TERRITORIO\n\nAVISO Nº 2020-001\n\nZONA MARÍTIMA TERRESTRE\n\nDelimitación de zona pública del Río Tempisque\n\nCon fundamento en las facultades que confiere el artículo 140 y artículo\n240 inciso 1 de la Ley N° 6227 General de la Administración Pública, y en lo\ndispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley\nN° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la\nLey Nº 6043 sobre la Zona Marítimo Terrestre, del 02 de marzo de 1977, y su\nrespetivo reglamento.\n\nConsiderando:\n\n1°-Que mediante Ley N° 8905, se establece el Instituto Geográfico\nNacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico, geodésico,\ngeofísico y de índole similar que tenga relación con dichas obras, con el fin\nde apoyar los procesos de planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley de Creación del Instituto Geográfico\nNacional (IGN), N° 59, en el artículo 62 del Reglamento a la Ley N° 6043, se\nreconoce la competencia del Instituto Geográfico Nacional para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta, mientras que el artículo\n63 del mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4°-Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en artículo 11 que: \"La Red Geodésica Nacional de Referencia\nHorizontal CR05 y el sistema de proyección cartográfica CRTM05,\nconstituirán el único sistema oficial de coordenadas para la República\nde Costa Rica a partir del cual se debe referenciar todos los\nlevantamientos y actividades cartográficos y geodésicos que desarrollen\nen el Territorio Nacional toda dependencia pública, persona o entidad\nprivada nacional o extranjera.\"; mientras que el artículo 7 indica que \"Conforme\nse produzcan datos cartográficos en el nuevo sistema de proyección\ncartográfica CRTM05, el Instituto Geográfico Nacional publicará por los\nmedios adecuados aquella información que se ha oficializado.\"\n\n6°-Que el Decreto Ejecutivo N° 40962-MJP \"Actualización del Sistema\nGeodésico de Referencia Horizontal Oficial para Costa Rica\" declara que: \"El\nsistema geodésico de referencia horizontal oficial para Costa Rica,\ndenominado como CR05 y su materialización mediante la Red Geodésica\nNacional, cambia en sus siglas a CRSIRGAS, como sistema de referencia\nhorizontal oficial para la República de Costa Rica,.\", mientras que \"El\nsistema de proyección cartográfica CRTM05 seguirá siendo el oficial para\nla representación cartográfica del territorio nacional continental.\"\n\nPor su parte, el artículo 12 del decreto de cita, refuerza la aplicación\nde la proyección cartográfica CRTM05 como el sistema nacional de coordenadas\noficial a la cual se deben referenciar en el territorio continental de nuestro\npaís, al señalar que \".todos los levantamientos y actividades\ncartográficos y geodésicos que desarrollen en el territorio nacional\ntoda dependencia pública, persona o entidad privada, nacional o\nextranjera, que emprendan o contraten trabajos geodésicos y\ncartográficos, contribuyéndose a evitar el gasto público y obteniendo,\npor otra parte, información geográfica confiable, uniforme y comparable,\nque sea de utilidad general y que apoye la toma de decisiones en los\ndistintos niveles del Estado.\"\n\n7°-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n8°-Que la información digital georreferenciada sobre delimitación de la\nzona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico\nNacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n9°-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N° 7841-P \"Reglamento a la Ley N° 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo N° 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05\", c) el Decreto Ejecutivo N° 40962-MJP \"Actualización del\nSistema Geodésico de Referencia Horizontal Oficial para Costa Rica\"; y d) el\nDecreto Ejecutivo N° 36642-MP-MOPT-MINAET \"Reglamento de Especificaciones para\nla Delimitación de la zona pública de la Zona Marítimo Terrestre\".\n\n10.-Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de\nfebrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará\nen el terreno los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n11.-El Instituto Geográfico Nacional, con base en criterio técnico\noficial competencia en materia ambiental del Área de Conservación Tempisque -\nSistema Nacional de Áreas de Conservación (SINAC), del Ministerio el Ambiente y\nEnergía (MINAE), utilizó la metodología de \"Delimitación Digital\nGeorreferenciada\" para delimitar la zona pública de la Zona Marítimo Terrestre\nen la ría del Río Tempisque, ubicada en los distritos 02 San Antonio, 03\nQuebrada Honda del cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa\nCruz; el distrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces\ndel cantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos\ncantones de la provincia 05 de Guanacaste.\n\n11.