  "body_es_text": "en la totalidad del texto\n\n                    -\n\n                        Texto Completo Norma 42493\n\n                        Reforma decreto ejecutivo N° 26945 \"Adiciona Área de Prusia al Parque\nNacional Volcán Irazú\"\n\nTexto Completo acta: 13AA29\n\nN°\n42493-MINAE\n\nEL PRESIDENTE DE LA REPÚBLICA Y\n\nEL MINISTRO DE AMBIENTE Y ENERGÍA\n\nEn el ejercicio de las facultades que les confiere el artículo 140,\nincisos 3) y 18), 50) y 146) de la Constitución Política; lo dispuesto en los artículos\n82 y 87 de la Ley de Conservación de la \nVida Silvestre N° 7317, del 30 de octubre de 1992, la Ley de Creación\ndel Servicio de Parques Nacionales N° 6084, del 24 de agosto de 1977, los\nartículos 1, 35 y 36 de la Ley Orgánica del Ambiente N° 7554, de 4 de octubre\nde 1995, los artículos 59 y 60 de la Ley de Biodiversidad N° 7788, de 30 de\nabril de 1998 y los artículos 13 y siguiente de la Ley Forestal N° 7575, del 13\nde febrero de 1996; y los artículos 6, 11, 25 inciso 1., 27 inciso 1. y 28\ninciso 2 acápite b) de la Ley General de la Administración Pública N° 6227, del\n2 de mayo de 1978.\n\nConsiderando:\n\n1. Que es de interés del Estado asegurar que todos los ecosistemas del\npaís se encuentren representados dentro del sistema de áreas silvestres\nprotegidas, las cuales tienen como fin la protección, conservación y manejo de\nla biodiversidad, así como zonas de recarga acuífera de importancia para la\nconservación.\n\n2. Que el Parque Nacional Volcán Irazú fue creado en el año 1955,\nmediante la Ley Nº 1917, del 30 de julio de 1955, Ley Orgánica del Instituto\nCostarricense de Turismo.\n\n3. Que en el año 1997 se adicionó al Parque Nacional Volcán Irazú el\nárea conocida como Reserva de Prusia, mediante el Decreto Ejecutivo Nº\n26945-MINAE.\n\n4. Que el espíritu de este decreto consideró la adición de nuevo\nterritorio al Parque Nacional Volcán Irazú, correspondiente al área de Reserva\nPrusia, consistente en terrenos recuperados de la devastación ocasionada por\nlas erupciones del Volcán Irazú en 1963, y que venía siendo administrada por el\nMinisterio de Obras Públicas y Transportes, encargado en el pasado de las\nactividades de defensa civil.\n\n5. Que el actual Decreto Ejecutivo número 26945-MINAE presenta\nerrores a saber: el punto de coordenadas 214800N-249300E indicado se\nencuentra ubicado en el Océano Pacífico abarcando gran parte del territorio\nnacional. Este error no ha sido oficial ni legalmente enmendado. Además,\npresenta otros errores que abarcan propiedades privadas.\n\n6. Que sobre el anterior punto de la coordenada que se ubica en el\nOcéano Pacífico, la Procuraduría General de la República, a petición del\nMinistro de Ambiente y Energía, se pronunció sobre el caso mediante Dictamen\nC-212-2017 del 19 de setiembre del 2017.\n\n7. Que en dicho Dictamen de la Procuraduría General de la República\nordena \".excluir los terrenos privados e incorporar todas las áreas estatales.\"\n\n8. Que el punto de coordenadas 214700N-550350E, indicados en el\nactual decreto (26945- MINAE), se ubica a 200 metros al este del cauce del Río\nReventado, cuestión que contradice lo indicado en dicha norma, ya que la misma\nmenciona que este punto cae en el cauce de dicho río.\n\n9. Que el decreto actual, dejó por fuera de los límites del Parque\nNacional, terrenos pertenecientes al Patrimonio Natural del Estado, tal y como\nse muestra en los considerandos 10, 11,12 y 13 siguientes.\n\n10. Que el día veintiocho de mayo de mil novecientos noventa y seis,\nmediante escritura Nº\n\nDOSCIENTOS CINCUENTA\nY SIETE, el ESTADO compró al señor Neftalí Gómez Coto, cédula de identidad número\ntres-cero sesenta y ocho-cero sesenta y uno, un lote de la finca inscrita en el\nRegistro Público, Sección de Propiedad, Partido de Cartago, al Folio Real\nmatrícula SESENTA Y DOS MIL TRESCIENTOS SESENTA Y CUATRO-CERO CERO CERO.