  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 0080\n\n                        Se amplía por un año los plazos otorgados en aquellas concesiones de\naprovechamiento y de permisos de vertidos, que vencen durante el año 2020\n\nTexto Completo acta: 135C73\n\nMINISTERIO DE\nAMBIENTE Y ENERGÍA\n\nR-0080-2020-MINAE.-MINISTERIO DE AMBIENTE Y ENERGIA.-San José, a las once\nhoras del veintisiete de marzo de dos mil veinte.\n\nRESULTANDO\n\nPRIMERO: Que mediante Decreto Ejecutivo N°42227-MP-S se declaró estado de\nemergencia nacional en todo el territorio de la República de Costa Rica, debido\na la situación sanitaria provocada por el COVID 19.\n\nSEGUNDO: Que con base en el decreto citado, se emitió la Directriz N° 0002-2020 y\noficioOM-183-2020, que dispone sobre tomar acciones preventivas para la salud\ndel personal y del administrado buscando facilitar los trámites ordinarios de\nforma no presencial y evitar la aglomeración de personas en las oficinas;\nademás que ordenó la no recepción de documentos de manera física, únicamente de\nmanera digital.\n\nTERCERO: Que conforme el Registro Nacional de Concesiones de Aprovechamiento\ndeAgua y Permisos de Vertidos que lleva la Dirección de Agua del Ministerio de\nAmbiente y Energía, para el año 2020, vencen por plazo, 390 concesiones de\naguas y 201 permisos de vertidos.\n\nCONSIDERANDO\n\nPRIMERO: Que el Ministerio de Ambiente y Energía es el ente que alcanza la\ntitularidad del dominio público sobre el agua, según lo establece la Ley de\nAguas Nº 276 y Ley Orgánica del Ambiente Nº 7554, por lo que es el competente\npara conocer y resolver sobre su uso privativo, lo cual desarrollará a través\nde la Dirección de Agua de conformidad con el artículo 177 de la Ley de Aguas.\n\nSEGUNDO: Que de conformidad con el artículo 28, inciso a) siguientes y\nconcordantes de la Ley General de la Administración Pública N°6227, corresponde\nal Ministro del ramo, como órgano jerárquico superior del respectivo\nMinisterio: \"Dirigir y coordinar todos los servicios del Ministerio\".\n\nTERCERO: Que el artículo 4 de la Ley General de la Administración Pública N°6227,\nestablece que la actividad de los entes públicos deberá estar sujeta en su\nconjunto a los principios fundamentales del servicio público, para asegurar su\ncontinuidad, su eficiencia, y adaptación en la necesidad social que satisfacen,\nbasándose para ello, siempre en la igualdad de trato de los destinatarios,\nusuarios o beneficiarios.\n\nPor su parte el numeral 226 del mismo cuerpo normativo, indica que en\ncasos de urgencia y para evitar daños graves a las personas o irreparables a las\ncosas, podrá prescindirse de una o de todas las formalidades del procedimiento.\n\nCUARTO: Que conforme las proyecciones del Ministerio de Salud, el proceso de\natención de la emergencia sanitaria conlleva un proceso de normalización que se\nextenderá durante este año 2020.\n\nQUINTO: Que tanto la concesión de aprovechamiento de agua como el permiso de\nvertido, sólo pueden nacer de un acto expreso de la Administración, por el cual\nésta valora la oportunidad y conveniencia de su otorgamiento, emitiéndose\nentonces para ello la resolución administrativa bajo la cual se otorga la\nconcesión de agua o el permiso de vertido, convirtiéndose éstas en el título\nhabilitante, emitidos por el Ministro de Ambiente y Energía.\n\nSEXTO: Que con fundamento en lo expuesto se debe tener por ampliado el plazo de\nvigencia de las resoluciones administrativas sean, de las concesiones de\naprovechamiento de agua como en los permisos de vertidos que vencen durante el\n2020.\n\nPOR TANTO\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA,\n\nRESUELVE\n\nAMPLIAR POR UN AÑO, los plazos otorgados en aquellas concesiones de\naprovechamiento y de permisos de vertidos, que vencen durante el año 2020.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 0080\n\n                        The terms granted in those water-use concessions and discharge permits that expire during the year 2020 are extended by one year\n\nComplete Text of record: 135C73\n\nMINISTRY OF\nENVIRONMENT AND ENERGY\n\nR-0080-2020-MINAE.—MINISTRY OF ENVIRONMENT AND ENERGY.—San José, at eleven o'clock on the twenty-seventh of March of two thousand twenty.\n\nWHEREAS\n\nFIRST: That by means of Executive Decree No. 42227-MP-S, a state of national emergency was declared throughout the territory of the Republic of Costa Rica, due to the health situation caused by COVID-19.\n\nSECOND: That based on the cited decree, Directive No. 0002-2020 and official communication OM-183-2020 were issued, which provide for taking preventive actions for the health of personnel and the administered public, seeking to facilitate ordinary procedures in a non-face-to-face manner and to avoid the agglomeration of people in offices; furthermore, it ordered the non-receipt of documents in physical form, only in digital form.\n\nTHIRD: That according to the National Registry of Water-Use Concessions and Discharge Permits maintained by the Water Directorate of the Ministry of Environment and Energy, for the year 2020, 390 water concessions and 201 discharge permits expire due to their term.\n\nCONSIDERING\n\nFIRST: That the Ministry of Environment and Energy is the entity that holds ownership of the public domain over water, as established by Water Law No. 276 and Organic Environmental Law No. 7554, and therefore is the competent authority to hear and resolve regarding its private use, which it shall carry out through the Water Directorate in accordance with Article 177 of the Water Law.\n\nSECOND: That in accordance with Article 28, subsection a) et seq. and concordant articles of the General Public Administration Law No. 6227, it is the responsibility of the Minister of the branch, as the superior hierarchical body of the respective Ministry: \"To direct and coordinate all the services of the Ministry.\"\n\nTHIRD: That Article 4 of the General Public Administration Law No. 6227 establishes that the activity of public entities must be subject, as a whole, to the fundamental principles of public service, to ensure its continuity, its efficiency, and its adaptation to the social need they satisfy, always basing itself on equal treatment of the recipients, users, or beneficiaries.\n\nFor its part, numeral 226 of the same normative body indicates that in cases of urgency and to avoid serious harm to persons or irreparable harm to property, one or all of the procedural formalities may be dispensed with.\n\nFOURTH: That according to the projections of the Ministry of Health, the process of attending to the health emergency entails a normalization process that will extend throughout this year 2020.\n\nFIFTH: That both the water-use concession (concesión de aprovechamiento de agua) and the discharge permit (permiso de vertido) can only arise from an express act of the Administration, by which it assesses the timeliness and advisability of its granting, therefore issuing the administrative resolution under which the water concession or the discharge permit is granted, these becoming the enabling title, issued by the Minister of Environment and Energy.\n\nSIXTH: That based on the foregoing, the term of validity of the administrative resolutions, both of water-use concessions and discharge permits that expire during 2020, must be considered extended.\n\nTHEREFORE\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY,\n\nRESOLVES\n\nTO EXTEND BY ONE YEAR the terms granted in those water-use concessions and discharge permits that expire during the year 2020.
