ESTERO/\n\nMANGLAR DE LA ZONA PÚBLICA DE GOLFO DULCE,\n\nDISTRITO SIERPE, CANTÓN OSA, PROVINCIA\n\nPUNTARENAS\n\nCon fundamento en las facultades que confiere el artículo 140 y artículo\n240 inciso 1 de la Ley N° 6227 General de la Administración Pública, y en lo\ndispuesto en la Ley N° 59 de creación del Instituto Geográfico Nacional, la Ley\nN° 8905 de traslado del Instituto Geográfico Nacional al Registro Nacional, la\nLey Nº 6043 sobre la Zona Marítimo Terrestre, del 2 de marzo de 1977, y su\nrespetivo reglamento.\n\nConsiderando:\n\n1°-Que mediante Ley N° 8905, se establece el Instituto Geográfico\nNacional, como una dependencia del Registro Nacional y que la Junta\nAdministrativa del Registro Nacional administrará el presupuesto del Instituto,\nsuscribirá los contratos y convenios necesarios para el ejercicio de sus\nfunciones. Asimismo, se establece que el Instituto Geográfico Nacional será la\ndependencia científica y técnica rectora de la cartografía nacional, destinada\na la ejecución del Mapa básico oficial y la Descripción básica geográfica de la\nRepública de Costa Rica y a los estudios, las investigaciones o labores y el\ndesarrollo de políticas nacionales de carácter cartográfico, geográfico,\ngeodésico, geofísico y de índole similar que tenga relación con dichas obras,\ncon el fin de apoyar los procesos de planificación.\n\n2º-Que la Ley de Creación del Instituto Geográfico Nacional, N° 59, lo\nconstituye de manera permanente y en representación del Estado, como la\nautoridad oficial en materia geodésica y de la representación espacial de la\ngeografía de la República, extendiéndose su autoridad a las actividades de cualquier\norden que tengan por origen los trabajos confiados a su cargo.\n\n3°-Que de conformidad con la Ley de Creación del Instituto Geográfico\nNacional (IGN), N° 59, en el artículos 62 del Reglamento a la Ley N° 6043, se\nreconoce la competencia del Instituto Geográfico Nacional para la delimitación\nde la zona pública de la Zona Marítimo Terrestre, y su oficialización a través\nde publicación en el Diario Oficial La Gaceta, mientras que el artículo\n63 del mismo Reglamento, señala que \"El Instituto Geográfico Nacional deberá\npublicar aviso en el Diario Oficial, de cada porción de la zona\nmarítimo-terrestre en que haya demarcado la zona pública\".\n\n4°-Que en el Decreto Ejecutivo N° 36642-MP-MOPTMINAET \"Reglamento de\nEspecificaciones para la Delimitación de la zona pública de la Zona Marítimo\nTerrestre\", se establece según el artículo 18° que para la delimitación de la\nzona pública de la Zona Marítimo Terrestre, el IGN podrá acudir a dos\nmetodologías de ejecución, que se indican en los artículos 19 y 20,\ncorrespondientes a la delimitación de la zona pública de la Zona Marítimo\nTerrestre a través de la colocación de mojones y/o a la delimitación digital\ngeorreferenciada, esto con el fin de agilizar las delimitaciones y proporcionar\nmayor seguridad técnica a los interesados.\n\n5°-Que en el Decreto Ejecutivo N° 33797-MJ-MOPT, el cual entre otros\naspectos determina, a la Red Geodésica Nacional de Referencia Horizontal CR05,\ny su proyección cartográfica asociada CRTM05, como el sistema oficial al cual\ndeben estar referidas las coordenadas de todos los trabajos geodésicos,\ncartográficos y catastrales que se ejecuten en nuestro país, señalando\nespecíficamente en artículo 11 que: \"La Red Geodésica Nacional de Referencia\nHorizontal CR05 y el sistema de proyección cartográfica CRTM05, constituirán el\núnico sistema oficial de coordenadas para la República de Costa Rica a partir\ndel cual se debe referenciar todos los levantamientos y actividades\ncartográficos y geodésicos que desarrollen en el Territorio Nacional toda\ndependencia pública, persona o entidad privada nacional o extranjera.\" ;\nmientras que el artículo 7 indica que \"Conforme se produzcan datos\ncartográficos en el nuevo sistema de proyección cartográfica CRTM05, el\nInstituto Geográfico Nacional publicará por los medios adecuados aquella\ninformación que se ha oficializado.\"\n\n6°-Que la georreferenciación al sistema nacional de coordenadas como\nmecanismo para delimitar la zona pública de la Zona Marítimo Terrestre,\nposibilita la correcta delimitación de la zona pública a los efectos de la\nelaboración de planes reguladores, el visado de planos de agrimensura, el\notorgamiento de concesiones en la Zona Restringida y otros aspectos de\nordenamiento territorial costero.\n\n7°-Que la información digital georreferenciada sobre delimitación de la\nzona pública de la Zona Marítimo Terrestre con que cuenta el IGN, se le\ndenomina Geodatabase Digital Georreferenciada (GDG) del Instituto Geográfico\nNacional (IGN) sobre la Zona Marítimo Terrestre (ZMT).