Será potestad de la Municipalidad\nde Turrialba nombrar la Junta Administrativa del Albergue Indígena Cabecar,\nconformada por dos representantes del Concejo Municipal, un representante de la\nAsociación de Desarrollo Integral de Reserva Indígena Cabecar de Chirripó, un\nrepresentante de la Administración Municipal, un representante del Ministerio de\nSalud, y un representante de la Comisión Nacional de Asuntos Indígenas.\n\nDicha Junta Administrativa estará conformada por presidente(a),\nvicepresidente(a), secretario(a), tesorero(a), fiscal, vocal 1., elegidos a lo\ninterno de la junta, los cuales deberán ser juramentados por el Concejo\nMunicipal.\n\nArtículo 4º-Funciones y facultades de la Junta Administrativa del\nAlbergue Indígena\n\na- Nombrar a la persona encargada de la administración del albergue\nindígena.\n\nb- Supervisar, controlar y coordinar todo lo pertinente para el adecuado\nfuncionamiento del albergue, así como velar por el cumplimiento de lo\nestipulado en el presente reglamento.\n\nc- Establecer mecanismos de control interno (revisión de libros de\nentradas y salidas, libro de inventario, libro contable, expedientes y otros\nque la Junta Administrativa determine).\n\nd- Podrá aplicar sanciones o destituir al administrador que incumpla con\nlo establecido en el presente reglamento o directrices emanadas por la Junta.\n\ne- Aplicar sanciones a los usuarios y usuarias que incumplan con lo\nestablecido en el presente reglamento o directrices del administrador.\n\nf- Presentar un informe anual a la Municipalidad de Turrialba (Alcaldía\ny Concejo Municipal).\n\ng- Capacitar y asesorar al administrador del albergue en las funciones\nque se le asignen.\n\nArtículo 5º-Obligaciones y Funciones del administrador del albergue\nindígena\n\na) Confeccionar un expediente de cada usuario y usuaria.\n\nb) Llevar un registro de entrada y salida de todos los usuarios y usuarias\ndel albergue.\n\nc) Brindar toda la información que requiera la Junta Administrativa.\n\nd) Llevar un registro de los ingresos y egresos económicos.\n\ne) Mantener actualizado el inventario de suministros.\n\nf) Participar en reuniones o actividades que se realicen en el Albergue\npor parte de la Junta Administrativa.\n\ng) Hacer cumplir el presente reglamento.\n\nh) Velar por el correcto uso del mobiliario y equipo del albergue.\n\ni) Comunicar a los usuarios y usuarias toda la información necesaria\npara la utilización del albergue según lo establecido en el presente\nreglamento.\n\nj) Podrá aplicar el derecho de permanencia y de admisión a los usuarios\no usuarias que resulten responsables de cualquier altercado, molestia o acto\nirrespetuoso, para lo cual deberá dejar documentado lo acontecido.\n\nCondiciones de alojamiento\n\nArtículo 6º-El uso del albergue estará sujeto al pago de la tarifa\nvigente aprobada por la Junta Administrativa, quien podrá actualizarla cada\naño.\n\nDicha cuota será cancelada a la persona designada como administrador y\ndeberá pagarla todo usuario y usuaria mayor de 13 años de edad que desee\nutilizar el albergue.\n\nSe utilizará un recibo de dinero como comprobante de pago.\n\nArtículo 7º-La utilización del albergue no podrá ser de forma\npermanente, a excepción de casos que así lo requieran, previa comprobación del\nadministrador mediante la documentación que estime conveniente.\n\nEl ingreso al albergue será de las 05:00 a.m. hasta las 10:00 p.m., con\nexcepción de situaciones de emergencia que requieran ingresar después de las\n10:00 p.m.\n\nArtículo 8º-Queda prohibido el ingreso y estancia de todo tipo de\nanimales dentro del albergue, a excepción de los perros guías, esto conforme a\nla Ley N° 7600.\n\nArtículo 9º-El albergue estará separado en dos sectores, para la\nutilización de las habitaciones y baños, uno de ellos para uso de mujeres y\nniños, y el otro sector para uso de hombres.\n\nArtículo 10.-Deberes y obligaciones para los usuarios y usuarias\n\n. Tener un comportamiento respetuoso con el personal que administre el\nalbergue y con las personas que se encuentren en el mismo.\n\n. Mantener conversaciones en un tono leve, de modo que no generen ruido\no molestia a los demás.\n\n. Utilizar un lenguaje apropiado.\n\n. Acatar las instrucciones emitidas por el personal encargado de administrar\nel albergue.