Pública, y en lo\ndispuesto en la Ley Nº 59 de creación del Instituto Geográfico Nacional, la Ley\nNº 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la\nLey Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su\nrespetivo reglamento.\n\nConsiderando:\n\n1º-Que mediante Ley Nº 8905, se establece el Instituto Geográfico\nNacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el desarrollo\nde políticas nacionales de carácter cartográfico, geográfico, geodésico, geofísico\ny de índole similar que tenga relación con dichas obras, con el fin de apoyar\nlos procesos de planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico Nacional, Nº 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\n3º-Que de conformidad con la Ley de Creación del Instituto Geográfico\nNacional (IGN), Nº 59, en el artículos 62 del Reglamento a la Ley Nº 6043, se\nreconoce la competencia del Instituto Geográfico Nacional para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta, mientras que el artículo\n63 del mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4º-Que en el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital georreferenciada,\nesto con el fin de agilizar las delimitaciones y proporcionar mayor seguridad\ntécnica a los interesados.\n\n5º-Que en el Decreto Ejecutivo Nº 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05\ny el sistema de proyección cartográfica CRTM05, constituirán el único\nsistema oficial de coordenadas para la República de Costa Rica a partir del\ncual se debe referenciar todos los levantamientos y actividades cartográficos y\ngeodésicos que desarrollen en el Territorio Nacional toda dependencia pública, persona\no entidad privada nacional o extranjera.\"; mientras que el artículo 7\nindica que \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional\npublicará por los medios adecuados aquella información que se ha oficializado.\"\n\n6º-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n7º-Que la\ninformación digital georreferenciada sobre delimitación de la zona pública de\nla Zona Marítimo Terrestre con que cuenta el IGN, se le denomina Geodatabase\nDigital Georreferenciada (GDG) del Instituto Geográfico Nacional (IGN) sobre la\nZona Marítimo Terrestre (ZMT).\n\n8º-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el\nDecreto Ejecutivo Nº 7841-P \"Reglamento a la Ley Nº 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo Nº 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica asociada,\nCRTM05\", y c) el Decreto Ejecutivo Nº 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\".\n\n9º-Que el artículo 16 de la Ley Forestal, Ley Nº 7575 del 13 de febrero\nde 1996, establece que el Ministerio del Ambiente y Energía delimitará en el\nterreno los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n10.-El Instituto Geográfico Nacional, utilizó la metodología de\n\"Delimitación Digital Georreferenciada\" para delimitar la zona pública de la\nZona Marítimo Terrestre en la ría del Río Bejuco, ubicado en el distrito\n06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste, esto conforme al\n\n11.-Que mediante la certificación ACT-OR-DR-001-2018, el Área de\nConservación tempisque, certifica el alcance de la ría del Río Bejuco, ubicado\nen el distrito 06 Bejuco, cantón 9 Nandayure, provincia de 05 Guanacaste según\nel \"Informe Final de Delimitación sobre Ortofotos Escala 1:5000/1:1000 y la\nVerificación de Campo sobre los Ríos, Esteros y Manglares del Litoral Pacifico\nde Costa Rica producto de la Contratación 2009EI-000084-UE del Programa de\nRegularización del Catastro Y Registro Contrato Préstamo 1284/ OC-CR\" del\nsector objeto del presente aviso.\n\n12.-Que la delimitación realizada cuenta con aval THE PUBLIC ZONE OF THE BEJUCO RIVER\n\nBased on the powers conferred by Article 140 and Article\n240, subsection 1 of Law No. 6227, General Public Administration Act, and in\naccordance with Law No. 59 creating the National Geographic Institute, Law\nNo. 8905 transferring the National Geographic Institute to the National Registry,\nLaw No. 6043 on the Maritime Terrestrial Zone, of March 2, 1977, and its\nrespective regulation.\n\nConsidering:\n\n1. That through Law No. 8905, the National Geographic\nInstitute is established as a dependency of the National Registry and that the Administrative\nBoard of the National Registry shall administer the Institute's budget, sign\nthe contracts and agreements necessary for the exercise of its\nfunctions. Likewise, it is established that the National Geographic Institute shall be the\nscientific and technical dependency governing national cartography, destined\nfor the execution of the official basic Map and the basic geographic Description of the\nRepublic of Costa Rica and for studies, investigations, work, and the development\nof national policies of a cartographic, geographic, geodetic, geophysical\nnature and of a similar nature related to said works, with the aim of supporting\nplanning processes.\n\n2. That the Law Creating the National Geographic Institute, No. 59, establishes\nit permanently and on behalf of the State, as the\nofficial authority in geodetic matters and the spatial representation of the\ngeography of the Republic, its authority extending to activities of\nany nature that originate from the works entrusted to its charge.\n\n3. That in accordance with the Law Creating the National Geographic\nInstitute (IGN), No. 59, in Article 62 of the Regulation to Law No. 6043, it\nrecognizes the competence of the National Geographic Institute for the delimitation\nof the public zone of the Maritime Terrestrial Zone, and its officialization through\npublication in the Official Gazette La Gaceta, while Article\n63 of the same Regulation states that \"The National Geographic Institute must\npublish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone\nin which it has demarcated the public zone.\"\n\n4. That in Executive Decree No. 36642-MP-MOPTMINAET, \"Regulation of\nSpecifications for the Delimitation of the public zone of the Maritime Terrestrial\nZone,\" it is established according to Article 18 that for the delimitation of the\npublic zone of the Maritime Terrestrial Zone, the IGN may resort to two\nexecution methodologies, indicated in Articles 19 and 20,\ncorresponding to the delimitation of the public zone of the Maritime Terrestrial\nZone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation (delimitación digital georreferenciada),\nwith the aim of streamlining delimitations and providing greater technical\nsecurity to interested parties.