\n\n11. Que dicho lote quedó debidamente inscrito en el Registro Público,\nSección de Propiedad, Partido de Cartago, al Folio Real matrícula CIENTO\nCINCUENTA Y CUATRO MIL SETECIENTOS TREINTA Y DOS- CERO CERO CERO. Dicho lote\ncorresponde a conformidad con el plano catastrado C-DOSCIENTOS NOVENTA Y NUEVE\nCERO SETENTA Y TRES - NOVENTA Y SEIS.\n\n12. Que una considerable sección de dicho lote quedó fuera de los\nactuales límites del parque, lo cual hace necesario incorporarlos al mismo\noficialmente.\n\n13. Que los inmuebles del Estado 3-47306-000, 3-47308-000, 3-38689-000,\n3- 47946-000, 3-47948-000, 3- 67108-000 ubicadas al este de Prusia sobre el Río\nReventado, están parcialmente fuera del límite abarcado por el Decreto Nº\n26945-MINAE\n\n14. Que el Estado adquirió dos propiedades más, bajo el folio real\n1-566318-000 y plano catastrado número SJ-0988037-2005; y la finca folio real\n1-60457-000 con el plano catastrado número SJ-1046982-2006, las cuales se\nencuentran fuera del límite comprendido por el Decreto Nº 26945-MINAE.\n\n15. Que en Decreto Nº 33797-MJ-MOPT, en artículo 2º, se declara como\nproyección oficial para la representación de la cartográfica nacional, la\nProyección Transversal de Mercator para Costa Rica con el acrónimo CRTM05,\ncambiando de esta forma la Proyección Lambert, por lo que se hace necesario\nactualizar el sistema en el presente decreto.\n\n16. Que, de acuerdo al Informe Estudio de Tenencia de la Tierra Parque\nNacional Volcán Irazú, elaborado por la empresa COTOBIRA S.A (Consultora\nTopográfica y Bienes Raíces de San José S.A), en donde identifica porciones de\nterrenos baldíos pertenecientes al Patrimonio Natural del Estado e identifica\npropiedades del Estado que carecían de plano catastrado, confeccionando los\nmismos.\n\nPor tanto,\n\nDECRETAN:\n\n\"Modificación al Decreto Ejecutivo Número 26945-MINAE, del 9 de\nnoviembre de 1997,\n\ndenominado: Adiciona Área de Prusia al Parque Nacional Volcán Irazú\"\n\nArtículo 1º- Incluir nuevos terrenos adquiridos por el Estado, incorporar porciones de\nterrenos de patrimonio natural del Estado que están fuera de los límites del\nárea protegida actual y corregir los errores en coordenadas del Decreto Nº\n26945-MINAE; basado en la hoja topográfica Istarú IV edición-IGNCR, 1981,\nescala 1:50.000, elaborada por el Instituto Geográfico Nacional de Costa Rica,\n\nArtículo 2.   "body_en_text": "in the entirety of the text\n\n-\n\nComplete Text of Norm 42493\n\nReform of Executive Decree No. 26945 \"Adds the Prusia Area to the Irazú Volcano National Park\"\n\nComplete Text of Act: 13AA29\n\nNo.\n42493-MINAE\n\nTHE PRESIDENT OF THE REPUBLIC AND\n\nTHE MINISTER OF ENVIRONMENT AND ENERGY\n\nIn exercise of the powers conferred by Article 140, subsections 3) and 18), 50) and 146) of the Political Constitution; the provisions of Articles 82 and 87 of the “Ley de Conservación de la Vida Silvestre” No. 7317, of October 30, 1992, the Law Creating the “Servicio de Parques Nacionales” No. 6084, of August 24, 1977, Articles 1, 35 and 36 of the “Ley Orgánica del Ambiente” No. 7554, of October 4, 1995, Articles 59 and 60 of the “Ley de Biodiversidad” No. 7788, of April 30, 1998, and Article 13 and following of the “Ley Forestal” No. 7575, of February 13, 1996; and Articles 6, 11, 25 subsection 1., 27 subsection 1. and 28 subsection 2 item b) of the “Ley General de la Administración Pública” No. 6227, of May 2, 1978.