(IMN) es un organismo técnico\ncientífico fundado el 7 de abril de 1888, como ente responsable de la\nvigilancia continua del tiempo y del clima, de la investigación del tiempo, la\nvariabilidad y el cambio climático, para prevención y mitigación de los\nimpactos provocados por los fenómenos hidrometeorológicos extremos, para\nproteger la atmósfera y el ambiente, así como fomentar la mitigación y\nadaptación al cambio climático, facilitando a la población costarricense, a los\nsectores marítimo, aeronáutico y productivos del país, el acceso oportuno y\neficaz a una información meteorológica y climática de alta calidad.\n\nII.-Que la ley de Creación del Instituto Meteorológico Nacional N° 5222,\ndata del 26 de junio de 1973, y en su artículo 12 inciso c), autoriza los\ningresos por servicios, regulados por reglamento específico y el inciso e)\nautoriza cualesquiera otros ingresos que por ley o donaciones obtenga el instituto.\n\nIII.-Que actualmente está vigente el \"Reglamento para el cobro de\nservicios especiales por parte del Instituto Meteorológico Nacional (IMN)\"\nDecreto Ejecutivo N° 20765-MIRENEM del 23 de septiembre de 1991, cuya\nestructura de costos se encuentra desactualizada en relación con lo que demanda\nla preparación, análisis e interpretación de los productos y servicios que\nofrece el IMN, no estando acorde con la estructura funcional y operativa actual.\n\nIV.-Que la actividad del IMN está sujeta a los principios fundamentales\ndel servicio público, para asegurar su continuidad y eficiencia, al\ncumplimiento a los objetivos del Plan Nacional de Desarrollo, que se orienta a\ngenerar un crecimiento económico inclusivo, coadyuvando al saneamiento de las\nfinanzas públicas, incrementando la competitividad, la productividad, mediante\nel fomento de la innovación, la capacitación del recurso humano y la inserción\nal mercado internacional.\n\nV.-Que actualmente, para planificar y enfrentar los riesgos que se\nasocian al Cambio Climático, el Calentamiento Global y los Eventos\nHidrometeorológicos Extremos; la demanda de los servicios e información\nmeteorológica ha ido aumentando exponencialmente, lo cual exige un tratamiento\nindependiente y particular de los datos básicos y la formación técnica\ncientífica de la actividad meteorológica.\n\nVI. Que mediante oficio N° DVGA-047-2018 del 22 de octubre de 2018, el\nViceministerio de Gestión Ambiental del Ministerio de Ambiente y Energía\nsolicitó la revisión y actualización de todos los trámites vinculados con la\nactividad sustantiva y el servicio público que presta el IMN, con el fin de\ncumplir con las disposiciones de la Ley N° 8220 del 4 de marzo de 2020 y sus\nreformas, Ley de Protección al Ciudadano del Exceso de Requisitos y Trámites\nAdministrativos, así como la Directriz N° 20-MP-MEIC del 3 de agosto de 2018,\nAcciones inmediatas para la simplificación de trámites en el Gobierno del Bicentenario,\ny en razón de ese proceso de actualización, se incluye el trámite en la\nplataforma del Catálogo Nacional de Trámites.\n\nVII.-Que, de conformidad con el Reglamento a la Ley de Protección al\nCiudadano del Exceso de Requisitos y Trámites Administrativos, Decreto\nEjecutivo Nº 37045-MP-MEIC y sus reformas, se determinó que la presente\npropuesta no establece ni modifica trámites, requisitos o procedimientos que el\nadministrado deba cumplir, situación por la que no se procedió con el trámite\nde control previo. Por tanto,\n\nDecretan:\n\n\"REGLAMENTO PARA EL COBRO DE SERVICIOS\n\nESPECIALES POR PARTE DEL INSTITUTO\n\nMETEOROLÓGICO NACIONAL\"\n\nArtículo 1°-Objeto. El presente reglamento tiene como objeto\nestablecer las normas, procedimientos y directrices que regularán el cobro de\nservicios especiales por parte del Instituto Meteorológico Nacional (IMN), de\nconformidad con el artículo 12, inciso c) de la Ley de Creación del Instituto\nMeteorológico Nacional, Ley N° 5222 del 26 de junio de 1973 y su reforma.\n\nArtículo 2°-Ámbito de Aplicación. El presente reglamento es de\nacatamiento obligatorio para todos los usuarios que soliciten los servicios y\nproductos descritos en el artículo 3 de este reglamento.\n\nArtículo 3°-Definiciones:\n\nI. Usuarios. Toda persona física o jurídica que requiera los servicios\nque ofrece el Instituto Meteorológico Nacional.