\n\n5. That in Executive Decree No. 33797-MJ-MOPT, which among other\naspects determines the National Geodetic Network of Horizontal Reference CR05,\nand its associated cartographic projection CRTM05, as the official system to which\nthe coordinates of all geodetic, cartographic,\nand cadastral works executed in our country must be referenced, specifically stating in\nArticle 11 that: \"The National Geodetic Network of Horizontal Reference CR05\nand the cartographic projection system CRTM05 shall constitute the only\nofficial coordinate system for the Republic of Costa Rica from which\nall surveys and cartographic and\ngeodetic activities developed in the National Territory by any public agency, domestic or foreign\nprivate person or entity must be referenced.\"; while Article 7\nindicates that \"As cartographic data are produced in the new\ncartographic projection system CRTM05, the National Geographic Institute\nshall publish through appropriate means that information which has been officialized.\"\n\n6. That georeferencing to the national coordinate system as\na mechanism for delimiting the public zone of the Maritime Terrestrial Zone\nenables the correct delimitation of the public zone for the purposes of\npreparing regulatory plans, approving cadastral survey plans (visado de planos de agrimensura), the\ngranting of concessions in the Restricted Zone, and other aspects of\ncoastal territorial planning.\n\n7. That the\ngeoreferenced digital information on the delimitation of the public zone of\nthe Maritime Terrestrial Zone held by the IGN is called the Digital Georeferenced Geodatabase\n(GDG) of the National Geographic Institute (IGN) on the\nMaritime Terrestrial Zone (ZMT).\n\n8. That the Digital Georeferenced Geodatabase (GDG) of the National\nGeographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically\nbased on the application of the regulations established by: a)\nExecutive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial\nZone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares CR05 as the official\nhorizontal datum for Costa Rica, and its associated cartographic projection,\nCRTM05\", and c) Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of\nSpecifications for the Delimitation of the public zone of the Maritime Terrestrial\nZone.\"\n\n9. That Article 16 of the Forestry Law (Ley Forestal), Law No. 7575 of February 13,\n1996, establishes that the Ministry of Environment and Energy shall demarcate on\nthe ground the boundaries of the areas that constitute the Natural Heritage of the\nState.\n\n10. The National Geographic Institute used the methodology of\n\"Georeferenced Digital Delimitation (Delimitación Digital Georreferenciada)\" to delimit the public zone of the\nMaritime Terrestrial Zone in the inlet (ría) of the Bejuco River, located in district\n06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste, in accordance with\n\n11. That through certification ACT-OR-DR-001-2018, the Tempisque\nConservation Area certifies the extent of the inlet (ría) of the Bejuco River, located\nin district 06 Bejuco, canton 9 Nandayure, province of 05 Guanacaste according to\nthe \"Final Report on Delimitation using Orthophotos Scale 1:5000/1:1000 and the\nField Verification of Rivers, Estuaries, and Mangroves of the Pacific Coast\nof Costa Rica, product of Contract 2009EI-000084-UE of the Cadastre\nand Registry Regularization Program Loan Agreement 1284/ OC-CR\"\nfor the sector subject to this notice.\n\n12. That the delimitation performed has internal technical endorsement\nin accordance with official communication No. DIG-TOT-307-2018, issued by the Official Limits\nSub-process of the Topographic and Territory Observation Department of the\nNational Geographic Institute.\n\n13. That Article 140 of Law No. 6227, General Public Administration Act,\nstates that \"the administrative act shall produce its effect after\nbeing communicated to the administered party, except if it only grants rights, in which\ncase it shall produce them from the moment it is adopted,\" a provision that must necessarily\nrelate to numeral 204) of the same regulatory body, which defines\nthe appropriate instrument for communicating acts of a generic nature by stating\nthat: \"General acts shall be communicated by publication and specific acts,\nby notification.\"\n\nCOMMUNICATES:\n\n1. The National Geographic Institute used, on the Bejuco River,\nlocated in district 06 Bejuco, canton 9 Nandayure, province 05 Guanacaste,\nbased on official communications ACT-ORDR-985-18 dated July 30, 2018,\nreferring to official communication DGT-TOT-094-18 and certification ACT-OR-DR-001-2018, a copy\nof report ACT-OSRHN-572-18 from the Tempisque Conservation Areas System.\n\n2. The public zone of the Maritime Terrestrial Zone used on the Bejuco\nRiver, located in district 06 Bejuco, canton 9 Nandayure, province of\n05 Guanacaste, determined, in the official cartographic projection system of\nCosta Rica CRTM05, from Map MBCR- 1/50,000 Sheet Herradura, namely:  \n\n| CR05 Coordinates | North | East |\n| --- | --- | --- |\n| Inlet (Ría) of the Bejuco River | 1086615 | 354456 |\n\n3. The sectors of the inlet (ría) of the Bejuco River located in district\n06 Bejuco, canton Nandayure, province 05 Guanacaste, which as of today\nhave a delimitation of the public zone of the Maritime Terrestrial Zone through\nthe placement of boundary markers (mojones) and respective publication in the Official Gazette La\nGaceta, maintain their official status.\n\n5. The official technical data of the georeferenced digital delimitation\nof the public zone of the Maritime Terrestrial Zone of the inlet (ría) of the Bejuco River, located\nin district 06 Bejuco, canton 09 Nandayure, province 05 Guanacaste, have\nbeen recorded in the Digital Georeferenced Geodatabase (GDG) of the\nNational Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT), in\na vector shape format file, under the code: RN/IGN_GDG-IGN-ZMT_inlets (rias).\n\nCurridabat, June 15, 2020.-" }
