Se\nautoriza la apertura del Refugio Nacional de Vida Silvestre Mixto Caño Negro,\npara fines turísticos dentro de las zonas de Uso Público.\n\nResultando:\n\n1º-Que de conformidad con\nel artículo 32 de la Ley Orgánica del Ambiente, al Ministerio del Ambiente y\nEnergía, le compete la administración de las Áreas Silvestres Protegidas del\npaís.\n\n2º-Que el artículo 22 de la\nLey de Biodiversidad, delega en el SINAC la competencia de administrar las\nÁreas Silvestres Protegidas, el cual establece que el Sistema Nacional de Áreas\nde Conservación (SINAC) es un sistema de gestión y coordinación institucional,\ndesconcentrado y participativo, con personería jurídica instrumental que\nintegra las competencias en materia forestal, vida silvestre, áreas protegidas,\nadscrito al Ministerio del Ambiente y Energía (MINAE), con el fin de dictar\npolíticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad\nen el manejo de los recursos naturales de Costa Rica.\n\n3º-Que de conformidad con\nla ley de Biodiversidad artículo 28 cada área de conservación es una unidad\nterritorial del país, delimitada administrativamente, regida por una misma\nestrategia de desarrollo y administración, debidamente coordinada con el resto del\nsector público. En cada uno se interrelacionan actividades tanto privadas como\nestatales en materia de conservación sin menoscabo de las áreas silvestres\nprotegidas.\n\n4º-Las Áreas de\nConservación se encargarán de aplicar la legislación vigente en materia de\nrecursos naturales, dentro de su demarcación geográfica. Deberán ejecutar las\npolíticas, las estrategias y los programas aprobados por el Consejo Nacional de\nÁreas de Conservación, en materia de áreas protegidas; asimismo, tendrá a su\ncargo la aplicación de otras leyes que rigen su materia, tales como la Ley de\nconservación de la vida silvestre, Nº 7317, de 30 de octubre de 1992 y sus\nreformas, y la Ley Forestal, Nº 7575, de 13 de febrero de 1996, Ley Orgánica,\nNº 7554, de 4 de octubre de 1995, y la Ley de Creación del Servicio de Parques\nNacionales, Nº 6084, de 24 de agosto de 1977.\n\n4º-Que existe el Decreto\nEjecutivo 34164-MINAE, del 2 de enero del 2008, publicado en La Gaceta N°\n7, mismo que en su artículo primero, faculta al SINAC-MINAE, a cobrar en las\náreas silvestres protegidas bajo su administración, tarifas diferenciadas por\nconcepto de ingreso en cada una de ellas, además por el uso de algunos\nservicios que el Estado puede brindar, según lo establecido en el citado\nDecreto Ejecutivo. Para lo cual se cuenta en el Refugio Nacional de Vida Silvestre\nMixto Caño Negro con las condiciones para el establecimiento del puesto de\nventa de boletos de ingreso y personal encargado de realizar dicha actividad,\nasí como la vigilancia del refugio.\n\nConsiderando:\n\n1º-Que el Refugio Mixto\nCaño Negro fue creado por decreto ejecutivo (Nº 15120-MAG) el 4 de enero de\n1984. El Refugio político administrativamente se ubica el cantón Los Chiles y\nen el cantón Guatuso. Además, forma parte del Corredor Biológico ruta Los\nMaleku - Medio Queso y se le considera además zona núcleo de la Reserva de la\nBiósfera Agua y Paz, declarada a nivel mundial por la UNESCO, en el año 2007,\nbajo la administración del Conservación Arenal Huetar Norte ACAHN.\n\n2º-Que el Refugio Caño\nNegro se clasifica como un Refugio de Propiedad Mixta, por poseer terrenos que\nen parte pertenecen al Estado (56%) y el resto son de propiedad privada (44%).\nConformado por un sistema complejo de lagunas que a su vez reciben caudales principalmente\ndel río Frío y río Mónico, donde predominan ecosistemas de humedal, con gran\ndiversidad de aves residentes y migratorias que utilizan el humedal para\nalimentarse, como refugio y también como sitio de anidación; por lo que en el\nmes de diciembre del año 1991 fue declarado Humedal de importancia\nInternacional especialmente como hábitat de aves acuáticas, pasando así a\nformar parte de los sitios RAMSAR.\n\n3º-Que el Refugio Nacional\nde Vida Silvestre Mixto Caño Negro cuenta con un Plan General de Manejo,\npublicado en La Gaceta Nº 226 del 09 de setiembre del 2020; que\nestablece en su zonificación, las siguientes: Uso Público Extensivo (ZUPE),\nZona Uso Público Intensivo (ZUPI), Zona de uso Público Combinado (ZUPC), así\ncomo las zonas de Zonas de Protección Absoluta (ZPA) y Zonas de Uso sostenible\nde los Recursos Naturales (ZUSRN), lo que permite a la administración definir y\nregular con claridad las zonas de visitación dentro del refugio, sin poner en\nriesgo los recursos naturales y brindar la atención adecuada a los visitantes.