Por\ntanto,\n\nACUERDA:\n\n1º-Modificar los artículos 3, 22 y transitorio II del acuerdo de Junta\nDirectiva del Incopesca AJDIP/077-2020, para que en lo sucesivo se lean así:\n\nArtículo 3º-Ámbito de aplicación. Es de observancia obligatoria\npara todas las embarcaciones nacionales de la flota pesquera comercial de\nmediana escala, comercial avanzada y semi industrial e industrial excepto\nembarcaciones con licencia de pesca turística y embarcaciones extranjeras con\nlicencia de pesca vigente, que realicen actos de pesca en aguas de jurisdicción\nnacional del Océano Pacífico y Mar Caribe, dentro de la Zona Económica\nExclusiva o en aguas internacionales a las cuales tenga acceso Costa Rica de\nconformidad con los convenios internacionales.\n\nIgualmente será obligatorio para todas aquellas embarcaciones\nextranjeras que soliciten autorización de descarga de productos pesqueros,\nautorización de trasbordo para descarga de productos pesqueros, el uso de\npuertos nacionales, o que cuenten con cuota de capacidad de acarreo asignada\npor Costa Rica.\n\nTodo anterior sin detrimento de que en el futuro por medio de acuerdo de\nJunta Directiva se acuerde incluir otras categorías de flotas, inclusive las\nexcluidas en el presente artículo.\n\nArtículo 22.-Emisión de la disconformidad. El CSC deberá emitir\nla disconformidad por medio de resolución debidamente fundamentada con todos\nlos argumentos técnicos que correspondan y las pruebas del caso, cuando la\nembarcación incurra en las siguientes situaciones:\n\na. Zarpe de puerto nacional sin llevar instalado y funcionando\ncorrectamente el DS y transmitiendo sus datos al SLSC del CSC del INCOPESCA.\n\nb. Que el armador o propietario de la embarcación, habiendo sido\nnotificado, no acate las alertas emitidas por el propio sistema o por el CSC o\nse determine por parte del CSC, que, de acuerdo con el reporte elaborado por el\nproveedor de servicio, que hubo manipulación del equipo y, por consiguiente,\ninterrupción o alteración de las transmisiones emitidas por el equipo instalado\na bordo.\n\nc. Que el armador omita hacer las comunicaciones correspondientes dentro\nde los plazos establecidos en este reglamento.\n\nd. Que el CSC por medio de una alerta, determine que hubo manipulación,\nalteración, desconexión y apagado del DS.\n\ne. Que las justificaciones de no transmisión sean consideradas no\nválidas para admitir su aprobación.\n\nf. Que no informe al CSC, dentro de los plazos establecidos en este\nreglamento, las causas por las que el DS de la embarcación no está\ntransmitiendo.\n\ng. Que la embarcación deje de transmitir y que no regrese en tiempo a\npuerto.\n\nh. Que la embarcación faene en zonas económicas exclusivas distintas a\nlas costarricenses, parques nacionales, áreas y zonas protegidas, reservas\nnacionales y áreas marinas de pesca responsable o zonas no autorizadas.\n\ni. Arribo a puerto sin poseer la autorización y validación del uso de\npuerto por parte del INCOPESCA.\n\nj. Que las posiciones recibidas en el CSC no coincidan con los libros de\ncontrol de viaje y faenas de pesca exigidos por la Administración Pesquera.\n\nk. Que utilice una baliza no autorizada a la embarcación o que trasfiera\nla misma a otra embarcación sin autorización previa del Incopesca.\n\nl. La disconformidad emitida por el CSC por medio de resolución se\nconsiderará como medios de prueba y tendrá el valor probatorio que se determine\nen las disposiciones jurídicas aplicables.\n\nEn caso de duda sobre la interpretación y aplicación del presente\nreglamento, así como situaciones no contempladas en el mismo; el CSC deberá\nrequerir criterio a la Dirección General Técnica, previo a la emisión de la\ndisconformidad correspondiente.\n\nEn caso de controversia prevalecerá el criterio de la DGT.\n\nTransitorio II.-Para las embarcaciones que faenan en el Mar Caribe de pesca\ncomercial en mediana escala, el presente reglamento será aplicable en el mismo\nmomento en que entre en vigencia su aplicación para las embarcaciones de\nmediana escala que faenan en el Océano Pacífico.\n\n2º-Publíquese.   "body_en_text": "in the entirety of the text\n\n                    -\n\n                        Complete Text of Norm 276\n\n                        Amendment to the Regulation for the monitoring, control and surveillance of\nfishing vessels of the national and foreign fleets (AJDIP/077-2020)\n\nComplete Text of minutes: 13E759\n\nCOSTA RICAN INSTITUTE OF FISHERIES AND AQUACULTURE\n\nAJDIP/276-2020.-Puntarenas, on the eleventh day of November, two thousand twenty.