-Que mediante las certificaciones ACT-ORDR- 1533-2018, de fecha 08 de\nnoviembre de 2018 y ACTPNE- 006-2018, ambas firmadas por el Lic. Nelson Marín\nMora Director Regional Área de Conservación Tempisque - SINAC, MINAE, se oficializa\nel \"Informe Final de Delimitación sobre \nOrtofotos Escala 1:5000/1:1000 y la Verificación de Campo sobre los\nRíos, Esteros y Manglares del Litoral Pacífico de Costa Rica producto de la\nContratación 2009EI-000084-UE del Programa de Regularización del Catastro y\nRegistro Contrato Préstamo 1284/ OC-CR\" en lo que respecta al alcance de la ría\ndel Río Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda\ndel cantón de Nicoya; el distrito 02 Bolsón del cantón de Santa Cruz; el\ndistrito 01 Filadelfia, del cantón de Carrillo; el distrito 01 Bagaces del\ncantón de Bagaces; y el distrito 05 Porozal del cantón de Cañas, todos cantones\nde la provincia 05 de Guanacaste.\n\n12.-Que la delimitación realizada cuenta con aval técnico interno\nconforme al oficio N° DIG-TOT-0465-2018 del 14 de noviembre de 2018, emitido\npor el Subproceso de Limites Oficiales del Departamento Topográfico y\nObservación del Territorio del Instituto Geográfico Nacional.\n\n13.-Que el artículo 140 de la Ley N° 6227 General de la Administración\nPública señala que \"el acto administrativo producirá su efecto\ndespués de comunicado al administrado, excepto si le concede únicamente\nderechos, en cuyo caso lo producirá desde que se adopte\",\ndisposición que necesariamente debe relacionarse con el numeral 204) del mismo\ncuerpo normativo, mismo que define el instrumento idóneo para comunicar actos\nde naturaleza genérica al señalar que: \"Se comunicaran por publicación los\nactos generales y por notificación, los concretos\".\n\nCOMUNICA:\n\n1º-Que el Instituto Geográfico Nacional, con base en criterio técnico\noficial competencia en materia ambiental del Área de Conservación Tempisque -\nSistema Nacional de Áreas de Conservación (SINAC), del Ministerio el Ambiente y\nEnergía (MINAE), realizó la delimitación digital georreferenciada de la ría del\nRío Tempisque, ubicada en los distritos 02 San Antonio, 03 Quebrada Honda del\ncantón de Nicoya; Likewise, it is established that the Instituto Geográfico Nacional shall be the scientific and technical dependency governing national cartography, destined for the execution of the official basic Map and the basic geographic Description of the Republic of Costa Rica and for studies, research or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, with the purpose of supporting planning processes.\n\n2- That the Law Creating the Instituto Geográfico Nacional, No. 59, establishes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, extending its authority to activities of any kind originating from the works entrusted to its charge.\n\n3- That in accordance with the Law Creating the Instituto Geográfico Nacional (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the Instituto Geográfico Nacional for the delimitation of the public zone of the Maritime Terrestrial Zone (Zona Marítimo Terrestre, ZMT), and its formalization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states that \"The Instituto Geográfico Nacional must publish a notice in the Official Gazette, for each portion of the maritime terrestrial zone in which it has demarcated the public zone.\"\n\n4- That Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,\" establishes according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of markers (mojones) and/or through digital georeferenced delimitation, for the purpose of streamlining delimitations and providing greater technical certainty to interested parties.\n\n5- That Executive Decree No. 33797-MJ-MOPT, which among other aspects determines, the National Geodetic Horizontal Reference Network CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically pointing out in Article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the CRTM05 cartographic projection system shall constitute the sole official coordinate system for the Republic of Costa Rica from which all cartographic and geodetic surveys and activities developed in the National Territory by any public dependency, person, or private national or foreign entity must be referenced.\"; while Article 7 indicates that \"As cartographic data are produced in the new CRTM05 cartographic projection system, the Instituto Geográfico Nacional shall publish by appropriate means that information which has been formalized.\"\n\n6- That Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\" declares that: \"The official horizontal geodetic reference system for Costa Rica, named CR05 and its materialization through the National Geodetic Network, changes its acronym to CRSIRGAS, as the official horizontal reference system for the Republic of Costa Rica.,\" while \"The CRTM05 cartographic projection system shall continue to be the official system for the cartographic representation of the national continental territory.\"\n\nFor its part, Article 12 of the cited decree reinforces the application of the CRTM05 cartographic projection as the official national coordinate system to which they must be referenced in the continental territory of our country, by stating that \".all cartographic and geodetic surveys and activities developed in the national territory by any public dependency, person, or private entity, national or foreign, that undertake or contract geodetic and cartographic works, contributing to avoid public spending and obtaining, on the other hand, reliable, uniform, and comparable geographic information, that is of general utility and supports decision-making at the different levels of the State.