\n\n4º-Que desde el año 2017 el\nSINAC invirtió una importante cantidad de recursos obtenidos a través de\nfinanciamiento del Banco Interamericano de Desarrollo para fortalecer la\ninfraestructura turística y administrativa dentro del Refugio Nacional de Vida\nSilvestre para lo cual se remodelaron y adecuaron las oficinas administrativas\npara la atención al turista y se construyeron tres muelles, para el anclaje de\nembarcaciones pequeñas en el margen del Río Frío, una torre de observación y\nsenderos elevados, lo que aunado a la belleza paisajística y la abundancia de\nvida silvestre lo convierte en un importante atractivo turístico en el sector\nnorte de Costa Rica.\n\n5º-Que el Refugio Nacional\nde Vida Silvestre Mixto Caño negro, es un área protegida que presenta una\ndemanda turística durante la mayor parte del año y cuenta con una importante inversión,\nasí como condiciones apropiadas para la visitación, para el uso y disfrute de\nlos visitantes que ingresen al refugio.\n\n6º-Que uno de los fines que\nse ha propuesto la Administración del Estado, es el impulso de los programas\npara la conservación de la biodiversidad y el lograr un desarrollo sostenible.\n\n7º-Que la apertura al\nturismo en esta importante Área Silvestre Protegida, sin duda alguna permitirá\nreactivar económicamente, la comunidad de Caño Negro, una de las comunidades\ncon bajos índices de desarrollo social, según se extrae de los informes de\nMIDEPLAN y particularmente tras la crisis generada por las medidas sanitarias\nimpuestas tras la afectación del COVID-19 en el país. Por tanto,\n\nLa directora del Área de\nConservación Arenal Huetar Norte, con fundamento en el contenido del artículo\n32 de la ley Orgánica del Ambiente, artículos 22 y 28 y 29 de la ley de\nBiodiversidad, el decreto ejecutivo número 34164 - MINAE, del 2 de enero del\n2008, publicado en La Gaceta N° 7, la fundamentación técnica contenida en\nel Plan de manejo del Refugio Nacional de Vida Silvestre Mixto Caño Negro.\n\nRESUELVE\n\n1º-Ordenar la apertura al\nturismo para la visitación de las zonas de uso público a partir del día 07 de\nnoviembre de 2020. En horario ordinario de visitación será de las 8:00 horas a\nlas 16:00 horas. Conforme a las siguientes disposiciones.\n\na) Para la actividad\nespecífica de observación de aves se establece un horario de 5:30 horas a 7:30\nhoras y de las 16:00 a 18:00 horas, esto únicamente por medio de guías acreditados\ny autorizados por la administración del Área Silvestre Protegida (ASP).\n\nb) Para la actividad de\npesca deportiva, se establece un horario de 5:30 horas a 7:30 horas y de las\n16:00 a 18:00 horas, esto únicamente por medio de guías acreditados y autorizados\npor la administración del ASP, y debidamente registrados en la oficina\nadministrativa.\n\nc) Para tour nocturno del\nsendero elevado (Los Chocuacos) se establece hasta las 21:00 horas previa\nautorización de la administración y acompañados de un guía acreditado y autorizado\npor la administración del ASP.\n\n2º-Ordenar la apertura de\nla boletería que operará de conformidad con las regulaciones contenidas en el\nDecreto ejecutivo número 34164-MINAE, del 2 de enero del 2008, publicado en La\nGaceta N° 7, se ubicará en las oficinas administrativas del Refugio, acondicionadas\npara este fin.\n\n3º-Los capitanes de\nembarcaciones deberán respetar la capacidad máxima de personas por embarcación\npermitida y tomar bajo su responsabilidad las precauciones correspondientes, respetando\nlas capacidades máximas incluyendo al capitán y al guía según el tipo de\nembarcación.\n\n4º-Las personas físicas que\ndeseen ingresar al refugio, podrán adquirir su boleto de forma directa en la\nboletería del refugio o a través de una tercera persona.\n\n5º-Los turistas deberán\nrealizar el ingreso únicamente por el sector autorizado que corresponde a las\noficinas administrativas (El Sitio).\n\n6º-La Administración del\nRefugio Nacional de Vida Silvestre Mixto Caño Negro establecerá los\ndispositivos de control que considere oportunos para garantizar que el acceso\nal área protegida se haga una vez cancelados los derechos de admisión correspondientes.\nEs muy importante que todos los visitantes o turistas porten su documento de\nidentificación o pasaporte al momento de visitar el Refugio.\n\n7º-Queda totalmente\nautorizada la Administración del Refugio Nacional de Vida Silvestre Mixto Caño\nNegro bajo la recomendación de los entes Técnicos, a efectuar cierres\ntemporales por cambios en las condiciones del área silvestre protegida o situaciones\nde emergencia.\n\n8º-Disposiciones Generales.