\n\nConsidering:\n\n1º-That by means of agreement AJDIP/077-2018, the Board of Directors approved the \"Regulation for the Monitoring, Control and Surveillance of Fishing Vessels of the National and Foreign Fleets.\"\n\n2º-That Mr. Méndez Barrientos, Legal Advisor of Incopesca, by means of official communication AL-262-11-2020 (3), submits the proposal to amend the Board of Directors agreement AJDIP/077-2020, specifically articles 3, 22 and transitional provision II.\n\n3º-That the amendment proposed by Mr. Heiner Méndez Barrientos having been duly analyzed and considered appropriate by the Board of Directors. Therefore,\n\nAGREES:\n\n1º-To amend articles 3, 22 and transitional provision II of the Incopesca Board of Directors agreement AJDIP/077-2020, so that they shall henceforth read as follows:\n\nArticle 3º-Scope of application. It is of mandatory observance for all national vessels of the commercial medium-scale, advanced commercial and semi-industrial and industrial fishing fleet, except vessels with a tourist fishing license and foreign vessels with a current fishing license, that engage in fishing activities in waters under national jurisdiction of the Pacific Ocean and Caribbean Sea, within the Exclusive Economic Zone or in international waters to which Costa Rica has access in accordance with international agreements.\n\nIt shall likewise be mandatory for all those foreign vessels that request authorization for the landing of fishery products, authorization for transshipment for landing fishery products, the use of national ports, or that have a carrying capacity quota assigned by Costa Rica.\n\nAll of the foregoing without prejudice to the future inclusion, by means of a Board of Directors agreement, of other fleet categories, including those excluded in this article.\n\nArticle 22.-Issuance of the non-conformity. The CSC must issue the non-conformity by means of a duly reasoned resolution with all the corresponding technical arguments and the evidence of the case, when the vessel incurs in the following situations:\n\na. Departure from a national port without having the DS installed and correctly functioning and transmitting its data to the SLSC of the CSC of INCOPESCA.\n\nb. That the vessel owner (armador) or proprietor, having been notified, fails to heed the alerts issued by the system itself or by the CSC, or it is determined by the CSC that, according to the report prepared by the service provider, there was tampering with the equipment and, consequently, interruption or alteration of the transmissions emitted by the equipment installed on board.\n\nc. That the vessel owner (armador) fails to make the corresponding communications within the timeframes established in this regulation.\n\nd. That the CSC, through an alert, determines that there was tampering, alteration, disconnection and shutdown of the DS.\n\ne. That the justifications for non-transmission are considered not valid to admit their approval.\n\nf. That it fails to inform the CSC, within the timeframes established in this regulation, of the reasons why the vessel's DS is not transmitting.\n\ng. That the vessel stops transmitting and does not return to port in time.\n\nh. That the vessel operates in exclusive economic zones other than Costa Rican ones, national parks, protected areas and zones, national reserves and marine areas of responsible fishing, or unauthorized zones.\n\ni. Arrival at port without possessing the authorization and validation of port use by INCOPESCA.\n\nj. That the positions received at the CSC do not match the voyage and fishing operations control logbooks required by the Fisheries Administration.\n\nk. That it uses a beacon not authorized for the vessel or transfers it to another vessel without prior authorization from Incopesca.\n\nl. The non-conformity issued by the CSC by means of a resolution shall be considered as means of evidence and shall have the probative value determined in the applicable legal provisions.\n\nIn case of doubt regarding the interpretation and application of this regulation, as well as situations not contemplated herein, the CSC must request a criterion from the General Technical Directorate, prior to the issuance of the corresponding non-conformity.\n\nIn case of controversy, the criterion of the DGT shall prevail.\n\nTransitional Provision II.-For vessels that operate in the Caribbean Sea for medium-scale commercial fishing, this regulation shall be applicable at the same time its application enters into force for medium-scale vessels operating in the Pacific Ocean.\n\n2º-Let it be published. It takes effect upon its approval. Firm agreement."
