Se crea el Parque Nacional Isla San Lucas, que\nademás de su condición de área silvestre protegida, será patrimonio histórico -\narquitectónico y zona de aprovechamiento turístico sostenible, en las áreas\nespecíficas que se determinan en la presente ley.\n\n Ficha articulo\n\nARTÍCULO 2- Interés nacional. Se declara de interés nacional y de alta\nprioridad el desarrollo turístico sostenible de la isla en los términos de la\npresente ley, así como la conservación y restauración de las edificaciones del\nantiguo presidio de la Isla San Lucas. Las dependencias de la Administración\npública y del sector privado, dentro del marco legal respectivo, podrán\ncontribuir con recursos económicos, en la medida de sus posibilidades y sin perjuicio\ndel cumplimiento de sus propios objetivos, para colaborar con el desarrollo turístico\nsostenible de la isla.\n\n \n\n Ficha articulo\n\nARTÍCULO 3- Delimitaciones. El Parque Nacional Isla San Lucas estará\nintegrado por una porción terrestre y un área marina costera.\n\nLa porción terrestre estará conformada por la parte insular de la Isla\nSan Lucas, ubicada en el Golfo de Nicoya, hoja cartográfica del Instituto\nGeográfico Nacional denominada Golfo, Edición 3-IGNCR en la latitud norte 9º\n55' 55\" - 9 57' 20\" y longitud oeste 84º 53' 23\", con una\nextensión de cuatrocientas sesenta y dos hectáreas (462 ha).\n\nEl área marina costera estará compuesta por las aguas alrededor de la\nisla, con una profundidad hasta de tres metros (3 m). Inserto, dentro de las\ndos áreas anteriores, existirá un espacio de manejo diferenciado dedicado a la\nactividad turística sostenible, la promoción y el desarrollo de los sitios de\ninterés histórico, arquitectónico y ambiental, que para todos los efectos se\ndenominará Zona turística.\n\n \n\n Ficha articulo\n\nARTICULO 4- Fines. Son fines del Parque Nacional Isla San Lucas los\nsiguientes:\n\na) La preservación del patrimonio natural, histórico, cultural,\narqueológico y arquitectónico.\n\nb) Coadyuvar al desarrollo socioeconómico del Golfo de Nicoya.\n\nc) El fomento del turismo sostenible e inclusivo, para la atención de\nvisitantes nacionales y extranjeros.\n\nd) El disfrute, la recreación, la generación de facilidades y\ncomodidades para la visitación turística inclusiva.\n\n \n\n Ficha articulo\n\nARTICULO 5- Significación cultural e histórica. Se declaran patrimonio\nhistórico - arquitectónico el conjunto de las edificaciones del antiguo\npresidio San Lucas; el Estado deberá restaurar y preservar este patrimonio para\nel disfrute y conocimiento de las actuales y futuras generaciones.\n\nEl Ministerio de Cultura deberá realizar un inventario del patrimonio\ncitado y de su estado de conservación, actualizándolo periódicamente, todo lo\ncual comunicará al Ministerio de Ambiente y Energía (Minae) y a la entidad\nencargada de la administración de la isla.\n\n \n\n Ficha articulo\n\nARTICULO 6- Zona turística. Las áreas correspondientes a las\nedificaciones del antiguo presidio San Lucas, incluyendo el muelle, así como la\nzona marina y terrestre de acceso a la isla, los predios, los senderos y las\nzonas de playa que se indican, estarán afectadas a la condición de Zona\nturística. El Parque Nacional Isla San Lucas se regirá por un plan maestro\nelaborado con base en criterios técnicos.\n\nPara el cumplimiento de los fines establecidos en esta ley, en la zona\nturística se podrán otorgar concesiones y permisos para actividades e\ninstalaciones distintas del servicio de parques. No se permitirán en esta zona\nlos servicios de hospedaje y juegos de azar.\n\nEn todo caso, se deberá promover la participación de las organizaciones\nlocales en el otorgamiento de concesiones.\n\nCualquier conflicto de competencias será dirimido por el ministro o la\nministra de Ambiente y Energía.\n\n \n\n Ficha articulo\n\nARTÍCULO 8- Gobernanza de la isla. Para el gobierno y la administración\ndel Parque Nacional Isla San Lucas se crea la Junta Directiva del Parque\nNacional Isla San Lucas, que será un órgano de desconcentración máxima adscrito\nal Ministerio de Ambiente y Energía (Minae), y con personalidad jurídica\ninstrumental para el ejercicio de sus competencias.\n\n \n\n Ficha articulo\n\nARTÍCULO 9- Cometidos y potestades. La Junta Directiva del Parque\nNacional Isla San Lucas tendrá las siguientes atribuciones:\n\na) Definir las estrategias y políticas tendientes a la consolidación y\nel desarrollo del parque.