaciones N°\n294964,publicado en La Gaceta N° 96 del21 de mayo del 2001, así como lo\nestablecido en el artículo 3, inciso ch) de la Ley de Impuesto sobre la Renta\nN° 7092 y en los artículos 103 y 104 de Código de Normas y Procedimientos\nTributarios N° 4755.\n\nConsiderando:\n\nI.-El artículo 32 de la Ley\nde Asociaciones N° 218 de 8 de agosto de 1939 y sus reformas, confiere al Poder\nEjecutivo la potestad de declarar de utilidad pública a las asociaciones simples,\nfederadas o confederadas, cuyo desarrollo y actividades sean particularmente\nútiles para los intereses del Estado y que por ello contribuyan a solventar una\nnecesidad social.\n\nII.-La Asociación Acueducto\nRural de Milano, cédula de persona jurídica número 3-002-330755, se inscribió\nen el Registro de Asociaciones del Registro Nacional desde el día 18 de\nsetiembre del 2002, folios del 1 al 13, expediente 14663.\n\nIII.-Los fines primordiales\nque persigue la asociación, según sus estatutos, son: \"A-Construir un\nacueducto en Milano de Germania de Siquirres. B-Administrar, operar y\nconservar en buenas condiciones el acueducto, de acuerdo con las disposiciones\ny Reglamentos que al respecto emita Acueducto y Alcantarillados.\nC-Obtener la participación efectiva de la comunidad, en la construcción\ny mantenimiento del acueducto. D-Colaboración en los programas y\ncampañas de índole educativas que se emprendan. E-Ayudar a explicar y\ndivulgar en la comunidad las disposiciones y Reglamentos de Acueductos y\nAlcantarillados. F- Cooperar con los planes, proyectos y obras que\nemprenda Acueductos y Alcantarillados en la comunidad. G-To participate in\nthe surveillance and protection of the water supply sources of the\nwater supply system, to prevent their contamination, and to help protect\nthe watersheds (cuencas hidrográficas) of the region\".\n\nIV.-Such purposes solve\na social need of the highest order, for which they deserve the support of the\nCosta Rican State.\n\nTherefore,\n\nThey decree:\n\nDECLARATION OF PUBLIC\nUTILITY\n\nFOR THE ASOCIACIÓN DEL\nACUEDUCTO\n\nRURAL DE MILANO\n\nArticle 1°-Declare of\npublic utility for the interests of the State the Asociación Acueducto Rural de\nMilano, legal entity identification number N° 3-002-330755.\n\nArticle 2°-It is the duty of the\nassociation to annually render a management report before the Ministerio de\nJusticia y Paz, in accordance with the provisions of article 32 of the Regulation\nto the Law of Associations.\n\nArticle 3°-The income and\nthe assets of the association that are allocated entirely and exclusively\nfor public or charitable purposes and that in no case are\ndistributed directly or indirectly among its members, shall be exempt\nfrom income tax; on the contrary, that portion that does not have this\npurpose, or is distributed in some manner among its associates, shall be subject\nto the imposition of this tax.\n\nArticle 4°-It is the responsibility of\nthe Tax Administration to control and oversee the correct fulfillment\nof the tax obligations of the association, in accordance with the provisions\nof articles 103 and 104 of the Code of Tax Norms and Procedures.\n\nArticle 5°-Once\nthis decree is published, the interested parties must formalize (protocolizar) and present the\nrespective certified copy (testimonio) before the Associations Registry of the National Registry,\nfor its respective registration.\n\nArticle 6°-It takes effect as of\nits publication.\n\nIssued at the Presidencia de la\nRepública.-San José, on the eighth day of January of two thousand twenty."