\n\n8°-Que la Geodatabase Digital Georreferenciada (GDG) del Instituto\nGeográfico Nacional (IGN) sobre la Zona Marítimo Terrestre (ZMT) se fundamenta\ntécnicamente en aplicación de la regulación establecida por: a) el Decreto\nEjecutivo N° 7841-P \"Reglamento a la Ley N° 6043 sobre la Zona Marítimo\nTerrestre\", b) el Decreto Ejecutivo N° 33797-MJ-MOPT \"Declara como datum\nhorizontal oficial para Costa Rica, el CR05, y su proyección cartográfica\nasociada, CRTM05\", y c) el Decreto Ejecutivo N° 36642-MP-MOPT-MINAET\n\"Reglamento de Especificaciones para la Delimitación de la zona pública de la\nZona Marítimo Terrestre\".\n\n9°-Que el artículo 16° de la Ley Forestal, Ley N°7575 del 13 de febrero\nde 1996, establece que el Ministerio del Ambiente y Energía delimitará en el\nterreno los linderos de las áreas que conforman el Patrimonio Natural del\nEstado.\n\n10.-El Instituto Geográfico Nacional, utilizó la metodología de\n\"Delimitación Digital Georreferenciada\" para delimitar la zona pública de la\nZona Marítimo Terrestre en un sector de costa y estero/ manglar en la playa\nconocida como Playa Mogos en el distrito 03 Sierpe, cantón 05 Osa; provincia\n06 Puntarenas.\n\n11.-El Instituto Geográfico Nacional junto con el Área de Conservación\nOsa, utilizó la metodología de \"Delimitación Digital Georreferenciada\" para\ndelimitar la zona pública de la Zona Marítimo Terrestre en un sector de\nestero/manglar en la playa conocida como Playa Mogos; ubicada en distrito 03\nSierpe, cantón 05 Osa; provincia 06 Puntarenas, esto conforme diligencias\nrealizadas por Sonia Carvajal González, cédula N° 5-01252-351 ante el Instituto\nGeográfico Nacional.\n\n12.-Que la delimitación realizada cuenta con aval técnico interno\nconforme al oficio N° DIG-TOT-0014-2020 del 26 de marzo de 2020, emitido por el\nSubproceso de Límites Oficiales del Departamento Topográfico y Observación del\nTerritorio del Instituto Geográfico Nacional.\n\n13.-Que la delimitación realizada contó con el acompañamiento del Área\nde Conservación Osa de Sistema Nacional de Áreas de Conservación, para la\ndemarcación de la zona pública en el sector de ecosistema de estero/manglar, de\nacuerdo con el oficio SINACACOSA-D-705-2019, de fecha 19 de diciembre de\n2020.\n\n13.-Que el artículo 140 de la Ley N° 6227 General de la Administración\nPública señala que \"el acto administrativo producirá su efecto después de\ncomunicado al administrado, excepto si le concede únicamente derechos, en cuyo\ncaso lo producirá desde que se adopte\", disposición que necesariamente debe\nrelacionarse con el numeral 204) del mismo cuerpo normativo, mismo que define\nel instrumento idóneo para comunicar actos de naturaleza genérica al señalar\nque: \"Se comunicaran por publicación los actos generales y por Likewise, it is established that the National Geographic Institute shall be the scientific and technical dependency governing national cartography, responsible for the execution of the official Basic Map and the basic geographic Description of the Republic of Costa Rica, and for studies, research, works, and the development of national policies of a cartographic, geographic, geodetic, geophysical, and similar nature related to such works, in order to support planning processes.\n\n2°—That the Law Creating the National Geographic Institute, No. 59, constitutes it permanently and in representation of the State, as the official authority in geodetic matters and the spatial representation of the geography of the Republic, its authority extending to activities of any nature originating from the works entrusted to its charge.\n\n3°—That in accordance with the Law Creating the National Geographic Institute (IGN), No. 59, Article 62 of the Regulations to Law No. 6043 recognizes the competence of the National Geographic Institute for the delimitation of the public zone of the Maritime Terrestrial Zone, and its officialization through publication in the Official Gazette La Gaceta, while Article 63 of the same Regulations states that \"The National Geographic Institute shall publish a notice in the Official Gazette, for each portion of the maritime-terrestrial zone in which it has demarcated the public zone.\"\n\n4°—That in Executive Decree No. 36642-MP-MOPTMINAET, \"Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone,\" it is established according to Article 18° that for the delimitation of the public zone of the Maritime Terrestrial Zone, the IGN may resort to two execution methodologies, indicated in Articles 19 and 20, corresponding to the delimitation of the public zone of the Maritime Terrestrial Zone through the placement of boundary markers (mojones) and/or through georeferenced digital delimitation, this in order to expedite delimitations and provide greater technical security to interested parties.