\n\nb) Contribuir con la protección y conservación ambiental del parque\nnacional.\n\nc) Establecer los lineamientos de protección, restauración y\nadministración de las edificaciones históricas, desarrollando instalaciones y\nservicios destinados al descanso y el esparcimiento de los visitantes, la\nhabilitación y accesibilidad de las vías terrestres y marítimas, las\nconstrucciones portuarias y, en general, la dotación de todos los servicios\nbásicos.\n\nd) Definir las actividades turísticas sostenibles ambientalmente, sean\ncomerciales, de transporte, deportivas, artísticas o culturales, que incentiven\nla atracción turística y la visitación a la isla.\n\ne) Aprobar los objetivos estratégicos para el mercadeo y la promoción\nnecesarios para dar a conocer el Parque Nacional Isla San Lucas, tanto dentro\ncomo fuera del país.\n\nf) Otorgar la aprobación de las autorizaciones, los permisos de uso y\nlas concesiones para llevar a cabo obras y servicios que se presten en la Zona\nturística.\n\nEn el caso de las obras relacionadas con las áreas declaradas\npatrimonio, se deberá coordinar con el Ministerio de Cultura.\n\ng) Aprobar el plan maestro del Parque Nacional, así como los programas,\nplanes y presupuestos correspondientes.\n\nh) Aprobar la estructura administrativa que se requiera para la gestión\ninstitucional del parque.\n\ni) Aprobar, renovar, modificar o revocar todo fideicomiso relativo al\nParque Nacional Isla San Lucas, así como todo tipo de contratos y convenios con\nentidades y personas, públicas o privadas. Deberá determinar los precios de entrada\nal parque nacional, así como aprobar los contratos de los diversos sistemas de\nreservación y compra.\n\nj) Aprobar la utilización de las figuras de concesión de obra pública\ncon servicio público y contratación de mutuo beneficio con entidades sin fines\nde lucro.\n\nk) Llevar a cabo cualquier otro tipo de actuación necesaria para\nasegurar la buena marcha del Parque Nacional Isla San Lucas y la consecución de\nsus fines.\n\nEn materia de conservación y preservación del patrimonio\nhistórico-arquitectónico prevalecerá el criterio del Centro de Investigación y\nConservación del Patrimonio Cultural del Ministerio de Cultura y para la\nprotección de la vida silvestre y conservación de la biodiversidad de la isla\nprevalecerá el criterio técnico del Sistema Nacional de Áreas de Conservación\n(Sinac). Ante requerimiento de la Junta Directiva, dichas entidades brindarán\nsus criterios de la forma más expedita posible.\n\n(Nota de Sinalevi: Mediante resolución de la Sala\nConstitucional N° 012817 del 31 de mayo de 2023, se interpretó el párrafo\nanterior en el sentido de que en aquellas decisiones que se refieren a la\nmateria ambiental y al patrimonio histórico arquitectónico, ese órgano\ncolegiado deberá consultar de previo a los órganos que ahí se citan, cuyos\ncriterios -en sus respectivas materias- serán obligatorios para la Junta\nDirectiva.)\n\n Ficha articulo\n\nARTÍCULO 10-Integración. La Junta Directiva del Parque Nacional Isla San\nLucas estará integrada por los siguientes miembros:\n\na) La ministra o el ministro de Ambiente y Energía, quien lo presidirá,\npudiendo actuar como suplente un viceministro o viceministra de la cartera.\n\nb) La ministra o el ministro de Cultura, pudiendo actuar como suplente\nun viceministro o viceministra de la cartera.\n\nc) La Presidencia Ejecutiva del Instituto Costarricense de Turismo\n(ICT), pudiendo actuar como suplente la persona que ostenta la gerencia o un\nintegrante de la Junta Directiva de dicho instituto.\n\nd) Una persona representante del Poder Ejecutivo designada por el\nConsejo de Gobierno, órgano que nombrará, además, a una persona suplente.\n\ne) La alcaldesa o el alcalde de la Municipalidad del cantón Central de Puntarenas,\npudiendo actuar como suplente una vicealcaldía.\n\nf) La presidenta o el presidente de la Cámara de Turismo de Puntarenas, pudiendo\nactuar como suplente alguno de los integrantes de la Junta Directiva de dicha\ncámara.\n\nEl presidente o la presidenta de la Junta ostentará la representación\njudicial y extrajudicial del órgano. Asimismo, contará con voto de calidad en\nlos términos del artículo 49 de la Ley 6227, Ley General de la Administración\nPública, de 2 de mayo de 1978. Los integrantes de la Junta Directiva no\ndevengarán ninguna dieta.