\n\n. Ante cualquier altercado, molestia o acto irrespetuoso causado entre\nlos usuarios y usuarias, o hacia la persona que administra el albergue, quedará\nreservado el derecho de permanencia y de admisión para la persona responsable.\n\n. Mantener las normas mínimas de convivencia social, higiene personal, y\nlimpieza del edificio.\n\n. Utilizar vestimenta adecuada en los lugares comunes.\n\n. Utilizar el comedor o en los lugares destinados para el consumo de los\nalimentos.\n\n. Conservar limpias las habitaciones, los baños, la cocina, el salón de\ncomedor, así como cualquier otra área de uso común después de haberlas\nutilizado.\n\n. Respetar y cumplir lo establecido en el presente reglamento del\nalbergue.\n\n. Comunicar al encargado de la administración del albergue las anomalías\nde funcionamiento, desperfectos o deficiencias que se presenten en el edifico,\nel mobiliario o el equipo.\n\n. Respetar los derechos y pertenencias de los demás usuarios y usuarias.\n\nArtículo 11.-Se prohíbe a todos los usuarios y las usuarias\n\n. Colocar cualquier tipo de ropa u objetos en las ventanas, u otro lugar\nque no sea específicamente señalado para ese fin.\n\n. Utilizar las ventanas u otros lugares para ingresar o salir del edificio,\npara ello debe utilizarse únicamente las puertas destinadas para ese fin.\n\n. Extraer del edificio todo tipo de muebles, colchones,\nelectrodomésticos, y cualquier otro tipo de equipo con que cuente el albergue.\n\n. Escupir dentro del edificio del albergue.\n\n. Fumar tabaco o cualquier tipo de sustancias estupefacientes.\n\n. Consumir cualquier tipo de bebidas con contenido alcohólico y\nsustancias estupefacientes.\n\n. Utilizar lenguajes o palabras obscenas, vulgares u ofensivas.\n\n. Realizar cualquier tipo de fogata, quemas o similar dentro y fuera del\nalbergue.\n\nArtículo 12.- (Nota de Sinalevi:\nEN la publicación de este reglamento no aparece este artículo. Utilizar el edificio, mobiliario y equipo con que cuenta el albergue.\n\n. Obtener la información completa sobre las condiciones del funcionamiento\nde dicho albergue.\n\n. Recibir un trato adecuado del administrador del albergue.\n\nArtículo 17.-Normas Especiales. Deberán respetarse las costumbres\nculturales de los indígenas Cabecar.\n\nArtículo 18.-Registro de Entrada. Para realizar el registro de\nentrada todos los usuarios y usuarias deben presentar a la persona encargada de\nla administración del albergue, la cédula de identidad o cualquier documento\nidóneo que logre la identificación.\n\nArtículo 19.-Habitaciones\n\n. Las habitaciones deben utilizarse únicamente para dormir, respetando\nlas horas de descanso y mantener las normas de convivencia con los demás\nusuarios y usuarias.\n\n. Los usuarios y usuarias deben respetar un período de silencio entre\nlas 10:00 p.m. horas y las 05:00 a.m. horas, con el fin de garantizar un\ndescanso idóneo a todos los demás usuarios y usuarias.\n\n. Queda prohibido almacenar, preparar y consumir todo tipo de alimentos\ndentro de las habitaciones.\n\nArtículo 20.-El albergue dispone de salas de entretenimiento, con\ntelevisión, libros y juegos de mesa, de uso para todos los usuarios y usuarias\ndel albergue.\n\nArtículo 21.-Del deterioro o daños en el edificio, el mobiliario y\nequipo del albergue. Los usuarios y usuarias deben tener cuidado y\ncompromiso con la conservación del edificio, el mobiliario y equipo.\n\nEn todo caso, quien cause deterioro en el edificio, mobiliario o equipo,\nresponderá por los daños ocasionados. La responsabilidad y sanciones que en\ncada caso pudieran aplicarse, se exigirán conforme a lo dispuesto en el\npresente reglamento o lo que la Junta Administrativa determine conveniente.\n\nArtículo 22.-Régimen sancionador. En el supuesto de incumplimiento\nde dicha reglamentación, las personas usuarias podrán ser desalojados de\ninmediato del albergue, sin perjuicio de la exigencia de las responsabilidades\nque se podrían aplicar, según así lo disponga la Junta Administrativa.\n\nArtículo 23.-Constituirán motivos para la no permanencia y admisión en\nel albergue, los siguientes:\n\n. El deterioro intencionado o la negligencia grave en el cuidado y\nconservación del edificio, las instalaciones o equipo.\n\n. La reiterada desobediencia a las instrucciones emitidas por la persona\nencargada de la administración.\n\nAcordado en la sesión ordinaria N° 205-2020 celebrada el martes 31 de\nmarzo del 2020 en el artículo cuarto, inciso 4.\n\nTurrialba, 26 de mayo del 2020.",