\n\na) El derecho de admisión\nes de uso personalísimo y por ningún motivo el mismo es transferible a otra persona.\n\nb) El monto cancelado al\nSINAC por el derecho de admisión cubre únicamente el derecho de ingreso diario\npara cada persona al Refugio Nacional de Vida Silvestre Mixto Caño Negro\nconforme a lo establecido en el decreto de tarifas vigente.\n\nc) Ningún turista podrá\ningresar después de los horarios establecidos al RNVSMCN.\n\nd) La exoneración del pago\nde derechos de admisión se podrá otorgar únicamente con base en lo establecido\npor el decreto ejecutivo que regula las tarifas de ingreso a las áreas silvestres\nprotegidas. Todo interesado en ingresar exonerado al Refugio, estará sujeto a\nla disponibilidad de espacio que la administración establezca para el día de la\nvisita.\n\ne) Todo visitante que\npermanezca dentro del Refugio Nacional de Vida Silvestre Mixto Caño Negro,\ndeberá demostrar la legitimidad de su permanencia durante su estadía,\npresentando un documento de identificación.\n\nf) Quien no acate las\ndisposiciones antes mencionadas no podrá ingresar ni permanecer dentro del\nRNVSMCN. De igual manera, aquellos visitantes que con sus acciones vayan en\ncontra de lo establecido en la presente resolución, también serán expulsados\ndel área protegida.\n\n11º-Contra la presente\nresolución proceden los recursos ordinarios de revocatoria y / o apelación, de\nconformidad con los artículos 343 y siguientes de la Ley General de la\nAdministración Pública, los cuales serán resueltos, el de revocatoria por el\nmismo órgano que lo dictó y el de apelación por el Consejo Nacional de Áreas de\nConservación. Furthermore, it forms part of the Los\nMaleku - Medio Queso Route Biological Corridor and is also considered the core zone of the Agua y Paz Biosphere Reserve,\ndeclared worldwide by UNESCO, in the year 2007,\nunder the administration of the Arenal Huetar Norte Conservation Area ACAHN.\n\n2º-That the Caño Negro\nRefuge is classified as a Mixed Property Refuge, as it possesses lands that\npartly belong to the State (56%) and the rest are privately owned (44%).\nFormed by a complex system of lagoons that in turn receive flows mainly\nfrom the Frío River and Mónico River, where wetland ecosystems predominate, with great\ndiversity of resident and migratory birds that use the wetland for\nfeeding, as a refuge, and also as a nesting site; therefore, in\nthe month of December 1991, it was declared a Wetland of International\nImportance especially as a habitat for aquatic birds, thus becoming\npart of the RAMSAR sites.\n\n3º-That the Caño Negro Mixed National\nWildlife Refuge has a General Management Plan (Plan General de Manejo),\npublished in La Gaceta No. 226 of September 9, 2020; which\nestablishes in its zoning the following: Extensive Public Use (ZUPE),\nIntensive Public Use Zone (ZUPI), Combined Public Use Zone (ZUPC), as well\nas the Absolute Protection Zones (ZPA) and Sustainable Use of\nNatural Resources Zones (ZUSRN), which allows the administration to define and\nclearly regulate the visitation zones within the refuge, without putting\nnatural resources at risk and providing adequate attention to visitors.\n\n4º-That since 2017,\nSINAC invested a significant amount of resources obtained through\nfinancing from the Inter-American Development Bank to strengthen\nthe tourism and administrative infrastructure within the National Wildlife Refuge, for which the administrative offices\nwere remodeled and adapted for tourist attention, and three docks were built for the anchoring\nof small boats on the bank of the Frío River, an observation tower, and\nelevated trails, which, coupled with the scenic beauty and the abundance of\nwildlife, makes it an important tourist attraction in the northern\nsector of Costa Rica.\n\n5º-That the Caño Negro Mixed National\nWildlife Refuge is a protected area that presents\ntourist demand during most of the year and has significant investment,\nas well as appropriate conditions for visitation, for the use and enjoyment\nof visitors entering the refuge.\n\n6º-That one of the goals\nproposed by the State Administration is the promotion of programs\nfor biodiversity conservation and achieving sustainable development.