Catastro y Registro\",\nDecreto Ejecutivo Nº 30106-J, de 6 de diciembre de 2001, \"Declara Zona\nCatastral la Totalidad de los Cantones del Territorio Nacional\" y Decreto\nEjecutivo Nº 35509-J de 30 de setiembre de 2009, \"Reglamento de Organización\ndel Registro Inmobiliario\".\n\nConsiderando:\n\nI.-Que mediante Ley Nº 8710, publicada en La Gaceta Nº 48 del 10\nde marzo de 2009 se reforma el artículo 2 de la Ley Nº 5695, Ley de\nCreación del Registro Nacional, y sus reformas, indicando que el\nCatastro Nacional pasa a formar parte del Registro Inmobiliario.\n\nII.-Que el Decreto Ejecutivo Nº 35509-J de 30 de setiembre de 2009,\nReglamento de Organización del Registro Inmobiliario publicado en el Diario\nOficial La Gaceta Nº 198 del 13 de octubre de 2009, establece que el\nRegistro Inmobiliario está conformado por la Subdirección Catastral y la\nSubdirección Registral.\n\nIII.-Que el Registro Inmobiliario del Registro Nacional, con fundamento\nen la Ley de Catastro Nacional Nº 6545 de 25 de marzo de 1981, en su artículo\n13 tiene como potestad exclusiva, la ejecución y mantenimiento del Catastro,\nfunción que puede delegar parcialmente en otras instituciones estatales.\n\nIV.-Que la Asamblea Legislativa, el 27 de noviembre de 2001, aprobó la\nLey Nº 8154, \"Convenio de Préstamo Nº 1284/OCCR,\n\nPrograma de\nRegularización del Catastro y Registro\", suscrito entre el Gobierno de la\nRepública y el Banco Interamericano de Desarrollo (BID), para la ejecución del\nPrograma de Regularización del Catastro y Registro Nacional, que por\ndisposición de la misma ley, está a cargo de una Unidad Ejecutora adscrita al\nMinisterio de Hacienda como órgano desconcentrado.\n\nV.-Que el Programa de Regularización del Catastro y Registro Nacional,\ntuvo como tarea el levantamiento catastral con el objetivo de formar el catastro\nnacional y compatibilizar la información catastral y registral de los\ninmuebles, en aplicación de lo que dispone la Ley de Catastro Nº 6545 de 25 de\nmarzo de 1981, función que culminó el 07 de mayo de 2014.\n\nVI.-Que de conformidad con lo que establece el artículo 1º Decreto\nEjecutivo Nº 30106-J donde se \"Declara Zona Catastral la Totalidad de los\nCantones del Territorio Nacional\" publicado en La Gaceta Nº 19 de\n28 de enero de 2002 y el artículo 7 del Reglamento a la Ley del Catastro\nNacional, Decreto Ejecutivo Nº 34331, el cual rige desde el 27 de setiembre de\n2008, la totalidad de los cantones del territorio nacional fueron declarados\nzona catastral.\n\nVII.-Que el Reglamento a la Ley de Catastro Nacional, Decreto Ejecutivo\nNº 34331 el cual rige desde el 27 de setiembre de 2008, establece los\nrequerimientos técnicos para el levantamiento de planos de agrimensura.\n\nVIII.-Que por haber concluido los trabajos de levantamiento catastral\ndel cantón 11 Garabito, distrito 02 Tárcoles, provincia de Puntarenas, y de conformidad\ncon lo que establece el artículo 19 de la Ley de Catastro Nacional y 10 de su\nreglamento, fueron invitados los titulares de inmuebles de dicho distrito a una\nexposición pública para conocer los resultados del levantamiento y manifestar\nsu conformidad o disconformidad, exposición que se llevó a cabo del 21 al 30 de\njunio del 2019.\n\nIX.-Que la invitación a la exposición pública de los resultados del\nlevantamiento catastral del cantón 11 Garabito, distrito 02 Tárcoles, provincia\nde Puntarenas, fue publicada Diario Oficial La Gaceta N° 96, de 24 de\nmayo del 2019, página 64 y el Diarios de Circulación Nacional La Extra del 10\nde junio de 2019, página 15.\n\nX.-Que en resolución de las ocho horas quince minutos del trece de enero\ndel año dos mil veinte, el Registro Inmobiliario del Registro Nacional declaró\nfirmes los datos catastrales resultantes del levantamiento catastral efectuado\nen el cantón 11 Garabito, distrito 02 Tárcoles, provincia de Puntarenas.\n\nXI.-Que ya transcurrieron los términos de los plazos establecidos en el\nartículo 20 de la Ley del Catastro Nacional y fueron resueltos, por la\nDirección del Registro Inmobiliario del Registro Nacional, los reclamos\npresentados por los propietarios.