Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada a\nla ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\nII.-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de\ncualquier orden que tengan por origen los trabajos confiados a su cargo.\n\nIII.-Que de conformidad con la Ley de Creación del Instituto Geográfico\nNacional (IGN), N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se\nreconoce la competencia del Instituto Geográfico Nacional para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta, mientras que el artículo 63\ndel mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\nIV.-Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de\nla zona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos metodologías\nde ejecución, que se indican en los artículos 19 y 20, correspondientes a la\ndelimitación de la zona pública de la Zona Marítimo Terrestre a través de la\ncolocación de mojones y/o a la delimitación digital georreferenciada, esto con\nel fin de agilizar las delimitaciones y proporcionar mayor seguridad técnica a\nlos interesados.\n\nV.-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual deben\nestar referidas las coordenadas de todos los trabajos geodésicos, cartográficos\ny catastrales que se ejecuten en nuestro país, señalando específicamente en\nartículo 11 que: \"La Red Geodésica Nacional de Referencia Horizontal CR05 y\nel sistema de proyección cartográfica CRTM05, constituirán el único sistema oficial\nde coordenadas para la República de Costa Rica a partir del cual se debe\nreferenciar todos los levantamientos y actividades cartográficos y geodésicos\nque desarrollen en el Territorio Nacional toda dependencia pública, persona o\nentidad privada nacional o extranjera.\"; mientras que el artículo 7 indica\nque \"Conforme se produzcan datos cartográficos en el nuevo sistema de\nproyección cartográfica CRTM05, el Instituto Geográfico Nacional publicará por\nlos medios adecuados aquella información que se ha oficializado.\"\n\nVI.-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\nVII.-Que la información digital georreferenciada sobre delimitación de\nla zona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico\nNacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\nVIII.-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N° 7841-P \"Reglamento a la Ley N° 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo N° 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05\", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre\".\n\nIX.-Que el artículo 16° de la Ley Forestal, Ley N° 7575 del 13 de\nfebrero de 1996, establece que el Ministerio del Ambiente y Energía delimitará\nen el terreno los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\nX.-El Instituto Geográfico Nacional, utilizó la metodología de\n\"Delimitación Digital Georreferenciada\" para delimitar la zona pública de la\nZona Marítimo Terrestre en la ría de los Ríos Bebedero-Tenorio, ubicado en el\ndistrito 05 Porozal y distrito 04 Bebedero, cantón Cañas y distrito 01 Bagaces,\ncantón 04 Bagaces; todos de la provincia de Guanacaste, Rio Cañas, ubicado en\nel distrito 04 Bebedero, cantón Cañas de la provincia 05 Guanacaste y Río\nAbangares, ubicado en el distritos 06 Manzanillo, cantón 06 Puntarenas,\nprovincia 06 Puntarenas y distrito 04 Colorado, cantón Abangares, de la\nprovincia 05 Guanacaste.\n\nXI.-Que mediante la certificación ACAT-PNE-080-2017, de fecha 28 de\nsetiembre de 2017 firmada por Carlos Wiessel Montano; PNE ACAT y remitido al\nIGN-RN por el Director del Área de Conservación Arenal Tempisque - SINAC-MINAE,\nIngeniero Alexander León Campos, en el cual se certifica el alcance de la ría\nde los Ríos Bebedero-Tenorio, ubicado en el distrito 05 Porozal y distrito 04\nBebedero, cantón Cañas y distrito 01 Bagaces, cantón 04 Bagaces; todos de la\nprovincia de Guanacaste, Rio Cañas, ubicado en el distrito 04 Bebedero, cantón\nCañas de la provincia 05 Guanacaste y Rio Abangares, ubicado en el distritos 06\nManzanillo, cantón 06 Puntarenas, provincia 06 Puntarenas y distrito 04\nColorado, cantón Abangares, de la provincia 05 Guanacaste según el \"Informe\nFinal de Delimitación sobre Ortofotos Escala 1:5000/1:1000 y la Verificación de\nCampo sobre los Ríos, Esteros y Manglares del Litoral Pacifico de Costa Rica producto\nde la Contratación 2009EI-000084-UE del Programa de Regularización del Catastro\ny Registro, Contrato Préstamo 1284/ OC-CR\", del sector objeto del presente\naviso.\n\nXII.-Que la delimitación realizada cuenta con aval técnico interno\nconforme al oficio N° DIG-TOT-0075-2020 del 03 de marzo de 2020, emitido por el\nSubproceso de Límites Oficiales del Departamento Topográfico y Observación del\nTerritorio del Instituto Geográfico Nacional.\n\nXIII.-Que el artículo 140 de la Ley N° 6227 General de la Administración\nPública señala que \"el acto administrativo producirá su efecto después de\ncomunicado al administrado, excepto si le concede únicamente derechos, en cuyo\ncaso lo producirá desde que se adopte\", disposición que necesariamente debe\nrelacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define\nel instrumento idóneo para comunicar actos de naturaleza genérica al señalar\nque: \"Se comunicarán por publicación los actos generales y por notificación,\nlos concretos\".\n\nCOMUNICA:\n\n1°-El Instituto Geográfico Nacional, utilizó en los Ríos Bebedero-Tenorio,\nubicado en el distrito 05 Porozal y distrito 04 Bebedero, cantón Cañas y\ndistrito 01 Bagaces, cantón 04 Bagaces; todos de la provincia de Guanacaste,\nRio Cañas, ubicado en el distrito 04 Bebedero, cantón Cañas de la provincia 05\nGuanacaste y Río Abangares, ubicado en el distritos 06 Manzanillo, cantón 06 Puntarenas,\nprovincia 06 Puntarenas y distrito 04 Colorado, cantón Abangares, de la\nprovincia 05 Guanacaste, con base en el oficio ACAT-PNE-080-2017, de fecha 28\nde setiembre de 2017 firmada por Carlos Wiessel Montano; PNE ACAT y remitido al\nIGN-RN por el Director del Área de Conservación Arenal Tempisque-SINACMINAE, Ingeniero\nAlexander León Campos.