En fe de lo anterior firmo en las oficinas Comerciales de\nla Empresa de Servicios Públicos de Heredia, Sociedad Anónima, el día de del 20 _ _\n\nNombre del cliente y firma\n\nContrato para la prestación de Servicios de Agua de la\n\nEmpresa de Servicios Públicos de Heredia Sociedad Anónima\n\nLa Empresa de Servicios Públicos de Heredia S.A., cédula jurídica número\ntres-ciento uno- cero cuarenta y dos mil veintiocho en adelante\n\"ESPH\", representada por Edgar Allan Benavides Vílchez, mayor,\ncasado, ingeniero electricista, vecino de San Rafael de Heredia, y portador de\nla cédula de identidad número cuatro - ciento dos- mil treinta y dos en su\ncondición de Apoderado General sin límite de suma y _____________________\nmayor, vecino(a) de __________ y portador(a) de la cédula ______________ número\n______________ . en adelante el \"ABONADO\", convienen en celebrar el\npresente contrato para la prestación del servicio de acueducto y/o\nalcantarillado sanitario, el cual se regirá por las siguientes cláusulas.\n\nPRIMERA: Suministro del Servicio: La \"ESPH\", suministrará el servicio\nde acueducto y/o alcantarillado sanitario solicitado por el \"ABONADO\"\npara los usos y tarifas establecidas por la Autoridad Reguladora de los\nServicios Públicos en adelante ARESEP (residencial, industrial, comercial,\ngobierno o preferencial) con las tarifas vigentes establecidos en los términos\nestablecidos en el Reglamento de Prestación de Servicios, Norma Técnica de\nHidrómetros y Reglamento Sectorial, de la ARESEP y de la Ley de Aguas vigente,\npara el inmueble tomo ______ , Asiento _______ 􀂶 número de plano\n_____ ,, en la dirección _____________________ , para lo cual contará con un\nplazo máximo de cinco(S) días hábiles para el Servicio de Agua Potable y diez\n(10) días hábiles para el Servicio de Alcantarillad Sanitario, contados a\npartir de la firma del presente contrato, para realizar su conexión, siempre y\ncuando no se den condiciones de fuerza mayor, caso fortuito, limitaciones o\nrestricciones especificadas en el Reglamento de Prestación de Servicios de Agua\nPotable, Alcantarillado Sanitario e Hidrantes de la ESPH S.A.\n\nSEGUNDA: De las instalaciones internas: El\n\"ABONADO\" tiene la obligación de construir, operar y mantener las\ninstalaciones internas de su propiedad, de conformidad en lo que corresponda,\ncon lo estipulado en las normas técnicas exigibles al efecto, aprobadas por la\nARESEP, así como cualquier otra que emita o adopte, o cualquiera aplicables en\nCosta Rica.\n\nTERCERA: Vencimiento y cobro de la factura: Las facturas por cada\nperíodo mensual se pondrán al cobro de acuerdo a los cronogramas estimados o\naproximados establecidos por la \"ESPH\", y comunicados previamente al\n\"ABONADO\" en el sitio web de la Empresa,\n\nCuando el 'ABONADO\" cancele la factura correspondiente al consumo\nde su servicio, en fecha posterior a la indicada para su vencimiento, deberá\npagar un importe adicional del 2% sobre el\n\nmonto facturado, con\nel fin de cubrir los costos en que incurre \"ESPH\" por no percibir\noportunamente los ingresos por los servicios ya brindados.\n\nPor la reconexión del servicio de acueducto suspendido por falta de\npago, el \"ABONADO\", deberá cancelar la suma que fije la Autoridad\nReguladora de los Servicios Públicos para cubrir el costo de la reconexión,\nademás del importe adicional por cancelación atrasada y las cuentas pendientes\npor el servicio suspendido.\n\nCUARTA: Responsabilidad por daños: \"ESPH\" no será responsable por\nningún daño ocasionado por el mal uso, funcionamiento y mal estado de la\ninstalación interna del \"ABONADO\", aun cuando las hubiese revisado\npor propia iniciativa o a pedido de éste, ni por las consecuencias de causa\nalguna que tengan su origen en dichas instalaciones.