\n\n7º-That the opening to\ntourism in this important Protected Wild Area will undoubtedly allow\nthe economic reactivation of the community of Caño Negro, one of the communities\nwith low social development indices, as extracted from the reports of\nMIDEPLAN, and particularly after the crisis generated by the sanitary measures\nimposed following the impact of COVID-19 in the country. Therefore,\n\nThe director of the Arenal\nHuetar Norte Conservation Area, based on the content of Article\n32 of the Organic Law of the Environment, Articles 22, 28, and 29 of the Biodiversity\nLaw, Executive Decree number 34164 - MINAE, of January 2,\n2008, published in La Gaceta No. 7, and the technical basis contained in\nthe Management Plan of the Caño Negro Mixed National Wildlife Refuge.\n\nHEREBY RESOLVES\n\n1º-To order the opening to\ntourism for the visitation of public use zones starting November 7,\n2020. The regular visitation hours shall be from 8:00 a.m. to\n4:00 p.m. In accordance with the following provisions.\n\na) For the specific\nactivity of bird watching, a schedule is established from 5:30 a.m. to 7:30\na.m. and from 4:00 p.m. to 6:00 p.m., this only through guides accredited\nand authorized by the administration of the Protected Wild Area (ASP).\n\nb) For the sport\nfishing activity, a schedule is established from 5:30 a.m. to 7:30 a.m. and from\n4:00 p.m. to 6:00 p.m., this only through guides accredited and authorized\nby the administration of the ASP, and duly registered at the administrative\noffice.\n\nc) For the night tour\nof the elevated trail (Los Chocuacos), a schedule is established until 9:00 p.m., with prior\nauthorization from the administration and accompanied by a guide accredited and authorized\nby the administration of the ASP.\n\n2º-To order the opening of\nthe ticket office, which will operate in accordance with the regulations contained in\nExecutive Decree number 34164-MINAE, of January 2, 2008, published in La\nGaceta No. 7, and will be located in the administrative offices of the Refuge, conditioned\nfor this purpose.\n\n3º-Captains of\nvessels must respect the maximum permitted capacity of persons per vessel\nand take the corresponding precautions under their responsibility, respecting\nthe maximum capacities including the captain and the guide according to the type of\nvessel.\n\n4º-Individuals who\nwish to enter the refuge may purchase their ticket directly at the\nticket office of the refuge or through a third person.\n\n5º-Tourists must\nenter only through the authorized sector corresponding to the administrative\noffices (El Sitio).\n\n6º-The Administration of the\nCaño Negro Mixed National Wildlife Refuge shall establish the\ncontrol measures it deems appropriate to guarantee that access\nto the protected area is made once the corresponding admission fees have been paid.\nIt is very important that all visitors or tourists carry their identification\ndocument or passport at the time of visiting the Refuge.\n\n7º-The Administration of the Caño Negro Mixed National\nWildlife Refuge is fully authorized, upon the recommendation of the Technical\nentities, to effect temporary closures due to changes in the conditions of the protected wild area or\nemergency situations.\n\n8º-General Provisions.\n\na) The right of admission\nis for strictly personal use and under no circumstances is it transferable to another person.\n\nb) The amount paid to\nSINAC for the right of admission covers only the daily entry fee\nfor each person to the Caño Negro Mixed National Wildlife Refuge\nin accordance with the provisions of the current fee decree.\n\nc) No tourist may\nenter the RNVSMCN after the established hours.\n\nd) The exemption from payment\nof admission fees may be granted only based on the provisions\nof the executive decree that regulates entry fees to protected wild\nareas. Anyone interested in entering the Refuge without paying a fee shall be subject to\nthe availability of space that the administration establishes for the day of the\nvisit.\n\ne) Every visitor who\nremains within the Caño Negro Mixed National Wildlife Refuge\nmust demonstrate the legitimacy of their stay during their visit,\npresenting an identification document.\n\nf) Anyone who does not comply with\nthe aforementioned provisions may not enter or remain within the\nRNVSMCN. Likewise, those visitors whose actions go\nagainst the provisions of this resolution shall also be expelled\nfrom the protected area.\n\n11º-Against this\nresolution, the ordinary remedies of revocation and/or appeal are available, in\naccordance with Articles 343 and following of the General Law of\nPublic Administration, which shall be resolved, the revocation by\nthe same body that issued it and the appeal by the National Council of\nConservation Areas. The remedies must be filed before the body issuing this\nresolution within three days following its publication.\n\nEffective as of November 7,\n2020. Let it be published." }