\n\nConsidering:\n\n1. That it is in the State's interest to ensure that all the country's ecosystems are represented within the system of protected wild areas (áreas silvestres protegidas), whose purpose is the protection, conservation, and management of biodiversity, as well as aquifer recharge zones of importance for conservation.\n\n2. That the Irazú Volcano National Park was created in 1955, through Law No. 1917, of July 30, 1955, “Ley Orgánica del Instituto Costarricense de Turismo”.\n\n3. That in 1997, the area known as Prusia Reserve was added to the Irazú Volcano National Park, through Executive Decree No. 26945-MINAE.\n\n4. That the spirit of this decree considered the addition of new territory to the Irazú Volcano National Park, corresponding to the Prusia Reserve area, consisting of lands recovered from the devastation caused by the eruptions of the Irazú Volcano in 1963, and which had been administered by the “Ministerio de Obras Públicas y Transportes”, formerly in charge of civil defense activities.\n\n5. That the current Executive Decree number 26945-MINAE contains errors, namely: the indicated coordinate point 214800N-249300E is located in the Pacific Ocean, encompassing a large part of the national territory. This error has not been officially or legally amended. Furthermore, it presents other errors that encompass private properties.\n\n6. That regarding the previous coordinate point located in the Pacific Ocean, the “Procuraduría General de la República”, at the request of the Minister of Environment and Energy, ruled on the case through Opinion C-212-2017 of September 19, 2017.\n\n7. That in said Opinion of the “Procuraduría General de la República”, it is ordered \".to exclude the private lands and incorporate all state areas.\"\n\n8. That the coordinate point 214700N-550350E, indicated in the current decree (26945-MINAE), is located 200 meters east of the Reventado River channel, an issue that contradicts what is stated in said norm, since the same mentions that this point falls on the channel of said river.\n\n9. That the current decree left out of the National Park's boundaries lands belonging to the State's Natural Heritage (Patrimonio Natural del Estado), as shown in the following considerandos 10, 11, 12, and 13.\n\n10. That on the twenty-eighth day of May of nineteen hundred ninety-six, through deed No.\n\nTWO HUNDRED FIFTY-SEVEN, the STATE purchased from Mr. Neftalí Gómez Coto, identity card number three-zero sixty-eight-zero sixty-one, a lot of the farm registered in the Public Registry, Property Section, “Partido de Cartago”, under Folio Real registration SIXTY-TWO THOUSAND THREE HUNDRED SIXTY-FOUR-ZERO ZERO ZERO.\n\n11. That said lot was duly registered in the Public Registry, Property Section, “Partido de Cartago”, under Folio Real registration ONE HUNDRED FIFTY-FOUR THOUSAND SEVEN HUNDRED THIRTY-TWO-ZERO ZERO ZERO. Said lot corresponds in accordance with the cadastral plan C-TWO HUNDRED NINETY-NINE ZERO SEVENTY-THREE-NINETY-SIX.\n\n12. That a considerable section of said lot was left outside the current park boundaries, which makes it necessary to officially incorporate them into the park.\n\n13. That the State acquired two more properties, under folio real 1-566318-000 and cadastral plan number SJ-0988037-2005; and the farm folio real 1-60457-000 with cadastral plan number SJ-1046982-2006, which are located outside the boundary comprised by Decree No. 26945-MINAE.\n\n15. That in Decree No. 33797-MJ-MOPT, in Article 2, the Transverse Mercator Projection for Costa Rica with the acronym CRTM05 is declared as the official projection for national cartographic representation, thus changing the Lambert Projection, which makes it necessary to update the system in this decree.\n\n16.