\"\n\n7- That georeferencing to the national coordinate system as a mechanism to delimit the public zone of the Maritime Terrestrial Zone, enables the correct delimitation of the public zone for the purposes of the elaboration of regulatory plans, the approval of cadastral survey plans, the granting of concessions in the Zona Restringida, and other aspects of coastal territorial planning (ordenamiento territorial costero).\n\n8- That the digital georeferenced information on delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT).\n\n9- That the Digital Georeferenced Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulation established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone,\" b) Executive Decree No. 33797-MJ-MOPT \"Declares as official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05,\" c) Executive Decree No. 40962-MJP \"Update of the Official Horizontal Geodetic Reference System for Costa Rica\"; and d) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone.\"\n\n10.-That Article 16 of the Ley Forestal, Law No. 7575 of February 13, 1996, establishes that the Ministerio del Ambiente y Energía shall delimit on the ground the boundaries of the areas that make up the Patrimonio Natural del Estado.\n\n11.-The Instituto Geográfico Nacional, based on the official technical criterion with environmental competence of the Área de Conservación Tempisque - Sistema Nacional de Áreas de Conservación (SINAC), of the Ministerio el Ambiente y Energía (MINAE), used the \"Digital Georeferenced Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in the estuary (ría) of the Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.\n\n11.-That through certifications ACT-ORDR- 1533-2018, dated November 8, 2018, and ACTPNE- 006-2018, both signed by Lic. Nelson Marín Mora, Regional Director of the Área de Conservación Tempisque - SINAC, MINAE, the \"Final Delimitation Report on Orthophotos Scale 1:5000/1:1000 and Field Verification of the Rivers, Estuaries, and Mangroves of the Pacific Littoral of Costa Rica, product of Contracting 2009EI-000084-UE of the Cadastre and Registry Regularization Program Loan Contract 1284/ OC-CR\" is formalized with respect to the scope of the estuary (ría) of the Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.\n\n12.-That the delimitation carried out has internal technical approval pursuant to official letter No. DIG-TOT-0465-2018 of November 14, 2018, issued by the Official Boundaries Subprocess of the Departamento Topográfico y Observación del Territorio of the Instituto Geográfico Nacional.\n\n13.-That Article 140 of Law No. 6227 General Law on Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it only grants rights, in which case it shall produce it from the moment it is adopted,\" a provision that must necessarily be related to numeral 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating that: \"General acts shall be communicated by publication and specific acts, by notification.\"\n\nCOMMUNICATES:\n\n1- That the Instituto Geográfico Nacional, based on the official technical criterion with environmental competence of the Área de Conservación Tempisque - Sistema Nacional de Áreas de Conservación (SINAC), of the Ministerio el Ambiente y Energía (MINAE), carried out the digital georeferenced delimitation of the estuary (ría) of the Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste.\n\n2- The public zone of the Maritime Terrestrial Zone corresponding to the estuary (ría) of the Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, has as extreme point coordinates of the estuary in the official cartographic projection system of Costa Rica CRTM05, as follows:\n\n| COORDINATES CRTM05 | NORTH | EAST |\n| --- | --- | --- |\n| Ría del Río Tempisque | 1152969.7857 | 346477.8004 |\n\n3- The sectors of the estuary (ría) of the Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, that currently have delimitation of the public zone of the Maritime Terrestrial Zone through the placement of markers (mojones) and respective publication in the Official Gazette La Gaceta, maintain their official status.\n\n5- The official technical data of the digital georeferenced delimitation of the public zone of the Maritime Terrestrial Zone of the estuary (ría) of the Río Tempisque located in Río Tempisque, located in districts 02 San Antonio, 03 Quebrada Honda of the canton of Nicoya; district 02 Bolsón of the canton of Santa Cruz; district 01 Filadelfia, of the canton of Carrillo; district 01 Bagaces of the canton of Bagaces; and district 05 Porozal of the canton of Cañas, all cantons of province 05 of Guanacaste, have been recorded in the Digital Georeferenced Geodatabase (GDG) of the Instituto Geográfico Nacional (IGN) on the Maritime Terrestrial Zone (ZMT), in a file in vector shape format, under the codification: RN/ IGN_GDG-IGN-ZMT_rias.-Curridabat, June 1, 2020." }