  "body_en_text": "throughout the entire text\n\n-\n\nComplete Text of Norm 205\n\nRegulation of the DITSÁ KÄPÄ KLÄ JUÍ (Indigenous Shelter for the Cabecar Population)\n\nComplete Text record: 138575\n\nMUNICIPALITY OF TURRIALBA\n\nREGULATION OF THE DITSÁ KÄPÄ KLÄ JUÍ\n\n(INDIGENOUS SHELTER FOR THE CABECAR POPULATION)\n\nGeneral provisions\n\nArticle 1.-The purpose of this regulation is to establish rights, duties, obligations, and responsibilities, and also to regulate the use and operation of the Indigenous Shelter located in Carmen Lyra in the first district of the canton of Turrialba.\n\nThis regulation must be placed in a visible location inside the shelter, and also in the Spanish language and the Cabecar language.\n\nArticle 2.-The shelter is a site intended for the lodging and stay of the Cabecar indigenous population who visit the central canton of Turrialba to carry out health procedures or other types of personal needs that are duly justified to the administrator.\n\nArticle 3.-Administrative Board. It shall be the authority of the Municipality of Turrialba to appoint the Administrative Board of the Cabecar Indigenous Shelter, composed of two representatives of the Municipal Council, one representative of the Integral Development Association of the Cabecar Indigenous Reserve of Chirripó, one representative of the Municipal Administration, one representative of the Ministry of Health, and one representative of the National Commission for Indigenous Affairs.\n\nSaid Administrative Board shall be composed of a president, vice president, secretary, treasurer, auditor, vocal 1, elected internally by the board, who must be sworn in by the Municipal Council.\n\nArticle 4.-Functions and powers of the Administrative Board of the Indigenous Shelter\n\na- Appoint the person in charge of the administration of the indigenous shelter.\n\nb- Supervise, control, and coordinate everything pertinent for the adequate operation of the shelter, as well as ensure compliance with the provisions stipulated in this regulation.\n\nc- Establish internal control mechanisms (review of entry and exit logs, inventory book, accounting book, case files (expedientes), and others that the Administrative Board determines).\n\nd- May apply sanctions or dismiss the administrator who fails to comply with the provisions established in this regulation or directives issued by the Board.\n\ne- Apply sanctions to users who fail to comply with the provisions established in this regulation or the administrator's directives.\n\nf- Submit an annual report to the Municipality of Turrialba (Mayor's Office and Municipal Council).\n\ng- Train and advise the shelter administrator in the functions assigned to them.\n\nArticle 5.-Obligations and Functions of the administrator of the indigenous shelter\n\na) Prepare a case file (expediente) for each user.\n\nb) Keep an entry and exit record of all users of the shelter.\n\nc) Provide all information required by the Administrative Board.\n\nd) Keep a record of economic income and expenses.\n\ne) Keep the supplies inventory updated.\n\nf) Participate in meetings or activities held in the Shelter by the Administrative Board.\n\ng) Enforce this regulation.\n\nh) Ensure the correct use of the shelter's furniture and equipment.\n\ni) Communicate to the users all the necessary information for the use of the shelter as established in this regulation.\n\nj) May apply the right of stay and admission to users who are responsible for any altercation, nuisance, or disrespectful act, for which they must document what occurred.\n\nLodging conditions\n\nArticle 6.-The use of the shelter shall be subject to the payment of the current fee approved by the Administrative Board, which may update it each year.\n\nSaid fee shall be paid to the person designated as administrator and must be paid by every user over 13 years of age who wishes to use the shelter.\n\nA money receipt shall be used as proof of payment.\n\nArticle 7.-The use of the shelter may not be permanent, except in cases that so require, upon prior verification by the administrator through the documentation they deem appropriate.\n\nEntry to the shelter shall be from 05:00 a.m. until 10:00 p.m., except for emergency situations that require entering after 10:00 p.m.