\n\n \n\n Ficha articulo\n\nARTÍCULO 11- Duración y organización. Las seis personas integrantes de\nla Junta Directiva del Parque Nacional Isla San Lucas permanecerán en sus\npuestos mientras ostenten el cargo que los legitima como integrantes y, en el\ncaso de la representación del Poder Ejecutivo, mientras no sea removida por el\nConsejo de Gobierno.\n\nLa Junta Directiva del parque podrá sesionar válidamente con la\nintegración de las personas suplentes, incluso en el supuesto de que el cargo\ntitular principal se encuentre vacante.\n\nEn lo no regulado en la presente ley, la Junta Directiva se regirá en su\nestructura, organización y funcionamiento por la Ley 6227, Ley General de la\nAdministración Pública, de 2 de mayo de 1978.\n\n \n\n Ficha articulo\n\nARTÍCULO 12- Sesiones. La Junta Directiva sesionará de forma ordinaria\nal menos una vez al mes y, de forma extraordinaria, cuando se requiera; en cuyo\ncaso, la Presidencia hará la convocatoria.\n\nTodas las sesiones de la Junta Directiva deberán ser documentadas\nformalmente.\n\nLa Junta Directiva podrá invitar a sus sesiones al personal técnico y a\notras personas que requiera para la toma de acuerdos.\n\n \n\n Ficha articulo\n\nARTÍCULO 13- Fideicomisos. La Junta Directiva del Parque Nacional queda\nautorizada para utilizar la figura del fideicomiso como instrumento de\nadministración, gestión, desarrollo y mantenimiento del Parque Nacional Isla\nSan Lucas, para el cumplimiento de las finalidades indicadas en la presente\nley. Este instrumento será establecido con un banco comercial del Estado y\ndeberá ejecutar directamente las labores y atribuciones que la Junta le asigne.\n\nDentro de la estructura del fideicomiso se contará con una Comisión\nAdministradora y una Fiscalía, cuyos miembros serán nombrados por la Junta.\nDicha comisión se tendrá como un Comité Especial, de conformidad con el\nartículo 116 de la Ley 1644, Ley Orgánica del Sistema Bancario Nacional, de 26\nde setiembre de 1953. Será un cuerpo colegiado interdisciplinario integrado por\ncinco personas de reconocida honorabilidad, con conocimiento en alguna de las\nsiguientes materias: administración, desarrollo de infraestructura, turismo,\nambiente, patrimonio cultural, mercadeo, u otras materias atinentes a los fines\nde la presente ley.\n\nSe autoriza además a la Junta Directiva para que administre los fondos\nque ingresen al parque por cualquier concepto, por medio de dicho fideicomiso.\n\nLa selección del banco comercial del Estado que actuará como fiduciario\nse realizará mediante una rigurosa determinación del perfil, bajo parámetros de\nseguridad, liquidez, diversificación, rentabilidad, experiencia fiduciaria y\ncontrol de riesgos.\n\nLa Contraloría General de la República tendrá acceso irrestricto a toda\nla información y documentación del fideicomiso, cuando lo considere pertinente.\n\n \n\n Ficha articulo\n\nARTÍCULO 14-Comisión Administradora del Fideicomiso y sus funciones. La\nComisión Administradora del Fideicomiso nombrará de su seno una presidencia, una\nvicepresidencia y una secretaria. Todos los miembros de esta comisión trabajarán\nad honorem.\n\nEntre las funciones de esta comisión se encuentran las siguientes:\n\na) Cumplir todas aquellas labores o tareas encomendadas por el\nfideicomitente, establecidas en el contrato de fideicomiso.\n\nb) Coordinar con la Junta Directiva del Parque Nacional Isla San Lucas y\nseguir sus lineamientos generales, para la correcta marcha y cumplimiento del\nfideicomiso.\n\nc) Aprobar los manuales correspondientes a la administración, gestión, vigilancia\ny otros relativos al fideicomiso.\n\nd) Conocer y aprobar, de forma anual, los presupuestos ordinario y extraordinarios\ndel fideicomiso.\n\ne) Instruir al fiduciario sobre las acciones que se requieran y se\nencuentren dentro del giro del fideicomiso.\n\nf) Reunirse al menos una vez al mes de forma ordinaria y,\nextraordinaria, cada vez que sea convocada por la Presidencia de la Junta o el\nrepresentante del fiduciario.\n\ng) Aprobar los convenios y contratos para la prestación de servicios\nrecreativos y o comerciales, así como de los servicios esenciales y no\nesenciales, para lograr el mayor aprovechamiento de la Zona turística y\ndisfrute de los visitantes.\n\nh) Las funciones que le atribuya el contrato de fideicomiso relativas a\ncontrol interno, vigilancia, compras, personal y otras necesarias para la\nadministración del parque nacional.