\n\nQUINTA: Daños al equipo de medición: El \"ABONADO\" velará por el buen\nestado del equipo de medición instalado en su inmueble, debiendo informar\noportunamente a \"ESPH\" sobre cualquier daño que le ocurra. In witness whereof, I sign at the Commercial offices of the Empresa de Servicios Públicos de Heredia, Sociedad Anónima, on this day of 20 _ _\n\nClient's name and signature\n\nContract for the Provision of Water Services of the\n\nEmpresa de Servicios Públicos de Heredia Sociedad Anónima\n\nThe Empresa de Servicios Públicos de Heredia S.A., legal identification number three-one zero one- zero forty-two thousand twenty-eight, hereinafter \"ESPH\", represented by Edgar Allan Benavides Vílchez, of legal age, married, electrical engineer, resident of San Rafael de Heredia, and bearer of identity card number four - one hundred two- thousand thirty-two, in his capacity as General Attorney-in-Fact without limit of sum, and _____________________ of legal age, resident of __________ and bearer of identity card ______________ number ______________ , hereinafter the \"SUBSCRIBER\", agree to enter into this contract for the provision of aqueduct and/or sanitary sewerage service, which shall be governed by the following clauses.\n\nFIRST: Provision of Service: \"ESPH\" shall supply the aqueduct and/or sanitary sewerage service requested by the \"SUBSCRIBER\" for the uses and rates established by the Autoridad Reguladora de los Servicios Públicos, hereinafter ARESEP (residential, industrial, commercial, government, or preferential), with the current rates established under the terms set forth in the Service Provision Regulation, Technical Standard for Water Meters, and Sectoral Regulation of ARESEP, and the current Ley de Aguas, for the property volume ______ , Entry _______ , cadastral map number _____ ,, at the address _____________________ , for which it shall have a maximum period of five (5) business days for the Potable Water Service and ten (10) business days for the Sanitary Sewerage Service, counted from the signing of this contract, to make its connection, provided that conditions of force majeure, unforeseen events, or limitations or restrictions specified in the Regulation for the Provision of Potable Water, Sanitary Sewerage, and Fire Hydrant Services of ESPH S.A. do not arise.\n\nSECOND: Regarding Internal Installations: The \"SUBSCRIBER\" is obligated to construct, operate, and maintain the internal installations on their property, in accordance with what is stipulated in the applicable technical standards required for this purpose, approved by ARESEP, as well as any other issued or adopted, or any applicable in Costa Rica.\n\nTHIRD: Due Date and Collection of the Bill: The bills for each monthly period shall be put up for collection according to the estimated or approximate schedules established by \"ESPH,\" and communicated previously to the \"SUBSCRIBER\" on the Company's website.\n\nWhen the \"SUBSCRIBER\" pays the bill corresponding to the consumption of their service on a date after the one indicated for its due date, they must pay an additional amount of 2% on the\n\nbilled amount, in order to cover the costs incurred by \"ESPH\" for not timely receiving the income for the services already provided.\n\nFor the reconnection of the aqueduct service suspended due to lack of payment, the \"SUBSCRIBER\" must pay the sum set by the Autoridad Reguladora de los Servicios Públicos to cover the reconnection cost, in addition to the additional amount for late payment and the outstanding accounts for the suspended service.\n\nFOURTH: Liability for Damages: \"ESPH\" shall not be liable for any damage caused by the misuse, operation, and poor condition of the \"SUBSCRIBER'S\" internal installation, even if it had inspected them on its own initiative or at the latter's request, nor for the consequences of any cause originating in said installations.\n\nFIFTH: Damages to Metering Equipment: The \"SUBSCRIBER\" shall ensure the good condition of the metering equipment installed on their property, and must timely inform \"ESPH\" of any damage that occurs to it.