\n\n2°-La zona pública de la Zona Marítimo Terrestre que se utilizó en los\nRíos Bebedero-Tenorio, ubicado en el distrito 05 Porozal y distrito 04 Bebedero,\ncantón Cañas y distrito 01 Bagaces, cantón 04 Bagaces; Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, intended for the execution of the official Basic Map and the basic geographical Description of the Republic of Costa Rica and for the studies, research, or work and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to said works, in order to support planning processes.\n\nII.-That the Law Creating the National Geographic Institute, No. 59, permanently constitutes it and, on behalf of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any kind originating from the works entrusted to its charge.\n\nIII.-That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulation to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulation states: \"The National Geographic Institute must publish a notice in the Official Gazette for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\nIV.-That in Executive Decree No. 36642-MP-MOPTMINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,\" it is established according to Article 18 that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of landmarks (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\nV.-That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Network of Horizontal Reference CR05, and its associated cartographic projection CRTM05, as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Network of Horizontal Reference CR05 and the cartographic projection system CRTM05 shall constitute the sole official coordinate system for the Republic of Costa Rica from which all surveys and cartographic and geodetic activities carried out in the National Territory by any public dependency, person, or national or foreign private entity must be referenced.\"; while Article 7 indicates that \"As cartographic data is produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by appropriate means, that information which has been officialized.\"\n\nVI.-That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for the purposes of preparing regulatory plans, the approval of survey plans, the granting of concessions in the Restricted Zone, and other aspects of coastal territorial planning.\n\nVII.-That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT).\n\nVIII.-That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) on the Maritime Terrestrial Zone (ZMT) is technically based on the application of the regulations established by: a) Executive Decree No. 7841-P \"Regulation to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares as the official horizontal datum for Costa Rica, the CR05, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulation of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\nIX.-That Article 16 of the Forest Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall demarcate on the ground the boundaries of the areas that make up the State's Natural Heritage.\n\nX.-The National Geographic Institute used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in the estuary (ría) of the Bebedero-Tenorio Rivers, located in district 05 Porozal and district 04 Bebedero, canton Cañas and district 01 Bagaces, canton 04 Bagaces; all in the province of Guanacaste, Cañas River, located in district 04 Bebedero, canton Cañas of province 05 Guanacaste, and Abangares River, located in district 06 Manzanillo, canton 06 Puntarenas, province 06 Puntarenas and district 04 Colorado, canton Abangares, of province 05 Guanacaste.\n\nXI.-That by means of certification ACAT-PNE-080-2017, dated September 28, 2017, signed by Carlos Wiessel Montano; PNE ACAT and sent to IGN-RN by the Director of the Arenal Tempisque Conservation Area - SINAC-MINAE, Engineer Alexander León Campos, which certifies the extent of the estuary (ría) of the Bebedero-Tenorio Rivers, located in district 05 Porozal and district 04 Bebedero, canton Cañas and district 01 Bagaces, canton 04 Bagaces; all in the province of Guanacaste, Cañas River, located in district 04 Bebedero, canton Cañas of province 05 Guanacaste, and Abangares River, located in district 06 Manzanillo, canton 06 Puntarenas, province 06 Puntarenas and district 04 Colorado, canton Abangares, of province 05 Guanacaste according to the \"Final Delimitation Report on Orthophotos Scale 1:5000/1:1000 and Field Verification of the Rivers, Estuaries, and Mangroves of the Pacific Littoral of Costa Rica, product of Contract 2009EI-000084-UE of the Cadastre and Registry Regularization Program, Loan Agreement 1284/ OC-CR\", for the sector subject to this notice.\n\nXII.-That the delimitation carried out has internal technical endorsement according to official letter No. DIG-TOT-0075-2020 of March 3, 2020, issued by the Official Limits Subprocess of the Topographic Department and Territory Observation of the National Geographic Institute.\n\nXIII.-That Article 140 of Law No. 6227 General Public Administration Act states that \"the administrative act shall produce its effect after being communicated to the administered party, except if it grants only rights, in which case it shall produce them from the moment it is adopted,\" a provision that must necessarily be related to numeral 204) of the same regulatory body, which defines the suitable instrument for communicating acts of a generic nature by stating: \"General acts shall be communicated by publication and specific acts by notification.\"\n\nNOTIFIES:\n\n1°-The National Geographic Institute, used in the Bebedero-Tenorio Rivers, located in district 05 Porozal and district 04 Bebedero, canton Cañas and district 01 Bagaces, canton 04 Bagaces;