\n\ni) Cualquier otra función que se desprenda del contrato de fideicomiso,\nsus manuales u otras relacionadas directamente.\n\n \n\n Ficha articulo\n\nARTÍCULO 15- Vigilancia y seguridad. Para la vigilancia y seguridad del\nParque Nacional Isla San Lucas se contará con la dotación necesaria de\nguardaparques del Sistema Nacional de Áreas de Conservación del Ministerio de\nAmbiente y Energía (Minae), sin perjuicio de la posibilidad de que la Junta\nDirectiva, directamente o por medio del fideicomiso de administración\ncorrespondiente, pueda contratar la seguridad que considere necesaria; dicho\npersonal no tendrá autoridad de policía ni podrá ejercer funciones indelegables\npropias de la administración. Asimismo, podrá recurrir al auxilio del Ministerio\nde Seguridad en situaciones que así lo ameriten.\n\n \n\n Ficha articulo\n\nCAPÍTULO III\n\nDESARROLLO Y FINANCIAMIENTO\n\nARTÍCULO 16- Desarrollo de infraestructura. El Parque Nacional Isla San\nLucas podrá desarrollar toda la infraestructura necesaria para facilitar el\nturismo sostenible, incluyendo la dotación de agua, electricidad,\ntelecomunicaciones, higiene y saneamiento, muelles, atracaderos, servicios de\nalimentación y vías de acceso, información y comunicación en diversos formatos,\nasí como la que estime pertinente para el provecho de los visitantes y asegurar\nel disfrute y apreciación de la riqueza histórica, arquitectónica y natural del\nparque.\n\nEn la construcción de muelles, atracaderos y demás facilidades\nmarítimas, el Instituto Costarricense de Puertos del Pacífico (lncop), el\nMinisterio de Obras Públicas y Transportes (MOPT) y el Instituto Costarricense\nde Turismo (ICT) suplirán el soporte técnico correspondiente a la Junta\nDirectiva; asimismo, se faculta a estas instituciones para que construyan y den\nmantenimiento a las obras indicadas en esta norma.\n\n \n\n Ficha articulo\n\nARTÍCULO 17- Financiamiento. El Parque Nacional Isla San Lucas dispondrá\nde recursos financieros que le permitan ejercer sus mandatos con agilidad y\neficiencia. Estos incluirán los recursos que le correspondan por ley del\nSistema Nacional de Áreas de Conservación (Sinac), transferencias de los\npresupuestos de la República o donaciones de cualquier persona física o\njurídica, así como los fondos propios que genere el ingreso al parque, la\nutilización de sus servicios, los cánones por concesiones y permisos y, en\ngeneral, por el pago de las actividades realizadas dentro del parque.\n\nLos recursos regulados en la presente ley así como todos aquellos que\nproduzca el parque, necesaria y exclusivamente serán invertidos en el mismo\nparque nacional.\n\nLa fiscalización estará a cargo de la Contraloría General de la\nRepública.\n\n \n\n Ficha articulo\n\nARTÍCULO 18- Autorización para donar y subvencionar. Se autoriza a todo\nel sector público estatal, no estatal y financiero para que haga donaciones,\ninversiones e incluya subvenciones presupuestarias a favor del Parque Nacional\nIsla San Lucas.\n\nEl Instituto Costarricense de Turismo (ICT) podrá transferir recursos\neconómicos a la Junta Directiva del Parque Nacional Isla San Lucas para la\nrealización de sus inversiones en desarrollo y actividades ordinarias;\nasimismo, podrá diseñar y realizar la promoción y el mercadeo para la\nvisitación del parque.\n\nPodrá recibir, la Junta Directiva, donaciones de parte de organismos\ninternacionales y gobiernos extranjeros interesados en coadyuvar en los fines\ndel parque.\n\n \n\n Ficha articulo\n\nARTÍCULO 19- Autorización para créditos y préstamos. The Isla San Lucas National Park is created, which, in addition to its status as a protected wild area, shall be a historical-architectural heritage site and a sustainable tourism use zone, in the specific areas determined in this law.\n\nARTICLE 2- National interest. The sustainable tourism development of the island under the terms of this law, as well as the conservation and restoration of the buildings of the former Isla San Lucas prison, are declared to be of national interest and high priority. The agencies of the public Administration and the private sector, within their respective legal framework, may contribute economic resources, to the extent of their possibilities and without prejudice to the fulfillment of their own objectives, to collaborate with the sustainable tourism development of the island.