\n\nII. Servicios de interés general. Los descritos en el Artículo 10\nde este Decreto Ejecutivo y en el artículo 3° de la Ley N° 5222.\n\nIII. Servicios Especiales. Serán considerados servicios especiales\ntodos aquellos servicios y productos que demanden por parte del Instituto\nMeteorológico Nacional (IMN), costes adicionales de preparación, análisis,\ndiseño, estudio, investigación o interpretación especial y por tanto objeto de\ncobro, según se detalla en los siguientes casos:\n\na) Cuando el usuario requiera que se prepare información, análisis o\nvaloración específica sobre algún tema meteorológico y climático en particular.\n\nb) En aquellos casos de trabajos eminentemente ocasionales y que no puedan\nser ejecutados durante la jornada ordinaria por el personal que se dispone para\nello, cuando procedan, y con la debida autorización de la jefatura del\nDepartamento de Información Meteorológica (DIM) para dicho trabajo\nextraordinario, de conformidad con el marco legal y técnico vigente.\n\nc) Cuando la información sea solicitada para efectos legales, o incluya\nla emisión de Certificaciones, Constancias o la realización de peritajes.\n\nd) Todos aquellos servicios que el IMN ofrezca como capacitación y\nformación técnica científica, en las materias atinentes a su competencia.\n\ne) Cuando para cumplir con la entrega de la información o el servicio\nsolicitado se deba recurrir a desplazar personal a recopilarla fuera del IMN.\n\nArtículo 4°-Solicitud. Para solicitar el servicio especial, el usuario\ndeberá ingresar a la dirección electrónica https://www.imn.ac.cr/web/imn/solicitud-de-servicios,\nllenar la información en línea y adjuntar la documentación solicitada.\n\nArtículo 5°-Costos. El costo del servicio y/o producto se estimará\ntomando en consideración los costos de reproducción del material, aplicación de\nmodelos numéricos, proyecciones de datos climáticos, investigaciones\nadicionales, equipo, viáticos y costo por viajes y transporte, conforme lo\nestablecido en el Reglamento de Gastos de Viaje y de Transporte para\nFuncionarios Públicos de la Contraloría General de la República y sus\nactualizaciones, cuando proceda.\n\nAdemás, se calcula con base en el valor de la hora promedio del salario\ndel funcionario público. Para ello se debe considerar el ingreso bruto mensual\npromedio de todos los funcionarios del Departamento de Información Meteorológica\n(DIM); según la Escala de Salarios vigente de la Administración Pública, este\ncálculo del valor de la hora promedio, se obtiene de la siguiente manera:\n\nSBM/CFDIM=SBPM\n\nSBPM /240H=VPH\n\nDonde:\n\nSBM= Sumatoria de\nlos Salarios Brutos Mensual de todos los\n\nfuncionarios de DIM\n\nCFDIM=Cantidad de\nfuncionarios de DIM\n\nSBPM= Salario Bruto\npromedio mensual\n\n240H= Horas\nmensuales laborales\n\nVHP= Valor hora\npromedio\n\nEstos costos se deben actualizar cada vez que se decreten ajustes a los\nsalarios de los funcionarios del sector público.\n\nArtículo 6°-Cotización. El DIM será el encargado de determinar el\ncosto por el servicio especial solicitado, con fundamento en lo señalado en el\nartículo anterior; debiendo comunicar lo correspondiente al interesado para\nobtener su aprobación en un plazo de tres días hábiles, de previo a iniciar la elaboración\ndel trabajo solicitado.\n\nArtículo 7°-Pago. El pago por los servicios a brindar se debe realizar\npor medio de transferencia o por un depósito a la cuenta bancaria indicada en\nla página web del IMN. Dichos ingresos se deben depositar en la Caja Única del\nEstado y se incorporarán al presupuesto del IMN de cada año.\n\nArtículo 8°-Servicios de interés general. El IMN proveerá gratuitamente\naquellos servicios de interés general, que se detallan a continuación:\n\na) Pronósticos de interés general.\n\nb) Información general sobre condiciones del tiempo para difundir por la\nprensa escrita, radio y televisión.\n\nc) Alertas sobre condiciones meteorológicas especiales.\n\nd) Información meteorológica dirigida a la gestión de riesgo hidrometeorológico.\n\ne) Resúmenes climatológicos mensuales y anuales de la red nacional de\nestaciones meteorológicas.\n\nf) Información general sobre la meteorología y climatología del país.