\n\n5°—That in Executive Decree No. 33797-MJ-MOPT, which among other aspects determines the National Geodetic Horizontal Reference Network CR05 and its associated cartographic projection CRTM05 as the official system to which the coordinates of all geodetic, cartographic, and cadastral works executed in our country must be referenced, specifically stating in Article 11 that: \"The National Geodetic Horizontal Reference Network CR05 and the cartographic projection system CRTM05 shall constitute the only official coordinate system for the Republic of Costa Rica, from which all cartographic and geodetic surveys and activities developed within the National Territory by any public agency, person, or private national or foreign entity must be referenced;\" while Article 7 indicates that \"As cartographic data are produced in the new cartographic projection system CRTM05, the National Geographic Institute shall publish, by adequate means, that information which has been officialized.\"\n\n6°—That georeferencing to the national coordinate system as a mechanism for delimiting the public zone of the Maritime Terrestrial Zone enables the correct delimitation of the public zone for purposes of preparing regulatory plans, approving survey plans (visado de planos de agrimensura), granting concessions in the Restricted Zone, and other aspects of coastal land-use planning (ordenamiento territorial costero).\n\n7°—That the georeferenced digital information on the delimitation of the public zone of the Maritime Terrestrial Zone held by the IGN is called the Georeferenced Digital Geodatabase (Geodatabase Digital Georreferenciada, GDG) of the National Geographic Institute (IGN) regarding the Maritime Terrestrial Zone (ZMT).\n\n8°—That the Georeferenced Digital Geodatabase (GDG) of the National Geographic Institute (IGN) regarding the Maritime Terrestrial Zone (ZMT) is technically based on the application of regulations established by: a) Executive Decree No. 7841-P \"Regulations to Law No. 6043 on the Maritime Terrestrial Zone\", b) Executive Decree No. 33797-MJ-MOPT \"Declares CR05 as the official horizontal datum for Costa Rica, and its associated cartographic projection, CRTM05\", and c) Executive Decree No. 36642-MP-MOPT-MINAET \"Regulations of Specifications for the Delimitation of the public zone of the Maritime Terrestrial Zone\".\n\n9°—That Article 16° of the Forestry Law (Ley Forestal), Law No. 7575 of February 13, 1996, establishes that the Ministry of Environment and Energy shall delimit on the ground the boundaries of the areas that constitute the Natural Heritage of the State.\n\n10.—The National Geographic Institute used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in a coastal and estuary/mangrove sector on the beach known as Playa Mogos in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.\n\n11.—The National Geographic Institute, together with the Osa Conservation Area (Área de Conservación Osa), used the \"Georeferenced Digital Delimitation\" methodology to delimit the public zone of the Maritime Terrestrial Zone in an estuary/mangrove sector on the beach known as Playa Mogos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas, this in accordance with proceedings carried out by Sonia Carvajal González, ID No. 5-01252-351 before the National Geographic Institute.\n\n12.—That the delimitation performed has internal technical endorsement in accordance with official communication No. DIG-TOT-0014-2020 of March 26, 2020, issued by the Official Boundaries Subprocess of the Topographic and Territory Observation Department of the National Geographic Institute.\n\n13.—That the delimitation performed included the accompaniment of the Osa Conservation Area of the National System of Conservation Areas, for the demarcation of the public zone in the estuary/mangrove ecosystem sector, according to official communication SINACACOSA-D-705-2019, dated December 19, 2020.\n\n13.—That Article 140 of Law No. 6227 General Law of Public Administration states that \"the administrative act shall produce its effect after being communicated to the administered party, unless it grants only rights, in which case it shall produce effect from the moment it is adopted,\" a provision that must necessarily be related to subsection 204) of the same normative body, which defines the suitable instrument for communicating acts of a generic nature by stating: \"General acts shall be communicated by publication, and specific acts, by notification.\"\n\nCOMMUNICATES:\n\nI.—That in the months of October and November 2019, the georeferenced digital delimitation to the national coordinate system was performed to delimit a coastal and estuary/mangrove sector of the public zone of the Maritime Terrestrial Zone on the beach known as Playa Mogos; located in district 03 Sierpe, canton 05 Osa; province 06 Puntarenas.\n\nII.—The works for determining the public zone of the Maritime Terrestrial Zone were carried out between the months of October and November 2020; this delimitation corresponds to a coastal sector where none exists as of the date of signing this Notice; as well as an estuary/mangrove sector through the establishment of boundary markers (mojones) on the beach known as Playa Mogos, whose point coordinates are indicated below, in the official cartographic projection system of Costa Rica CRTM05, namely:\n\n| Estuary / Mangrove .