\n\nARTICLE 3- Delimitations. The Isla San Lucas National Park shall be composed of a terrestrial portion and a coastal marine area.\n\nThe terrestrial portion shall be comprised of the insular part of Isla San Lucas, located in the Gulf of Nicoya, on the National Geographic Institute cartographic sheet called Golfo, Edition 3-IGNCR at north latitude 9º 55' 55\" - 9 57' 20\" and west longitude 84º 53' 23\", with an area of four hundred sixty-two hectares (462 ha).\n\nThe coastal marine area shall be comprised of the waters around the island, with a depth of up to three meters (3 m). Inserted within the two previous areas, there shall be a differentiated management space dedicated to sustainable tourism activity, the promotion, and the development of sites of historical, architectural, and environmental interest, which for all purposes shall be called the Tourism Zone (Zona turística).\n\nARTICLE 4- Purposes. The purposes of the Isla San Lucas National Park are the following:\n\na) The preservation of the natural, historical, cultural, archaeological, and architectural heritage.\n\nb) To contribute to the socioeconomic development of the Gulf of Nicoya.\n\nc) The promotion of sustainable and inclusive tourism, for the attention of national and foreign visitors.\n\nd) Enjoyment, recreation, the generation of facilities and amenities for inclusive tourist visitation.\n\nARTICLE 5- Cultural and historical significance. The complex of buildings of the former San Lucas prison is declared a historical-architectural heritage site; the State must restore and preserve this heritage for the enjoyment and knowledge of current and future generations.\n\nThe Ministry of Culture must conduct an inventory of said heritage and its state of conservation, updating it periodically, all of which it shall communicate to the Ministry of Environment and Energy (MINAE) and to the entity in charge of the island's administration.\n\nARTICLE 6- Tourism Zone (Zona turística). and restrictions. The Isla San Lucas National Park shall be governed by a master plan prepared based on technical criteria.\n\nFor the fulfillment of the purposes established in this law, concessions and permits for activities and facilities other than park services may be granted in the Tourism Zone (Zona turística). Lodging services and games of chance shall not be permitted in this zone.\n\nIn all cases, the participation of local organizations in the granting of concessions must be promoted.\n\nAny conflict of jurisdiction shall be settled by the Minister of Environment and Energy.\n\nARTICLE 8- Governance of the island. For the government and administration of the Isla San Lucas National Park, the Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) is created, which shall be an organ of maximum deconcentration attached to the Ministry of Environment and Energy (MINAE), and with instrumental legal personality for the exercise of its powers.\n\nARTICLE 9- Duties and powers. The Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) shall have the following attributions:\n\na) Define the strategies and policies aimed at the consolidation and development of the park.\n\nb) Contribute to the environmental protection and conservation of the national park.\n\nc) Establish the guidelines for the protection, restoration, and administration of the historic buildings, developing facilities and services intended for the rest and leisure of visitors, the enablement and accessibility of land and maritime routes, port constructions, and, in general, the provision of all basic services.\n\nd) Define environmentally sustainable tourist activities, whether commercial, transportation, sports, artistic, or cultural, that encourage tourist attraction and visitation to the island.\n\ne) Approve the strategic objectives for marketing and promotion necessary to publicize the Isla San Lucas National Park, both within and outside the country.\n\nf) Grant approval for authorizations, use permits, and concessions to carry out works and services provided in the Tourism Zone (Zona turística).\n\nIn the case of works related to areas declared heritage sites, coordination with the Ministry of Culture is required.\n\ng) Approve the master plan of the National Park, as well as the corresponding programs, plans, and budgets.\n\nh) Approve the administrative structure required for the institutional management of the park.