\n\ng) Cualesquiera otros de conformidad con el artículo 3° de la Ley N°\n5222.\n\nArtículo 9°-Cooperación interinstitucional. El IMN prestará todos\nlos datos, productos y servicios que brinda en forma gratuita a las\ninstituciones públicas centrales, descentralizadas y a las empresas públicas,\nsiempre y cuando no sean para fines comerciales, este servicio puede ser\nbrindado mediante la aplicación del principio de cooperación interinstitucional\no cuando medie un convenio de cooperación suscrito entre las instituciones.\n\nArtículo 10.-Centros de educación. Para la realización de trabajos y proyectos de investigación de\ncentros educativos, el IMN proveerá los datos requeridos en formato digital, de manera gratuita. En\nestos casos, el estudiante y el profesor deberán ingresar a la dirección\nwww.imn.ac.cr/web/imn/solicitud-de-servicios, llenar la información en línea y adjuntar la\ndocumentación solicitada.\n\nArtículo 11.-Derogatoria. That through official letter N° DVGA-047-2018 of October 22, 2018, the\nVice-Ministry of Environmental Management of the Ministry of Environment and Energy\nrequested the review and update of all procedures linked to the\nsubstantive activity and the public service provided by the IMN, in order to\ncomply with the provisions of Law N° 8220 of March 4, 2020 and its\namendments, Law for the Protection of the Citizen from the Excess of Requirements and Administrative\nProcedures, as well as Directive N° 20-MP-MEIC of August 3, 2018,\nImmediate actions for the simplification of procedures in the Bicentennial Government,\nand due to this update process, the procedure is included in the\nplatform of the National Catalog of Procedures.\n\nVII.-That, in accordance with the Regulation to the Law for the Protection of the\nCitizen from the Excess of Requirements and Administrative Procedures, Executive\nDecree Nº 37045-MP-MEIC and its amendments, it was determined that the present\nproposal does not establish or modify procedures, requirements or processes that the\nadministered party must comply with, a situation for which the process of\nprior control was not carried out. Therefore,\n\nThey Decree:\n\n\"REGULATION FOR THE CHARGING OF SPECIAL SERVICES\n\nBY THE NATIONAL METEOROLOGICAL INSTITUTE\"\n\nArticle 1.-Purpose. The purpose of this regulation is to\nestablish the rules, procedures and guidelines that will regulate the charging of\nspecial services by the National Meteorological Institute (IMN), in\naccordance with article 12, subsection c) of the Law Creating the National\nMeteorological Institute, Law N° 5222 of June 26, 1973 and its amendment.\n\nArticle 2.-Scope of Application. This regulation is of\nmandatory compliance for all users who request the services and\nproducts described in article 3 of this regulation.\n\nArticle 3.-Definitions:\n\nI. Users. Any natural or legal person who requires the services\noffered by the National Meteorological Institute.\n\nII. Services of general interest. Those described in Article 10\nof this Executive Decree and in article 3° of Law N° 5222.\n\nIII. Special Services. All those services and products that demand\nfrom the National Meteorological Institute (IMN) additional costs for preparation, analysis,\ndesign, study, research or special interpretation, and therefore subject to\ncharging, shall be considered special services, as detailed in the following cases:\n\na) When the user requires that specific information, analysis or\nvaluation on a particular meteorological and climatic topic be prepared.\n\nb) In those cases of eminently occasional work that cannot\nbe carried out during the ordinary working day by the staff available for\nit, when applicable, and with the due authorization of the head of the\nDepartment of Meteorological Information (DIM) for said extraordinary\nwork, in accordance with the current legal and technical framework.\n\nc) When the information is requested for legal purposes, or includes\nthe issuance of Certifications, Verifications or the performance of expert appraisals (peritajes).\n\nd) All those services that the IMN offers as technical-scientific training\nand education, in the matters pertaining to its competence.