\n\nArticle 8.-The entry and stay of all types of animals inside the shelter is prohibited, except for guide dogs, in accordance with Law No. 7600.\n\nArticle 9.-The shelter shall be separated into two sectors for the use of the rooms and bathrooms, one of them for the use of women and children, and the other sector for the use of men.\n\nArticle 10.-Duties and obligations for users\n\n. Behave respectfully with the staff who administer the shelter and with the people who are in it.\n\n. Maintain conversations in a low tone, so as not to generate noise or nuisance to others.\n\n. Use appropriate language.\n\n. Abide by the instructions issued by the staff in charge of administering the shelter.\n\n. In the event of any altercation, nuisance, or disrespectful act caused between users, or towards the person who administers the shelter, the right of stay and admission shall be reserved for the responsible person.\n\n. Maintain minimum standards of social coexistence, personal hygiene, and building cleanliness.\n\n. Use appropriate clothing in common areas.\n\n. Use the dining room or the areas designated for food consumption.\n\n. Keep the rooms, bathrooms, kitchen, dining room, as well as any other common area clean after having used them.\n\n. Respect and comply with the provisions established in this regulation of the shelter.\n\n. Notify the person in charge of the shelter administration of any operating anomalies, breakdowns, or deficiencies that arise in the building, furniture, or equipment.\n\n. Respect the rights and belongings of the other users.\n\nArticle 11.-All users are prohibited from\n\n. Placing any type of clothing or objects on the windows, or any other place not specifically designated for that purpose.\n\n. Using windows or other places to enter or exit the building; only the doors intended for that purpose must be used for this.\n\n. Removing from the building all types of furniture, mattresses, appliances, and any other type of equipment the shelter has.\n\n. Spitting inside the shelter building.\n\n. Smoking tobacco or any type of narcotic substances.\n\n. Consuming any type of alcoholic beverages and narcotic substances.\n\n. Using obscene, vulgar, or offensive language or words.\n\n. Receive adequate treatment from the shelter administrator.\n\nArticle 17.-Special Norms. The cultural customs of the Cabecar indigenous people must be respected.\n\nArticle 18.-Entry Registry. To perform the entry registry, all users must present to the person in charge of the shelter administration their identity card or any suitable document that achieves identification.\n\nArticle 19.-Rooms\n\n. The rooms must be used only for sleeping, respecting rest hours and maintaining standards of coexistence with the other users.\n\n. Users must respect a period of silence between 10:00 p.m. and 05:00 a.m., in order to ensure adequate rest for all other users.\n\n. Storing, preparing, and consuming all types of food inside the rooms is prohibited.\n\nArticle 20.-The shelter has entertainment rooms, with television, books, and board games, for the use of all shelter users.\n\nArticle 21.-Deterioration or damage to the building, furniture, and equipment of the shelter. Users must exercise care and commitment to the conservation of the building, furniture, and equipment.\n\nIn any case, whoever causes deterioration to the building, furniture, or equipment, shall be liable for the damages caused. The liability and sanctions that could be applied in each case shall be demanded in accordance with the provisions of this regulation or as the Administrative Board determines convenient.\n\nArticle 22.-Sanctions regime. In the event of non-compliance with this regulation, users may be immediately evicted from the shelter, without prejudice to the demand for any liabilities that could be applied, as determined by the Administrative Board.\n\nArticle 23.-The following shall constitute grounds for non-stay and admission to the shelter:\n\n. Intentional deterioration or gross negligence in the care and conservation of the building, facilities, or equipment.\n\n. Repeated disobedience of the instructions issued by the person in charge of the administration.\n\nAgreed upon in ordinary session No. 205-2020 held on Tuesday, March 31, 2020, in article four, subsection 4.\n\nTurrialba, May 26, 2020."