\n\ni) Approve, renew, modify, or revoke any trust (fideicomiso) related to the Isla San Lucas National Park, as well as all types of contracts and agreements with public or private entities and persons. It must determine the entrance fees to the national park, as well as approve contracts for the various reservation and purchase systems.\n\nj) Approve the use of the figures of public works concession with public service and mutual benefit contracting with non-profit entities.\n\nk) Carry out any other type of action necessary to ensure the proper functioning of the Isla San Lucas National Park and the achievement of its purposes.\n\nIn matters of conservation and preservation of the historical-architectural heritage, the criterion of the Cultural Heritage Research and Conservation Center (Centro de Investigación y Conservación del Patrimonio Cultural) of the Ministry of Culture shall prevail, and for the protection of wildlife and conservation of the island's biodiversity, the technical criterion of the National System of Conservation Areas (SINAC) shall prevail. Upon request of the Board of Directors (Junta Directiva), said entities shall provide their criteria as expeditiously as possible.\n\n(Note from Sinalevi: By resolution of the Constitutional Chamber (Sala Constitucional) No. 012817 of May 31, 2023, the preceding paragraph was interpreted to mean that in those decisions referring to environmental matters and historical-architectural heritage, this collegiate body must previously consult the bodies cited therein, whose criteria - in their respective matters - shall be binding on the Board of Directors (Junta Directiva).)\n\nARTICLE 10- Composition. The Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) shall be composed of the following members:\n\na) The Minister of Environment and Energy, who shall preside over it, with a Vice-Minister of the ministry being able to act as an alternate.\n\nb) The Minister of Culture, with a Vice-Minister of the ministry being able to act as an alternate.\n\nc) The Executive President of the Costa Rican Tourism Institute (ICT), with the person holding the management position or a member of the Board of Directors of said institute being able to act as an alternate.\n\nd) A representative of the Executive Branch appointed by the Government Council (Consejo de Gobierno), an organ which shall also appoint an alternate person.\n\ne) The Mayor of the Municipality of the Central Canton of Puntarenas, with a Deputy Mayor being able to act as an alternate.\n\nf) The President of the Chamber of Tourism of Puntarenas (Cámara de Turismo de Puntarenas), with one of the members of the Board of Directors of said chamber being able to act as an alternate.\n\nThe President of the Board (Junta) shall hold the judicial and extrajudicial representation of the organ. Likewise, the President shall have a casting vote in the terms of Article 49 of Law 6227, General Law of Public Administration (Ley General de la Administración Pública), of May 2, 1978. The members of the Board of Directors (Junta Directiva) shall not receive any per diem.\n\nARTICLE 11- Duration and organization. The six members of the Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) shall remain in their positions as long as they hold the office that legitimizes them as members and, in the case of the representative of the Executive Branch, as long as they are not removed by the Government Council (Consejo de Gobierno).\n\nThe Board of Directors (Junta Directiva) of the park may validly hold sessions with the participation of alternate members, even in the event that the principal titular position is vacant.\n\nIn matters not regulated in this law, the Board of Directors (Junta Directiva) shall be governed in its structure, organization, and operation by Law 6227, General Law of Public Administration (Ley General de la Administración Pública), of May 2, 1978.\n\nARTICLE 12- Sessions. The Board of Directors (Junta Directiva) shall hold ordinary sessions at least once a month and, extraordinarily, when required, in which case the Presidency shall issue the call.\n\nAll sessions of the Board of Directors (Junta Directiva) must be formally documented.\n\nThe Board of Directors (Junta Directiva) may invite technical personnel and other persons it requires for decision-making to its sessions.