\n\ne) When to fulfill the delivery of the requested information or service,\nit is necessary to deploy staff to collect it outside the IMN.\n\nArticle 4.-Request. To request the special service, the user\nmust enter the electronic address https://www.imn.ac.cr/web/imn/solicitud-de-servicios,\nfill in the information online and attach the requested documentation.\n\nArticle 5.-Costs. The cost of the service and/or product shall be estimated\ntaking into consideration the costs of reproduction of the material, application of\nnumerical models, climatic data projections, additional\nresearch, equipment, per diem (viáticos) and cost for travel and transportation, in accordance with\nthe provisions of the Regulation on Travel and Transportation Expenses for\nPublic Officials of the Comptroller General of the Republic and its\nupdates, when applicable.\n\nFurthermore, it is calculated based on the value of the average hour of the salary\nof the public official. To do this, the average monthly gross income\nof all the officials of the Department of Meteorological Information\n(DIM) must be considered; according to the current Public Administration Salary Scale, this\ncalculation of the value of the average hour is obtained as follows:\n\nSBM/CFDIM=SBPM\n\nSBPM /240H=VPH\n\nWhere:\n\nSBM= Sum of the\nGross Monthly Salaries of all\n\nDIM officials\n\nCFDIM= Number of\nDIM officials\n\nSBPM= Average Monthly\nGross Salary\n\n240H= Monthly\nworking hours\n\nVHP= Value of the average\nhour\n\nThese costs must be updated each time adjustments are decreed to the\nsalaries of public sector officials.\n\nArticle 6.-Quotation. The DIM shall be responsible for determining the\ncost for the requested special service, based on what is indicated in the\nprevious article; having to communicate the corresponding amount to the interested party to\nobtain their approval within a period of three business days, prior to starting the preparation\nof the requested work.\n\nArticle 7.-Payment. Payment for the services to be provided must be made\nby means of a transfer or a deposit to the bank account indicated on\nthe IMN website. Said income must be deposited in the Single State\nTreasury (Caja Única del Estado) and will be incorporated into the IMN budget each year.\n\nArticle 8.-Services of general interest. The IMN shall provide free of charge\nthose services of general interest, which are detailed below:\n\na) Forecasts of general interest.\n\nb) General information on weather conditions to be disseminated by the\nwritten press, radio and television.\n\nc) Alerts on special meteorological conditions.\n\nd) Meteorological information aimed at hydrometeorological risk management.\n\ne) Monthly and annual climatological summaries of the national network of\nmeteorological stations.\n\nf) General information on the meteorology and climatology of the country.\n\ng) Any others in accordance with article 3° of Law N°\n5222.\n\nArticle 9.-Inter-institutional cooperation. The IMN shall provide all\nthe data, products and services it offers free of charge to central\nand decentralized public institutions and public enterprises,\nprovided they are not for commercial purposes; this service may be\nprovided through the application of the principle of inter-institutional cooperation\nor when there is a cooperation agreement signed between the institutions.\n\nArticle 10.-Educational centers. For carrying out research works and projects from\neducational centers, the IMN shall provide the required data in digital format, free of charge. In\nthese cases, the student and the professor must enter the address\nwww.imn.ac.cr/web/imn/solicitud-de-servicios, fill in the information online and attach the\nrequested documentation.\n\nArticle 11.-Derogation. The \"Regulation for the Charging\nof Special Services by the National Meteorological Institute (IMN)\",\nExecutive Decree Nº 20765-MIRENEM of September 23, 1991, published in La\nGaceta N° 199 of October 18, 1991, is hereby repealed.\n\nArticle 12.-Effectiveness. This Regulation shall come into effect\nupon its publication in the Official Gazette La Gaceta.\n\nGiven at the Presidency of the Republic.-San José, on the seventh day of the\nmonth of October of the year two thousand twenty." }