\n\nPor the Organization\nof the Real Property Registry\".\n\nConsidering:\n\nI.-That through Law Nº 8710, published in La Gaceta Nº 48 of March 10,\n2009, article 2 of Law Nº 5695, Law of Creation of the National Registry,\nand its reforms, is reformed, indicating that the National Cadastre becomes part of the Real Property Registry.\n\nII.-That Executive Decree Nº 35509-J of September 30, 2009,\nRegulation for the Organization of the Real Property Registry published in the Official\nJournal La Gaceta Nº 198 of October 13, 2009, establishes that the\nReal Property Registry is composed of the Cadastral Subdirectorate and the\nRegistry Subdirectorate.\n\nIII.-That the Real Property Registry of the National Registry, based\non the National Cadastre Law Nº 6545 of March 25, 1981, in its article\n13 has as its exclusive power, the execution and maintenance of the Cadastre,\na function that it may partially delegate to other state institutions.\n\nIV.-That the Legislative Assembly, on November 27, 2001, approved\nLaw Nº 8154, \"Loan Agreement Nº 1284/OCCR,\n\nCadastre and Registry Regularization\nProgram\", signed between the Government of the\nRepublic and the Inter-American Development Bank (IDB), for the execution of the\nCadastre and National Registry Regularization Program, which by\nprovision of the same law, is under the charge of an Executing Unit attached to the\nMinistry of Finance as a deconcentrated body.\n\nV.-That the Cadastre and National Registry Regularization Program,\nhad as its task the cadastral survey (levantamiento catastral) with the objective of forming the national\ncadastre and making the cadastral and registry information of the\nproperties compatible, in application of the provisions of the Cadastre Law Nº 6545 of March\n25, 1981, a function that concluded on May 7, 2014.\n\nVI.-That in accordance with the provisions of article 1 of Executive\nDecree Nº 30106-J wherein \"the Entirety of the Cantons of the National Territory is Declared a Cadastral Zone\" published in La Gaceta Nº 19 of\nJanuary 28, 2002 and article 7 of the Regulation to the National Cadastre Law,\nExecutive Decree Nº 34331, which has been in effect since September 27,\n2008, the entirety of the cantons of the national territory were declared\na cadastral zone.\n\nVII.-That the Regulation to the National Cadastre Law, Executive Decree\nNº 34331 which has been in effect since September 27, 2008, establishes the\ntechnical requirements for the survey of land surveying (agrimensura) plans.\n\nVIII.-That because the cadastral survey work of\ncanton 11 Garabito, district 02 Tárcoles, province of Puntarenas, has concluded, and in accordance\nwith the provisions of article 19 of the National Cadastre Law and 10 of its\nregulation, the holders of properties in said district were invited to a\npublic exhibition to learn about the survey results and express\ntheir agreement or disagreement, an exhibition that was held from June 21 to 30, 2019.\n\nIX.-That the invitation to the public exhibition of the results of the\ncadastral survey of canton 11 Garabito, district 02 Tárcoles, province\nof Puntarenas, was published in the Official Journal La Gaceta N° 96, of May 24,\n2019, page 64 and the National Circulation Newspapers La Extra of June 10, 2019, page 15.\n\nX.-That in a resolution at eight hours and fifteen minutes on January 13,\ntwo thousand twenty, the Real Property Registry of the National Registry declared\nthe cadastral data resulting from the cadastral survey carried out\nin canton 11 Garabito, district 02 Tárcoles, province of Puntarenas, to be final.\n\nXI.-That the terms of the periods established in\narticle 20 of the National Cadastre Law have already elapsed and the claims\nfiled by the owners have been resolved by the\nDirectorate of the Real Property Registry of the National Registry.\n\nTherefore,\n\nThey Decree:\n\nDISTRICT 02 TÁRCOLES, CANTON 11 GARABITO,\n\nPROVINCE OF PUNTARENAS IS DECLARED A SURVEYED CADASTRAL ZONE (ZONA CATASTRADA)\n\nArticle 1.-In accordance with article 20 of the National Cadastre\nLaw Nº 6545 of March 25, 1981, canton\n11 Garabito, district 02 Tárcoles,