\n\nARTICLE 13- Trusts (Fideicomisos). The Board of Directors of the National Park (Junta Directiva del Parque Nacional) is authorized to use the figure of the trust (fideicomiso) as an instrument for the administration, management, development, and maintenance of the Isla San Lucas National Park, for the fulfillment of the purposes indicated in this law. This instrument shall be established with a state commercial bank and must directly execute the tasks and attributions that the Board (Junta) assigns to it.\n\nWithin the structure of the trust (fideicomiso), there shall be an Administrative Commission (Comisión Administradora) and an Oversight Office (Fiscalía), whose members shall be appointed by the Board (Junta). Said commission shall be considered a Special Committee, in accordance with Article 116 of Law 1644, Organic Law of the National Banking System (Ley Orgánica del Sistema Bancario Nacional), of September 26, 1953. It shall be an interdisciplinary collegiate body composed of five persons of recognized honorability, with knowledge in one of the following subjects: administration, infrastructure development, tourism, environment, cultural heritage, marketing, or other subjects pertaining to the purposes of this law.\n\nThe Board of Directors (Junta Directiva) is also authorized to administer the funds that enter the park for any reason, through said trust (fideicomiso).\n\nThe selection of the state commercial bank that will act as fiduciary shall be made through a rigorous determination of the profile, under parameters of security, liquidity, diversification, profitability, fiduciary experience, and risk control.\n\nThe Office of the Comptroller General of the Republic (Contraloría General de la República) shall have unrestricted access to all information and documentation of the trust (fideicomiso), when it deems it pertinent.\n\nARTICLE 14- Trust Administrative Commission (Comisión Administradora del Fideicomiso) and its functions. The Trust Administrative Commission (Comisión Administradora del Fideicomiso) shall appoint from its members a president, a vice-president, and a secretary. All members of this commission shall work ad honorem.\n\nAmong the functions of this commission are the following:\n\na) To fulfill all those tasks or assignments entrusted by the trustor (fideicomitente), established in the trust contract (contrato de fideicomiso).\n\nb) To coordinate with the Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) and follow its general guidelines, for the proper operation and fulfillment of the trust (fideicomiso).\n\nc) To approve the manuals corresponding to administration, management, surveillance, and others related to the trust (fideicomiso).\n\nd) To review and approve, annually, the ordinary and extraordinary budgets of the trust (fideicomiso).\n\ne) To instruct the fiduciary on the actions required and that are within the scope of the trust (fideicomiso).\n\nf) To meet at least once a month ordinarily and, extraordinarily, whenever convened by the Presidency of the Board (Junta) or the representative of the fiduciary.\n\ng) To approve agreements and contracts for the provision of recreational and/or commercial services, as well as essential and non-essential services, to achieve the greatest use of the Tourism Zone (Zona turística) and enjoyment of visitors.\n\nh) The functions attributed to it by the trust contract (contrato de fideicomiso) relating to internal control, surveillance, purchases, personnel, and others necessary for the administration of the national park.\n\ni) Any other function arising from the trust contract (contrato de fideicomiso), its manuals, or others directly related.\n\nARTICLE 15- Surveillance and security. For the surveillance and security of the Isla San Lucas National Park, the necessary contingent of park rangers from the National System of Conservation Areas (SINAC) of the Ministry of Environment and Energy (MINAE) shall be provided, without prejudice to the possibility that the Board of Directors (Junta Directiva), directly or through the corresponding administration trust (fideicomiso), may contract the security it deems necessary; said personnel shall not have police authority nor may they exercise non-delegable functions inherent to the administration. Likewise, it may resort to the assistance of the Ministry of Security in situations that so warrant it.\n\nCHAPTER III\n\nDEVELOPMENT AND FINANCING\n\nARTICLE 16- Infrastructure development. The Isla San Lucas National Park may develop all the necessary infrastructure to facilitate sustainable tourism, including the provision of water, electricity, telecommunications, hygiene and sanitation, docks, moorings, food services and access routes, information and communication in various formats, as well as any other it deems pertinent for the benefit of visitors and to ensure the enjoyment and appreciation of the historical, architectural, and natural richness of the park.\n\nIn the construction of docks, moorings, and other maritime facilities, the Costa Rican Institute of Pacific Ports (INCOP), the Ministry of Public Works and Transport (MOPT), and the Costa Rican Tourism Institute (ICT) shall provide the corresponding technical support to the Board of Directors (Junta Directiva); likewise, these institutions are empowered to build and maintain the works indicated in this regulation.\n\nARTICLE 17- Financing. The Isla San Lucas National Park shall have financial resources that allow it to exercise its mandates with agility and efficiency. These shall include the resources legally corresponding to it from the National System of Conservation Areas (SINAC), transfers from the Republic's budgets or donations from any natural or legal person, as well as the own funds generated by park entrance fees, the use of its services, the fees for concessions and permits, and, in general, for payment of activities carried out within the park.\n\nThe resources regulated in this law as well as all those produced by the park, shall necessarily and exclusively be invested in the same national park.\n\nOversight shall be in charge of the Office of the Comptroller General of the Republic (Contraloría General de la República).\n\nARTICLE 18- Authorization to donate and subsidize. The entire state, non-state, and financial public sector is authorized to make donations, investments, and include budgetary subsidies in favor of the Isla San Lucas National Park.\n\nThe Costa Rican Tourism Institute (ICT) may transfer economic resources to the Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) for the realization of its investments in development and ordinary activities; likewise, it may design and carry out the promotion and marketing for park visitation.\n\nThe Board of Directors (Junta Directiva) may receive donations from international organizations and foreign governments interested in contributing to the purposes of the park.\n\nARTICLE 19- Authorization for credits and loans. To fulfill its objectives, the Board (Junta) may arrange credits and/or loans with public or private entities, national or foreign, always subject to the controls and provisions of Law 8131, Law of Financial Administration of the Republic and Public Budgets (Ley de Administración Financiera de la República y Presupuestos Públicos), of September 18, 2001.\n\nARTICLE 20- Derogation. Articles 2 through 8 of Law 5469, Law for the Transfer of Isla San Lucas to the Municipality of Puntarenas (Ley de Traspaso de la Isla San Lucas a Municipalidad de Puntarenas), of April 25, 1974, are derogated.\n\nTRANSITORY I- The Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas) must be integrated within a period not exceeding two months, counted from the entry into force of this law.\n\nTRANSITORY II- As long as the trust (fideicomiso) referred to in this law has not been constituted or during periods when it may become ineffective, the Board of Directors (Junta Directiva) shall carry out all corresponding tasks through the powers that this law and other laws grant it.\n\nThe period to initiate the efforts aimed at contracting the trust (fideicomiso) may not exceed ninety calendar days from the effective date of this law.\n\nTRANSITORY III- Within a maximum period of six months, from the entry into force of this law, the institutions and organizations that make up the Board of Directors of the Isla San Lucas National Park (Junta Directiva del Parque Nacional Isla San Lucas), as well as the Ministry of Economy, Industry, and Commerce (MEIC), must develop a strategy for promoting the participation of local organizations in the tourism activities developed in the park.\n\nEffective upon its publication.\n\nGiven at the Presidency of the Republic, San José, on the twenty-fourth day of the month of August of the year two thousand twenty.\n\nLET IT BE EXECUTED AND PUBLISHED." }
